    • Memories are as important as mon-ey. Don't leave it to adult children to di-

vide personalitems. These decisionscancause more fights than dividing money.Have an opendiscussion about personalitems, then make a nonbinding wish listand attach it to your will or living trustto giveyour childrensome guidance.

    • Recognizethat equal is notnecessar-ilyfair. If onechild has been a caregiverandyour intentionis to givethe caregiv-er a larger share of the assets, tell yourchildrennow.

    • The executor or successor trustee

decision is critical. Don't just appointthe eldest child. Discuss this issue withall your children, and explain your rea-sons.

    • Never assume your children will want to inherit something or are able toinherit it. One child, for example, may not want to inherit and run a family

business.• Never assume your second spouse

will protect the children of your first

marriage.• Organization is critical. Make a list

of all your accounts, assets and the loca-tionof keys to safe-deposit boxes. Other-

wise, some assets might never be foundor distributed.

    • You don’t have to have an attorney prepare your will, though an experi-enced lawyer could provide advice onestate-planning strategies suchas livingtrusts. Do-it-yourself will kits are wide-ly available.

    • Estate planners discourage joint wills, and some states don’t recognize

them. You and your spouse are unlikely to die at the same time, and you proba- bly have some property that isn’t jointly held.

    • Anyone can serve as your witness, but you should choose someone whoisn’t a beneficiary ‒ a disinterested wit-ness. The attorney who dras a willshould not be the witness. South Caroli-na requires twowitnesses.

    • South Carolina requires that wills

be written, but holographic wills (thosethat are handwritten and unwitnessed)

arenot recognized.• A spouse, adult child or trusted

friend can serve as an executor. If youraffairs are complicated, though, it may make more sense for an attorney toserve asexecutor. Be sure thewordingof

your will empowers the executor to pay  your bills and deal with debt collectors.

    • Probate courts usually require theoriginal will before they can process

your estate, so it’s important to keep thedocument safe but accessible. A water-

proof, fireproof safe in your house is agood place to store it. Your attorney orsomeone you trust should keep signedcopies.

    • Review your will aer major lifechanges, such as marriage, divorce, the

birthof a child, thedeath of a beneficiary or executor, a significant purchase, etc.
