About me Originally from the UK, I have lived in The Netherlands for more than 30

years. After 5 years in-house at ASML, I moved to the private practice

DeltaPatents in 2007, dividing my time between patent work, EPO

oppositions, management and giving training in European & PCT law.

I was the author of the DeltaPatents' D exam methodology for DI and DII,

and spent several years improving the Question and Answer books. I

taught PCT to IP Administrators for many years, including classes at the EPO as part of

their EPAC program. As partner, I was responsible for the procedures and functioning of

the formalities group, as well as Marketing and Business Development.

Inspired by the creativity, enthusiasm & passion of technical Startups & SME's, I founded a

different kind of IP law firm in April 2017. We operate like a Startup ourselves, keeping

overhead low and providing tailor-made services at fixed prices. Fireball Patents is driven

to find the most appropriate way to protect our clients’ brilliant inventions. I work in the

fields of software, electronics, mechanics, optics, mechatronics, communications, data

Compilation Notes Every year, the WIPO produces a printable version of the complete Applicants Guide,

including all annexes, specifically for the Pre- and Main Exams. The current version can be

found here: http://www.wipo.int/pct/en/eqe/index.html. However, it is 1800 pages and

much of the information will never be required at the exam. I have produced this

abbreviated (and improved) version to lighten the load and to save a few trees.

Using input from the EQE Regulations, past D papers and comments from the D

Examination Committee, I have limited it to adequately cover what you may need.

In addition, I have added several useful overviews from the WIPO and EPO websites which

can speed up answering questions during the exam.

This book of about 850 pages is available free of charge to download from the Salted

Patent Blog (saltedpatent.blogspot.nl) and Fireball Patents (www.fireballpatents.com).

Please feel free to pass on the links to anyone who needs them. To save paper when

printing, it should be printed with 2 pages on each side of an A4.

For the states most relevant for the EQE, all information from the Applicants Guide

annexes has been included. These states are:

• The 15 most used RO’s in 2016 and the 15 most used DO/EO’s in 2015 (WIPO

statistics)

• All EPC states, extension and validation states (in force)

• All ISA’s, SISA’s, IPEA’s, and all Intergovernmental Organizations

For the rest of the PCT states, only basic information is included such as Treaty

membership, reservations, national entry deadlines etc. The EPO is covered extensively,

using information from both the WIPO and the EPO websites. For the other four largest

patent offices - CN, JP, KR, US, the complete summary of entry requirements and national

procedure from the national chapter is provided (but the fees and forms have been

removed as they are too detailed for the EQE).

Location

Patent Prosecution Highway pilot programme between the IP5 Offices based onPCT and national work products

I. Background

The European Patent Office (EPO), the Japan Patent Office (JPO), the Korean Intellectual PropertyOffice (KIPO), the State Intellectual Property Office of the People's Republic of China (SIPO) and theUnited States Patent and Trademark Office (USPTO), referred to as the IP5 Offices, have decided toextend the comprehensive Patent Prosecution Highway pilot programme.

The Patent Prosecution Highway leverages fast-track patent examination procedures already available atthe offices to allow applicants to obtain corresponding patents faster and more efficiently. It also permitseach office to exploit the work previously done by the other office.

The present notice replaces that published in the OJ EPO 2014, A8.

II. IP5 PPH pilot programme

The PPH enables an applicant whose claims have been determined to be patentable/allowable to have acorresponding application filed with a PPH partner office processed in an accelerated manner while atthe same time allowing the offices involved to exploit available work results.

Under the IP5 PPH pilot programme a PPH request can be based

either on the latest PCT work product (written opinion of the ISA (WO-ISA) or international preliminaryexamination report (IPER)) established by one of the IP5 Offices as ISA or IPEA,

or on the national work product established during the processing of a national application or a PCTapplication that has entered the national phase before one of the IP5 Offices,

where this work product determines one or more claims to be patentable/allowable.

Where the EPO work product contains one or more claims that are determined to bepatentable/allowable, the applicant may request participation in the PPH pilot programme at one of theIP5 partner offices, i.e. JPO, KIPO, SIPO and the USPTO. The procedures and requirements for filing arequest with these offices are available from their respective websites.

For the purposes of this notice

the IP5 Office, i.e. JPO, KIPO, SIPO, USPTO, also in its capacity as ISA and/or IPEA, the work productof which is used as a basis for the PPH request is referred to as Office of Earlier Examination (OEE),

while the Office of Later Examination (OLE) refers to the office before which participation in the PPH pilotprogramme is being requested, i.e. the EPO.

A. Trial period for the IP5 PPH pilot programmeWith effect from 6 January 2017 the IP5 PPH pilot programme is extended for a period of three yearsending on 5 January 2020. The requirements laid forth below will apply to PPH requests filed with theEPO on or after 6 January 2017.

The EPO will evaluate the results of the pilot programme to determine whether and how the programmeshould be fully implemented after the trial period. The trial period may be extended if necessary toadequately assess the feasibility of the IP5 PPH programme. The EPO may also terminate the IP5 PPHpilot programme early if the volume of participation exceeds a manageable level, or for any other reason.Notice will be published if the IP5 PPH pilot programme is terminated before 5 January 2020.

B. Requirements for requesting participation in the IP5 PPH pilot programmeIn order to be eligible to participate in the IP5 PPH pilot programme at the EPO, the followingrequirements must be met:

(1) The EP application for which participation in the PPH pilot programme is requested must have thesame earliest date with the corresponding application, whether this be the priority or filing date of acorresponding national application filed with another IP5 Office (see Annex 1) or a corresponding PCTapplication for which one of the IP5 Offices has been ISA and/or IPEA (see Annex 2).

(2) The corresponding application(s) has/have at least one claim indicated by one of the IP5 Offices in itscapacity as a national or regional Office, ISA and/or IPEA to be patentable/allowable . The claim(s)determined as novel, inventive and industrially applicable by the ISA and/or IPEA has/have the meaningof patentable/allowable for the purposes of this notice.

(3) All claims in the EP application for which a request for participation in the PPH pilot programme ismade must sufficiently correspond to the patentable/allowable claims in the OEE correspondingapplication(s). Claims are considered to sufficiently correspond where, accounting for differences due toclaim format requirements, the claims are of the same or a similar scope or the claims in the EPapplication are narrower in scope than the claims in the OEE corresponding application(s). In this regard,a claim that is narrower in scope occurs when an OEE claim is amended to be further limited by anadditional feature that is supported in the specification (description and/or claims). Additionally, a claim inthe EP application which introduces a new/different category of claims than those indicated to bepatentable/ allowable by the OEE is not considered to sufficiently correspond. For example, where theOEE claims only contain claims to a process of manufacturing a product, then the claims in the EPapplication are not considered to sufficiently correspond if the EP claims introduce product claims thatare dependent on the corresponding process claims. The applicant is required to declare that the claimsbetween the EP and the OEE applications sufficiently correspond.

(4) Substantive examination of the EP application for which participation in the PPH pilot programme isrequested has not begun. The examination starting date is visible

for unpublished applications only at the request of the applicant or his representative or by inspecting thefile using the MyFiles service,

for published applications to all in the European Patent Register.

C. Documents required for participation in the IP5 PPH pilot programmeFor participation in the PPH pilot programme at the EPO the applicant has to:

(1) file a request for participation in the PPH pilot programme. The request form

EPA/EPO/OEB 1009 (Participation in the Patent Prosecution Highway (PPH) pilot programme)

is available via the EPO website at www.epo.org;

(2) file a declaration of claims correspondence which is included in the request form EPA/EPO/OEB1009;

(3) submit a copy of

either all the office actions for the OEE corresponding application(s) containing the patentable/allowableclaims that are the basis for the PPH request and a translation thereof in one of the EPO officiallanguages,

or

the latest work product in the international phase of a PCT application, the WO-ISA or, where a demandunder PCT Chapter II has been filed, the WO-IPEA or the IPER and a translation thereof in one of theEPO official languages.

(4) submit a copy of the patentable/allowable claim(s) from the OEE application(s) and a translationthereof in one of the EPO official languages.

(5) submit copies of all the documents other than patent documents cited in the OEE office action(s) orthe PCT work product identified in point (3) above.

When the requirements set forth above are met, the request for participation in the PPH pilot programmewill be granted and the EP application will be processed in an accelerated manner. In those instanceswhere the request for participation in the PPH pilot programme does not meet all the requirements setforth above, the applicant will be notified and the defects in the request will be identified. The applicantwill be given one opportunity to correct formal deficiencies identified in the request. If the request is notcorrected, the application will be taken out of the PPH pilot programme and the applicant will be notified.

If any of the documents identified in points (3) and (4) above

(a) have already been filed in the EP application prior to the request for participation in the PPH pilotprogramme, it will not be necessary for the applicant to resubmit these documents with the PPH request.The applicant may simply refer to these documents and indicate in the request for participation in thePPH pilot programme when these documents were previously filed in the EP application.

(b) are available via the respective Dossier Access System (DAS) or Patentscope, the applicant doesnot need to submit a copy thereof, but has to provide a list of the documents to be retrieved. Machinetranslations will be admissible for the documents identified in points (3) and (4). The EPO will requestapplicants to submit a translation of the documents identified in points (3) and (4) above, if DAS does notprovide a machine translation. The EPO can request applicants to submit an accurate translation, if themachine translation is insufficient. If the OEE application(s) is (are) unpublished, the applicant mustsubmit the documents identified in points (3) and (4) above upon filing the PPH request.

D. Prosecution in an accelerated mannerOnce the request for participation in the PPH pilot programme has been granted, the EP application willbe processed in an accelerated manner. The conditions applicable to the PACE programme shallapply by analogy to the prosecution of EP applications processed under the IP5 PPH pilot programme.

Either the JPO, KIPO, SIPO or the USPTO has been ISA and/or IPEA. Applications for which theEPO was ISA and/or IPEA are not eligible for processing via the PPH before the EPO as DO/EO. TheEPO understanding of the PPH is that an application is processed in an accelerated manner on the basisof a patentability assessment made by another office. Where the EPO has been ISA and/or IPEA, thePCT WO/ISA or IPER have effectively the same status as a first communication in substantiveexamination before the EPO as DO/EO. Thus, in this case there is no work product that can beconsidered as work done by "another" office. This case can, however, fall under the regular programmefor accelerated processing of European patent applications ("PACE") which the applicant can request.

For the JPO claims are indicated to be allowable/patentable when the JPO examiner clearly identifiedthe claims to be allowable/patentable in the latest office action. The office action includes:

(a) Decision to Grant a Patent

(b) Notification of Reasons for Refusal

(c) Decision of Refusal

(d) Appeal Decision.

If the following standard expression is described in the "Notification of Reason for Refusal", those claimsare clearly identified to be allowable/patentable:

"<Claims(s) which has (have) been found no reason for refusal>

At present for invention concerning Claim _, no reason for refusal is found."

For SIPO claims are "determined to be allowable/patentable" when the SIPO examiner explicitlyidentified the claims to be allowable/patentable in the latest office action, even if the application is notgranted for patent yet. The office action includes:

(a) Decision to Grant a Patent,

(b) First/Second/Third/… Office Action,

(c) Decision of Refusal,

(d) Reexamination Decision, and

(e) Invalidation Decision.

Claims are also "determined to be allowable/patentable" in the following circumstances: If the SIPO officeaction does not explicitly state that a particular claim is allowable/patentable, the applicant must includeexplanation accompanying the request for participation in the PPH pilot programme that no rejection hasbeen made in the SIPO office action regarding that claim, and therefore, the claim is deemed to beallowable/patentable by the SIPO. For example, if claims are not shown in the item of "6. the Opinion onthe Conclusion of Examination about Claims" in the "First Notice of the Opinion on Examination" or "5.the Opinion on the Conclusion of Examination about Claims" in the "Second/Third/… Notice of theOpinion on Examination" of the SIPO, those claims may be deemed to be implicitly identified to beallowable/patentable and then the applicant must include the above explanation.

(1) The fees for the international searchand for the international preliminaryexamination carried out on internationalapplications under Article 2, items 2 and19, of the Rules relating to Fees shall bereduced by 75% if the international appli-cation or the demand for internationalpreliminary examination is filed by anatural person who is a national of andresident in a state which is not acontracting state to the European PatentConvention, and which, on the date offiling of the application or of the demand,is listed as a low-income or lower-middle-income economy by the WorldBank.*

DAS - Digital Access Service

The WIPO Digital Access Service (DAS) is anelectronic system allowing prioritydocuments and similar documents to be securelyexchanged between participating intellectualproperty (IP) offices.

The system enables applicants and offices to meet the requirementsof the Paris Convention for certification in an electronic environment. Traditionally, applicants have been obliged to request certified papercopies of documents from one office and then submit thosedocuments to other offices. DAS allows applicants to simply requestthe first office (known as the Depositing Office or Office of First Filing)to make priority documents available to the system andthen to request other offices (known as the Accessing Offices orOffices of Second Filing) to retrieve those documents via the service. The exchange of documents then takes place electronically betweenthe offices.

The service is intended for use with documents related to patents,utility models, industrial designs and trademarks. At present, it isused for priority documents relating to patent applications. It will beextended to other IP rights, such as industrial designs andtrademarks, once the participating offices have made the necessaryoperational and technical changes.

The DAS web portal was replaced on December 19, 2014. The newversion of the portal requires a WIPO account:

Participating Offices

The digital libraries of the following offices areparticipating in the WIPO DigitalDocument Access Service (DAS), establishedunder the Framework Provisions for the DigitalAccess Service.

There are two different types of notification possible:

Depositing Office (paragraph 10 of the FrameworkProvisions): The Office, which is usually acting as the Office of firstfiling, allows applications to be made available to the Service;Accessing Office (paragraph 12 of the Framework Provisions): The Office, acting as an Office of second filing, allows the applicantto request that a priority document be retrieved from the Serviceinstead of having to file a certified copy.

At present, the service is operational for patent documents only. Oneoffice is ready to deposit and retrieve patent and utility modeldocuments. Documents relating to other IP rights, such as industrialDesigns and trademarks will be exchanged through the system oncethe participating offices have made the necessary operational andtechnical changes.

The main effects of the notifications, as well as information on digitallibraries which have been designated, are summarized in the tablebelow. For more information, refer to the complete notifications.

Only offices where aservice date is given arecurrently offering theexchange of documentsthrough the Service.A status of "designated"in the table means that adigital library held by theoffice has beendesignated inaccordance withparagraph 7 of theFramework Provisions,but that as yet nonotification has beengiven by that office as towhen the digital librarywill be available for usethrough the Service.Several other offices areworking with theInternational Bureauto allow use of theirdigital libraries withthe Service but have notyet had their librariesdesignated.

New "Access Code" Procedure

As of July 1, 2012, a new procedure has been introduced for accessing offices to retrieve priority documentsfrom the service by using access codes. Applicants provide the access code directly to the office of secondfiling.

The table below indicates offices which have implemented the necessary operational and technical changesto offer this new procedure.
