all being co-beneficiaries of the Erasmus Mundus Action 2 Project Lot 13, hereinafter

referred to as ' Parties" or ''Party" related to the joint action entitled ''Networking and

Mobility Actions for Sustainable Technology and Environment in India", in short

''NAMASTE" hereinafter referred as "Project''. The NAMAST Consortium Agreement is a

multilateral agreement between the coordinator and the partners. The NAMASTE Consortium

consists of ten associate partners, whose role is to disseminate the project information and the

results in the countries concerned in the Lot.

NAMAST is guided by a desire to strengthen already existent relations with, and to establish

new relations among, its respective institutions from the EU as well as India. Within the

Pr~oject, the Parties will seek to extend collaborative activities that will lead to the future

sustainability of the cooperation, or enhanced exchange agreements and other joint study and

research projects.

THE FOLLOWING HAS BEEN AGREED:

Section 1: Aim of the Agreement

The purpose of the NAMAST Consortium Agreement is to establish the terms and

conditions for the implementation and management of the Erasmus Mundus Action 2 Project

NAMASTE among the Parties within the framework of the Grant Agreement No. 2013-2542 I

001-001 - EM Action 2 - Partnerships between the Education, Audio-visual and Culture

Executive Agency (EACEA) of the European Commission and the Project Coordinator. This

Agreement shall specify the respective rights and obligations of the Parties with regard to the

execution of the NAMJ\STE Project. All Parties are subject to the rules and regulations laid

out by the European Commission in the aforementioned Grant Agreement regarding both the

responsibilities towards the Commission and towards other Parties to this Agreement.

Duration

The duration of the Project is from 15 July 2013 to 14 July 2017.

Section 2: General Commitment

!\II partner institutions of the Consortium define and acknowledge, prior to the mobilities,

programmes and studies that will be performed, and endeavour to formally recognise credits,

study degrees and qualifications in accordance with the Bologna Process. The NAMJ\STE

Consortium will refrain from any action that could contribute to the favouring of a brain-drain

from India.

Section 3: Organisation of the Partnership

In order to ensure efficient coordination and transparent decision-making processes, all co­

beneficiaries will be involved in Project activity management, the organisation of mobility,

and financial management.

3.1. Consortium Organisation

The Consortium has a joint governance structure with joint election, admi sian, supervision,

monitoring and assessment procedures. The governance structure is as fo llows:

a. The Coordinator of the Consortium is the Georg-August-UniversiUit Gottingen

(GAUG). rt hosts the Consortium Secretariat. The main responsibilities of the

Coordinator are as follows:

• Overall management of the Project based on the guide lines and

objectives defined by the Grant Agreement (Annex I) between the

Coordinator (GAUG) and the EACEA in Brussels, and by any

additional rules estab li shed by the Steering Committee. The

Coordinator manages the adm inistrative, legal and financial matters of

the Partnership, and is responsible for all contact with the EACEA on

behalf of the NAMASTE Consortium;

• To take all necessary steps to ensure that the objectives of the Project

are achieved according to plan;

• To establish transparent communication with the Partners by providing

a copy of the Grant Agreement and its annexes and any other official

document concerning the Project.

b. The Consortium appoints a Steering Committee consisting of one representative

per pa11ner as well as one non-voting member per associate partner. It will support

the Coordinator in setting up the management of the programme. The Coordinator

will chair the Steering Committee meetings. The Steering Committee will work in

close relation with the administrative staff. The main responsibilities of the Steering

Committee are as follows:

• To undertake the application, selection-consultation, and admission

process (defining the selection procedures and methods; common

evaluation criteria; selection of the candidates);

• To undertake the academic, administrative and financial management of

the Project (defining the distribution of mobilities among the partners;

approving the selected candidates to be submitted to EACE!\;

reviewing and amending the scholarship conditions, if necessary) ;

• Quality assurance through the management organisation of the

programme (internal academic quality assessment; evaluation and

follow up) ;

• The Consortium additionally appoints a Selection Committee

consisting of one representative from the following Partner Institutions:

University of Gottingen, Germany - Chair; IISER - Pune as Co-Chair;

Assam University and liT - Kanpur in India; and University of

Groningen, the Netherlands and 1ST - Lisbon, Portugal. The main

responsibility of the Selection Committee is to undertake the selection

process.

c. The Indian Institute of Science Education and Research Pune (IIS ER- Punc) is the

Joint Coordinator of the Consortium, due to its long standing and wealth of

experience in coordinating other scientific projects with the Indian Universities, and

universities within Europe and US, as well as its strong interest in strengthening

international collaboration and national networks. As Joint Coordinator, llS ER

Pune will ensure a wider more transparent coordination, which will provide better

implementation of the project objectives for the consortium in general and India in

particular. IISER's role and responsibilities will encompass the following aspects:

• Supp011ing the coordinator in the creation of project promotional

materials, website development, online application tool supervising;

designing the promotional strategy for all Indian partners - planning,

implementing and monitoring it;

• Administrative, financial , academic and quality control tasks;

• Acting as a main central contact point for Indian H ~ Is and mobility

candidates from the participating third countries

• Organising recruitment events, including information days at IIS ER

Pune, presentations and information sessions at non-partner

universities, regional outreach, news releases, informing associated

partners, project promotion during educational fairs, etc.;

• Organising accompanying events: project launch selection meetings,

potentially summer schools;

• Providing full time assistance to partners, key stakeholders in

education, potential applicants in the program application process, etc. ;

• Preparing all the supporting documentation from the third country

partners for the coordinator (proposal preparation phase, reporting,

documents for QA, etc.) ;

• Direct involvement in the preparation of the project activities in India

(Kick-Off meeting, selection meeting, promotion plan and promotion

campaign, additional activities such as round-table meetings, seminar ,

workshops, etc.) ;

• Directly helping with the preparation of reports for the EACEA

(activity, progress and final reports);

• Acting as the main point of contact for Target Group II and III

candidates in India

• Coordinating promotion activities carried out for non-partner

institutions with the help of the responsible associated partners in India;

• Coordinating and monitoring the activities carried out by the local

management teams at the partner institutions in India in connection

with project promotion, mobility aspects, academic recognition and

mutual problem solving;

• Acting as the main contact person responsible for reporting to the EU

delegation in India and the Council for Higher Education as well as

taking leading role as the local contact person for NAMASTE Project to

DAAD, NUFFIC, British Council, Goethe Institute, etc., thereby

enhancing sustainable collaboration with those organisations and the

consortium partners in India.

d. At each partner Institution a Local Coordination Team is established which is

under the responsibility of its representative in the Steering Committee. The Local

Coordination Team shall usually consist of 3 people from the administrative and

scientific staff. Should the Local Coordination Team consist of administrative staff

only, it must be assured that scientists will be involved in academic selection and

ranking. The main responsibilities of the Local Coordination Team will be a

follows:

• Planning and organising individual mobility; distributing and promoting

the Project at partner institutions; screening, evaluating and assessing

applications;

• Organising and overseeing the selection process of applicants (students,

Post-Doctorates, academic and administrative staff), who applied for a

scholarship for a stay at a Hosting partner;

• Assessing and determining the ranking quality control of the mobility

based on reports on the assessment questionnaires of mobility students,

researchers and teaching staff of the respective partner institution ;

• Providing assistance and support to incoming students, researchers and

staff with incoming procedures, such as finding housing and ensuring

that the NAMASTE Grantees will have access to language courses,

libraries and canteens, as well as the services of the respective

International Relation Offices (IROs);

• Forwarding the data needed to draw up the reports, financial statements,

annual applications and other documents mentioned in the Grant

Agreement, including its Annexes to the Coordinator;

• Ensuring that all information to be provided to the ~ AC ~ A is sent via

the Coordinator;

• Informing the Coordinator immediately of any substantial event that

may affect or delay the implementation of the action;

• Providing the Coordinator with all the necessary documents in the event

of audits and checks of evaluations, as described in articles 11.6 and

II. I 8 of the Grant Agreement;

• Respecting the common general objective which form the basis for

establishing the partnership, as mentioned in the preamble of the Grant

Agreement;

• Making every effort to achieve in practice the aforementioned common

general objectives in each action for which a community grant is

awarded;

• Refraining from any action that could contribute to the favouring of a

brain drain from India;

• Encouraging Indian participants tn mobility activities to usc their

knowledge and skills acquired for the benefit of the social, human,

economic and political development of their home countries;

• Encouraging all participants in the mobility activities to become

ambassadors for a better understanding between people;

• Adopting a transparent attitude with regards to managing and

maintaining accounts on the actions for which an EJ\CEA grant is

awarded, and cooperating fully with annual or occasional checks on the

implementation of the Grant Agreement.

e. The Steering. Committee will have meetings at least once a year by Skype or Video

Conference in order to have all the options available, and furthermore to hold an

actual meeting during which the effectiveness of the Project shall be reviewed ; to

evaluate ongoing mobilities, administrative procedures and further co-operation; to

discuss the dissemination and exploitation of further actions.

f. As for decision-making procedures, urgent decisions to be made will be suggested

by the Coordinator and approved by the Steering Committee with a simple majority

of the votes. Decisions may be taken via email communication or via E-voting. A

failure to respond within a requested period of time will be considered as an

agreement.

g. Co-operation with associate partners will be specified in separate Associate Partner

Agreements (not yet available- to be suggested by the Coordinator and to be

discussed with the as ociate partners).

3.2 Obligations of the Parties

The Parties will give full academic recognition to the study period spent abroad. By means of

quality assurance, the Parties shall create optimal conditions for the organisation of the

mobi I ities as follows :

a. Provisions for the selection of students and staff taking part in the individual

mobility activities.

b. Provision of adequate linguistic support both prior to departure and during the

mobility period. This language training is aimed at facilitating the Grantees'

social and cultural integration in the country.

c. Provision of information and assistance to students and staff: introduction to

the host institution, academic advice for students, assistance with practical

matters such as accommodation, social security, visa and residence permits,

travel and provision of tutor/mentor for incoming students.

d. Academic and organisational arrangements with partner institutions:

• for students: agreed examination criteria, academic recognition of study

periods abroad;

• for academic staff: the inclusion of courses taught in the regular

programme of the host institution, arrangements for student and cour c

assessment etc.

e. Agreements with students on an individual study plan and on the workload

required to pass any examinations or other forms of assessment (learning

agreements).

f. Provision of a transcript of records for incoming students after the completion

and assessment of their course work covering the course followed and

completed, and the ECTS credits earned at the host institution. In the case of

completing a full degree, a Diploma Supplement will be given to the student.

g. Arrangements for the monitoring of outgoing students, including organising

feedback from returning students and staff for pro pcctivc outgoing tudents

and staff.

h. Preparation of a long-term recognition of studies between institutions through

ECTS.

1. Internal evaluation and quality assessment mechanisms: evaluation sheet to be

filled out by all outgoing students and staff. Online surveys to be filled in

annually by the local management team.

3.3 Mobility Procedures for IROs

The Coordinator, in accordance with the host university rule , has the right to terminate the

grant holder's contract in the ca e of poor conduct, ill will , unauthorized absence, i ucs of

security, the breach of the house regulations in force at the host university, or a negative

evaluation by the study or research programme concerned.

Section 4: Financial Provisions

The financial contribution of the European Commission to the Project shall be distributed by

the Coordinator according to the Consortium Budget as de cribcd hereunder.

Payments shall be made by the Coordinator in Euros. Any conversion of actual costs into

Euros shall be made at the daily rate published in the Official Journal of the European Union,

or, failing that, at the monthly accounting rate established by the EU Commission and

published on its website.

4.1 Organisation of Mobility:

All Parties will receive a lump sum of 3,000 E which can be u cd within the framework of the

Project ( taff costs, travel costs, publications, meetings, administrative costs etc.). The EU

partners will receive the full amount at the start of the Project, wherea the Indian partners

will receive 50% of the lump sum at the start of the Project and will receive the remaining 50

% when the second instalment of the Project money is made available by the European

Commission. The Parties will keep accounting documents to justify these 3,000 E.

The Parties agree that there will be a central budget of 200 000 E as a general coordination

budget for the Coordinator (Kick-off and selection meetings project coordinator,

administrative assistant, project website with application tool, meetings, project publications

and other activities and general costs related to the Project). The Coordinator will also cover

the accommodation and travel cost to these meetings). The Coordinator will keep transparent

accounts concerning the amount of 200,000 . Joint Coordinator will receive I 0,000 Euro for

the Joint Coord ination Activities. A breakdown of the Joint-Coordination budget is given

below:

4.2 Individual Mobility, Based on Unit-Costs (see annex 1).

All Parties will receive participation costs (3000 Euro/academic year) at the beginning of the

mobility period to the hosting partner for students (undergraduate, master and PhD), with 10

or more months per academic year. The participation costs in NAMASTE will be 3000 Euro

per academic year. The partner will repay the amount of participation costs which is found

ineligible due to the cancellation or interruption of the mobility period, or due to the early

return of the grantee, according to the defined rules in the Administrative and Financial

Handbook (Annex V).

The Coordinator shall provide the integrity of the subsistence allowance to the vi iting

students/staff. A part shall be provided upon arrival to cover installation co ts, and the

remaining part shall be provided on a regular basis. In the case of mobilitie lasting longer

than I 0 months, the last payment will be made after receipt of the evaluation form. Under no

circumstances may Parties claim tuition/registration fees from visiting grant holders beyond

the amounts indicated above or retain the funding foreseen as subsistence allowance to cover

such fees.

The first two instalments (2 months subsistence allowance) for Undergraduate, Master, PhD

and PostDoc grantees and one instalment for Staff will be transferred to the respective U

ho t universities once the mobility dates are finalized and the travel is booked for the

grantees. Further payments after the third months will be transferred to the grantees EU Bank

Account directly by the Coordinator.

The Coordinator is in charge of all travel and insurance costs and will centrally organise and

conduct all matters regarding travel arrangements and insurance for the NAMASTE grantees.

The Coordinator will also arrange the travel of the partners participating in the NAMA TE

Consortium meetings.

Costs mu t satisfy the following general criteria:

j. They must be connected with the subject of the Grant Agreement and they

must fall within the estimated budget annexed to it;

k. 1 hey must be necessary for carrying out the action covered by the Grant

Agreement;

I. They must be reasonable and justified, and they must accord with the

principles of sound financial management in particular in term s of value for

money and cost-effectiveness;

m. They must be generated during the period of eligibility for Community funding

as specified in the Grant Agreement;

n. They must be actually incurred by the partner institutions, recorded in their

accounts in accordance with the applicable accounting principles, and declared

in accordance with the requirements of the applicable tax and social

legislation;

o. They must be identifiable and verifiable.

The Parties ' internal accounting and auditing procedures must permit direct reconciliation of

the costs and revenue declared in respect of the action with the corresponding accounting

statements and supporting documents.

The Coordinator undertakes to provide any detailed information requested by the EAC I: A or

by any other outside body authorised by the EACEA to check that the actions and the

provisions of the Grant Agreement are being properly implemented. Where the Commission

or the EAC ~ A o wishes, it may request such information to be provided directly by a Party.

The Parties shall keep all original documents at the EACEA's disposal, especially accounting

and tax records, or, in exceptional and duly justified case certified copies of original

documents relating to the Grant Agreement for a period of five years from the date of

financial closure of the corresponding action.

4.3 Administrative and Financial Handbook

All Parties agree to have read the Administrative and Financial Handbook for partners

se lected under Strand 1 and agree to act according to the regulations tipulated in this

I landbook. The Administrative and Financial Handbook will be uploaded in the Project's

database for the reference purposes of all partners and sent by email.

The Parties agree that in case of uncertainty, the Coordinator can decide upon the applicable

interpretation or implementation of the financial and administrative rules and regulations

applied within the Project.

Section 5: Application Procedure and Selection

5.1 Application Procedures

Application procedures include a call for mobility places on offer, via an online application

system integrated in a web platform to be created by the Coordinator. Each application shall

include:

r. An ECTS study plan approved by the home univcr ity. A learning agreement

(in the case of credit seeking students at Bachelor and Master level and

Doctoral level for some sending Partner Institutions);

Language certificates or certification of language of instruction. A statement

given by the home institution is enough for exchange students but for degree­

seeking students an internationally recognised language test such as TO FL or

I L TS may be required according to the program they are applying to·

t. A CV (preferably in the Europass format);

u. Recommendation letter (s);

v. A research and training plan (for Doctorate and Post-Doctorate mobilities);

w. An invitation letter from the host institution or supervisor (for Doctorate, Post­

Doctorate and Staff mobil ties) ;

x. A teaching, research and training/work plan (for Staff mobilities) ;

y. Documents indicating the candidate belongs to TG3 (if applicable).

All documents need to be provided in English

Once the call for applications is closed, the selection procedure will start. The mobility of the

l5t call for applications in the 1st Cohort in 2013/14 has to start latest by 31 December 2014 at

the latest, c cept for Staff mobilities.

5.2 Condition of the Application

All applicants should comply with the requirements established in the guidelines of the

Erasm us Mundus Action 2. Applicants must have knowledge of the language used for the

course and programmes offered at the hosting partner institution: in the case of Master,

Doctorates and Teaching Staff, the language of instruction is required. Applicants may apply,

in accordance with their preferences, to a maximum of 2 partner institutions in which offer

courses/study oppottunities compatible with their thematic areas of interest.

5.3 Selection

During the election process, the election Committee will consider applications from

economically disadvantaged candidates who, without the scholarship, could otherwise not

Both academic and administrative staff should have contacted their respective counterpart at

the host university and thus have accordingly drawn up a teaching/work plan.

Once the call for applications is closed, home universities will be able to validate the

applications of the TG 1 Candidates from their home institutions, and host universi ties will be

able to evaluate the dossiers of the candidates according to the defined criteria.

In general, the selection criteria established within the NAMASTE Project include:

a. Quality ofthe application (clearly defined goals and expected outcomes expected

impact, methodology, fitness for the Project's objectives, time-frame and other),

b. Motivation (motivation letter has to be written in English),

c. In the case of Doctoral students, Post-Doctorates, and Staff, those with an

invitation letter from the Host university will be given preference,

d. Aptitudes (such as intercultural readiness, interpersonal kill , and problem

olving),

c. Academic qualifications and aptitudes,

f. Language ski lis,

g. Impact and relevance for the country of the home University (especially 111

research activities, Doctoral student, Post-Doctorate, and teacher mobilities).

Applications will be assessed by giving a score according to the weighting of the different

criteria (the final weighting will be decided by the Consortium in the Kick-Off Meeting). In

the case of Doctoral students, priority will be given to students who have received a

supervision acceptance letter by a professor of the corresponding host institution.

In the case of Target Group 3 applications, home partners must verify the proof of particular

vulnerable situations presented by the applicant.

Nomination of the candidates:

every partner institution.Two weeks is given to confirm the scholarship acceptance.

Reserve candidates: will be given the chance to check the evaluation re ult of their

application and further information on the chances and conditions of being selected by return.

They will also be given the chance to submit an electronic request for appeal which will be

directed to the Steering Committee and accessed through the online system.

Not selected candidates: not included in the reserve list: will be given the chance to check the

evaluation result of their application and any further comment and reasons for not being

selected, based on that, they will be given the chance to submit an electronic request for

appeal which will be directed to the Steering Committee and accessed through the online

system. Two weeks is given to appeal on the selection results.

5.6 Admission

!\ list of pre-selected candidates will be published. Candidates will be able to accept or reject

their candidacy. Thereafter, the NAMASTE Project Coordinator will announce a final list of

candidates. Henceforth, the hosting partners will take responsibility for organising the

mobilities. All applicants will be informed of the results of the selection. Hosting partners will

send a Certificate of Admission or an invitation letter to all the candidates who have accepted

the Erasmus Mundus grant. In the case of a rejection of a scholarship a candidate from the

reserve list will be invited to participate.

5.7 Examination

xaminations are conducted by the hosting partner according to their own procedure and

regulations. xaminations can take the form of written or oral exams, essays, or project work.

Degree award criteria follow the host institution 's own grading system. Ilowevcr, the ECTS

evaluation system will be applicable, namely credits will be received either by capitalisation

or by compensation. Given the differences in evaluation systems between EU countries, this

' . qualitative system (A to E) will be able to harmonise the marks of the students across the

Consortium.

Section 6: Further collaboration

Through their International Relations Offices and other departments responsible for incoming

students, partners will promote the creation of integrated language programmes and cultural

integration, as well as the creation of means for disseminating "good practices'' and

administrative procedures, aimed at improving methods of hosting third country candidates

from third-countries or in mobility. Further collaboration will be encouraged.

Section 7: General Provisions

7.1 Legal Provisions

The partners agree that all exchange students and staff will have to sign an agreement to

ensure their compliance with the laws of each host institution-home country, or other relevant

jurisdiction, as well as the statutes, regulations and disciplinary rules promulgated by each

host institution.

The Partners agree that nothing in this Partnership Agreement shall be deemed to require a

Partner to breach any mandatory statutory or university laws or statutes under which the

Partner is operating.

7.2 Intellectual Property Rights

a. The Partie recognise that visiting students, researchers, and academic taff

will sign a separate agreement on confidentiality and the protection of the

intellectual property rights of the hosting university, when necessary. The

Parties concerned shall, if appropriate, reach bilateral agreements on the right

use of Project results as regards the whole NAMASTE Project; the right for

non-commercial use in general should be granted as perpetual and free of any

charge.

b. In the event that information, files, documents, records or data are disclosed to

another Party during the duration of the Project which are marked or identified

as confidential, the Parties agree to keep these in confidence and not to transfer

these to any third party, neither in written nor in oral form.

7.3 Liability

To the extent legally possible, a Party ' s liability towards other Parties shall be limited to gross negligence and intent, and shall be excluded from consequential damages.

7.4 Disagreements

The Parties agree that any dispute arising from the performance of this Agreement hall be

resolved in the Steering Committee.

7.5 Language of the Partnership

The language of the NAMASTE Consortium and all communication among the partners will

be English.

7.6 No Representation, Partnership or Agency

The Parties shall not be entitled to act or to make legally binding declarations on behalf of any

other Party. Nothing in this Consortium Agreement shall be deemed to constitute a joint

venture, agency, partnership, interest grouping, or any other kind of formal business grouping

or entity between the Parties.

7.7 Brain Drain

The EU partner institution participating in the Project will not offer any job opportunities or

further study possibilities to the participants in this programme in the year following their

period abroad, extending their mobility. The NAMAST grantees must return to their home

country after the completion of the mobility period and the study programmes, or in the ca e

of degree-seeking grantees after the degree has been accomplished.

7.8. Applicable Law

This Agreement shall be ruled by German Jaw. The competent Courts shall be the ouris of

Germany except for the dispute resolution. Disputes if any, will be re olved in accordance

with clau e 7.4.

7.9 Amendments

This Agreement may be amended or modified by a written document signed by all Parties.

This Agreement represents the complete understanding of the Parties with respect to the

subject matter hereto, subject to any additional information provided in handbooks prepared

and agreed by the partner institutions.

The present Agreement will take effect when all partner have signed it, and it will remain in

effect for the period of the Project's duration. Modifications will be incorporated according to
