TENDER FOR PROVIDING ROUND THE CLOCK SECURITY SERVICES

TENDER NOTICE NO. IPR/ADMN/TN/01/2012 dated 13.01.2012

Institute invites Sealed tenders in “Two part” for providing round the clock security services

on rate contract basis for a period of two years at (1) Institute for Plasma Research, (2) GIDC

Electronic Estate, Gandhinagar- Two Locations and (3) Residential Quarters at Ghatlodiya,

Ahmedabad & Bopal.

available from 14-01-2012 to 20-01-2012 during 10.00 am. to 4.30 pm. on working days

on payment of Rs 500/- (non-refundable) by pay order or demand draft in favour of "Institute

For Plasma Research" payable at Ahmedabad at the above address. The bid shall have to be

submitted duly filled and signed at the above mentioned address. The Bidders who has

downloaded the document from website should attach ,along with the bid document , a pay

order or Demand Draft of Rs. 500/- ( Non Refundable ) in favour of “Institute For Plasma

Research ” payable at Ahmendabad. All the bidders should also enclose a demand draft of Rs.

50000/- (Rs. Fifty Thousand Only) drawn in favour of “Institute For Plasma Research ”

payable at Ahmendabad, as the Earnest Money Deposit along with Technical Bid.

The offers should be submitted in two sealed covers one superscribed “ Technical Bid and

Commercial Terms & Conditions” and other “Price Bid”. Both covers shall be put in another

sealed cover superscribing the envelope with “ Security Services, Notice No. and due date”.

The last date of submission of bid is 23-01-2012 on or before 12.30 pm. The Technical bid

will be opened at 2.30 pm. on the same day in the presence of attending tenderers or their

authorized representatives. The representatives have to bring an authority letter for the same.

After opening of Technical bid, the capability and suitability of the bidders shall be evaluated,

if needed an evaluation committee will visit the office and sites. Subsequently the Price bid of

the qualified bidders shall only be opened in the presence of the attending bidders. The date of

opening of Price bid will be informed to the qualified bidders.

Following are the Qualifying Criteria: 1) The Firm/Company should have 10 years experience and a full fledged

establishment /office in Ahmedabad or Gandhinagar since five years with

facilities like telephone, Computers, Printers, Fax, e-mail facilities. Patrolling &

Support system for night patrolling & full fledge training center to train guards.

2) Should currently have at least one security service contract of over Rs. 5 lac and

one contract having more that 70 security guards deputed at one premises in and

around Gandhinagar/Ahmedabad.

3) Capable of providing security personnel after complete antecedent / police

verification.

4) Should have ISO 9000 certification.

5) The Firm/Company should have all the necessary registrations of the Government

failing which they will disqualify.

The Director, IPR reserves the right to accept or reject any or all tenders without assigning

any reason thereof.

INSTRUCTIONS Tenderers should strictly take into account the following conditions while quoting their rates. (1) Tenderers should quote as per prevailing minimum wages being

announced by Labour Commissioner (Central) for Zone C i.e. remaining area of Gujarat, for Security Guards in unskilled category.

(2) The wages of all the security personnel should be quoted for 26

days working and for 8 hours duty only. (3) The rates quoted by the tenderers should also include :

• Statutory obligations

• Bonus

• Liveries

• Reliever’s salary

• Overheads & profit etc.

• All applicable taxes (4) Tenderers should note that their rate should be in the form of

package deal containing all Statutory Provisions, Bonus, Liveries, Reliever’s salary, Overheads & Profit, etc. on monthly basis. Service Tax would be allowed extra at actual from time to time

(5) The tenderers should also note that they should have registration

of PF/ESI/Service Tax while quoting for statutory provisions and should have licence under the Private Security Agencies (Regulation) Act 2005. Copies of the same to be submitted to the Institute.

(6) The tenderer, if contract is awarded, would be required to submit

along with bill :

(a) Necessary challans in respect of PF, ESI & Service Tax in support of having made the payment to concerned authorities, every month.

(b) Copy of attendance register, wage slip & bonus register

whenever required. If the party fails to submit the above documents, appropriate action including that of imposing penalty may be taken by the in institute. 7) The tenderer should sign all the pages of tender document

before submission as token of having read, accepted and understood the terms and conditions.

8) The tender documents are issued to the tenderers meeting the details as specified in the tender notice, which does not mean that they are pre-qualified to execute the work.

9) The Institute is not bound to accept the lowest tender. The

Institute shall be under no obligations to accept the lowest tender.

10) The rates quoted in the tender shall remain firm for the entire

period of the contract. 11) The rates offered by the tenderers should be valid up to 120

days from the date of opening of the tenders. 12) The tenderers are advised to survey all the premises before

quoting. 13) Incomplete and late tenders are liable to be rejected. 14) Institute authorities may personally visit the tenderers

office/training center to verify the facilities available required fulfilling the qualifying criteria and their decision would be final and binding. They may also visit one or more of your clients to confirm the quality of you manpower.

15) The Institute reserves the right to split the contract and award

separately between two or more parties. 16) The tender if awarded, the contractor will have to provide the

necessary manpower only after getting the police verification done of the individuals.

Part I – TECHNICAL & Commercial TERMS AND CONDITIONS

1. SCOPE: The scope of work is to effectively & efficiently cater to the security needs of the Institute and therefore involves jobs such as:

� watch & ward � preventing entry of unauthorised persons & vehicles � regulating entry and exit of vehicles � regulating entry and exit of materials � frisking labours, guests and employees � prevention of theft, loss and damage to IPR property � vigilance � keeping constant patrolling of the premises � fire fighting in case of need � driving away stray animals � safety of movable & immovable property � Regular checking of all office rooms and switching off lights, fans,

power points, air conditioners etc. � Attending telephone calls when office is closed and keeping record

of telephonic message/communication. � Record keeping and all other functions essential to meet security needs of the institute in a foolproof manner. The scope of work also includes induction, deployment of trained security personnel, constant monitoring of check posts, survey, surprise checks, reporting and review of security matters by handling all security requirements of the institute independently & recommend measures to improve the security arrangements. The contract rate shall also include any work of incidental & contingent nature although not specifically mentioned in the tender, but necessary for its completion in an efficient manner. The scope of work in terms of the number of security personnel required by the institute may increase or decrease during the term of the contract. Accordingly the package rate / extra security personnel payment too may increased or decreased.

2. GENERAL TERMS & CONDITIONS : 2.1 The contractor shall be fully responsible in all respects to effectively take care of security needs of the Institute by deploying personnel with adequate experience of having worked in similar organisations of repute, in all the shifts to ensure foolproof security arrangements.

2.2 The contractor shall be fully responsible for complete watch and ward of entire IPR Campus in Bhat Village including Office Building, Tokamak Hall, Minor Experimental Labs., SST-I Building, Utility Building, Pump House, Liquid Nitrogen Plant and other Laboratories, Stores, Workshop, Compressor hall, Workshop, Library, Computer center, Electrical substations, Scrap Yards, health club, and other installations. The contractor shall be fully responsible for complete watch and ward of other premises viz. ITER INDIA Office – Plot No. A-29 & A-26, FCIPT Plot No A 10-B in GIDC Electronic Estate, Sector 25, Gandhinagar, Director’s Residence at Bopal and Residential premises at Ruswi-Park in Ghatlodia, Ahmedabad, and any other premises. 2.3. The contractor shall deploy trained guards at all points and impart regular training to all his guards at regular intervals. The training should include basic training in vigilance, fire fighting and using of the fire extinguishers. 2.4 The contractor shall also make special security arrangements involving deployment of additional manpower as and when required, for which additional payment will be paid as quoted in the Price bid. 2.5 The contractor is required to provide armed guard/gunman, presently one in each shift at IPR. 2.6 The contractor shall ensure that no theft, pilferage, damage or any such similar act is committed or omitted with regard to properties and assets of the Institute. 2.7 The contractor shall be responsible to check, restrict and regulate the movements/entries of persons/vehicles by using the Hand Held Metal Detector (HHMD), Trolley Mirror etc. provided at main gate and prevent unauthorised persons, things/material and vehicles from entering the premises. Necessary registers shall be maintained and all entries made therein of all visitors and their belongings. 2.8 The contractor shall keep a check on materials moving in and out of the campus. No materials shall be allowed to be taken away by anyone without proper authority and entry in the material gate pass register to be maintained for this purpose. 2.9 The contractor shall co-ordinate and liaison with the State Police Department immediately in case of breach of peace/theft and shall lodge complaint / assist the Institute in lodging complaint with Police for loss, damage, destruction, pilferage or any of the properties of the Institute or their staff members. 2.10 The contractor shall ensure regular attendance and proper performance of duties by security staff deployed by him at the respective points. The Proprietor/Director or his deputy should have a meeting with the concerned officer at least twice in a month.

2.11 The contractor shall ensure that the alertness and patrolling in the campus is very effective particularly on holidays and after office hours to prevent/detect theft, pilferage or any other damage to Institute’s assets. 2.12 The contractor shall not allow any of the personnel deployed at the Institute to work in more than one shift in a day. The Institute shall have the right to impose a suitable penalty if security personnel are posted in more than one shift without sufficient cause and intimation to the concerned officials of the Institute. 2.13 The contractor shall be responsible for lapses committed or omitted either inside or outside the premises by the persons deployed by the contractor in the campus. 2.14 The contractor shall not assign or sublet, transfer or sub-contract the job awarded to them in favour of any other contractor or agency. 2.15 The contractor shall strictly check the authenticity and identity of the persons visiting the campus and shall keep the records of all persons entering in and leaving the campus through a computer programme. 2.16 The contractor should have at least 10 years of experience in operating security services in a large or medium type of organisation of repute. 2.17 The contractor shall make their own arrangements for accommodation, transport, canteen and any other facility for their personnel deployed at the respective points. 2.18 There shall be no employee or employer relationship between the persons deployed by the contractor and the Institute as the essence of the contract shall be hiring the services which constitute expertise, security functions, enquiries/surveys and monitoring of security functions and not that of the persons. 2.19 Within 15 days of the award of the contract, the contractor will be required to register themselves as the contractor with the concerned authorities and shall produce one copy of the licence to the Chief Administrator Officer. 2.20 The contractor shall provide liveries such as two sets of uniforms & socks, single belts, badges, raincoats, gumboots, winter uniforms, whistle, lathis, big torches (with cells) and other paraphernalia to his security staff at his own cost and maintain them in working condition at their own cost. 2.21 The contractor shall be required to make the entries of materials bought out of the imprest money by the staff members. The necessary register shall be maintained at the main gate / Admin point.

2.22 The contractor shall deploy strong, stout, mentally sound, experienced, smart, well-disciplined, intelligent, hardworking security personnel, after due medical check-up, preferably in the age group and the qualifications & experience specified herein below at his own risk & cost : Security Officer :Ex-serviceman who has served at least

as Junior Commanding Officer and or has handled security independently at any Govt. organisations or reputed Private Companies for not less than 7-8 years.

The knowledge of spoken & written

English is a must besides Hindi. Knowledge of local language is desirable.

Age limit : Preferably 45 years. The

candidates above 40 years of age (but below 55 with good track records may be considered.

Security Supervisor H.S.C., Ex-serviceman from Army, Navy

or Air-Force or para-military having

minimum 5 years of experience in this line. Trained in Fire Fighting. The knowledge of written English & Hindi is a must. Knowledge of local language is desirable. Age limit : 30 to 45 years

Security Guards Minimum Qualification : S.S.C. having

3 years of experience in this line from any reputed security agency. Trained and having knowledge of fire fighting. Should be able to of read & write English/Hindi. Knowledge of local language is desirable.

Age limit : 22 to 30 years. 2.23 The weekly off of all security personnel shall be allowed as per the statutory provisions. The contractor shall further ensure that the personnel are of high integrity and their credentials must be verified with reference to the pending police cases etc. 2.24 The contractor shall be fully responsible for all disputes, issues, claims & matters related to employment, non-employment & terms of employment as far as employees engaged by him are concerned. The contractor shall indemnify IPR for all appointment of his personnel under him and that they shall have no claim for permanent employment at IPR.

2.25 There shall not be any privity of contract between the Institute on one side & employees engaged by the contractor on the other side and the contractor alone should be responsible for all matters arising out of employees engaged by him. There would be no direct control / supervision of the Institute on the employees of the contractor. 2.26 The work should be carried out as per the instructions of Chief Adminstrative Officer / Officer in charge. The contractor shall be required to ensure maintenance of Institute’s decorum himself and by all the persons deployed by him. 2.27 In case the contractor abruptly stops the work with/without sufficient notice, the Institute may decide to terminate the contract forthwith and will make immediate alternative arrangements. In such case, the Contractor shall be liable for making good the additional expenditure that may be incurred by the Institute for making alternative arrangements, till appropriate arrangements are made through calling the quotations, besides forfeiture of security deposit. 2.28 The contractor shall neither allow any unauthorized person to enter or sit at any of Institutes premises nor allow any cattle grazing or tree felling. 2.29 In case of dispute on the interpretation of terms and conditions of the contract, the decision of the Director, IPR shall be final and binding on both the parties. 2.30 The contractor shall ensure that all the persons deployed by him are free from all communicable contagious infectious and other diseases and the contractor shall have them medically examined in case of any illness at his own cost. IPR also reserves the right to direct the contractor to get his persons medically examined by a physician approved by IPR at the sole expense of contractor. If in the opinion of the IPR any person deployed by the contractor is found to be suffering from any such communicable diseases or if any of the persons of the contractor is found to commit any misconduct or misbehaves, IPR may restrain such person from entering the premises and the contractor will have to replace him by a suitable person. 2.31 The contractor shall be responsible for the persons deployed by him observing all safety rules from time to time. In case, IPR suffers any loss etc. of whatever nature from the persons deployed by you not following the safety regulations/instructions, the contractor shall be liable to make good all such losses as may be right to recover all such losses etc. from the security deposit and/or dues payable by IPR to the contractor besides other remedies open to IPR. 2.32 The contractor shall maintain a fully equipped medical first aid box, which should be easily available to the persons deployed by him. In case of accident or death of any personnel deployed by the contractor while on duty it shall be the sole liability of the contractor.

2.33 The contractor would be required to arrange the screening/scrutiny of security personnel, which he intends to deploy at this Institute, on the date/time convenient to us before final selection is done. The contractor would be required to submit the Police verification certificate of all the personnel to be engaged for security work at any of the premises of the Institute. 2.34 If, at any time, IPR finds any of the security personnel is unfit, the contractor will be required to replace the same by another security person of the same rank and status immediately. The decision of the officer-in-charge in this regard shall be final and binding on the contractor. 2.35 All security personnel to be deployed by the contractor for providing security services should possess sound health and physique, clean shaved and they should be in neat terry cotton uniform and black shoes only. If the person deployed are not found in neat and clean condition and well pressed at all times while on duty, a penalty of ` 100/- (Rupees One hundred only) per person per lapse

may be levied by the institute. 2.36 The contractor shall inform the Officer-in-Charge any change in any of its security personnel posted at any point and shall do so only after prior approval of the Officer-in-Charge after fulfilling all the terms and conditions laid down in the tender document. 2.37 The security guards deployed in the IInd and IIIrd shifts will be required to keep continuous night patrolling and ringing of whistle at the interval of each hour regularly. 2.38 The tenderer should have its own registered office with their own telephone and other communication facilities at Ahmedabad/Gandhinagar, and should have round the clock support and monitoring system from its local office. The contractor should do surprise checking during day/night and submit a report of the concerned officer at IPR. 2.39 The institute reserves its right to change/alter any of the terms & conditions without any notice. 2.40 The contractor will be required to submit a copy of bio-data with the permanent address, one passport size photograph in respect of each of the security personnel to be deployed by him at the Institute. 2.41 In the event of having found that the contractor or his personnel have contributed to a theft by deliberately convincing or by themselves taking part in such an activity, the Director, IPR reserves the right to forfeit the security deposit and terminate the contract immediately. 2.42 The contractor will be required to provide identity cards to his security personnel under applicable labour laws.

2.43 The contractor shall deploy security personnel having basic knowledge of emergency communication, fire fighting and use & operation of various types of fire extinguishers. Security personnel shall also be responsible for fire fighting whenever need arises. In case of the major fire emergency, they have to guide external fire fighting services and also help them in fire fighting as per the instructions given by the Officer-in-charge of IPR.

3. COMPLIANCE WITH VARIOUS ACTS : 3.1 The Contractor shall be fully responsible for complying with all the relevant statutory obligations as applicable from time to time including : � Contract Labour (Regulation and Abolition) Act � Minimum Wages Act � Payment of Wages Act � Employees Provident Fund Act � ESI/Workmen’s Compensation Act � Bonus Act � Fatal Accident Act � Gratuity Act � Private Security Agencies (Regulation) Act 2005. � Any other act, as applicable from time to time

Consequences arising out of the non-compliance with statutory requirements shall be the entire responsibility and be borne by the contractor.

All the relevant records / documents / registers /

correspondences / receipts etc., for the above may be produced for verification whenever desired by the Institute. 3.2 The contractor shall have to strictly pay minimum wages as notified by the Asst. Labour Commissioner (Central) for Zone C i.e. remaining area of Gujarat, from time to time to his security personnel. The payment of wages to the persons deployed by the Contractor may be witnessed by an accredited representative of the Institute.

4. DURATION: 4.1 The tenure of contract shall be for two years with initial trial period of 3 months. The performance will be evaluated during the trial period of contract. At the sole discretion of IPR, the trial period can be extended for a further period of three months or more. The Institute reserves the exclusive right to terminate the contract during the trial period/extended trial period without assigning any reason whatsoever. 4.2 The Institute also reserves the right to extend the contract beyond two years on the same terms & conditions and also to discontinue the contract by giving one month’s advance notice at any time during the pendency of the contract. The Institute also reserves

the right to revise the scope of work, if necessary, during the pendency of the contract. 4.3 In case the contractor wants to discontinue the contract, he will be required to give three months advance notice in writing to the Institute, stating reason for the same.

5. EARNEST MONEY DEPOSIT: The tenderer shall be required to deposit an interest free amount of ` 50,000/- (Rupees Fifty thousand only) towards Earnest Money

Deposit along with the Technical Bid in the form of demand draft in favour of INSTITUTE FOR PLASMA RESEARCH. The EMD of unsuccessful tenderers shall be refunded within a reasonable time after finalisation of the contract without any interest thereon. The EMD may be forfeited, in case the contractor accepts a Letter of Intent but does not turn up to take over the contract within the stipulated time, or withdraws his bid subsequent to the opening of the tenders.

6. SECURITY DEPOSIT: 6.1 The contractor shall be required to deposit an amount of

`1,00,000/- (Rupees One Lac only) as security deposit

immediately after issue of Letter of Intent in the form of demand draft in favour of INSTITUTE FOR PLASMA RESEARCH. No interest shall be paid on such security deposit, which shall remain with Institute during the continuance of the contract and it shall be released only three months after the expiry or termination of the contract, subject to clearance of all dues by the contractor.

6.2 The whole amount of the security deposit will be liable to

forfeiture in case of breach of any of the terms agreed upon by the contractor. The security deposit shall also be liable to appropriation against dues payable to the IPR, under the agreement or damage or expenses that may be sustained by Institute for Plasma Research as a result of negligence or such acts and omissions on the part of the contractor or the persons deployed by him at any of the IPR premises. In the event of appropriation of security deposit fully or partly the contractor shall immediately make good the amount so appropriated from the security deposit in the form of demand draft failing which it shall be adjusted from the amount payable to the contractor.

6.3 The whole amount of the security deposit will be liable to

forfeiture in the event of the Contractor not being able to continue the contract for the entire duration of the contract on the same rates, terms and conditions and chooses the option to give 3 months notice in writing to the Institute for termination of the contract.

7. RATE SCHEDULE: The rates may be furnished in the Price bid and the same shall

remain firm and all inclusive for the entire period of the contract. The contractors are advised to read the instructions carefully and thoroughly survey the respective points before submitting their tender. The rates quoted shall be package/lumpsum rate and while quoting the contractor should consider any future increase/decrease in the statutory obligations.

7.1 In case the rise in the applicable minimum wages is more than

10% during the contract period, the contractor will be eligible to get the difference over 10% from the date of the rise.

The contractor is also advised to pay wages as per prevailing minimum wages from time to time as notified by the Asst. Labour Commissioner (Central) for Zone C i.e. remaining area of Gujarat. The information provided should be clear, specific and to the point. Incomplete offer may be rejected outright.

8. PAYMENT:

The bill(s) should be submitted in duplicate by the contractor along with necessary documents. The payment will be made by the Institute after verification of the bill(s) by an Account Payee cheque within 30 days time from the date of receipt of bill(s). The Institute reserves the right to recover any amount due for whatsoever reason from the bill(s) submitted by the contractor.

9. COMMENCEMENT OF THE WORK : The security work will be commenced from tentatively from

March 1, 2012. In case the contractor fails to commence the work within the stipulated time, the EMD shall be forfeited in addition to seeking other legal remedy for any loss or suffering to the Institute arising out of such failure of the contractor.

10. DAMAGES FOR LOSS/DESTRUCTION / THEFT & PILFERAGE:

It shall be the duty of the contractor to ensure that no property, assets, instruments, machineries of the Institute are damaged, destroyed, pilfered or taken away by any person. In case, any such damage, destruction, loss, theft or pilferage arises due to negligence/lapse on the part of the persons deployed by the contractor, the contractor shall be fully accountable, responsible and liable for making good the loss.

11. PENALTY : In case the persons deployed by the contractor are found to be negligent during the performance of the security services at any of the security points or if the contractor fails to comply with any of the terms and conditions of the contract, a penalty ranging from ` 100/- to ` 1000/- per day according to the

graveness of the lapse shall be levied at the discretion of the authorised officer of the Institute in addition to recovery of any loss arising out of such losses. The penalty for repeated double duties shall be Rs.100/- per duty.

For any violation, short-comings, acts and omissions of the contractor or his security personnel, which would affect the quality of services & decorum of the Institute, and for violation of any clause as state above, a penalty ranging from ` 100/- to `1000/- per lapse shall be levied.

12. ARBITRATION: All disputes arising between the parties shall be referred to and settled through Arbitration conducted in accordance with the provisions of the Arbitration & Conciliation Act,1996 and the rules framed there under. Such Disputes shall be adjudicated by an arbitral tribunal comprising of three arbitrators, one to be appointed by each party and the two appointed arbitrators shall jointly appoint the third arbitrator for the purposes of constituting the arbitration tribunal. The arbitrators shall have powers to award only such remedy as is contemplated by this Agreement, including as appropriate, injunctive relief. The place of arbitration shall be Ahmedabad. The language of arbitration shall be English.

13. JURISDICTION : Notwithstanding any other court or courts having jurisdiction to

decide the question(s) forming the subject matter of the reference if the same had been the subject matter of suit, any and all actions and proceedings arising out of or relating to the contract (including any arbitration in terms thereof shall lie only in the court of competent civil jurisdiction in this behalf at Ahmedabad / Gandhinagar and only the said courts shall have jurisdiction to entertain and try such action(s) and/or proceedings to the exclusion of all the other courts.

14. WAIVER : No failure or delay by IPR in enforcing any right to remedy of

IPR in terms of contract or any obligation or liability of the contractor in terms thereof shall be deemed to be a waiver of such right, remedy obligation or liability, as the case may be, by IPR and not withstanding such failure or delay, IPR shall be entitled at any time to enforce such right, remedy, obligation or liability, as the case may be.
