The following are applications for extra-provincial and public vehicle operating licenses filed under the Motor Vehicle Transport Act, 1987, and the Public Vehicles Act. All information pertaining to the applicant i.e. business plan, supporting evidence, etc. is on file at the Board and is available upon request.

Any interested person who has an economic interest in the outcome of these applications may serve and file an objection within 29 days of this publication. The objector shall:

1. complete a Notice of Objection Form,

2. serve the applicant with the objection,

3. file a copy of the objection and provide proof of service of the objection on the applicant with the Board,

4. pay the appropriate fee.

The Director has been notified by the Minister of Finance that the following corporations are in default in complying with the Corporations Tax Act.

NOTICE IS HEREBY GIVEN under subsection 241(1) of the Business Corporations Act, that unless the corporations listed hereunder comply with the requirements of the Corporations Tax Act within 90 days of this notice, orders will be made dissolving the defaulting corporations. WHEREAS the Minister of Health and Long-Term Care (the “Minister”) has received the advice of the General Manager, as defined in section 1 of the Health Insurance Act, R.S.O. 1990, c. H.6 (the “Act”);

1. Section 3 of Ontario Regulation 124/99 is amended by adding the following subsection:

(21) Subsection 94 (1) of the Act does not apply to a transfer of an interest in property described in subsection 94 (1), (1.1) or (2) of the Act if the following conditions are satisfied:

1. The transfer is made to,

i. a municipal corporation in Ontario that is exempt under subsection 149 (1) of the Income Tax Act (Canada) from the payment of tax under that Act at the time of the transfer,

ii. a municipal electricity utility that is exempt under subsection 149 (1) of the Income Tax Act (Canada) from the payment of tax under that Act at the time of the transfer, or

iii. Hydro One Inc., Ontario Power Generation, Inc. or a subsidiary of either of them (the “transferee”) and the transferee is exempt under subsection 149 (1) of the Income Tax Act (Canada) from the payment of tax under that Act at the time of the transfer.

2. The transfer is made after October 16, 2009.

2. This Regulation is deemed to have come into force on October 17, 2009.

TERMS AND CONDITIONS OF EMPLOYMENT IN DEFINED INDUSTRIES — TEMPORARY HELP AGENCY INDUSTRY

Definition

1. In this Regulation, “defined industry” means the temporary help agency industry. Scope

2. This Regulation is restricted in its application to temporary help agencies and their assignment employees. Transitional terms and conditions of employment

3. This Regulation sets out transitional terms and conditions of employment that apply to employers and employees described in section 2 following the coming into force of the Employment Standards Amendment Act (Temporary Help Agencies), 2009. Determination of temporary lay-off

4. For the purposes of subsection 56 (2) of the Act, the following rules apply: 1. Only a period of 20 consecutive weeks or 52 consecutive weeks, as the case may be, that begins after November 5,

2009 shall be taken into account. 2. In the case of a lay-off that begins on or before November 5, 2009, only the part of the lay-off, if any, that occurs after

November 5, 2009, shall be taken into account. Deemed termination date

5. For the purposes of subsection 56 (5) of the Act, if part of a lay-off is taken into account under paragraph 2 of section 4, the employment is deemed to be terminated on November 6, 2009. Mass termination provisions, notice

6. For the purposes of the provisions of the Act that require an employer to provide notice otherwise than in accordance with section 57 of the Act if the employment of 50 or more employees is terminated in the same four-week period, only four-week periods that end before November 6, 2009 or begin after November 5, 2009 shall be taken into account. Severance

7. (1) For the purposes of clause 63 (1) (c) of the Act, the following rules apply: 1. Only a period of 52 consecutive weeks that begins after November 5, 2009 shall be taken into account. 2. In the case of a lay-off that begins on or before November 5, 2009, only the part of the lay-off, if any, that occurs after

November 5, 2009, shall be taken into account. (2) For the purposes of clause 63 (1) (d) of the Act, only a lay-off of an employee that begins after November 5, 2009 because of a permanent discontinuance of all of a temporary help agency’s business at an establishment of the agency after that date results in a severance of the employee’s employment. (3) For the purposes of clause 63 (1) (e) of the Act, only a notice of termination given after November 5, 2009 shall be taken into account. Length of employment

8. (1) Where the entitlement of an assignment employee under a provision of Part XV of the Act is dependent on or varies with how long he or she has been employed by a temporary help agency, nothing in this Regulation shall be construed to exclude time spent in the employ of the agency before November 6, 2009. (2) Subsection (1) applies in respect of any provision of Part XV of the Act or the regulations that makes reference to length of employment, however expressed, and, without restricting the generality of the foregoing, applies in respect of,

3. Le présent règlement énonce les conditions d’emploi transitoires qui s’appliquent aux employeurs et aux employés visés à l’article 2 après l’entrée en vigueur de la Loi de 2009 modifiant la Loi sur les normes d’emploi (agences de placement temporaire). Établissement d’une mise à pied temporaire

4. Les règles suivantes s’appliquent dans le cadre du paragraphe 56 (2) de la Loi : 1. Seule une période de 20 semaines consécutives ou de 52 semaines consécutives, selon le cas, qui commence après le 5

novembre 2009 est prise en compte. 2. Dans le cas d’une mise à pied qui commence avant le 5 novembre 2009 ou à cette date, seule la partie de la mise à pied

qui tombe après le 5 novembre 2009, le cas échéant, est prise en compte. Date réputée date de licenciement

5. Si une partie seulement d’une mise à pied est prise en compte en application de la disposition 2 de l’article 4, le licenciement est réputé se produire le 6 novembre 2009 pour l’application du paragraphe 56 (5) de la Loi. Dispositions relatives aux licenciements collectifs : préavis

6. Seules les périodes de quatre semaines qui se terminent avant le 6 novembre 2009 ou qui commencent après le 5 novembre 2009 sont prises en compte pour l’application des dispositions de la Loi qui obligent l’employeur à donner un préavis autre que celui prévu à l’article 57 de la Loi s’il licencie 50 employés ou plus au cours de la même période de quatre semaines. Cessation d’emploi

(2) Seule la mise à pied d’un employé qui commence après le 5 novembre 2009 en raison d’une interruption permanente, après cette date, de toute l’entreprise que l’agence de placement temporaire exploite à un de ses établissements entraîne la cessation de l’emploi de l’employé pour l’application de l’alinéa 63 (1) d) de la Loi. (3) Seul un préavis de licenciement donné après le 5 novembre 2009 est pris en compte pour l’application de l’alinéa 63 (1) e) de la Loi. Durée de l’emploi

8. (1) Lorsque le droit d’un employé ponctuel prévu par une disposition de la partie XV de la Loi dépend de la durée de son emploi auprès d’une agence de placement temporaire ou varie en fonction de cette durée, le présent règlement n’a pas pour effet d’exclure une période d’emploi auprès de l’agence qui est antérieure au 6 novembre 2009. (2) Le paragraphe (1) s’applique à l’égard de toute disposition de la partie XV de la Loi ou disposition des règlements qui mentionne la durée de l’emploi, de quelque manière que ce soit, et s’applique notamment à l’égard de ce qui suit : a) la mention d’une période d’emploi; b) la mention d’un emploi continu; c) la mention d’un emploi, qu’il soit continu ou non et qu’il soit effectif ou non; d) la mention d’un nombre d’années ou de mois d’emploi. Entrée en vigueur

Information

The Ontario Gazette is published every Saturday. Advertisements/notices must be received no later than 3 pm on Thursday, 9 days before publication of the issue in which they should appear. For weeks including Easter Monday, November 11th or a statutory holiday allow an extra day. For the Christmas/New Year holiday schedule please contact the Gazette at (416) 326-5310 or by email at [email protected]

Advertising rates and submission formats:

1) Please submit all notices in a Word.doc format to: [email protected]

2) For a first insertion electronically submitted the basic rate is $75 up to ¼ page.

3) For subsequent insertions of the same notice ordered at the same time the rate is $40 each.

4) Clients may confirm publication of a notice by visiting The Ontario Gazette web site at: www.ontariogazette.gov.on.ca or by viewing a printed copy at a local library.

Subscriptions:

The annual subscription rate is $126.50 + G.S.T. for 52 or 53 weekly issues beginning the first Saturday in January, payable in advance. In-year new subscriptions will be pro-rated for the first year. A new subscriber may order back issues of the Gazette at the single-copy rate as inventory permits.

Refunds for cancelled subscriptions will be pro-rated from 50% or less depending upon date. For subscription information/orders please call (416) 326-5306 during normal business hours.

Single Copies:

Individual Gazette copies may be ordered on-line through the website at www.serviceontario.ca/publications or by phone at 1-800-668-9938.
