Senator Syed Muzaffar Hussain Shah: Sir, thank you for giving me this opportunity. Sir, let me state first that on behalf of the Pakistan Muslim League (Functional) that we support Mian Muhammad Nawaz Sharif as the elected Prime Minister of Pakistan. In a democracy in Pakistan, where the Constitution and Parliament is supreme, any other method would lead to anarchy in Pakistan. Mian Sahib has been elected as the Prime Minister by the Lower House of the National Assembly of Pakistan with an over-whelming majority, and Pakistan was achieved through a struggle by Constitutional means. If you read the Pakistan Movement in 1942 to 1947, the Quaid-e-Azam led this movement for Pakistan through legal and constitutional means. There was no violence. And this State of Pakistan was

achieved by the strength and the margin of the votes of those provinces of British India which voted for Pakistan, including West Bengal, Sindh, Punjab, the then North West Frontier Province. So, Pakistan came into existence as a result of the vote, the franchise, and over the last sixty five years, they have struggled to create the basic law in Pakistan, the 1965 Constitution, the 1962 Constitution, the 1956 Constitution. Ultimately in 1973, all of Pakistan’s democratic and political forces agreed on a consensus for Pakistan’s Islamic and Federal Constitution, the 1973 Constitution of Pakistan. This is the basic law of Pakistan Sir. And the Parliament is the mother-body in this Constitutional arrangement. Parliament is a repository of the power of the people of Pakistan. And I may point out to you Sir, that this copy of the Constitution, all organs of the State can exercise only such authority as is conferred by Parliament: no more, no less.

The executive branch of the Government, whether it

is a Prime Minister or the Governor or the Chief Minister, can only exercise authority which is conferred

by Parliament upon it, including the Judiciary. The Constitution Sir, also lays down the mechanism for the formation of a Government, election of the Prime Minister, the Chief Minister, the powers of the Judiciary, the powers of the Executive. And if anybody is interested in removing the Prime Minister, who is the elected representative of the people of Pakistan, then the method has been laid down, bring a vote of no-confidence in Parliament, in the National Assembly. The very fact that today you cannot bring a vote of no-confidence, shows that you do not subscribe to the principles of democracy and the supremacy of the Constitution.

I would respectfully point out Sir, that this Joint

Session of Parliament must take stock of the prevailing political situation in Pakistan. Why are we hearing slogan outside the walls of the Parliament House, some shouting for Inqilab and some shouting for Azadi. Azadi we achieved in 1947 and Inqilab or change, if any, in Pakistan, will come through Parliament and Parliament

alone Sir. No other way will be accepted in a democratic process.

Here Sir, I would like to place before the Joint

Session of Parliament, that with this noise outside the walls of Parliament House, we must debate here today in the Joint Session, the relevance of Parliament in today’s political scenario. Is Parliament relevant today to Pakistan’s political and social and economic problems or has Parliament become irrelevant? We must take stock of the situation that whether Parliament has come up to the expectations of the people of Pakistan. What we are hearing the shouts outside the Parliament building is that donkeys and human beings are drinking water from the same pool, that there is no education, that there are no health services, that there is no justice.

I would request the Prime Minister of Pakistan and

all political forces in Parliament that Sir, this is a challenge for Parliament, we must address these issues. And the first suggestion I would make to the Prime Minister is, irrespective of the negotiations with those

who are shouting outside Parliament, there should be a joint committee of Parliament to bring about socio-economic reforms in Pakistan.

This Committee should consist of all Pakistan’s

political forces. It should address the issues of unemployment, education, health, inflation and load shedding. Then Sir, a lot of water has flown under the bridge since 1973. Sir, we call ourselves a federation and I think the statesmanship of Zulfiqar Ali Bhutto and Mr. Hafeez Pirzada, one must pay them a compliment that they put together a basic document which is today the consensus document of Pakistan, the 1973 Constitution. But are we a federation? Are we truly, simply a federation? The Senate, the Upper House in Pakistan is a repository of the interest of the smaller provinces and sir, what is it? It is a debating society of lords. There is no fiscal authority, we made 138 recommendations to the National Assembly of Pakistan in the budget, only 18 were accepted. Why? Why can the Senate not has financial and fiscal authority? It is the Upper House of Parliament and what do we do

here. We say that the Senate is indirectly elected. For those who say the Senate is indirectly elected, let me remind them in 1962 and 1965 of Field Marshal Ayub Khan, the then National Assembly of Pakistan was elected by basic democrats (BD Members) and they had fiscal authority, they had financial authority.

Today the Senate of Pakistan is elected by

Provincial Assembly Members. If you want Pakistan to be a truly federal state, give the Senate of Pakistan financial and fiscal authority before there are rumblings outside Parliament House. I think Parliament should take cognizance, Parliament should be conscientious for what the murmurs and what the tremors outside Parliament are. We must feel what the people of Pakistan say and the people of Pakistan are saying that the Upper House of Parliament should be given authority, authority in matters which are decisive especially the fiscal authority. I may point out to you, sir, one Parliament, one Parliament building, why cannot we have Joint Committees of Parliament? The Lok Sabha and the Raj

Sabha have 15 Committees which are Joint Parliamentary Committees. One Parliament, two libraries. Why? There should be a unified Parliament, there should be Joint Committees. I am the Chairman of the Senate Committee on National Food Security and Research. I hold a meeting, a meeting is held after two days by the National Assembly. Same agenda, the Ministers and the Secretaries are the same. Why have this duplication? Sir, I would request the Prime Minister of Pakistan and the Leader of the Opposition to kindly be in a position to take cognizance. Have Joint Committees of Parliament. National Security, Foreign Affairs. So, if you really want to make the Constitution of Pakistan effective and like we talk about the rhetoric of the supremacy of the Constitution then the Constitution must become relevant to the prevailing circumstances in Pakistan. A stagnant Parliament will not be a successful Parliament, sir. Parliament must reflect aspirations of the people of Pakistan. Pakistan must address the problems of the people of Pakistan.

The doctrine Imran Khan is exploiting the frustration and disenchantment prevailing under certain sections. Parliament must ensure that this frustration is addressed by Parliament. This is the forum and this forum alone should resolve problems. Imran Khan raised the issue of a recount in four constituencies fourteen months back. Sir, for fourteen months Pakistan’s politics did not find any eruptions. Imran Khan called for opening up four constituencies and he asked the Government to open up four constituencies. Now, the point is that the Government does not have the authority to open up four constituencies. Article 225 of the Constitution says that all matters pertaining to election disputes will be decided by the Election Commission and by the Election Tribunals. Therefore, Parliament should have taken notice that if there was no authority, we should have created that authority. If the law did not permit it, we should have amended the law and this I say sir, India, Australia, the United States and Britain, this is a dynamic sub-law that law must keep pace with the problems of the people.

Now today, whether Imran Khan and associates agree to the Electoral Reforms Programme or not? I would suggest to the honourable Prime Minister that, sir, these Electoral Reforms must be carried through, irrespective of whether these negotiations failed or they succeed and what are the nature of these reforms, number one? Pakistan’s elections should be held on a biometric system. Do away with corrupt and illegal practices through these machines. In this day and age, in the 21st century, we are still arguing whether the thumb impression is right or not, sir. Whether the ink used was right or not. In this day and age, there should be a biometric system, there should be an independent election authority. Once elections are announced, the entire staff for polling including polling officers, presiding officers and returning officers should be brought under the administrative control of the Election Commission. Delimitation of constituencies should be done fairly by an independent authority like in India and in Pakistan we never seem to be doing things on time. Census is overdue, sir. We are still struggling to say that what is his share, what is my share? Please for God’s sake

hold a census and after the census delimit the constituencies hold local body elections. Today, we are running around the country, there is no elected authority at the grass root level. Why can’t we hold local body elections? We can’t hold local body elections for the simple reason that we do not want to give authority and power. We don’t want to delegate authority. We want to keep everything with ourselves and that is the tragedy of Pakistan.

For 56 years, every power was with the Central Government, then finally the 18th Amendment devolved power from the center to the provinces but from the provinces to the local councils, we will need another change, another revolution in Parliament for local body elections. Why can’t we hold local body elections? Local issues; drainage, law and order, sewerage, health, these are, sir, the responsibilities under the Constitution of local councils.

There are problems Sir. The Prime Minister is

sitting here and I would like to mention to him. Sir,

please make Parliament, a pro-active Parliament, a Parliament that can deliver. A stagnant Parliament will not be able to resolve your problems. And a status-quo Parliament cannot be a Parliament that can address issues. Let the Prime Minister take the initiatives we are with him. All the democratic forces in Parliament are behind the Prime Minister. Let him take the step that we need to break the status-quo in Pakistan. We need to provide social security, education, health and the basic law, the security to life and property under the 1973 Constitution. Let me take advantage of this Joint Session to bring to the notice of the Prime Minister that the agriculture sector, which contributes 62% of your employment. Instead of showing growth it has gone backwards. A tractor today, a Belarus tractor is available for 14 and a half lac of rupees. Diesel has gone up, labour has gone up, fertilizers has gone up. In India, next door, there are massive subsidies been given to the Agricultural sector. When we negotiate with India for the most favourite nation treatment, if those goods and

services come into Pakistan, the Pakistani farmer will not be able to compete with Indian products. Please give emphasis on the agriculture sector in Pakistan Sir.

Today, cotton is being at 2400 rupees per mound. The initial cost actually of production for a farmer works out at-least minimum 3000 rupees per mound. The farmer is shouting. They come to us and say what is Parliament doing? What are you sitting there for? You are supposed to raise a voice, you are supposed to address our issues. Sir, this is the issue.

Sir, Parliament has to resolve issues. If we don’t

resolve them, we will hear murmurs and tremors outside the Parliament House. We must take notice and cognizance of problems and therefore, I would suggest to the honourable Prime Minister, Sir, where the laws are not sufficient, change the laws. Where the Constitution needs an Amendment, amend it. Where

problems cannot be addressed by one House, have a joint sitting.

Therefore, the challenge, the ball is in your court.

Rise, sir, Leaders are those leaders in history, Winston Churchill, De Gaulle and Jinnah were those people who lead their people. So, I would call upon Mian Muhammad Nawaz Sharif! lead Pakistan today. We are at the cross-roads of history. If you really want to be in a position to make a point, let Mian Nawaz Sharif, Prime Minister of Pakistan, lead the Pakistani nation and Parliament will be behind him fully.

Therefore, Sir, if this Joint Sitting of Parliament is to be meaningful, if some results is to be taken out, it should not be a routine Session of the Parliament. Merely, because there is the “Dharna� so we should continue to meet. No, I think this is a great opportunity of stock taking, brain storming, that are we delivering, are we coming up to the expectations of the people of Pakistan. If we are not coming, then we should be able

to analyze our shortcomings. We should be able to analyze our weaknesses and in a way, I think, this is a great opportunity to show the quality of leadership and I would hope that Parliament would provide the leadership for which the people of Pakistan have elected it to address these issues and what are the issues today.

One group is asking for electoral reforms. Like I

said sir, on the biometric system and independent election, delimitation and officers, now we come to the point of a Commission. Sir, if you look at the constitutional history of Pakistan, the enactment which deals with corrupt and illegal practices is again a good law which was passed in 1976 during Mr. Bhutto’s regime called the Representation of People’s Act. It is an exhaustive law, it is a law which deals with all eventualities but I would suggest that the Electoral Reforms Committee that Prime Minister has been able to form should be able to make recommendations, bring them to Parliament, legislate and bring into open a draft which is acceptable to all democratic and political forces

for elections. So, once for all we should settle this matter of fraud, corrupt and illegal practices.

Then sir, I would like to say that in relation to the

18th Constitutional Amendment, Mian Raza Rabbani is not here, he and many other stalwarts played a pivotal role in bringing about the 18th Constitutional Amendment which realized the dream of the decentralization of power. But many problems remain both at the provincial level as well as at the federal level. The Prime Minister and Leaders of the Parliamentary parties are sitting here. We need to revisit the 18th Constitutional Amendment. In the light of the experiences that we have had Sir, the 18th Constitutional Amendment needs to be revisited for a better and along with that have mercy upon the Upper House of Parliament. Take them out of a debating society and equip them with the authority of a federal government. If you really want to be called a federal state then you must make the Upper House powerful, give them the authority and don’t make them into a post office or sending recommendations to the National Assembly of Pakistan only Sir. A lot of

Senators are sitting here. They embody the aspirations of the provinces of the people of Pakistan. Unless, and 65 years is a long time in a national history. If you look at federal states; America, Canada, Australia and India, all Upper Houses, there have financial authority. Therefore, I am grateful to you that you gave me the opportunity of giving you my view points.
