Approval of any Interdistrict Transfer Request shall be subject to space availability at the receiving school.

Interdistrict Transfer attendance shall be permitted only as long as the student maintains proper attend-ance, behavior, and academic achievement.

The parent is responsible for providing transportation for the student to and from the requested school of attendance.

All requests for transfers must be submitted in writing and signed by the parent or guardian. Transfers are to be approved for one school year and must be re-newed annually.

UNIFORM COMPLAINT PROCEDURE

The Golden Valley Unified School District has primary responsibility for ensuring the District complies with state and federal laws and regula-

tions governing educational programs. Any complaints alleging unlawful discrimination or failure to comply with state or federal laws in:

Adult education, consolidated categorical aid programs, migrant education, child care and development programs, child nutrition pro-

grams, vocational education and special education programs, and complaints which allege unlawful discrimination on the basis of ethnic

group identification, gender, sexual orientation, race, ancestry, national origin, religion, age, sex, color, or physical or mental disability, in

a program or activity conducted by a local agency funded by the State of California.

Complaints will be reviewed and mediated or investigated by the District. Employees designated to receive and investigate complaints are

knowledgeable about the laws and programs for which they are responsible. Pupil and employee rights to privacy are to be respected, and

retaliation in any form is prohibited.

The Board encourages the early, informal resolution of complaints at the site level whenever possible.

Compliance Officer

The District follows Uniform Complaint Procedures established in Board Policy #1312.3. Complaints should be directed to the District compli-

ance officer, Andrew G. Alvarado, Superintendent, (559) 645-3570. This individual is knowledgeable about the laws/programs assigned to

investigate.

Notifications

The Superintendent or designee shall annually notify students, parents/guardians, employees, and advisory committees of these

procedures in English and/or in other languages as required by EC 48985.

Procedures

Step 1: Filing a Complaint

Any individual, public agency or organization may file a written complaint of alleged noncompliance. The complaint shall be presented to the

appropriate compliance officer for investigation. If a complaint is not covered by this procedure, the complainant shall be referred to the proper

agency for filing a complaint. A discrimination complaint must be initiated no later than six months from the time the alleged discrimination oc-

curred or the complainant was aware of the alleged discrimination. Golden Valley Unified School District prohibits retaliation in any

form for the filing of a complaint, the reporting of instances of discrimination or participation in complaint procedures. Golden Valley Unified

School District respects student and employee rights to privacy. Discrimination complaints shall be investigated in a manner that protects the

confidentiality of the parties and facts.

Step 2: Mediation (Special Education/Categorical)

Within three days of receiving the complaint, the compliance officer may informally discuss with the complainant the possibility of using media-

tion. If the complainant agrees to mediation, the compliance officer shall make arrangements for this process. Mediation does not extend the

time line for investigation and resolution of complaints unless the complainant agrees, in writing, to the extension. If mediation does not resolve

the problem, the compliance officer shall proceed with his/her investigation of the complaint adhering to the 60-day timeline.

Step 3: Investigation of Complaint

The compliance officer shall hold an investigative meeting within five days of receiving the complaint or an unsuccessful attempt to mediate the

complaint. In the mediative/investigative process, the complainant shall have an opportunity to present information and evidence relative to the

complaint.

Step 4: Response

Within 60 days of receiving the complaint, the compliance officer shall prepare and send to the complainant a written report of the investigation

and decision.

Step 5: Final Written Decision

The report will be presented in written form in English and in the language of the complainant whenever feasible. If it is not feasible to write this

report in the complainant’s primary language, the report shall be interpreted to the complainant. The report shall include the findings and dispo-

sition of the complaint including corrective actions, if any; the rationale for the disposition; and notice of the complainant’s right to appeal the

decision in writing to the California Department of Education within 15 days if dissatisfied with the GVUSD decision.

If dissatisfied with the Golden Valley Unified School District’s decision, the complainant may appeal in writing to the California Department of

Education within 15 working days of receiving the District’s decision. Complainants may also pursue civil law remedies through mediation cen-

ters, the county office of education and public/private interest attorneys. In seeking civil law remedies in discrimination complaints, the com-

plainant may not pursue such remedies until 60 days after filing an appeal to CDE.

California Education Code 35186 authorizes the filing of complaints concerning the following:

1. There should be sufficient textbooks and instructional materials. That means each pupil, including English learners, must

have a textbook or instructional materials, or both, to use in the class and to take home to complete required homework as-

signments.

2. School facilities must be clean, safe, and maintained in good repair.

3. There should be no teacher vacancies or misassignments. There should be a teacher assigned to each class and not a

series of substitutes or other temporary teachers. The teacher should have the proper credential to teach the class, includ-

ing the certification required to teach English learners, if present.

Teacher vacancy means a position to which a single designated certificated employee has not been assigned at the begin-

ning of the year for an entire year or, if the position is for a one-semester course, a position to which a single designated

certificated employee has not been assigned at the beginning of a semester for an entire semester.

Misassignment means the placement of a certificated employee in a teaching or services position for which the employee

does not hold a legally recognized certificate or credential or the placement of a certificated employee in a teaching or ser-

vices position that the employee is not otherwise authorized by statute to hold.

4. Pupils, including English learners, who have not passed one or both parts of the high school exit examination by the end of

grade 12 are to be provided the opportunity to receive intensive instruction and services for up to two consecutive academic

years after the completion of grade 12.

Our school district excels above many others because our parents, teachers, staff, school board and

community do a remarkable job of supporting our students and setting high expectations.

Our work here in Golden Valley Unified School District is centered on providing a curriculum-rich

education that is driven by real-world and real-life experiences. We will continue to stress to our

teachers and administrators the importance of our core values of providing a rigorous curriculum,

making learning relevant to our students and developing positive relationships with our chil-

dren; this is the Golden Valley Way.

Our community expects us to prepare our students for the real-world. We understand, in order to

accomplish this task, it truly takes a GVUSD community. We take this responsibility wholeheart-

edly and vow to bring our best day in and day out. Our children need to be able to compete

globally and we are committed to being increasingly proactive in preparing students for challenges

that do not yet exist. We must recognize the paradigm shifts in education and adjust our systems to

properly and proactively address an ever changing society. Our past is not a prelude to our

children’s future.

We have set the highest standard of what we expect from our students and staff. Our students and

staff will be respectful. Our students will represent themselves, their family and their school

community with pride. Our students expect to be guided in this way. It is our duty to embrace this

challenge and hold our students to the highest standard, especially when it comes to dress and

grooming and behavior. We believe in addressing the “little” things each and every time, so they

do not become “bigger” things. Our learning environments will be such where students and

teachers are respected. Our administrators are charged with making sure the classroom remains

protected and sacred in order for teaching and learning to be optimized; this is a non-negotiable.

Competition is real! This is what the real-world is truly about. In the game of life there are

winners and losers. We know that winning is an everyday thing; it is not something that you turn

on today and off tomorrow. Our students and community expect us to bring forth a winning effort

each day. You can’t be a winner if you are afraid to lose. There is much to gain in defeat.

Winning is contagious and needs to be celebrated, no matter how small or how big that win may

be; unfortunately, losing is also contagious. Our students will compete at the highest level and we

will not shy away from this competition. It is our job to prepare them for success. We will Pursue

Victory with Honor and celebrate our victor ies as if we have been there before.

We have a deeply embedded belief in people and the ability to get the best out of each person

through a combination of high expectations, clear communication and positive relationship

building. As educators we are public servants, first and foremost, and will continue to surround

ourselves and enlarge those around us that have a deep passion for teaching children and serving

the public.
