Ban Ki-moon has proposed the inquiry could be headed by the former New Zealand prime minister Geoffrey Palmer and include representatives from Turkey – under whose flag many of the ships in the aid convoy sailed – Israel and the US, an official from Israeli prime minister Binyamin Netanyahu’s office said. Ban’s proposal came after Israel risked a fresh wave of international condemnation yesterday by detaining a boat carrying humanitarian aid attempting to break the blockade of Gaza and forcibly diverting it to the port of Ashdod. Israel has said that most of those aboard the MV Rachel Corrie will be deported today. Ban discussed his proposal for an investigation into the first raid with Netanyahu yesterday, the Israeli official, who spoke on condition of anonymity, told Reuters. Netanyahu plans to convene senior cabinet ministers today to decide whether Israel should take part. Israeli leaders have spoken publicly about setting up an internal inquiry with foreign observers into the interception of the Turkish-flagged Mavi Marmara last week. A statement on the UN’s website said Ban held telephone discussions with the prime ministers of Turkey and Israel on “options for moving forward with the investigation called for by the United Nations security council”. Last week, the council called for a “prompt, impartial, credible and transparent investigation”. Five days after the botched assault on a six-boat flotilla ended with Israeli troops shooting dead eight Turkish activists and one US citizen, naval commandos boarded the MV Rachel Corrie in international waters about 20 miles from the coast of Gaza. Yesterday’s operation was mounted despite growing calls for Israel to ease significantly its siege of Gaza. The US, Israel’s staunchest ally, pointedly repeated that the blockade was “unsustainable and must be changed” – a call Netanyahu again rejected. Israel said it had met no resistance in stopping the 1,200-tonne Rachel Corrie. However, Greta Berlin of the Free Gaza Movement, an organisation behind the flotilla, said passengers and crew had four times refused to accede to Israeli demands to voluntarily divert to Ashdod, resulting in the raid. “There’s no way that 20 people are going to resist a fully-armed force,” she said. “The fact that Israel boarded a civilian boat in international waters is a violent act.” She expected that the 11 passengers – including the Nobel peace laureate Máiread Corrigan – and nine crew would be treated “with kid gloves. The world is watching”. There had been no contact with the boat since early yesterday, she added. Tomorrow, Britain will say £19m in aid will be given to refugees in Gaza. The money, to be spent on healthcare, education and other services, will be announced by the international development secretary, Andrew Mitchell. It will go to the UN Relief and Works Agency (UNRWA), on which about 70% of Gazans rely to meet their basic needs. The support comes amid heightened international concern about Israel’s blockade. The latest detention of a ship bound for Gaza came as the last of the Turkish citizens wounded in last week’s assault on the Mavi Marmara was repatriated. It coincided with a warning from the UN’s commissioner for human rights, Navi Pillay, that Israel’s embargo was illegal. “International humanitarian law prohibits starvation of civilians as a method of warfare and it is also prohibited to impose collective punishment on civilians,” Pillay said. According to Israeli military accounts, commandos boarded the Rachel Corrie – named after an activist crushed to death by an Israeli bulldozer in Gaza in 2003 – from naval vessels alongside rather than winching troops from helicopters as happened in Monday’s operation. The boat, carrying medical supplies and construction materials, was towed into Ashdod. Israel said it would unload the aid and transfer it to Gaza. The passengers – from Ireland and Malaysia – would be immediately deported, Ygal Palmor, spokesman for the Israeli foreign ministry, said. Israel has spent the past five days struggling to contain a diplomatic crisis. Relations with its regional ally Turkey have sunk to an unprecendented low. Autopsy reports on the dead activists yesterday revealed that five had gunshot wounds to the head. The US joined the growing international chorus for the siege to be eased. Yesterday the Free Gaza Movement said it was planning another flotilla. “We will continue until we break the siege of Gaza,” Berlin said. Israel’s use of brutal force againstthe aid flotilla is a clear violation ofinternational law. The attack on MaviMarmara took place 77 miles off thecost of Gaza in international watersover which the state of Israel has nolegal ent i t lement . By brutal lyattacking and killing unarmed people,t h e N e t e n y a h u - L i e b e r m a ngovernment has committed a crimethat must and will be investigated byan international court. People in the aid flotilla came from32 different countries and includedaid workers, peace activists, writers,journalists , reporters, lawyers,members of parliaments and ordinarycitizens. Contrary to the claims of theIsraeli propaganda machine, thesepeople are not terrorists but aidworkers and peace activists fromaround the world who believe that theblockade of Gaza by Israel must endto restart the peace process in theMiddle East. This was a chance forIsrael to show that it is genuinelyinterested in peace. By defending theattack and the killing of civilians, theNetenhayu-Lieberman governmenthas shown that they have no interestin peace in the region. The aid floti l la was bringinghumanitarian aid to the people ofGaza who have been suffering undera suffocating siege since the Gazawar at the end of 2008. Let’sremember that Ehud Olmert, theprime minister of Israel at the time,

had given orders for the destructionof Gaza only four days after he metthe Turkish prime minister, RecepTayyip Erdogan, in Ankara to finalisethe Syrian-Israeli talks. Having lied toTurks, Syrians, Europeans andAmericans a l l of whom wereinvolved in the talks, the Olmertgovernment started a war whichresulted in the killing of more than1,400 civilians with thousandsinjured. In the three-week war, Gazawas completely destroyed and nocivilian buildings, schools, hospitals,houses of worship or even a UNbuilding were spared. Since then,Gaza and its 1.5 million people havebeen living under Israeli blockade. Israel has turned a deaf ear to callsby the Obama administration and theEuropean Union to lift the blockadein Gaza, stop settlement activities inthe Palestinian territories and restartthe peace talks. By defying thein t e rna t iona l communi ty andviolating international law, Israel hascornered itself both morally andpolitically. The international reactionto the murdering of unarmed civiliansin the aid flotilla shows the extent towhich the world is becoming evermore impatient with the arrogant andirresponsible policies of successiveIsraeli governments. While the rageover what happened in MaviMarmara has not died down, otherships l ike Rachel Corrie – inremembrance of the young Americanstudent so cruelly bulldozed by theIsraeli Defence Forces in Gaza 2003while trying to stop the demolishingof a Palestinian home – were already

making attempts to challenge theblockade. The United Nations security counciland the UN human rights commissioncondemned Israel for its action. Sodid scores of other states andinternational organizations includingNato and the Elders Group, whichincludes Nelson Mandela, JimmyCarter and Desmond Tutu. Heads ofstates from the UK and Russia to theArab world have called for theinvestigation of events and theimmediate lifting of the blockade ofGaza. Israel faces a dilemma here: the siegeof Gaza has not localised the realityof occupation but internationalised it.By acting in defiance and hoping thatit can get away with illegal use offorce against unarmed civilians, theNetenyahu-Lieberman government isturning against the whole world. I personally do not know if theTurkish-Israeli relations will ever goback to normal after what happenedin Mavi Marmara. But it is clear thatIsrael must formally apologise to theTurkish people for its brutal killing ofTurkish aid workers. An internationalfact-finding mission, as called for bythe UN, must be immediatelyestablished to investigate the eventsand those responsible for the raidmust be brought to justice. Finally,the blockade of Gaza must be lifted tonormalise the lives of 1.5 millionsPalestinians. Furthermore, Egyptmust keep the Rafah gate open to letinternational aid into Gaza. These measures will not make usforget what happened in the early

Where we are and where we need togo Caroline Glick does a brilliant jobof taking stock of where Israel findsitself today and what strategies itought to adopt to cope with the nexttwo and a half years (at least) ofdealing with a hostile government inWashington. For decades two things limited thesalience of Jew hatred as a politicalforce in the Muslim world. First,Israel’s reputation as a regionalpower deterred Arab states fromattacking it. And second, the US’sMiddle East policy of rewardingstates that lived at peace with Israeland spurning those that did not madeattacking Israel a less attractiveoption for most Muslim states. Thelikes of Iran and Syria were punishedfor their support for terrorism andtheir refusal to make peace withIsrael. Then too, Turkey’s rise inprominence in the US in the 1990sowed a great deal to its close strategicties with Israel. Israel’s reputation as a regionalpower was diminished by its 2000withdrawal from south Lebanon andits less than stellar performances inthe 2006 war. As for the US, in the year and a halfsince Obama took office he hasfundamentally restructured USforeign policy in a manner thatrewards US enemies at the expense ofUS allies. From Honduras andColombia to Britain, Poland, and theCzech Republic, to Japan and India toIsrael, Iraq and Afghanistan, Obamahas treated US allies with contemptand hostility. At the same time, hisrepeated bids to woo US adversarieshave rewarded the leaders of Iran,Venezuela, Russia and others for theiraggression.… THIS BRINGS US to Israel’s currentquandary about how to respond to theinternational campaign against it.Israel of course can do nothing to

The catch here is the meaning of“armed conflict.” Traditionally,armed conflict can take place onlybetween sovereign states. If Gazawere clearly a sovereign state, thenIsrael would be at war with Gaza andthe blockade would be lawful. If,however, Gaza were just a part ofIsrael, Israel would have the right tocontrol its borders— but not byintercepting foreign ships outside its12-mile territorial sea or contiguouszone. Gaza is not a sovereign state(although it has its own government,controlled by Hamas) and is not apart of Israel or of any other state. Itsstatus is ambiguous, and so too is thenature of the armed conflict betweenIsrael and Hamas. Thus there is noclear answer to the question whetherthe blockade is lawful. However, the traditional idea ofarmed confl ict involving onlysovereign states has long given wayto a looser definition that includessome conflicts between states andnonstate actors. The internationalrules governing blockades attempt tobalance belligerents’ interest insecur i ty and o ther count r ies ’economic interests in shipping.During war, security interests prevail.
