A N O R D I N A N C E TO A M E N D T H E I N T O X I C A T I N G L I Q U O R S ( M A N U F A C T U R E A N D S A L E ) O R D I N A N C E .

B E IT E N A C T E D by the H i g h Commissioner for Palestine, with the advice of the Advisorv Council thereof :—

1. This Ordinance may be cited as the Intoxicating Liquors (Manufacture and Sale) (Amendment) Ordinance, 1910, and shall be read as one with the Intoxicating Liquors (Manufacture and Sale) Ordinance, hereinafter referred to as the principal Ordinance.

2. Section 2 of the principal Ordinance shall be amended by the insertion, after the definition of " s t i l l " appearing therein, of the following definition :—

" w h i s k y " means a spirit obtained by distillation from a mash of cereal grains, saccharified by the diastase of m a l t ; " .

3. The following section shall be inserted i n the principal Ordinance immediatelv after section 11 thereof :— "Bestr ict ion on sale and delivery of whisky.

11A.—(1) No whisk}- shall be delivered from the premises of a manufacturer for consumption in Palestine unless it has been matured i n wood in the premises of a manufacturer for a period of at least three years, and no whisky shall be sold for consumption in Palestine unless it has been matured in wood as aforesaid.

(2) A n y person who acts in contravention of the provisions of this section is guilty of an offence and is liable to a fine of one hundred pounds."

O B J E C T S A N D S E A S O N S .

Several wine and spirit manufacturers in Palestine have recently put on the market a product called "Palestine whisky" which is produced by mixing a small proportion of Scotch whisky with about 30% of locally made molasses alcohol and sufficient water to bring the resulting mixture down to 40—45% alcoholic strength.

2. The sale of this so-called " w h i s k y " is not only deceptive but also imposes on purchasers an immature spirit, as compared with foreign manufactured whisky, which cannot be imported into Palestine unless it is accompanied by a certificate certifying that it has been stored in wood for not less than three years. Further ­more, the production of the above-described mixture introduces the "cold process" which complicates excise control.

3. This Ordinance accordingly inserts a definition of " w h i s k y " and a new sec­tion 11A in the principal Ordinance wi th a view to prohibiting the delivery and sale of w^hisky for consumption in Palestine, unless it has been matured in wTood for at least three years. The Ordinance is based on section 24 of the United Kingdom Finance Act , 1933 (23 & 24 Geo. 5, c. 19).

4. It is also intended to enact rules under the Public Health (Eules as to Food) Ordinance, No . 6 of 1935 —

(a) prohibiting the sale of whisky (as defined in clause 2 of the Ordinance under report) which contains any added substance other than caramel, and

(b) providing that the word " w h i s k y " or expressions which include or resemble the word " w h i s k y " shall not be used on the label attached to any package containing a mixture of genuine whisky with any substance other than caramel.

Notices of registration of Companies, Co­operative Societies, Trade M a r k s and Patents wi l l not be accepted for publication unless submitted through the appropriate Registrar.
