JK-71/18-20 RNI No. 28547/65 Vol No. 55 No. 1 JAMMU, TUESDAY, JANUARY 1, 2019 14+4 (Supplement) = 18 Pages ` 5.00 Mohinder Verma JAMMU, Dec 31: In bla- tant violation of Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956 and Jammu and Kashmir Government Employees (Conduct) Rules, 1971, several Government departments have failed to initiate depart- mental proceedings against large number of officers against whom FIRs under Prevention of Corruption Act have been registered by the Anti-Corruption Bureau (for- merly State Vigilance Organization). This is notwithstanding the fact that the General Administration Department on the instructions of Chief Secretary BVR Subrahmanyam has already made it clear to all the departments that there is no legal bar to the holding of disci- plinary proceedings and the criminal trial simultaneously. The Rule 3 of Jammu and Kashmir Government Employees (Conduct) Rules, 1971 states: Every Government employee shall at all times maintain absolute integrity, devotion to duty and do nothing which is unbecoming of a Government employee. If any Government employee violates this Rule and his/her act amounts to misconduct then he/she is required to be dealt with under the provisions of Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956. Moreover, the Supreme Court in the cases titled "State of Rajasthan Verus B K Meena and Others" and "State Bank of India and Others Versus Neelam Nag" has held that approach and the objective in the criminal pro- ceedings and the disciplinary proceedings is altogether dis- tinct and different. "In the disciplinary pro- ceedings, the question is whether the respondent is guilty of such conduct as would merit his removal from service or a lesser punishment whereas in the criminal pro- ceedings the question is whether offences registered against him under the Prevention of Corruption Act and the Indian Penal Code (Ranbir Penal Code in case of Jammu and Kashmir) are established and if established what sentence should be imposed", the Supreme Court has mentioned in the judg- ment of these cases. Speaking at a party pro- gramme at BJP Headquarters here today held in connection with joining of prominent leader from Jammu and president of Rajput Sabha, Naraian Singh in BJP, Shah said that there is every possibility that the Assembly elections in the State can also be held along with Parliamentary poll which falls due in April, 2019 after the expiry of present term of Lok Sabha. He said BJP is the ultimate choice of the people all over the country as well as Jammu and Kashmir as it is the only party which serves the common man under the leadership of Narendra Modi and during over last four years of its rule at Centre it has launched many public welfare schemes and projects so that the neglected and deprived sections of the society can also take their advantage. He said influenced by Party’s good work and pro*public poli- cies many leaders across the country are joining BJP to make India a strong and powerful nation. Shah, while stressing on strengthening of nationalist forces in the J&K said this is the only solution and way to bring the State out of present mess. “It is right time for us to go to people and apprise them of the pro poor, pro women and pro youth policies of Narendra Modi led Government’’, he added. The BJP chief asked the par- tymen to concentrate on Ladakh region, far flung and remote areas of Jammu region and Kashmir Valley by taking party’s message and develop- mental agenda to each and every house hold. There is need of hour to strengthen the nationalist forces in Kashmir Valley to defeat the secessionist and anti national elements, he added. BJP State president, Ravinder Raina, who was also present in the programme, said BJP activists in the State are in an upbeat mood and the party is all set to cross magic figure of +44 to form the next Government in the State on its own. He said the ULB and Panchayat elections which were held in the State recently showed that BJP will perform far better than other parties in the State and seek majority on its own. Asserting that there has been no report of excesses with the families of militants, Malik said if at all some excesses have hap- pened, he was ready to hold a high-level inquiry into the inci- dent. Mehbooba had yesterday visited some parts of South Kashmir and met family mem- bers of the militants after which she issued a statement alleging that sister of a militant has been harassed and tortured by the cops. She had said that this would further alienate the Kashmiri youth. "We have nothing personal with families of militants and strict instructions have been issued to the security forces to be careful during counter insur- gency operations,'' Malik said. Through an official state- ment this evening, the Governor called upon all political parties to understand fragile situation in some parts of Jammu and Kashmir and not to upset this through "motivated statements'' and "false allegations''. "I have been informed that there has been no tearing up of a lady's clothes or her being harassed by the police. I once again reiterate that all police officers and staff will be directed not to harass women who happen to be relatives of militants or treat them in any unbecoming manner. A senior Army officer said that a group of Pakistani troops under the cover of thick forests and assisted by high caliber weapons firing, mortars and rockets, from Pakistani posts, attempted to carry out a major strike on an army post in Nowgam sector. He said that the Army deployed along the LoC detect- ed the movement of the Pakistani BAT. He said that Army strongly retaliated and the exchange of fire continued the whole night. The officer said Army con- ducted prolonged search oper- ations in thick forests and dif- ficult terrain to ascertain the situation. He said that during the searches, two bodies of Pakistani troops were found and large cache of warlike stores were recovered. "The search operations are still underway in the sector to sanitise the area. A few other intruders managed to escape across the LoC, taking advan- tage of the Pakistani firing and adverse weather and visibility conditions", the officer said. He said that the intruders were wearing combat dresses like Pakistani Regulars and were carrying stores with Pakistani markings. "Some intruders were also seen in BSF and old pattern IA dresses as part of deception", he said. The officer said that they had intruded well equipped with IEDs, incendiary materials, explosives, and a plethora of arms and ammunition. "From the recovery, it was estimated that they intended to carry out a gruesome attack on the Indian Army forward post in Nowgam sector. The alertness and resilience of the own troops, who engaged and neutralised the intruders, thus eliminated a like- ly treacherous attack on the Army forward posts along the Line of Control on the eve of New Year", he said. today foiled a major BorderAction Team (BAT) strike at aforward post along the Line ofControl in Nowgam Sectorand killed two Pakistani sol-diers.

A senior Army officer saidthat a group of Pakistani troopsunder the cover of thick forestsand assisted by high caliberweapons firing, mortars androckets, from Pakistani posts,attempted to carry out a majorstrike on an army post inNowgam sector.

He said that the Armydeployed along the LoC detect-ed the movement of thePakistani BAT. He said thatArmy strongly retaliated and theexchange of fire continued thewhole night.

The officer said Army con-ducted prolonged search oper-ations in thick forests and dif-ficult terrain to ascertain the

situation. He said that duringthe searches, two bodies ofPakistani troops were foundand large cache of warlikestores were recovered.

"The search operations arestill underway in the sector tosanitise the area. A few other

intruders managed to escapeacross the LoC, taking advan-tage of the Pakistani firing andadverse weather and visibilityconditions", the officer said.

He said that the intruderswere wearing combat dresseslike Pakistani Regulars and werecarrying stores with Pakistanimarkings. "Some intruders werealso seen in BSF and old patternIA dresses as part of deception",he said.

The officer said that they hadintruded well equipped withIEDs, incendiary materials,explosives, and a plethora ofarms and ammunition. "From

the recovery, it was estimatedthat they intended to carry out agruesome attack on the IndianArmy forward post in Nowgamsector. The alertness andresilience of the own troops,who engaged and neutralised theintruders, thus eliminated a like-ly treacherous attack on theArmy forward posts along theLine of Control on the eve ofNew Year", he said.

The Defence spokesmansaid: "Army applauded thecourage and perseverance ofthe alert troops. Army'sresolve to keep a strict vigilalong the LoC and defeat allsuch nefarious designs ofPakistan will continue toremain firm and consistent.".

2018 witnessed several of ceasefire violations byPakistan both on LoC as well as along the InternationalBorder which resulted in the martyrdom of our manybrave hearts. While 'Excelsior' remained in the forefrontin highlighting the supreme sacrifices of the martyrs, theplight of border dwellers as a result of intermittentshelling etc from across the border too was prominentlyhighlighted. Unprecedented delays in several develop-mental projects took place surprisingly due to non sub-mission of Utilization Certificates. We played our part asa constituent of responsible media in bringing into lime-light peoples' grievances during Governor's rule and toour satisfaction got them addressed.

The State witnessed a turning leaf in the democraticactivities at the grass root levels by conducting of longdue Local Bodies and Panchayat elections in which not asolitary incident of violence took place, the credit ofwhich undoubtedly goes to the administration under theGovernor's rule. ‘Excelsior’ not only led from the front ingiving wide coverage to these elections but also con-tributed towards ensuring peoples’ participation in theseelections.
