One of them was attending PACOs Law Day and Paralegal Day celebration at the Statehouse. I hope that all of you feel it was a successful luncheon in terms of celebrating the paralegal profession as well as incorporating the Law Day theme, Celebrate your freedom: Independent Courts Protect Our Liberties. Judge Klatt did a wonderful job of incorporating how paralegals fit into that theme. It was nice to see a couple of PACOs founding members in the audience. I also think it was wonderful that many of the paralegal employers had other celebration activities or gifts planned for their paralegals. Michelle Schaefer, PACOs PR Director, planned the event along with the help of other PACO members to make it successful and a great day for those in attendance. She was able to do it and be the newest person to join the Board. Another neat thing I have been able to do is participate as a moderator for a couple of panels for Capitals summer immersion paralegal program. A group of about 20 people are enrolled in this program at Capital. The program started in mid-May and runs to mid-August. The students are in class from 8:00 AM until 3:30 PM, Monday through Thursday, although there first two weeks, they also had class on Fridays. What I find interesting about this class is that they are driven, enthusiastic and full of questions about the paralegal profession. Many of them have expressed an interest in becoming student members. If you see them at a PACO membership meeting or a committee meeting, I hope you make an effort to introduce yourself and welcome them to the profession. I believe I have mentioned it before, but it is worth mentioning again. I personally have much to celebrate. I attended my sons graduation from Capital Law School on May 18th. On June 8th, I will attend my daughters graduation from Thomas Worthington High School and on June 13th, I will attend my other sons graduation from the Ohio State University. Right after his graduation, my kids and I and our extended family (grandma, Aunts, Uncles and cousins) are off to a week at the Outer Banks. I regret that I will not be able to attend PACOs annual meeting, but will leave it in the hands of other capable Board and Nominating Committee members. Like me, if you cannot attend this very important meeting, please send in your absentee ballot. I have a great job, I work for great people, I have a great family, and great friends and I have much to be thankful for.

LETTERI have had the pleasure of doing a couple of neat

things lately. One of them was attending PACO�s LawDay and Paralegal Day celebration at the Statehouse. Ihope that all of you feel it was a successful luncheon interms of celebrating the paralegal profession as well asincorporating the Law Day theme, �Celebrate yourfreedom: Independent Courts Protect Our Liberties.�Judge Klatt did a wonderful job of incorporating howparalegals fit into that theme. It was nice to see a coupleof PACO�s founding members in the audience. Below are some highlights from the April 21, 2003General Membership Meeting and the May 12, 2003Executive Board meeting, in addition to routine businessdiscussed.

April 21, 2003 General Membership MeetingLaw Day- Michelle Schaefer reported that plans for Law

Day are proceeding. The luncheon will be held May 19 inthe North Hall of the Statehouse at noon with Judge WilliamKlatt of the 10th District Court of Appeals as the featuredspeaker.

Andrea Doty reported on agenda topics discussed at theNFPA Spring Convention she recently attended. An articlewith full details of the meeting and agenda topics was in Apriledition of The Citator for members who are interested inreading it.

Kathy McGranahan gave a brief presentation on theStatewide Meeting and paralegal regulation. She alsoannounced that the Statewide Forum, �Paralegals TakingFlight�, will be held September 26-27 in Dayton.

May 12, 2003 Executive Board meetingTreasurer�s Report - Rebekah Smith reported that we

are still awaiting a response from the IRS regarding ourrequest to waive penalties from the failure to file a 1998 taxreturn.

Committee Report � DeAnna Barnett reported on thefollowing matters:

Pro Bono: Robin Hartman will prepare an article onthe NFPA Pro Bono Conference, which she recently attended.

CLE: The CLE Committee recognized the speakers whovolunteered to speak at the CLE seminar that was cancelled.

Membership Report � Bridgett Klingbeil reported thatall individuals who have not renewed their membership havebeen dropped from the membership list, approximately 75people were dropped.

Statewide Report - Kathy McGranahan circulated thenew letterhead and stationary adopted by the Statewideorganizations. June 13 is the deadline for the summer editionof the statewide newsletter, if you are interested in submittingan article.

NFPA Report � NFPA will be instituting a membersonly section of their website. NFPA has expressed concernabout the NALS �Certified Paralegal Professional� exam andcriteria being questionable. Member associations areencouraged to voice their opinions as well. Lastly, RFP�shave been sent out for the new management contract.

Public Relations:Law Day - Please mark your calendar for May 19 at the

Statehouse to celebrate Law Day. Michelle Schaefer reportedthat plans are progressing to make this a successfulcelebration. The Board reviewed and approved the programfor Law Day. The PR Committee has been assemblingpromotional items from vendors to give to attendees. Anarticle also appeared in the May 9 Daily Reporter promotingLaw Day.

The PR Committee is also taking orders for soft sidebriefcases with the PACO logo. The briefcases are $15 andcan be ordered from any Board member.

Adopt-A-Highway - Clean up will be June 14. Timeand place to meet will be determined and announced in futureissues of The Citator.

Editor - The focus in the next issue of The Citator willbe Family Law. The Board also discussed the feasibility ofconducting a salary survey.

Parliamentarian - The Board formally adoptedrevisions to the PACO Procedure Manual regarding the abilityof the PESC to investigate UPL allegations, as recommendedin the PESC report presented at the April Board meeting.

New Business - The Board discussed the possibility ofan alliance between PACO and the Columbus Bar Association.It was decided to form an ad hoc committee to study theissue. Please see Rebekah Smith if you are interested injoining the committee.

The Board also voted to purchase a table at the CBAluncheon on June 6

The next Executive Board Meeting will be held MondayJune 9, 2003 at 5:45 p.m. at the offices of Hahn Loeser.

�Whew! By the time this column is published, our PACOLaw Day and Ohio Paralegal Day celebrations will haveoccurred. The Public Relations Committee worked very hardto make this event special for our members, and I would liketo more formally thank Bridgett Klingbeil, KathyMcGranahan, Kathleen Saul, Colleen Sinnott, and all of thePACO Executive Board members. Without the significantcontributions of time, effort, and patience made by the abovepeople, this event would not have been possible. I would alsolike to thank all of the corporate sponsors. Our sponsorswere very generous this year, and as members, please showyour gratitude and appreciation of their commitment in anyway possible. Finally, we hope that you enjoyed the PACOpromotional items that were given away as well as thewonderful talk given by Judge William A. Klatt from the 10th

District Court of Appeals.

As much as we would like to remain focused on thisday, we must move forward to PACO�s 30th Anniversarycelebration in July. In honor of this event, we will be

of the Profession winner, and this award will not necessarilybe given on an annual basis. It will be reserved only for thoseparalegals that have made an extraordinary contribution toour profession as a whole.

NFPA NEWSBy Kathy McGranahan

NFPA is trying to streamline the administrative duties,which HMS fulfilled, although not required under contracttherefore, Coordinators and Volunteers are needed.

One of administrative items recently changed was themembership list and dues notices will now be electronicversions. On the website there is a �Members only� sectionnow. Contact [email protected] for your ID andpassword.

The NALS �Certified Paralegal Professional� exam andits related educational criteria are questionable based onNFPA standards. Members associations or individuals areencouraged to voice their opinions. For more informationon this test and the organization visit, http://www.nals.org/Certification/cpp.html.

According to Diana Smiley, NFPA President, the HMSManagement Company Contract Negotiations, is pendingNFPA Board review. The contract negotiation committee hasbeen working with HMS regarding a new contract. The samedraft contract was sent for attorney review. After which, theBoard will schedule a conference call do discuss theattorney�s recommendations. In the meantime, RFP�s weresent out and they anticipate response from interestedcompanies.

Our sister Ohio Association, The Cincinnati ParalegalAssociation, membership voted to withdraw its affiliationwith NFPA effective May 14, 2003, during their AnnualEvening Meeting. As stated by Jose Pedro Santos, theirNational Affairs Chairperson, �The CPA was privileged andhonored to have served alongside many of our colleagueswithin NFPA, and contribute toward the development of theparalegal profession. However, our integrity and ourprofessional standards will now lead us in a new direction toserve the profession in an alternative venue to further

presentin g several awards this year. Qualifications for eachaward are as follows:

Outstanding PACO Member of the Year � This awardwill be presented to the PACO member who has providedsignificant encouragement to many Central Ohio paralegalsthroughout the year. This person will have given generouslyof his/her time and will have assisted and influenced otherPACO members in many positive aspects. This individual willhave exceeded the expectations for any volunteer positionsthat he/she may hold and will have gone beyond the usualPACO volunteer responsibilities to contribute significantlyto the profession as well. This member�s contributionsshould be evident in past years and years to come to earnthis award.

Paralegal of the Year � This award will be presented tothe individual who has touched the lives of many paralegalsand furthered our profession in Central Ohio. This personwill have exemplified the communication, organizational, andfunctional disciplines necessary to prove his/her value tothe paralegal community as a whole. This individual will havegone above and beyond any usual work-relatedresponsibilities in an effort to further the respect andadmiration of the paralegal profession.

Paralegal Educator of the Year � This award will bepresented to an educator, full or part-time, who has inspiredstudents in the growth of the paralegal profession. This personwill have exemplified the training, patience, and overallcommitment necessary to introduce new students to the legalcommunity and the paralegal profession in general. Thiseducator will have shown students how to aspire to greaterheights in the Central Ohio paralegal community.

Special Attorney of the Year � This award will bepresented to the Central Ohio attorney who has championedthe cause of the paralegal profession. This person will haveshown paralegals how they can best support the legalcommunity and will have provided growth and learningopportunities for paralegals within their sphere of influence.This attorney will have shown paralegals and the paralegalprofession respect and admiration and will have benefitedfrom several examples of their practical value to the CentralOhio legal community.

Finally, there will be a very special award this year. Thisaward, the Paralegal of the Profession, will honor a CentralOhio paralegal who has been around for all 30 years of PACOif possible. We would ask this person to tell us about thegrowth and changes of the paralegal profession during thistime. This person will have obviously championed the causeof our profession and watched it develop into what it is today.Honor, ethics, and integrity will be evident in our Paralegal

Enforcement Agency

The Child Support Enforcement Agency (CSEA) hasmore responsibilities than just transferring money from thechild support obligor, to the child support obligee and keepinga record of those transfers. In the limited space we have forthis article, we will give you a brief overview of the CSEA.In areas that may be of particular interest to paralegals, wewill give you information that we hope will be of value inyour practice.

Establishment of Paternity and Support OrdersThe CSEA, pursuant to statute, can determine either the

existence or non-existence of the father-child relationship.Ohio Revised Code Section 3111.381(A) states: �Except asprovided in division (B) of this section, no person may bringan action under sections 3111.01 to 3111.18 of the RevisedCode unless the person has requested an administrativedetermination under section 3111.38 of the Revised Codeof the existence or nonexistence of a parent and childrelationship.� This administrative determination can be doneby an acknowledgment of paternity, or one of the parties canrequest genetic testing. Thirty days after the establishmentof paternity, the CSEA will hold a hearing to establish a childsupport order.

If the CSEA is unable to administratively establish thefather-child relationship, we assign the case to one of its�staff attorneys for the filing of a judicial action.

The Franklin County CSEA has developed a procedurethat permits private counsel to bypass the administrativeprocedure. To bypass the administrative process, the partyrequesting the bypass, must obtain two documents from theCSEA. One of the documents is an affidavit, which is signedby the party requesting the bypass. The other document is anotice to the court, which the party requesting the bypass,their counsel, and a CSEA Hearing Officer have all signed.These documents, along with the health insurance affidavitand custody affidavit are filed with your complaint. (Note:This bypass procedure applies to Franklin County only. Othercounties have developed similar procedures. It will benecessary to check with the CSEA in the county in whichyou will be filling your complaint, to learn if they have abypass procedure).

The CSEA, subsequent to the establishment of the father-child relationship, either administratively or judicially, willestablish an order for the payment of child support. Supportorders can also be established if there is either a presumption

of paternity, or an Acknowledgment of Paternity Affidavitwas signed at the hospital. When the CSEA establishes childsupport administratively, the CSEA cannot deviate from thechild support guidelines.

The CSEA does not address issues of visitation orcustody.

Administrative Enforcement ActionsThe Ohio General Assembly has, by various statutes,

given the county child support enforcement agencies, thepower to enforce child support orders by administrativemeans. We will briefly discuss a few of these. Some actionscan be done automatically, by the computer generating thenecessary forms, or by the computer sending information toanother computer.

� Revised Code Sections 3121.01 through 3121.39requires withholding of the obligor�s income orassets upon commencement of the court or admin-istrative order for the collection of the support andany arrearages that occurs.

� Conducting default investigations and issuing an Ad-vance Notice of Default, Revised Code Sections2301.35, 5101.31 and 5101.32. Of all the Admin-istrative actions the CSEA can take, the issuance ofan Advance Notice of Default is one of the mostimportant actions. Once the CSEA has taken thisaction, and the appeal time has passed, the CSEAcan take any of the administrative actions listed inthe Notice, with no appeal possible by the obligor.If you represent a child support obligor, and theyhave informed you that they have received an Ad-vance Notice of Default, the first question youshould ask them, is �What is the date of the No-tice?� This should be the first question because thetime for an appeal starts running from the date onthe notice, not the postmark date.

� The Federal Personal Responsibility and Work Op-portunity Reconciliation Act of 1996 requires thatstates enter into agreements with financial institu-tions doing business in the state to conduct quar-terly matches of noncustodial parents who owepast-due support with funds on deposit in the finan-cial institutions. See Section 3121.74 to 3121.85and 3123.24 to 3123.38 of the Revised Code. Oncea match is found, funds on deposit in the accountcan be recovered for past due child support. TheCSEA jargon for this action is a FIDM (FinancialInstitution Data Match).

� The CSEA can issue seek work orders to obligorswho are not making paying their child support obli-gation. Ohio Revised Code Section 3111.23.1. If

the administrative seek work order is unsuccessful,the CSEA shall request the court to issue a seekwork order, pursuant to Ohio Revised Code Sec-tion 3113.21(D)(4).

� Drivers license suspension both Ohio and CDL, canbe instituted by the CSEA, after the issuance of theAdvance Notice of Default. Ohio Revised CodeSection 2301.37.4

� Income tax intercepts from both Ohio and the IRSare available to the CSEA to collect child supportarrearages. Under the federal income tax refund off-set process, support arrearages are satisfied throughthe offsetting of federal income tax refunds pay-able to obligors owing past-due support. Ohio Re-vised Code Sections 5101.32, 5101.32.1 and5101.32.6.

� The CSEA can request, for people employed in Ohio,that a professional license be suspended to enforcethe obligation to pay child support. Revised CodeSection 2301.37.3.

� UIFSA (Uniform Interstate Family Support Act)actions, The CSEA sends these to other states ask-ing them to take a particular action on a case, e.g.,establish paternity and support or enforce an exist-ing support order.

In addition to enforcing child support orders throughthe administrative procedures, the child support enforcementagencies can modify a child support order or terminate achild support order.

� A modification review of the child support ordercan be requested by either party. The CSEA cannotdeviate from the child support guidelines, and ei-ther party may request the results of the review tobe reviewed by an Administrative Hearing Officer.Either party can request the decision of the Hear-ing Officer to be reviewed by the Court. To qualifyfor a review, one of the parties must reside in Ohio.If the order was established or modified within thepast three years, a review cannot take place unlessa). Either party has encountered a 30% change ingross income or income producing assets for atleast six months which is beyond their control andcan reasonably be expected to continue an extendedperiod of time. b). The last time the child supportwas set, it was set at a minimum amount due to theobligor�s unemployment or underemployment andhe/she is now employed or has obtained more gain-ful employment. c). Either party has experienced aloss of employment for at lest six months, which isbeyond their control, and can reasonably be ex-pected to continue an extended period of time. d).

Either party becomes permanently disabled reduc-ing their earnings ability (Medical verification isrequired). e). The obligor cannot pay support forthe duration of the child�s minority because of in-stitutionalization or incarceration with no chanceof release and no income or assets are available forthe support. f). If one or more of the children havebeen deleted from the order because of the eman-cipation or other reasons. g). In order to accesshealth insurance or improved health insurance forthe child(ren), regardless of whether an adjustmentin the amount of support ordered in necessary. h).If the current support award was established as arebuttal of the guidelines and the requestor can nowshow change in circumstance with resulted in theoriginal rebuttal of the guideline amount.

� Valid reasons for which a support order should ter-minate include, but are not limited to: death, mar-riage, emancipation, enlistment in the armed ser-vices, deportation, or change of legal or physicalcustody of the child.

Judicial Enforcement ActionsThe final area that we will discuss, in this brief overview

of child support, is that of actions that the CSEA takes,judicially, to either establish paternity and/or a support order,or to enforce an existing support order. We will also offer afew suggestions that we hope will be beneficial. However,before we begin this area, it is important that we say a fewwords about child support and bankruptcy.

If you represent an obligor who is filing bankruptcy, youshould ask them in what state, and county the child supportand/or spousal support was ordered. Do not make thecommon mistake of assuming that the support order wasissued in the state and county where your client now resides.Also, notifying the Ohio Child Support Payment Centraloffice of the bankruptcy is not necessary because they haveno enforcement powers. Any notices, of any type, that aresent to them are forwarded onto the county or counties withthe underlying order.

Both child support and spousal support arenondischargable in bankruptcy. Child support and spousalsupport arrearages are unsecured priority claims in a Chapter13 bankruptcy, 11 U.S.C. § 507(a)(7). When the courtnotifies the Franklin County CSEA, that an obligor has filedbankruptcy, under chapter 13 of the Code, the Franklin CountyCSEA will file a Proof of Claim with the Court. If the FranklinCounty CSEA was not notified of the bankruptcy, we willfile a Proof of Claim, only if requested to do so, by thecustodial parent. Ohio counties, other than Franklin, may ormay not file a Proof of Claim, and some may file a Claimonly in certain circumstances. If you are dealing with a

county, other than Franklin, you will need to check with thatcounty to learn is policy regarding the filing of Proof ofClaims.

Because the Automatic Stay Provisions of the Code (11U.S.C. § 362) apply to the enforcement of child supportorders, it is very important the CSEA be notified of the filingof the bankruptcy, because as noted above, someadministrative enforcement actions can take placeautomatically by computer. If the CSEA is not notified ofthe bankruptcy, it cannot enter data into the computer thatwill block most of these automatic actions. If you representa debtor, and the CSEA is inadvertently taking enforcementactions a phone call or letter to the CSEA can usually resolvethe problem, without the necessity of filing a motion inbankruptcy court. At the Franklin County CSEA the authorsof this article can resolve most issues.

If the CSEA was unable to establish paternity and/orsupport via the administrative procedures then either privatecounsel or the CSEA can file an action in court. In the majorityof cases it is the CSEA who files the action. After service iscompleted on the defendant, and a hearing has beenscheduled, the Court can establish paternity any of thefollowing ways. 1). After a trial, although trails are very rare.2.). By the defendant admitting he is the father of thechild(ren). 3. As a result of genetic testing done on theparties. 4). By default, because the defendant failed to answer,and failed to appear and defend against the accusations againsthim.

If you represent an alleged father in a paternity action,requesting genetic testing is always the best course of actionif your client has even the smallest doubt that he is the father,however, if he is found to be the father, the CSEA will seekreimbursement of the cost. (Note: there are rare cases wherea man can be found not to be the father, and still be requiredto pay the cost the genetic testing).

In paternity actions the Court will enter a child supportorder at the paternity hearing, if the court has enough financialinformation to compute an order, based on the child supportguidelines. If there is insufficient data to compute an order,the Court will hold that a separate hearing established thechild support order.

Paternity can also be established, even if one of theparties is deceased. If the mother of the child is deceasedpaternity can be established through genetic testing on thematernal parents of the mother. Paternity can be establishedin either Juvenile Court or Probate Court, if the alleged fatheris deceased. If the parents of a deceased alleged father arealive, and willing to cooperate, then genetic testing can bedone in Juvenile Court. If they are deceased, or unwilling tocooperate, then the action needs to be filed in Probate Court.In Probate Court, the action is filed as a Complaint to

Determine Heirship. After genetic testing, if it is determinedthe deceased is the father of the child(ren), then the child(ren)are entitled to collect under the estate, and/or to apply forsocial security benefits. To collect from the estate, a Bill inEquity then needs to be filed, in the Probate case, to collectfrom the estate.

Child support orders can also be established without afinding of paternity. These orders can be entered, after serviceof process, when there is a presumption of paternity becausethe child(ren) was/were born during the course of themarriage, and the parties are now living separate and apartfrom each other. Also, if there existing case, such as adivorce, dissolution, or custody action, and no support wasordered, then after service of process, a child support ordercan be issued.

To enforce an existing support order though the courts,the tools available to the CSEA are no different that thoseavailable to private counsel.

If the support order was established administratively, andthe obligor is not complying with that order, the CSEA willfile a Complaint to Enforce an Administrative Order. (Note:In many smaller Ohio counties, the Administrative order isautomatically filed with the court, making it an order of thecourt). In a Complaint to Enforce an Administrative Order,the prayer of the complaint ask the court to approve and adoptthe Administrative Order as an order of the court, and to findthe Defendant in contempt, for failure to comply with theAdministrative Order.

To enforce a support order that originated from a Courtorder, the CSEA will file a Motion for Contempt and/orJudgment and/or to Determine and Liquidate Child SupportArrearages. At the hearing on this motion the CSEA willusually ask the court to find the obligor in contempt, imposea jail sentence, suspend the jail sentence on condition thatthe obligor liquidate the arrearages, (the amount of theliquidation order is statutorily mandated at 20% of the order,unless the Court should determine otherwise). Occasionally,the CSEA will request the court set a date for a review hearing,to see if the obligor is complying with the purge order.

Occasionally, an obligor�s employer will not send theCSEA the obligor�s child support payments, as required bythe income withholding order. Often a simple phone call fromthe Agency will resolve the problem. On those occasionsthat a phone call does not resolve the problem, the filing ofa contempt action against the employer is necessary. Whenit is necessary to file an action against an employer, the agencywill also file a contempt action against the obligor, becauseit is their responsibility to pay the support. If an employer isfound in contempt, they can be required to pay the amountnot withheld, and the court can impose a fine on the employer.See Ohio Revised Code Section 3113.21.3.

The Qualified Domestic Relations Order (QDRO) isanother method available to collect past due child support,if the obligor has funds in a retirement account. The languagein these orders must meet with the approval of the planadministrator before they are filed with the court.

The filing of a lien against the property of the obligor isanother method to enforce the child support order. The filingof a lien does not result in the immediate payment of thechild support obligation. The Franklin County CSEA doesnot commence foreclosure actions against child supportobligors. If the obligee wishes to file a foreclosure action,it must be done through private counsel. The CSEA does notfile liens outside Franklin County, Ohio. Often, you will findthat a child support obligee assumes that because their lienis for child support, it is a priority, which it is not. If a childsupport obligor request that you file a foreclosure action,before proceeding, it would be best to ascertain the cost ofthe action to your client, and the likelihood they will recoverany funds.

The last method of enforcing a child support orderjudicially is to refer the case to the Franklin CountyProsecutor�s Office, for possible criminal prosecution. Thisis done pursuant to Ohio Revised Code Section 2919.21.For a felony indictment, the obligor must have failed to makepayments for 26 weeks out of 104 consecutive weeks. Thisis the lone statutory requirement for a felony indictment;however, the Franklin County CSEA and the Franklin CountyProsecutor�s Office have established additional criteria thatin most cases, we must meet, before we refer a case to theProsecutor�s Office. These additional criteria help insurethe CSEA has undertaken, or attempted to undertake, civilremedies, before referring the case for criminal prosecution.The purpose of criminal prosecution is to punish the obligorfor not paying the support, not to collect support. That beingsaid however, often the offender will, if convicted, be placedon probation. One of the terms of the probation is to complywith the child support orders, from the Domestic Court. Anoffender�s failure to pay child support can result in therevocation of their probation, and the imposition of the prisonsentence.

As we said above that the CSEA will send other statesUIFSA (Uniform Interstate Family Support Act) Petitions,asking them to take a particular action on a case, e.g.,establish paternity and support or enforce an existing supportorder. The CSEA also receives UIFSA Petitions asking usestablish or enforce an existing child support order. Once anorder is established, or if we are enforcing an existing order,all the above enforcement tools, both administrative andjudicial are available to the CSEA to enforce the child supportorder.

Practice TipsWe said at the start of this final section that we would

try to include some practice suggestions that might bebeneficial. Where the context permitted, we tried to includethem in the body of this article. Below we have listed a fewadditional suggestions.

� When writing the section dealing with child sup-port of your entry, the best advice we can give is toKISS. (Keep It Simple Stupid). You should just saythe amount of the child support order per month,per child, plus processing charge. This will elimi-nate any confusion about what you intended theamount of the order to be. Sometimes, in draftingthe child support section of the order, the attorney,or paralegal, will attempt to say the same thing sev-eral different ways. This, in addition to be confus-ing to lay people, can if you are not careful in yourmath, result in conflicting amounts being in the or-der.

� An automatic increase in child support order mightlook impressive in the entry, but the CSEA comput-ers have no way to track or compute when theseincreases are to take place. For example the CSEAhas seen entries that tie and increase in child sup-port to the amount of increase in Gross DomesticProduct, or to the rate of inflation, or tying the in-crease to the amount of the annual increase in wagesby the child support obligor.

� Tying the effective date of a child support order toa specific event is also unadvisable, as the CSEAcomputers will no way of knowing when the eventhas taken place. The CSEA has seen entries thatmake the effective date the date the obligor obtainsfull-time employment, or upon the live birth of thechild, or upon the obligor graduating high school orcollege.

� Occasionally the parties, for various reasons, willagree to waive all child support arrearages. If youare doing this you need to contact the CSEA to learnif any of those arrearages are owed to the State ofOhio for past public assistance payments. The obli-gor does not have the authority to waive thesearrearages and the CSEA can still collect thosearrearages from obligee.

� In any case where there is a child born prior to themarriage of the parties, you need to determine ifthere is a prior existing order, either Administra-tive, or Judicial for child support. A court that at-tains jurisdiction over and enters orders concern-ing the custody and support of children retains con-

tinuing and exclusive jurisdiction over such mat-ters. Hardesty v. Hardesty (1984) 16 Ohio App.3d. 56, 474 N.E. 2d. 368.

� If, in a bankruptcy action, you represent a child sup-port obligee, you should be aware of Ohio RevisedCode Section 2329.66.

I�m not promoting an exercise in debating idle semanticsnor attempting to squash the quest for a balanced life. WhatI have observed is there is a curious detachment phenomenato the whole movement toward balance. Somehow, thosewho tout a balanced life (those media gurus) are not quiteable to teach us how they are achieving a lofty life of balance.Yet, this inquiry regarding balance certainly deserves plentyof attention so we can discover it for ourselves.

Chronic stress simply wears you down mentally andphysically. It�s no news to those of us in the legal field thatlawyers have been ranked number one among allprofessionals in depression. Yet, some consultants who sellus balance seem to have adopted a �Do as I say, not as I do�approach to teaching this concept. It�s as though they haveforgotten many of us now exist in a combative workplacethat pulls each of our hairs out, strand by strand. While thereis nothing wrong with working toward balance in your life,frankly, you�re the only one who can define the level ofbalance that resonates with your wishes.

Here are my observations regarding those who are themost financially �successful� people (those who have themoney, time and connections to do what they want, whenthey want with whom they want). They:

� Worked hard, efficiently and smart� Defined their goals and knew what they wanted to

accomplish� Kept up their networking� Formed a �Board of Directors� they could call upon

for anything� Praised and rewarded those who worked with and

for them� Did whatever it took to complete their projects on

time and under budget� Under-promised and over-delivered� Were fair in all their business dealings� Took care of their physical, mental and emotional

health� Were careful not to burn bridges and made sure to

mend fences� Treated their vendors well� Surrounded themselves with people who also

worked toward achieving a successful balance in their lifeSuccessful people�s days are filled with meetings, phone

calls, travel, correspondence, conferences, spending timewith co-workers, preparing assignments and implementation,enjoying quality time with their families, participating inregular physical exercise, and doing everything in their powerto enhance their CAREER. They�re actively focused andsuccessful because of their dedication to their own needsand goals. Their lives are not particularly well balanced, andyet, they are successful as defined by them. Balance is

achieved on a foundation of success not the other way around.A recent study by one well-known career coach found

that activities that financially successful people seldom doare:

� Meditate more than a few hours a month� Practice yoga on a regular basis� Deep breathing exercises� Spiritual retreats� Take on causes that have world wide implications� Participate in long philosophical discussions with

people in similar situations� Become involved in local politics� Take on causes that require more than a few hours a

month of their time� Complaining about the state of the economy or the

state of the world� GossipThe most fascinating aspect of this examination in

looking at balance is that the people who spend their timeand efforts focused on this last list (meditation, yoga, etc.)were not the most successful people and yet they talk aboutbalance more in an hour than highly successful people everdo.

Where does the quest for balance fit into your life? Canyou handle becoming a raging success first and then achievea higher level of balance in your life later? Or, are youdedicating your life to a balanced life of poverty and hopefor a better future to somehow show up because of your�balanced� life?

The truth is, we all have different needs, and those needsare constantly changing. Our lives are dynamic, not static.Children are born, loved ones get sick, we land a new job orlose one, develop an entirely new interest. At different pointsin our lives, different life events and priorities compete forour attention, and we focus on whatever is most important tous at that moment.

Now, it�s true that some people do lead lives that arewildly unbalanced, focusing obsessively on work andignoring everything else with serious consequences to theirhealth, relationships and family. But when that happens, theirlife isn�t simply out of balance; it�s out of control.Workaholics, for example, have little or no sense of how tobalance work and personal life: the syndrome is the result ofdeep-seated psychological issues, such as a lack of self-worthor an inability to develop an identity separate from one�swork. Such issues cannot be addressed, or redressed, throughgreater attention to balance.

If you instead doggedly pursue that elusive state of work/life balance, trying to have some measured ration of

everything you want at any given time, you are likely to endup in a kind of grey zone, where none of your needs are reallybeing met, and you end up feeling chronically dissatisfied. The important thing is to be conscious of the decisionsyou are making now, and to think serially about your life. Inone chapter of your life, your personal life may take priority,in another chapter your career aspirations. Over time, a kindof balance emerges.

With an extraordinary dedication to designing andcreating the life you want on your own, you can achievesuccessful balance in your life. Most people are amazed atthe amount of time that becomes freed-up after theyconcentrate on success and stop worrying about balance intheir lives. I know that for some of you, what I�m saying maybe controversial. Then again, I�ve never been accused of beinga wallflower. <sigh>

Stand first on the side of success and then balance,because achieving success first brings you a much higherlevel of rewards and is loads of magnitude more fun for youand everyone else. Now go forth my friends and seek success.The balance will follow.

PACO�s highway is a 2 mile section of Rt 70 west ofdowntown. It is between miles 93 and 95 heading EAST (or95 to 93 traveling WEST). PACO�s section is a hard one.There is the �on� and �off� ramps for Hague Rd., Wilson Rd.,and 270. Because of this we have to be extra careful. SeeMap below. Law Day Speaker, Judge Klatt

Specifically, when heading WEST, PACO�s area startsjust before the exit from Rt.70 to Hague Rd and ends nearthe 270 exit. When traveling EAST PACO�s area starts justafter the 270 North exit ramp from 70 and ends just after theHague Rd. entrance ramp to 70. There is a sign saying�Paralegal Association of Central Ohio� at the beginning ofthe area. There is no ending sign when heading west, so referto the mile markers. (Note: There are blue and green signsin the median that mark miles in tenths or two/tenths of amile.) When heading east you will see the marker for thenext adopt-a-highway group (Clerk of Courts) at mile 95.
