3. HISTORY OF THE FISHERY

The intertidal harvest of goose barnacles grew rapidly from its beginning in 1985. Landings peaked in 1988 with 467 licences issued and reported landings of 49 tonnes. Between 1989 and 1993 annual landings ranged between 30 and 40 tonnes. In 1994 reported catch declined to about 19 tonnes and preliminary data for 1995 shows a further decline to seven tonnes. The

'landed value of this fishery was approximately $73,000 in 1995, a decline from $273,000 in ' 1994. The fluctuations in reported landings are related to market conditions rather than stock abundance.

There are currently no limits applied in this fishery, since most of the stock is not available for harvest due to inaccessible harvest conditions or unsuitable size and qUality. It has been estimated that less than 10% of the total stock is available to the fishery.

The fishery expanded into the north coast in 1988 and 1989, but shipment of live product from the north has proved difficult. Only 0.5 tonnes were landed from all north coast areas in 1990, 0.2 tonnes in 1992 and no subsequent landings ()f goose barnacles were reported from the north coast areas until 1994 when nine tonnes were landed. No reported landings were made in 1995 for the north coast region. The reported landings from south coast areas mainly occur along the west coast of Vancouver Island. Areas 23, 24 and 26 make up the vast majority of the Goose Barnacle catch each year. Goose Barnacle harvesting usually occurs steadily throughout the "J year,

4. ENFORCEMENT PLAN

The Conservation and Protection Sector of the Department of Fisheries and Oceans has the responsibility to enforce the Fisheries Act and associated regulations, to address conservation, health and safety issues and to maintain proper management and control of the various fisheries.

Users of the resource have a responsibility to report violations. Any suspected or actual fisheries, wildlife or pollution violations can be quickly and discretely reported to the appropriate Enforcement Officer by using the toll free Observe, Record and Report hotline. This toll free number is available 24 hours a day. Confidentiality is assured.

ABORIGINAL FISHERIES PLAN

The Department of Fisheries and Oceans (DFO) recognizes the importance of fish, including invertebrates, to the aboriginal peoples of British Columbia. Through the Aboriginal Fisheries Strategy, DFO seeks to negotiate, with aboriginal organizations, allocations for food. social and ceremonial purposes. Subject to conservation, these allocations will have priority over allocations for commercial and recreational user groups.

DFO will consult with aboriginal organizations to determine what these allocations should be. In some cases, instead of negotiating allocations, an area may be closed to certain fishing except fishing by an aboriginal organization. These closures may be for the season or for specified times. Whenever possible, the appropriate annual fishing plan will identify such closures. It is possible, however, that situations may arise in the implementation of this plan where access to the fishery by aboriginal organizations for food, social and ceremonial purposes is jeopardized. In-season closure adjustments may be required. Communal licences will be issued to the aboriginal organization for the fishing.

6. SPORT FISHING PLAN

The recreational harvest of shellfish is regulated via the British Columbia Sport Fishing Regulation~ made under the Fisheries Act. A DFO Tidal Waters Sport Fishing Licence is required for the recreational harvest of all shellfish species. The regulations are summarized annually in the British Columbia Tidal Waters Sport Fishing Guide which lists closed times, bag limits, size limits (where applicable) and closed areas. If necessary, public notices are posted to document closures or changes from the Guide. Closures may be implemented in order to conserve vulnerable stocks, or to protect the public from consumption of contaminated shellfish or to meet aboriginal food, social and ceremonial needs. For some species, areas have been closed to commercial harvest or commercial harvest openings have been delayed to provide an opportunity for the recreational community.

The primary consultative body for the recreational fishing community is the Sport Fishing Advisory Board (SFAB). The SFAB has representatives from all parts of this community including the B.C. Wildlife Federation and the Sport Fishing Institute of B.C. If you have any questions or need further information, please contact a Recreational Fisheries Coordinator listed in Section I of this fishing plan or a local Fisheries Office.

The sport fishing limit is 2 kg per day, with a possession limit of 4 kg.

7.4. Licensing

7.4.1. Licence Category

A category "Z-6" Goose Barnacle licence (fishing without a vessel) is required for each harvester, in addition to a Fishers Registration Card (FRC). Vessels used to transport harvesters and product do not require a licence at this time.

7.4.2. Species

Goose Barnacles (Pollicipes).

7.4.3. Gear

Intertidal handpicking with hand tools only. Mechanical devices are prohibited. Collection by diving not permitted.

7.5.1. Harvest Log Data

7.5.1.1. The vessel master is responsible for the provision and maintenance of an accurate record, ~"Iog", of daily harvest operations. This log must be completed and a copy submitted in both hard copy (paper) and electronic form in an approved format as defined by the Department of Fisheries and Oceans (DFO) Stock Assessment Division's Shellfish Data Unit.

The vessel master is also responsible for the provision of a chart record of the locations fished. This harvest chart must have marked directly on it the CFV number, the licence tab number and the dates that fishing activity occurred at each location.

Logbooks meeting DFO requirements are available from outside service bureaus who, for a fee, will provide the logbook coding and keypunch service, and the chart coding and mapping service, thus complying with the requirements for a hard (paper), an electronic copy and location information.

The original white page copy of the log, the accompanying chart record and the electronic copy must be forwarded within 28 days following the end of each month in which fishing occurred. This information must be sent to:

As an alternative to harvest log provision through a service bureau, the vessel master may provide a hard copy log in the same form and providing the same particulars as shown in the fishing log sample attached hereto (see Appendix I). The vessel master must also provide an electronic copy which is required to be a true and accurate transcription of the hard copy data, delivered on a DOS compatible 3.5" disk. Disks will remain the property of Department of Fisheries and Oceans. The electronic copy must be either:

a) an ASCII text file in the data format specified by the DFO Shellfish Data Program, or

b) the equivalent information in a database table of approved design created by any of the following database management tools: Access, FoxPro, Paradox or dBase.

Contact the Shellfish Data Unit at the above address to obtain the full requirements and acceptable data formats for supplying harvest log, chart, bonded mapping sevice and electronic data in a format which meets the Conditions of Licence. The hard copy of the harvest logs and chart records, as well as the completed electronic copy of both must be forwarded within 28 days following the end of each month in which fishing occurred. This information must be sent to the above address.

7.5.1.2. Catch information·must be recorded in the harvest log by midnight of the day of fishing. The logbook must be at the harvest site. Logbooks must be produced for examination on demand of a fishery officer, guardian or a fishery observer designated under the Fisheries Act.

7.5.1.3. The licence holder of record reported with the Commercial Licence Unit is responsible for completing and submitting a copy of the log data. DFO can only release the log data to the licence holder of record, and only upon written request.

THE DEPARTMENT OF FISHERIES AND OCEANS WISHES TO REMIND FISHERS THAT IT IS A CONDITION OF LICENCE THAT LOGS BE COMPLETED DAILY FOR EACH DAY FISHED AND TURNED IN WITHIN 28 DAYS FOLLOWING THE END OF EACH MONTH IN WHICH FISHING OCCURRED. DELAY OF COMPLETION OR SUBMISSION OF LOGS IS A VIOLATION OF A CONDITION OF LICENCE.

7.5.2. Confidentiality of Harvest Data

7.5.2.1. Harvest data, including fishing location data supplied through lat.llong. co·ordinates, loran or chart records, collected under the harvest logbooks for Shellfish Fisheries programs, are collected for use by DFO in the proper assessment, management and control of the fisheries. Upon receipt by DFO of harvest log data andlor fishing location information, supplied by the fisher in accordance with conditions of licence, Section 20(1 )(b) of the Access to Information Act prevents DFO from disclosing to a third party, records containing financial, commercial, scientific or technical information that is confidential information. Further, Section 20(l)(c) of the Act prevents DFO from giving out information, the disclosure of which could reasonably be expected to result in material financial loss or could reasonably be expected to prejudice the competitive position of the fisher.

7.5.3. Fish Slip Requirements

7.5.3.1. It is a condition of this licence that an accurate written report shall be furnished on a fish slip of all fish and shellfish caught under the authority of this licence. A report must be made even if the fish and shellfish landed are used for

8. OTHER RESTRICTIONS AND GENERAL INFORMATION

8.1. Fisher Responsibility

8.1.1. Sewage, Garbage and Debris Control

Although most harvesters have shown a responsible approach towards keeping beaches free from garbage and other pollution, recently an increasing number of complaints have been received from other beach users about garbage spread by harvesters on some beaches. DFO asks that harvesters take care to remove all garbage from harvest sites; violators are subject to prosecution under the B.C. Litter Act.

8.1.2. Wet Storage

It should be noted that wet storage of harvested goose barnacles may not occur in those areas closed for sanitary reasons. Consult local fisheries office.

8.1.3. Openings and Closures

Fishers are responsible for ensuring areas are open for harvest before going fishing. Fishers may contact the Vancouver Shellfish Tape Message at (604) 666-2828 to receive information on open and closed areas or contact a fisheries manager listed in Section I of this plan.

CONDITIONS OF 1997 GOOSE BARNACLE LICENCE

Pursuant to subsection 22(1) of the Fishery (General) Regulations, and for the proper management and control of the goose barnacle fishery, the following conditions are specified for this 1997 commercial fishing licence:

I. Species of fish permitted to be taken:

Goose barnacle (Pollicipes).

2. Fishing gear permitted to be used:

Hand tools and hand picking only; no power or mechanical devices.

3. Harvest Log and Chart Data:

(I) The licence holder must maintain a log of all harvest operations and provide this infonnation in both hard (paper) copy and electronic copy to the Department of Fisheries and Oceans (DFO). The content and fonnat of this log (paper and electronic) must meet the requirements as defined by the Shellfish Data Unit for the 1997 licence year.

(2) The infonnation for each day's harvest operations shall be recorded in the log no later than midnight of that day.

(3) The log must be kept by the licence holder at the harvest site.

(4) The log must be produced for examination on demand of a fishery officer or a fishery guardian.

(5) The licence holder must provide a chart record of the locations fished to DFO. This chart must be marked with the licence holder's name, the licence tab number, and the dates that fishing activity occurred at each location.

(6) The licence holder must make provisions to have charts referred to in subsection 3(5) mapped onto master charts at the Shellfish Data Unit, Pacific Biological Station, Nanaimo bya bonded mapper.

(7) The completed log pages (original copy), electronic copy of the log and the chart record oflocations fished, must be forwarded within 28 days following the end of each month in which fishing occurred to:

Explanatory Note - Harvest Log and Chart Data: Logbooks meeting the requirements of the Shellfish Data Unit are available from service bureaus who, for a fee, will provide the logbook and coding, keypunch, chart coding, and mapping services.

As an alternative to the use of a service bureau, the licence holder may provide a hard copy log in the same form and providing the same particulars as shown in the fishing log sample in Appendix 1. The licence holder must also provide an electronic copy which is required to be a true and accurate transcription of the hard copy data, delivered on a DOS compatible 3.5" disk. Disks will remain the property of DFo. The electronic copy must be either:

an ASCII text file in the data format specified by the DFO Shellfish Data Unit, or the equivalent information in a database table of approved design created by any of the following database management tools: Access, FoxPro, Paradox or dBase.

Contact the Shellfish Data Unit at the address above for information on the acceptable text data format or acceptable database table design.

Chart records must also be provided and arrangements made for the transfer of information by a bonded mapper (see subsections 3(5) and 3(6)).

4. Fish Slips:

An accurate written report shall be furnished on a fish slip of all fish and shellfish caught under the authority of this licence. A report must be made even if the fish or shellfish landed are used for bait, personal consumption or disposed of otherwise. The report shall be mailed not later than seven days after the oflloading and sent to:
