2013 – 2014 PAC Analysis Overview

The NC FreeEnterprise Foundation has produced a report on PAC giving during the most-recent election cycle for a number of years now, providing insights into trends in political giving and specifically offering an opportunity to see which categories of PACs are giving how much and to which candidates.

What’s interesting in comparing the 2010 election cycle (the previous midterm election – the ‘apples to apples’ comparison with the 2014 cycle)is that there is little change among the ‘usual suspects’ of PACs at the top of the rankings, and the total amount contributed to candidates by PACs, comparing 2010 with 2014, was roughly the same.

It’s important to note that sometimes what drives the amount in contributions given by a PAC is the success achieved in getting individuals to give to the PAC. In some cases, PACs were able to raise and thus contribute more because of an expansion in the pool of contributors to the PAC (as was the case with the merger of Duke Energy and Progress Energy into a single company and thus a single PAC) and in other cases the PAC simply got better at raising money (as was the case with the NC Chamber PAC, clearly catching it’s fundraising stride now in its third election cycle of existence).

With regard to giving levels between the political parties, the adage that political money tends to follow power was again proven true. Republicans – who controlled both chambers of the NC General Assembly going into the 2014 elections – were recipients of three times as much PAC support as Democrats. In 2010, Democrats – who were in charge of both the state House and Senate going into that election – received 55% of all PAC contributions (and that was probably less than it would have been if that year’s national GOP wave dynamic hadn’t become obvious during the 2010 election cycle).

Among trends of note, Healthcare related PACs increased their giving by approximately 15% over 2010 levels. Given the significant public policy implications relative to Obamacare and the continuing legislative debate around Certificate of Need (CON), it’s not surprising that doctors, hospitals, and others within the world of medicine would be inclined to engage candidates more directly during this past cycle. Other groups, most notably Ideological, Labor Unions, and the Trial Lawyers saw decreases in their PAC giving by comparison with the last midterm election.

The most interesting factor present this past election may be that PAC contributions in aggregate were significantly less than the total spent by outside groups in independent expenditures and 501(c)(4) ‘social welfare’ organizations. In some state legislative races in 2014, the combined sum raised and spent by candidates (which includes PAC contributions those candidates received) was eclipsed by the amount spent by groups operating independently of their campaign committees.

Wither PACs going forward? A PAC provides a group of individuals the opportunity to collectively support the campaign operations of candidates aligned with that group on public policy issues of interest to them – but the nature of campaign operations is changing. Republican presidential candidate Jeb Bush has already signaled that a federal Super PAC will probably take on many of the tactical functions for his effort that were historically conducted by a presidential candidate’s own campaign committee. If this becomes the new norm in electoral politics (although the coordination prohibition between IE and candidate seemingly makes this a tricky thing to pull off), the traditional PAC may not provide as effective a vehicle for participation in the political process going forward.

With more than $100 million spent by outside groups during the 2014 elections in NC (including the state and federal races), and $250 million or more projected for 2016 (given the ‘triple full moon’ of a presidential, gubernatorial and US Senate race taking place coupled with North Carolina’s ‘battleground state’ designation), it should come as no surprise many associations and business are actively considering the formation of their own I.E. efforts.
