ON97/10/2013, I WAS CONTACTED BY DETECTIVE BRIAN CHRISTIE OF THE BROWARDSHERIFPS OFFICE. DETECTIVE CHRISTIE INFORMED ME OF A RESIDENTIALBURGLARY/GRANDTHEFT AUTO CASE THAT HAD OCCURRED NEAR THE AREA OFELLWOOD'S PREVIOUS RESIDENCE IN LOXAHATCHEE ON 06/26/2013. DETECTIVE CHRISTIEINFORMED ME THAT DETECTIVE HUMAN OF THE PALM BEACH SHERRIFPS OFFICE WASINVESTIGATING THE CASE (PBSO CASE #13-090031). . -

I CONTACTED DETECTIVE HUMAN WHO INFORMED ME THAT THE VICTIM OF THERESIDENTIAL BURGLARY HAD INFORMED HIM THAT A WALLET STOLEN DURING THEBURGLARY HAD BEEN RETURNED TO THE VICTIM AFTER BEING FOUND BY A STATETROOPER IN TENNESSEE. DETECTIVE HUMAN FURTHER ADVISED THAT THE VICTIM'SSTOLEN VEHICLE HAD A SUNPASS INSIDE THE VEHICLE AT THE TIME OF THE THEFT.

I THEN CONTACTED JENNFIER NATTER, THE NORTH BROWARD REGIONAL INVESTIGATORNITH THE DEPARTMENT OF TRANSPORTATION AND ASKED HER TO CHECK TOLL PLAZACAMERAS FOR THE STOLEN VEHICLE (GRAY HYUNDAI, FL TAG E18 2KV). NATTER LATERSENT ME AN EMAIL WITH SEVERAL PHOTOGRAPHS TAKEN FROM TOLL PLAZAS BEVNEENPALM BEACH COUNTYAND LEESBURG FLORIDA ON 06/26/2013, DEPICTING THE STOLENVEHICLE AND THE DRIVER OF THE VEHICLE, WHO WAS RICHARD ELLWOOD. I FORWARDEDTHE EMAIL WITH THE PHOTOGRAPHS TO DETECTIVE HUMAN.

ON 07/15/2013, SPECIAL AGENT LOUIS KUYKENDALL OF THE TENNESSEE BUREAU OFINVESTIGATIONS ALONG WITH OTHER MEMBERS OF THE USMS MIDDLE TENNESSEEFUGITIVE TASK FORCE AND THE MACON COUNTY SHERIFPS OFFICE, LOCATED ANDARRESTED RICHARD ELLWOOD AT HIS MOTHER'S RESIDENCE AT 1982 HANESTOWN ROADIN A RURAL AREA NEAR WESTMORELAND, TENNESSEE. AT THE TIME OF THE ARREST, THE .PREVIOUSLY MENTIONED STOLEN VEHICLE WAS ALSO RECOVERED AT THE SAME

RESPONSE TO DEFENDANT' S MOTION FOR

POST-CONVICTION RELIEF

COMES NOW, the State of Florida, by and through the

undersigned Assistant State Attorney, and responds to the

Defendant' s Motion for Post-Conviction Relief, pursuant to

Fla. R. Crim. P. 3. 850, and the Order of this Honorable Court, as

follows:

1. The allegations of the defendant that he was coerced into

entering the plea in this matter is refuted by the record. The

change of plea transcript (Exhibit I) reflects that the Court asked

the defendant if anyone threatened the defendant into entering his

change of plea, and the defendant stated that no one had threatened

him to change his plea (Exhibit I, pp. 13-14). The defendant was

also indicated that he felt that accepting the plea bargain

is what he wanted to do, was in his best interest, and that

no one was "twisting his arm" to accept the plea

( Exhibit I, p. . 9) . Additionally, the plea form ( Exhibit I I ) , which

was adopted and ratified during the change of plea (Exhibit I, pp.

6-8, 17-18), reflects that no one coerced the defendant into

changing his plea. Since the record conclusively refutes the

allegation of the defendant, relief must be summarily denied.

Alfred v. State, 7} So.3d 138 (Fla. 4th DCA 2011); Scheele v.

State, 953 So.2d 782 (Fla. 4th DCA 2007).

2. The allegation of the defendant that he was on psychotropic

medication at the time of the plea is without merit. This.Court

asked the defendant if he was on medication, and the defendant

stated that he was not (Exhibit I, p. 8) . Additionally, the change

of plea transcript refutes the allegation of the defendant that he

did not understand the procceedings (Exhibit I) . Since the record

conclusively refutes the allegations of the defendant, relief must

be summarily denied. Ezer v. State, 10 So.3d 1175 (Fla. 4th DCA

2009); Iacono v. State, 930 So.2d 829 (Fla. 4th DCA 2006).

3. The allegation of the defendant of an alleged discovery

violation is legally insufficient, because he fails to allege a

material prejudice. Duggan v. State, 588 So.2d 1054 (Fla. 1st DCA

1991) . Regardless, the transcript of the change of plea reflects

that the defendant knew and understood that there would be no

further pretrial discovery proceedings nor would there be a jury

trial by changing his plea (Exhibit I, pp. 12-13, 15-17) .

4. Although not perfectly pled, it appears that the defendant

is alleging that the sentencing order in this matter and it case

number 12-15004 CF should be running concurrently. The plea forms

in both matters reflect that the sentences on all cases and counts

are to run concurrently (Exhibits II and III) . The sentencing

orders, however do not reflect that the sentences are running

concurrently, which means that the defendant is serving consecutive

sentences (Exhibits IV and V). F.S. § 921.16. The plea transcript

notes that the plea form reflects the understanding of the

defendant as to the length of the sentences (Exhibit I, pp. 17-18) .

The fact that the sentencing transcript does not reflect that the

sentences in this matter and 12-15004 CF are not running

concurrently seems to be an oversight. Consequently the State

agrees that the sentencing orders in this matter and 12-15004 CF

should be corrected to reflect that the sentences are running

concurrently.

WHEREFORE, the State of Florida:

1. Respectfully requests that the Motion for Post-Conviction

Relief should be denied.

2. That the sentencing order in this matter and in case number

12-15004 CF be corrrected to reflect that the sentences as to both

matters are running concurrently.
