SUMMARY OF ALLEGATIONS:

On July 5, 2012, at approximately 6:00p.m., Officer Joseph Sims was supervising inmates •• and observed an inmate in N-1 dormitory chow line grasp his own identification card and stated "Bathroom." At approximately 6:04 p.m., he entered N-1 dormitory to conduct a security check and upon area, he observed Inmate Bruce Hunsicker lying in the shower floor

SUMMARY OF DISPOSITION/JUSTIFICATION FOR DOWNGRADE/EXONERATION:

As a result of this investigation, it is determined that Inmate Rocky Beamon and Valentin Reyes did commit Murder upon Inmate Bruce Hunsicker in violation of F.S.S. 782.04 (l)(a), the unlawful killing of a human being, (Murder-First Degree).

On March 7, 2014, the Fourteenth Judicial Circuit declined prosecution of Inmates Rocky Beamon and Valentin Reyes. Both inmates are serving a life sentence. They did not feel this was a death penalty case and another life sentence would be all they could get. They took into account the security risks associated with these inmates serving life sentences and the risks of transporting not only the Defendants, but also the inmate witnesses that would be utilized in the prosecution and their courtroom exposure. The case against Inmate Reyes was substantially weaker than that of Inmate Beamon and it was not felt the State

FINDINGS:

On July 5, 2012, at approximately 6:45p.m. (EST), I was notified by Inspector Supervisor Doug Glisson ofa Homicide at Apalachee Correctional Institution, East Unit in N-dormitory and I responded to the institution. Upon arrival it was discovered that Inmate Bruce Hunsicker #X09325 was found in the shower area of N-

at 6:05 m. by Officer Joseph Sims. Inmate Hunsicker was

Inspectors were on-site. Senior Inspector Cecil Smith and Inspector Supervisor Glisson was en-route. Florida Department of Law Enforcement (FDLE) was also en­route.

In his incident report and digitally recorded sworn statement of July 5, 2012, Officer Joseph Sims indicated the following:

Officer Sims was assigned as internal security officer and while working as N­dormitory inmates were returning to the dorm from chow, Inmate Rodriguez pointed at his identification badge and said bathroom. Officer Sims noticed other inmates looking at him and he thought something

might be going on. At approximately 6:04p.m., Officer Sims escorted inmates back into N-dormitory and went straight to the urinal area and did not see anything unusual. Officer Sims went left to the shower area, looked over the t~alf wall and saw Inmate um;i'tcke~r••••••

In her digitally recorded sworn statement ofJuly 5, 2012, Officer Kimberly Baxter indicated the following:

Officer Baxter was assigned toN-dormitory at approximately 2:35p.m., and she escorted some inmates out of the dormitory and remained on the yard until inmate count, she then returned to N-dormitory at approximately 4:00p.m. Officer Baxter conducted inmate count and all inmates were accounted for, she passed out legal mail. Sergeant Pearletha White was assigned as housing sergeant of N-dormitory and departed at approximately 4:49p.m., to assist in feeding the evening meal.

At approximately 5:25 p.m., Inmate Tavares Newman asked to clean up and went to the dayroom. Inmate Newman knelt down put. his finger over his mouth and put his thumb at his crotch area. Officer Baxter called Inmate Newman to' the officer's station window where she counseled Inmate Newman and he admitted he was going to masturbate at her. At approximately 5:27p.m., Officer Baxter called for assistance and Officer Sims entered and escorted Inmate Newman out of the dormitory. Officer Baxter was working on paperwork N-2 dormitory was called to go to the evening meal. N-1 was lining up to go to the evening meal and was later released to chow. At approximately 5:31 p.m., inmates began returning from to the dormitory. At approximately 6:00p.m., Officer Sims entered N-1 dormitory, went to the bathroom area. Officer Sims made a radio transmission, she did not understand, he then cal1ed via radio to the dormitory at approximately 6:30p.m. Officer Baxter did not bathroom area. Other staff entered N-dormitory and she was later relieved at approximately 7:00p.m. Officer Baxter did not witness any altercation and she was in the dormitory alone. (Exhibit Bl)

In her digitally recorded sworn statement of July 5, 2012, Sergeant Pearletha White indicated the following:

Sergeant White was assigned toN-dormitory and she was present in the dormitory during inmate count. Inmate count cleared at approximately 4:52 p.m., and all inmates were accounted for. Sergeant White departed to assist in the evening meal at approximately 4:49 p.m. Sergeant White returned when

witness any incident before she departed the dormitory. Inmates were on their bunks and everything was quiet. Officer Baxter was in the dormitory alone during the evening meal. (Exhibit Bl)

In the shift supervisor comment section on Officer Joseph Sims incident report dated July 5, 2012, Captain Michael Silcox indicated the following:

Captain Silcox responded to call for assistance in Nl-dormitory with the emergency Response Team. Upon his arrival · · · of the situation and he had discovered the body of Inmate Hunsicker. the dormitory and verified Inmate Hunsicker was deceased. All inmates were were ordered to their assigned bunks and Captain Silcox advised all staffto treat all areas of the dormitory as a crime scene. At approximately 6:07 p.m., Captain Silcox instructed all notifications to begin. The Rapid Response Team was activated. At approximately 6:35 p.m., entered the compound and departed at approximately 6:50p.m. (Exhibit Al)

There was no video recording ofany area inN]-dormitory at Apalachee Correctional Institution.

On July 5 and 6, 2012, Senior Inspector Cecil Smith assisted in preserving the crime scene for the investigation into the homicide of Inmate Bruce Hunsicker, in N1-dormitory. Inspector Smith secured the scene until the Medical Examiner Investigator and Crime Scene Analysis from FDLE arrived. Inspector Smith also took photographs ofthe crime scene. (Exhibit B3)

On July 5, 2012, Florida Department of Law Enforcement (FDLE) Crime Scene Unit, Carmin Clements and Jennifer Kay responded to Apalachee Correctional Institution and photographed and processed Inmate Bruce Hunsicker. Items of evidentiary value were searched and collected. The crime scene was also examined for biological type evidence. A total of seven (7) items were removed at the scene on that date. FDLE Analyst Carmin Clements advised she would be 1.forwarding the reports and a CD containing photographs taken.

On July 5, 2012, the Fourteenth Judicial Circuit Medical Examiner's Investigator, Rebecca Reid, arrived and processed the body for transport to the ME's Office. The body was transported to the ME's Office in Panama City, Florida, by Archer Funeral Home. An autopsy was conducted at 9:00a.m., CST, on July 6, 2012, and was attended by Senior Inspector Cecil Smith. Photographs were taken by the Medical Examiner's Office. Evidence, including clothing, fingernail clippings, DNA card and the right and left hand bags, were recovered from the body of Inmate Bruce Hunsicker. It was secured by Senior Inspector Smith and forwarded to Senior Inspector Randy Anglin to be secured and delivered to the Florida Department of Law Enforcement, Pensacola Regional Operations Center for processing. On July 12, 2012, Inmate Rocky Beamon was moved from Y dormitory cell 1106L, where he was housed alone, to 11 07L. Inside of cell Y -1106 writings were found on the inside of the cell door stating "Crash, 813-14-88, 7-5-12, murdered I molester in N-1 ". ("Crash" is identified as a nickname ofInmate Beamon.)

On July 17, 2012, Inspectors Michael ifcCord and Ilsa Hayes searched the personal property ofInmate Bruce Hunsicker where a few gambling sheets were found, but mostly where he kept statistics on races, nothing of evidentiary value.

On July 11, 2013, a manila envelope containing shoes of the victim, a -shaped weapon wtth 1:::::.The victims blue, pants,

tJ cloth wrapped around it, from Inmate Rocky Beamon and Inmate Valentin Reyes were submitted to FDLE for examination. (Exhibits Al3, B13, Bl5, B21- 824 &B29)

In his affidavit dated July 22, 2013, Inspector Michael McCord indicated the following:

On July 6, 2012, Inspector McCord was asked by Inspector Anglin to follow-up on some information we received regarding a possible murder weapon that had been flushed in a toilet in Nl-dormitory. Inspector McCord entered Nl-dormitory at approximately 8:18 a.m., and watched the vocational instructor and his assigned inmate work crew attempt to retrieve evidence from a floor drain. At approximately 9:55 a.m., Inspector McCord took possession of one white state towel, two tom state towels, one . of state boxer shorts and one T -shaped weapon with a cloth handle that appeared £ j

was removed from the floor drain. (The evidence was photographed) (Exhibits A14 & B25- B30)

Seventy-nine (79) inmates housed in N !-dormitory at the time of the alleged incident were interviewed during the course of the investigation by Senior Inspectors Randy Anglin, Cecil Smith, Inspectors Michael McCord and lisa Hayes. Thirty-eight (38) inmates provided digitally recorded sworn statements indicating either they did not see the incident, hear anything or they were sleeping at that time. Two (2) inmates refused to participate in interviews. (Exhibit 835)

During the course of this investigation and interview process Inmate Bruce Hunsicker was identified as "Nascar ", Inmate Valentine Reyes was identtfied as "Mexico" or "Lil Mexico. "

In his digitally recorded sworn statement dated July 5, 2012, Inmate Daniel Jackson indicated the following:

Inmate Jackson has known Inmate Hunsicker for approximately three and a half years. According to Inmate Jackson, he worked with Inmate Hunsicker earlier in the day. Inmate Hunsicker was fine and acted normal, nothing out of the ordinary. Inmate Jackson was not aware of any problems Inmate Hunsicker might have been having. Inmate Hunsicker told Inmate Jackson that he (Inmate Hunsicker) owed an inmate approximately $5.00, but had since paid off the debt. Inmate Jackson did not know the

inmate that Inmate Hunsicker owed. Inmate Jackson did not know anything further about Inmate Hunsicker's debt.

After count cleared, Inmate Jackson went to the front of the dormitory and played chess with an inmate nicknamed "Jihad." Inmate Jackson stated he was facing the officer's station. Inmate Jackson played chess until the dormitory was 'released for chow. Inmate Jackson did not recall any loud noises or anything out of the ordinary during that time. After chow was called, Inmate Jackson immediately departed the dormitory. Inmate Jackson did not know if anyone was showering during that time. Inmate Jackson also did not know iflnmate Hunsicker went to chow. Upon returning to the dormitory, Inmate Jackson went to his bunk and saw Inmate Hunsicker lying on the floor in the shower. Inmate Hunsicker's Inmate Jackson did not know if Inmate Hunsicker Inmate Jackson stated he did not check on Inmate Hunsicker, because he did not want anything to do with the situation. Numerous inmates looked at the body. Inmate Jackson believed someone notified an officer, because Officer Sims entered the dormitory and went straight to the shower area. Inmate Jackson then went to the front of the dormitory and began playing chess. (Exhibit B33)

In his digitally recorded sworn statement dated July 5, 2012, Inmate Larry Mobley indicated the following:

Inmate Mobley had been assigned to Nl-dormitory approximately a week and a half. Inmate Mobley knew the deceased inmate as "Nascar." Inmate Mobley had seen Inmate Hunsicker several times earlier in the day; however, he could not recall the times. Inmate Mobley departed his assigned dormitory prior to count on July 5, 2012, because Inmate Mobley did not notice anything unusual prior to departing the dormitory · . After Inmate Mobley was counted •••

•••in the dining hall, he walked over to wing 2 ofN-dormitory to speak with a friend. Inmate Mobley then departed the 1 dormitory with inmates from Wing 2 and ate chow again. During that time, Inmate Mobley saw Officer Sims escorting a black inmate from Nl-dormitory. After departing the dining hall, Inmate Mobley entered Nl-dormitory and saw a white inmate and a black inmate. Inmate Mobley then proceeded to his bunk and then the sink to rinse his mouth. At the sink, Inmate Mobley saw Inmate Hunsicker lying on the floor in the shower area. Inmate Hunsicker appeared to be dead. At that time, Inmate Mobley heard someone state, "Don't mess with him!" Inmate Mobley did not know who made the statement. Inmate Mobley returned to his bunk Nl-166S. Inmate Mobley did not see anyone take a shower during that time. There were numerous inmates in the dormitory talking about the incident. Inmate Mobley did not listen to them, as he was busy discarding contraband from his locker. Most inmates in the dormitory were doing the same, because everyone knew that the dormitory was going to be searched by officers. Inmate Mobley did not see anyone acting suspicious or anyone with blood on them. Inmate Mobley did not know why Inmate Hunsicker was stabbed. (Exhibit B33)

Inmate Jones had been assigned to Nl-dormitory approximately five months. Inmate Jones slept in the bunk next to Inmate Hunsicker. According to Inmate Jones, there were inmates in the dormitory that did not care for Inmate Hunsicker, because Inmate Hunsicker was a sex offender. Inmate Jones could not identify those inmates. After count cleared, Inmate Jones remained on his bunk until chow was called. Inmate Jones believed Inmate Hunsicker remained on his bunk as well. Inmate Jones saw Inmate Hunsicker go to chow with the dormitory. Inmate Hunsicker returned to the dormitory before Inmate Jones, because Inmate Jones- Upon returning toN-dormitory, Inmate Jones noticed approximately half of the inmates assigned to Wing 1 had returned from chow. Inmate Jones went to the sink to wash his hands and saw Inmate Hunsicker lying on the floor in the shower area. Inmate Jones did not check on Inmate Hunsicker, because Inmate Hunsicker appeared to be dead. Inmate Jones saw a black inmate taking a shower during that time. Inmate Jones did not know the black inmate. Inmate Jones returned to his bunk and an officer entered the dormitory and discovered Inmate Hunsicker's body. (Note: Prior' to obtaining Inmate Jones' recorded statement, Inmate Jones stated Hispanic inmates were involved. Inmate Jones would not provide any further iriformation out offear for his safety.) Inmate Curi had been assigned to Nl-dormitory approximately one month. Inmate Curi did not know the deceased inmate. According to Inmate Curi, Inmate Hunsicker appeared to be a quiet inmate. After count cleared on July 5, 2012, Inmate Curi went to the front ofthe dormitory to play cards. Inmate Curi was facing the officer's station. Sometime during the card game, a female officer in the officer's station accused a black inmate of masturbating in the dayroom area. An officer entered the dormitory and removed the black inmate. Inmate Curi remained at the card table until the officer called for chow. Inmate Curi did not hear anything unusual in the dormitory prior to departing for chow. Upon Inmate Curi's return to the dormitory, he saw most of the dormitory had returned from chow. Inmate Curi went towards his bunk and saw numerous inmates into the shower area. saying that the inmate was "blue." Inmate Curi said a black inmate was taking a shower during that time. An officer told the inmate to get out of the shower. Inmate Curi did not know the black inmate in the shower. Inmate Curi went to the sink and washed off. Inmate Curi did not see any inmates with blood on them in the dormitory. Inmate Curi stated someone in the dormitory had to have seen the inmate being stabbed. Somebody told the officer something, because the officer went straight to tlue shower area after entering the dormitory. (Exhibit 833)

At approximately 4:45 p.m., Inmate Gibson saw a white inmate-- go to the shower after count like he does every day. A short stocky Mexican (Inmate Valentin Reyes) and a bald headed white inmate (Inmate Rocky Beamon) followed the white inmate (Inmate Bruce Hunsicker) into the shower. The Mexican (Inmate Reyes) had a V shaped, wide weapon and the white inmate (Inmate Beamon) had a round poker (Ice Pick) type weapon that appeared to be approximately six to eight inches long. The white inmate (Inmate Beamon) '~as wearing blue pants, white t-shirt, Nike shoes and a towel. The Mexican inmate (Inmate Reyes) was wearing blue pants and at-shirt. They began talking to the white inmate (Inmate Hunsicker) and then began stabbing him. The Mexican (Inmate Reyes) and white inmate (Inmate Beamon) washed themselves off in the shower and then exited the shower wearing their boxers and at-shirt. The Mexican (Inmate Reyes) went to his bunk, third bunk from shower area against the wall (N-1112). The white inmate (Inmate Beamon) went to the bathroom and Inmate Gibson heard something tearing. The drains stopped up in the bathroom and Inmate Gibson thinks it is because the white inmate (Inmate Beamon) · The white inmate (Inmate Beamon) came out of the bathroom Both inmates got dressed and went to chow.

Upon returning to N-dormitory after chow, Inmate Reyes saw numerous inmates in the dormitory. Inmate Reyes returned to his bunk and listened to his radio. Inmate Reyes did not see anyone with blood on them or acting suspicious. Inmate Reyes did see a black inmate taking a shower sometime later. Inmate Reyes did not know the black inmate that was taking the shower. Inmate Reyes stated at some point he saw somebody's feet in the shower. Prior to departing the dormitory to be interviewed, Inmate Reyes learned that an inmate had been stabbed. Inmate Reyes did not hear anyone in the dormitory talking about an inmate had been stabbed. Inmate Reyes did not know what happened to the inmate that had been stabbed. According to Inmate Reyes, black inmates pick on the white inmates that are gay. (Exhibit 833)

In his digitally recorded sworn statement dated July 6, 2012, Inmate Raymond Sanchez indicated the following:

Inmate Sanchez knew the deceased inmate as "Nascar." Inmate Sanchez did not recall ever speaking with Inmate Hunsicker. Inmate Sanchez described Inmate Hunsicker as a loud inmate that caused problems for other inmates. Iru:pate Sanchez did not recall seeing Inmate Hunsicker in the dormitory earlier in the day. After count eleared, Inmate Sanchez went to the front of the dormitory and began playing chess. Inmate Sanchez was facing the officer's station. At some point, Inmate Sanchez lost and left the table to return to his bunk Nl-180S. Inmate Sanchez did not see or hear anything unusual or suspicious during that time. Inmate Sanchez then departed the dormitory for chow. Upon returning to the dormitory, Inmate Sanchez returned to his bunk. Inmate Sanchez did not hear anyone talking about the incident. Officer Sims entered the dormitory and found Inmate Hunsicker in the shower area. Inmate Sanchez did not see anybody stab anyone. Inmate Sanchez stated he

had nothing to do with the stabbing. (Exhibit 833)

Sometime after count cleared, but before chow, Inmate Crockett noticed no one was taking a shower, which was unusual. Numerous inmates were looking towards the area. Inmate Crockett initially thought an inmate had been raped in the shower area. Inmate Crockett then saw two short Hispanic looking inmates in boxers departing the area with towels. Inmate Crockett did not know if they had just taken a shower or if they were planning to take a shower and decided not to. Inmate Crockett was sitting in the front of the dormitory and it was very hard to see. Inmate Crockett did not see anybody stab anyone. One of the Hispanic inmates slept in the middle of the dormitory and the other Hispanic inmate slept in the back of the dormitory near the showers. Inmate Crockett saw the Hispanic inmates congregating in the dormitory. ' . (Exhibit B33)

Inmate Hunsicker did not appear to be in fear or act as if he was having any problems. After count cleared, Inmate Martin went to the front of the dormitory to watch inmates play cards. Inmate Martin was facing the shower area. Inmate Martin did not see anything unusual or suspicious during that time. After chow was called, Inmate Martin departed the dormitory. Inmate Martin said he was the last inmate to enter the dormitory after chow. Inmate Martin immediately went to the restroom area and washed off in the sink. Inmate Martin did not see Inmate Hunsicker during that time. Inmate Martin then saw Officer Sims, who told him to depart the area. Inmate Martin then saw Inmate Hunsicker on the shower floor. Inmate Martin did not see anybody stab anyone. (Exhibit B33)

In his digitally recorded sworn statement dated July 6, 2012, Inmate Steven Brinker indicated the following:

Inmate Brinker said he was washing his hands in the sink when he turned and saw four inmates attacking Inmate Hunsicker. Three of the inmates were hitting Inmate Hunsicker and one was stabbing Inmate Hunsicker with a homemade weapon. The inmate stabbing Inmate Hunsicker was a nice looking, clean-shaven Mexican inmate with tattoos on both of his arms. That inmate slept in N 1-127L. (Note: ident(fied as Inmate Andrew Robles.) Inmate Brinker stated the inmate assigned to N l-177S might have also been stabbing Inmate Hunsicker, but he was not certain. (Note: N 1-1778 was identified as Inmate Rocky Beamon.) Inmate Brinker did not hear anything, because he had headphones on. Inmate Brinker saw Inmates "Reyes" and Beamon showering after the incident and washing clothes. (Note: Inmate "Reyes" was identified as Inmate Valentin Reyes.) The other Mexican inmate involved slept in Bunk #Nl-167S. (Note: Angeles.) Inmate Brinker stated Inmates Robles and Angeles threw and Inmates Reyes and Beamon washed them. The inmates took the clothes to the Dining Hall and handed them off to another inmate. Inmate Brinker saw the inmates hand their clothes off, but he did not know the inmate who received them. Inmate Brinker stated Inmate Angeles hid a homemad~.e and traded his shoes at the dining hall. Inmate Brinker Beamon'~after the incident and Inmate Beamon All of the inmates in the back of the

dormitory witnessed the incident. Inmate Brinker looked at the officer and she was sitting in the Officer's Station. There was a lot of movement in the dormitory during the time that the inmate was being stabbed. N1-dormitory has been out of control for months.

According to Inmate Brinker, Inmate Hunsicker worked for an older, stocky, Mexican inmate with one front tooth that was assigned to M2-dormitory. Inmate Hunsicker messed up that inmate's money on a gambling ticket. (Exhibit 833)

In his digitally recorded sworn statemeqt dated July 6, 2012, Inmate Jonathan Frazier indicated the following: I

Inmate Frazier had been assigned to N !-dormitory approximately two months. Inmate Frazier knew Inmate Hunsicker from Apalachee C.I. West Unit, as they had been housed there together for approximately a year. According to Inmate Frazier, Inmate Hunsicker was not a problem inmate and made money sewing and washing other inmates' clothing. Inmate Frazier was unaware of Inmate Hunsicker having any enemies. Inmate Frazier saw Inmate Hunsicker walking to the shower after count cleared. Inmate Hunsicker was always the first inmate in the shower after count. Inmate Frazier believed that he heard Inmate Hunsicker yell for an inmate to tell the officer to turn the shower on. According to Inmate Frazier, Inmate Hunsicker did not appear to be in fear of anyone and there did not appear to be any tension in the dormitory. Inmate Frazier remained at his bunk N1-134S reading after count cleared. Inmate Frazier did not see anybody stab anyone nor did he hear or see anything unusual or suspicious. After the officer called for chow, Inmate Frazier departed the dormitory. Inmate Frazier stopped ·prior to returning toN-dormitory. When Inmate Frazier returned to the dormitory, he went to his bunk and began reading. Officer Sims found Inmate Hunsicker's body in the shower. There was a black inmate taking a shower during that time. Inmate Frazier did not know the black inmate. (Exhibit B33)

Inmate Mosley had been assigned to N !-dormitory approximately six months. Inmate Mosley knew the deceased inmate as "Nascar." According to Inmate Mosley, Inmate Hunsicker was a humble inmate that took everything very serious. After count cleared, Inmate Mosley was speaking with an inmate that was teaching him how to draw. After returning from chow, Inmate Mosley went to his bunk. Inmate Mosley never went to the shower area and never saw anybody stab anyone nor did he see anyone with blood on them. (Exhibit B33)

Inmate Thomas had been assigned toNI-dormitory approximately three days. Inmate Thomas did not know the deceased inmate. After count cleared on July 5, 20I2, Inmate Thomas immediately went to the dayroom to watch television. According to Inmate Thomas, there were approximately five inmates in the dayroom during that time. Just prior to chow, Inmate Thomas saw an officer having a problem with a black inmate in the front of the dormitory. Officer Sims entered the dormitory and escorted the black inmate out of the dormitory. Inmate Thomas then departed the dormitory for chow. Upon returning to N-dormitory, Inmate Thomas went to his bunk and changed clothes. During that time, Inmate Thomas heard Officer Sims calling for assistance. Inmate Thomas did not see anyone in the shower area during that time. Inmate Thomas did not see anybody stab anyone. (Exhibit B33)

Inmate Joyner stated that after count cleared, he began playing cards again and was facing the inmate showers. Inmate Joyner did not see or hear anything unusual during that time. Inmate Joyner played cards until the officer called for chow. Inmate Joyner was located near the middle of the line when the dormitory was released for chow. Inmate Joyner stated he did not see anyone with blood on them or acting suspicious · that time. Inmate Joyner did not immediately return to the dormitory after chow, As Inmate Joyner was returning to the dol11'[litory, he saw Officer runnmg toN-dormitory. Upon entering the dormitory, Inmate Joyner sat down to play cards. Inmate Joyner did not recall seeing anyone taking a shower during that time. As soon as Inmate Joyner sat down, Officer Bell told everyone to get on their bunks. Inmate Joyner heard an officer state that an inmate had been stabbed. Inmate Joyner did not know why Inmate Hunsicker had been stabbed. (Exhibit B33)

In his digitally recorded sworn statement dated July 6, 2012, Inmate William Davies indicated the following:

Inmate Davies had been assigned to N1-dormitory approximately three weeks. Inmate Davies is assigned to Bunk Nl-143S. Inmate Davies knew the deceased inmate as "Nascar." Sometime after count, but before chow, Inmate Davies heard a noise (Inmate Davies was unable to describe the noise) and turned to the shower area and saw a short Mexican inmate's head pop up. The short Mexican inmate slept in bunk N1-112L (Inmate Valentin Reyes). Inmate Davies was speaking with another inmate at the time and continued his conversation. Inmate Davies then saw movement in the shower area out of the comer of his eye. At that time, Inmate Davies turned and saw a white inmate's head pop up. The white inmate slept in N1-177S (Inmate Rocky Beamon). Inmate Davies was unable to see what the two inmates were doing due to a half-wall blocking his view. Sometime after that, Inmate Davies saw the Mexican inmate (Inmate Reyes) dry off and get dressed. Inmate Davies did not know if the Mexican inmate (Inmate Reyes) showered due to a wall blocking his view of the area. Inmate Davies then saw the white inmate (Inmqte Beamon) depart the shower area and walk towards the toilet area. Inmate Davies assumed that the 1.White inmate (Inmate Beamon) was flushing something, because he heard a toilet being flushed two or three times. The white inmate (Inmate Beamon) then departed the toilet area, went to his bunk, dried off, and departed the dormitory for chow. Inmate Davies did not see the inmates carrying any weapons. Inmate Davies saw them carrying soap and towels. Inmate Davies also departed the dormitory for chow. When Inmate Davies returned from chow, he sat on his bunk. Inmate Davies never went over to the shower area. Inmate Davies later found out that Inmate Hunsicker had been stabbed in the shower area. Inmate Davies never saw anybody stab anyone. Inmate Davies only saw the two inmates' heads pop up. (Exhibit B33)

In his digitally recorded statement dated July 6, 2012, Inmate Jamie Gordon indicated the following:

Inmate Gordon had been assigned to N1-dormitory approximately three months. Inmate Gordon knew the deceased inmate as "Nascar." Inmate Gordon described Inmate Hunsicker as "harmless, but controversial." Inmate Hunsicker enjoyed debating issues. Numerous inmates shunned Inmate Hunsicker, because of his charges. Inmate Hunsicker was very open about his charges and on one occasion told an inmate that he did not penetrate his victim. Inmate Gordon did not speak or associate with Inmate Hunsicker for that reason. After count cleared on July 5, 2012, Inmate Gordon went to the front of the dormitory to watch other inmates play cards. Inmate Gordon did not see or hear anything unusual or suspicious during that time. Inmate Gordon then departed the dormitory for chow. Upon returning to the dormitory, Inmate Gordon went to his bunk to draw. Inmate Gordon said he did not go to the shower area. Inmate Gori:fon did not see anybody stab anyone nor did he see any inmates with blood on them. Inmate Gordon did not know what happened to Inmate Hunsicker. (Exhibit B33)

In his digitally recorded sworn statement dated July 6, 2012, Inmate Henry Davis indicated the following:

Inmate Davis had been assigned to N !-dormitory approximately six months. Inmate Davis did not know the deceased inmate. After count cleared on July 5, 2012, Inmate Davis went to the front of the dormitory to play cards. Inmate Davis was facing the officer's station and did not hear anything suspicious or out of the ordinary during that time. Inmate Davis remained at the card table until he departed for chow. After chow, Inmate Davis returned to the card table. Inmate Davis did not see or hear anything suspicious during that time. Inmate Davis later saw Officer Sims conduct a security check and tell all of the inmates to get on their bunks. Inmate Davis never saw anybody stab anyone nor anyone with blood on their clothing. Inmate Reese did not witness the incident as he was in the front of the dorm for most of the afternoon and did not notice anything until the responding officer entered the dorm. Inmate Reese did not know the victim. (Exhibit 833)

to the shower area. When he got to the shower area, he saw an inmate lying on the floor. Inmate Rodas did not witness what happened to the inmate. (Exhibit 833)

In his digitally recorded sworn statement dated July 6, 2012, Inmate James Edsall indicated the following:

Inmate Edsall returned to the dorm from work and went to sleep, he was awakened for count and after count cleared, he went back to sleep. Inmate Edsall was awakened by the officer calling for assistance. Inmate Edsall never got off of his bunk nor witnessed any incident. (Exhibit 833)

In his digitally recorded sworn statement dated July 6, 2012, Inmate Alphonso Benjamin indicated the following:

Inmate Benjamin was in the chow hall -and was not in the dormitory during count. Inmate Benjamin returned to the dorm prior to the dorm being released for chow. Inmate Benjamin gathered his shower things and went to the shower; he then saw a body lying on the floor. Inmate Benjamin returned to his bunk and stayed there until an officer came in the door and found the body.

Prior to this incident, someone had taken some of Inmate Hunsicker's property and Inmate Hunsicker confronted the whole dormitory about the incident and called anyone involved a bunch of "fuck faces" (to no particular person). On July 5, 2012, Inmate Lapton remained on his bunk after chow and went directly out of the dorm when the door was opened. Inmate Lapton did not witness any incident in the dormitory. (Exhibit 833)

In his digitally recorded sworn statement dated July 6, 2012, Inmate Lewis McFadden indicated the following:

After count cleared, Inmate McFadden witnessed Inmate Hunsicker motion to the officer to turn the showers on. Inmate Hunsicker then headed to the shower area. Inmate McFadden stated that was a daily routine and did not pay much more attention to Inmate Hunsicker after that time. Inmate McFadden did not witness any incident in the dopnitory. (Exhibit 833)

In his digitally recorded sworn statement dated July 6 2012, Inmate Dennis Elliot indicated the following:

Two days prior, Inmate Hunsicker had his combination lock and one of his shoes stolen. Inmate Hunsicker addressed the dormitory about someone taking his property and called who ever took it a "punk and a bitch" and told them to come see him. Inmate Elliot also witnessed an unknown black inmate on this same date.

On July 5, 2012, approximately two hours before the evening meal, Inmate Hunsicker was involved in an argument with a black inmate and the black inmate told Inmate Hunsicker to get out of his face

Officer Sims came in the dormitory and looked over the shower wall and saw the inmate lying in there. There was an unknown tall black inmate bathing in the sink. (Exhibit B33)

Inmate Rodriguez did not witness what occurred behind the wall. When Inmate Beamon came out of the shower he was wearing blue pants and a t-shirt with something in his hand. Inmate Beamon on the

When Inmate Rodriguez returned from chow he went back to the area and saw that Inmate Hunsicker Inmate Rodriguez did not stop or look v~ry long. Inmate Rodriguez has heard Inmate Beamon comments about killing a pedophile, but he 's always joking around. Inmate Rodriguez did not witness any other inmate in the shower with Inmate Beamon, he acted alone. Inmate Hunsicker was always cleaning and in everyone's business. (Exhibit B33)

In an interview ofJuly 6, 2012, Inmate Donald Waters refused to provide a recorded statement, but indicated the he saw an unknown Hispanic inmate in the back shower before chow. "Nascar" (Inmate Hunsicker) was usually in the shower before chow, but did not see him. Inmate Waters did not witness anything or hear anything.

Inmate Robles was assigned to N-1127 and Inmate Hunsicker slept behind him. On July 5, 2012, he was asleep during inmate count and after count he went to chow. Inmate Robles denied having an altercation with Inmate Hunsicker, denied committing battery or having any involvement in the death of Inmate Hunsicker. Inmate Hunsicker's nickname was "Nascar". A couple days prior to the incident someone took some of Inmate Hunsicker's property and he made an outburst toward the dormitory about his property. Some inmates don't like sex offenders. Inmate Hunsicker was loud and argues with inmates he knew. (Exhibit 833)

In his digitally recorded sworn statement of August 1, 2012, Inmate Andrew Robles was advised of his Constitutional Rights and he waived his rights and indicated the following:

Inmate Robles requested to speak to an inspector to tell what he saw on July 5, 2012. Inmate Robles said Inmate Beamon told him he confessed to the murder of Inmate Hunsicker and Inmate Robles felt he needed to tell what he witnessed. On the night of the incident, he did not want to have to go to court or inmates to think he was telling on them. On July 5, 2012, at approximately 3:30p.m., he returned toN­dormitory and fell asleep during count. When he woke up, one of his brothers "John" (13 on back of neck) told Inmate Robles to get his "stuff right" (clean out his locker ofany contraband), the "police" is about to rush the dormitory. The inmate told him a white inmate just got stabbed in the bathroom. Inmate Robles looked back toward the shower and did not see anything. "John" said he is dead and

'walked off. Inmate· Robles looked around the dormitory and a lot of the inmates were toward the front of the dormitory. Inmate Robles stood up to look toward the shower and saw a little Mexican (Inmate Reyes), (Sleeps in N-1112, back ofdorm on left against the wall) facing him and Inmate Beamon was leaning down as if they were moving something in the shower. The Mexican (Inmate Reyes) came out of the shower fast, took off his shirt and wiped his hands. Inmate Beamon starts washing his hands and both went to their bunks. Inmate Robles asked his friend who got killed and was told the inmate that slept next to him (Robles). The 'friend said the white inmate (Inmate Beamon) killed him and did not know what the Mexican (Inmate .keyes) was doing. Inmate Robles went to his locker and removed some tape and disposed of it. Approximately thirty minutes later, the dormitory went to chow and when he returned a black inmate was taking a shower. Inmate Robles said the Mexican (Inmate Reyes) was short, low cut hair, some tattoos, does not speak good English and thinks he is on interstate compact.

Officer Sims came in the dormitory and went to the bathroom area and then to the shower and looked over the wall and told the inmates to get on their bunks. Inmate Robles denied witnessing the incident, denied taking a weapon or shoes out of the dormitory. (Exhibit 833)

In his digitally recorded sworn statement of July 9, 2012, Inmate Rocky Beamon was advised of his Constitutional Rights and he waived his rights and indicated the following:

Inmate Beamon said he did not know the inmates name, but found out he was a child molester. Inmate Beamon confronted the inmate (Hunsicker) about it and Inmate Hunsicker told him, he did not see anything wrong with it as long as there was no penetration with the penis. Inmate Beamon had no plans to act on it until Inmate Hunsicker told him that. Inmate Beamon said he found out three months ago his son was molested. It brought back a lot ofmemories and Inmate Beamon did not want anyone else to go through it when Inmate Hunsicker got out of prison. Inmate Beamon took it upon himself to stop it. Inmate Beamon made the decision approximately thirty minutes before Inmate Hunsicker got into the shower. Inmate Beamon said he could not so he took the rage and anger out on Inmate Hunsicker. Inmate Beamon had been to Inmate Hunsicker to see what goes through those peoples mind.

Inmate Beamon watched Inmat~ Hunsicker for three days. Every day after 4:00 p.m., count Inmate Hunsicker went to the shower. Inmate Beamon's intent was to scare Inmate Hunsicker by pulling a knife and putting him on the wall. Inmate Beamon did not have it on his mind to kill him. When Inmate Beamon pulled the knife, Inmate Hunsicker slung his hands and Inmate Beamon •••

After inmate count and before the evening meal Inmate Beamon went into the shower, walked up behind Inmate Hunsicker and grabbed him around the throat and threw him on the floor. Inmate Hunsicker was on top of Inmate Beamon and Inmate Beamon wrapped his legs around Inmate Hunsicker. Inmate Beamon stabbed Inmate Hunsicker £md Inmate Hunsicker began yelling and Inmate Beamon started -and stabbed three or four more times. Inmate Beamon stabbed Inmate Hunsicker some mo~nmate Beamon realized what he was doing, Inmate Hunsicker was still moving, so he stabbed him some more Inmate Beamon did not know how many times he stabbed Inmate Hunsicker. Inmate Beamon took a shower to clean himself off and went to the bathroom and flushed his clothes in the third toilet. Inmate Beamon was only wearing his boxers and a pair of crocks. Inmate Beamon broke the knife in half, ripped his boxers and towel and flushed them down the toilet. Inmate Beamon noticed Inmate Beamon went to chow .-. Someone told an . cer because an officer came to the dormitory after chow. Inmate

In his digitally recorded sworn statement of August 1, 2012, Inmate Rocky Beamon was advised of his Constitutional Rights and he waived his rights and indicated the following: Inmate Beamon requested to speak to an inspector.

Inmate Beamon was approached by a little Spanish inmate who asked him if he would be willing to help get rid of an inmate. Inmate Beamon did not know the Spanish inmates name, but they call him "Lil Mexico" who sleeps against the wall, third bunk from back close to the showers. (Identified as Inmate Valentin Reyes) When Inmate Beamon found out it was "Nascar" he told the inmate he would. Originally it was going to be done on Sunday night while Inmate Hunsicker was lying on his bunk.

On July 5, 2012, Lil Mexico (Inmate ReyesJ came to him and said they were going to do it after 4:00 p.m., count in the shower. After count, Inmate Beamon went to Lil Mexico's (Inmate Reyes) bunk. Inmate Hunsicker went to the shower and Lil Mexico (Inmate Reyes) said let's do it now. Inmate Beamon went into the shower behind Inmate Hunsicker and grabbed him around neck from behin .. _ -with his right arm and threw Inmate Hunsicker on the shower floor. Inmate Hunsicker was lying on top of Inmate Beamod to the left side and "Mexico" (Inmate Reyes) began stabbing Inmate Hunsicker. Mexico (Inmate Reyes) had a t-shaped piece of metal approximately seven inches long. Inmate Beamon lost count on how many times Mexico (Inmate Reyes) stabbed Inrriate Hunsicker, but it· was over fifty times. Inmate Hunsicker was attempting to push Mexico (Inmate Reyes) away and Inmate Beamon attempted to gr~unsicker's hands with his left hand when Mexico (Inmate Reyes) stabbed Inmate Beamon- Inmate Beamon then grabbed Inmate Hunsicker around the throat again. Inmate Beamon denied stabbing Inmate Hunsicker, but held him while Mexico (Inmate Reyes) stabbed him. Mexico (Inmate Reyes) broke the weapon in half and Inmate Beamon flushed their boxers, towels and the weapon in the toilet. No other inmates were involved in the incident.

Inmate Beamon said he confessed to the murder in the beginning because he had a life sentence and there was no reason for both of them to get charged. When he found out the inspectors had Mexico (Inmate Reyes), Inmate Beamon wanted to tell everything that occurred. (Exhibit B34)

In his digitally recorded sworn statement of August 1, 2012, Inmate Valentin Reyes was advised of his Constitutional Rights and he waived his rights and indicated the following:

Inmate Reyes said he was sitting on his bunk during inmate count, then went to chow, returned and an officer went to the shower and yelled for everybody to get on their bunks. Inmate Reyes denied witnessing anything involving th¢ alleged incident and denied being involved in the murder of Inmate Hunsicker. Inmate Reyes indicat~d he gave another inspector a statement. The FDLE Laboratory Report dated August 21, 2013, authored by Chan documented the nail clippings from right and left hand of victim. blue, and left shoes of the victim, a T -shaped weapon with from Inmate Rocky Beamon and Inmate Valentin Reyes were examined and due to the limited nature of these results, the data is insufficient for inclusion purposes. (Exhibit Al7)

On September 3, 2013, I met with Assistant State Attorney Shad Redmon, Fourteenth Judicial Circuit along with Inspectors Michael McCord and lisa Hayes. The case was presented to ASA Redmon and a Draft Copy of the report was submitted to him for review.

On October 7, 2013, ASA Shad Redmon called requesting other evidence be submitted for examination. On October 11, 2013, the following evidence was submitted to FDLE Laboratory which consisted of one pair of state issued boxer shorts, three torn white state towels and a plastic bag used during the drying process of these items which were found in the toilet drain inN-dormitory. (Exhibits A18, B25- B28 & B30)

The FDLE Laboratory Report dated October 31, 2013, authored by Analyst Berenger Chan documented the boxer shorts, the three white towels an~ the plastic bag gave chemical indications ••1 Due to the complexity of the mixture, Inmates Beamon and Reyes were excluded as contributors to the mixed DNA profile. Inmate Hunsicker was included as a possible contributor to some of the items and excluded from others. (Exhibits A19, B25- B28 & B30)

On March 18, 2014, I received two letters from the Office of the State Attorney, Shad Redmon of the Fourteenth Judicial Circuit declining prosecution of Inmates Rocky Beamon and Valentin Reyes. Both inmates are serving a life sentence. They did not feel this was a death penalty case and another life sentence would be all they could get. They took into account the security risks associated with these inmates serving life sentences and the risks of transporting not only the Defendants, but also the inmate witnesses that would be utilized in the prosecution and their courtroom exposure. The case against Inmate Reyes was substantially weaker than that of Inmate Beamon and it was not felt the State could prevail with Inmate Reyes prosecution under the best circumstances.
