The information contained in this report summarizes new, interim, and final actions taken by the

Oregon Medical Board between September 16, 2018, and October 15, 2018.

Scanned copies of Interim Stipulated Orders, Orders of Emergency Suspension, Stipulated

Orders, Final Orders, Termination Orders, Modification Orders and Voluntary Limitations are

included at the end of this report in the order that they appear in the report. These orders are

marked with an * asterisk. Scanned copies of Consent Agreements are not posted, as they

are not disciplinary action and impose no practice limitations. Complaint and Notices of

Proposed Disciplinary Action are not listed in this report, as they are not final actions by the

Board. Both Orders, however, are public and are available upon request.

On October 4, 2018, Licensee entered into a Corrective Action Agreement with the Board. In

this Agreement, Licensee agreed to complete a pre-approved course on prescribing to treat

chronic pain; complete 20 hours of pre-approved CME relating to prescribing; be subject to

no-notice chart audits and office visits by the Board's designee; and establish and maintain

care with a healthcare provider.

On October 4, 2018, Licensee entered into a Stipulated Order with the Board for

unprofessional or dishonorable conduct; gross or repeated acts of negligence; willful violation

of any rule adopted by the Board; and prescribing controlled substances without a legitimate

medical purpose or without following accepted procedures for examination of patients or for

record keeping. This Order reprimands Licensee; suspends Licensee from the practice of

medicine for 15 days; assesses a $2,500 civil penalty; places Licensee on probation for 10

years; restricts Licensee from prescribing stimulants; restricts Licensee from treating chronic

pain with any DEA scheduled medications; limits Licensee's treatment of acute or intermittent

pain and restricts licensee's prescribing of concurrent benzodiazepines or muscle relaxants

with Schedule II or III medications; requires Licensee to complete a pre-approved CPEP

initiating chronic pain treatment with opioids; maintain or taper current patients to 90 MED or

less or transfer care of the patient; limit prescribing for acute pain; taper concurrent

benzodiazepines or transfer care of the patient; and upon completion of the benzodiazepine

tapering, cease prescribing concurrent benzodiazepines with opioids pending the completion of

the Board's investigation into his ability to safely and competently practice medicine.

On October 3, 2018, Licensee entered into a Consent Agreement for Re-Entry to Practice with

the Board. In this Agreement, Licensee agreed to practice under the supervision of a pre-

approved mentor for six months, to include chart review and reports to the Board by the

mentor.

On October 4, 2018, Licensee entered into a Corrective Action Agreement with the Board. In

this Agreement, Licensee agreed to complete a pre-approved course on professionalism.

9 The Oregon Medical Board (Board) is the state agency responsible for licensing,

10 regulating and disciplining certain health care providers, including physicians, in the State of

11 Oregon. Alan Cleve Compton, Jr., MD (Licensee) is a licensed physician in the State of Oregon

12 and holds an active license.

13 2.

14 Licensee is a board certified family medicine physician practicing in Hillsboro, Oregon.

15 The Board opened an investigation after receiving a complaint in regard to Licensee’s manner of

16 prescribing combinations of controlled substances (opioids and benzodiazepines) for patients.

17 3.

18 Licensee and the Board now desire to settle this matter by entty of this Agreement.

19 Licensee understands that he has the right to a contested case hearing under the Administrative

20 Procedures Act (chapter 183), Oregon Revised Statutes. Licensee fully and finally waives the

21 right to a contested case hearing and any appeal therefrom by the signing of and entry of this

22 Agreement in the Board’s records. The Board agrees to close the current investigation and does

23 not make a finding in regard to any violation of the Medical Practice Act. This Agreement is a

24 public document; however, it is not a disciplinary action. This document is reportable to the

24 National Practitioner Data Bank and the Federation of State Medical Boards.

2 In order to address the concerns of the Board and for purposes of resolving this

3 investigation, Licensee and the Board agree that the Board will close this investigation

4 contingent upon Licensee agreeing to the following conditions:

5 4.1 Within six months from the signing of the Agreement by the Board Chair,

6 Licensee agrees to successfully complete a course on prescribing to treat chronic pain that has

7 been pre-approved by the Board’s Medical Director.

8 4.2 Subsequent to the completion of term 4.1, and within one year of the effective

9 date of this Agreement, Licensee agrees to complete 20 hours CME related to prescribing which

10 have been pre-approved by the Board’s Medical Director. These hours may not be applied to the

11 mandatory CME hours required for license renewal.

12 4.3 Licensee’s practice is subject to no-notice office visits and/or chart audits by the

13 Board’s designee(s).

14 4.4 Licensee agrees to establish and maintain care with a primary care healthcare

15 provider.

16 4.5 Licensee must obey all federal and Oregon State laws and regulations pertaining

17 to the practice of medicine.

18 4.6 Licensee agrees that any violation of the terms of this Agreement constitutes

19 grounds to take disciplinary action under ORS 677.190(17).

10 Oregon. Daniel Elliott Drew MD (Licensee) is a licensed physician in the state o f Oregon.

12 On M arch 20 ,2017, the Board issued a Complaint and Notice o f Proposed Disciplinary

13 Action (Notice) in which the Board proposed taking disciplinary action by imposing up to the

14 maximum range o f potential sanctions identified in ORS 677.205(2), to include the revocation of

15 license, a $ 10,000 civil penalty, and assessment o f costs, against Licensee for violations o f the

16 Medical Practice Act, to wit: ORS 677.190(l)(a) unprofessional or dishonorable conduct, as

17 defined in ORS 677.188(4)(a); ORS 677.190(13) gross or repeated acts o f negligence; ORS

18 677,190(17) willful violation o f any rule adopted by the Board; and ORS 677.190(24)

19 prescribing controlled substances without a legitimate medical purpose or without following

20 accepted procedures for examination o f patients or for record keeping. Prior to the issuance o f

21 the Notice, on July 6 ,2016 , Licensee entered into an Interim Stipulated Order w ith the Board in

22 which he voluntarily agreed to prescribing restrictions for chronic pain patients. On December

23 18,2017, Licensee entered into a second Interim Stipulated Order in which he voluntarily agreed

24 to voluntarily withdraw from the management o f intrathecal pain pumps.

25 3.

26 Licensee’s acts and conduct that violated the Medical Practice Act follow:

27 The Board conducted a review of Licensee’s management and treatment o f chronic pain

28 patients which revealed a pattern o f practice that breached the standard o f care, subjected

1 patients to the risk o f harm, and violated a Board regulation (OAR 847-015-0030), and

2 constitutes prescribing controlled substances without a legitimate purpose or without following

3 accepted procedures for examinations o f patients or for record keeping, as described below:

4 • Licensee maintained his chronic pain patients on a long term medication regimen

5 that included high dosages o f opioids, often in combination with a benzodiazepine or

6 Carisoprodol (Soma), which subjected his chronic pain patients to significant risk of

7 cardiac arrest and respiratory depression as well as other adverse side effects.

8 • In the context o f managing chronic pain patients, Licensee failed to provide each

9 patient with material risk notification, as required by OAR 847-015-0030.

10 • Licensee failed to conduct a cardiovascular examination (to include ordering or

11 reviewing an electrocardiogram (ECG) prior to treating patients with Methadone

12 (Schedule II), and during the course o f treatment.

13 • Licensee failed to follow-up on positive tests revealing illegal drugs or negative

14 urine drug screens (UDS) for prescribed medications, or other evidence o f aberrant

15 departures from the treatment plan.

16 • Licensee failed to conduct adequate physical examinations at the outset o f or

17 during the course o f treatment to justify diagnoses and therapeutic decisions.

19 Licensee and the Board desire to settle this matter by entiy o f this Stipulated Order.

23 Order in the Board’s records. Licensee admits that he engaged in the conduct described in

24 paragraph 3 (above) and that this conduct violated ORS 677.190(l)(a), as defined in ORS

25 677.188(4)(a); ORS 677.190(13); ORS 677.190(17); and ORS 677.190(24). Licensee

26 understands that this Ol der is a public record and is a disciplinary action that is reportable to the

27 National Data Bank and the Federation o f State Medical Boards.

2 Licensee and the Board agree to resolve this m atter by the entry o f this Stipulated Order

3 subject to the following terms and conditions:

4 5.1 Licensee is reprimanded.

5 5.2 Licensee’s medical license is suspended for 15 calendar days effective the first

6 day o f the month following the month in which this Order becomes effective.

7 5.3 Licensee m ust pay a civil penalty o f $2,500 within two years from the effective

8 date of this Order. Licensee may make monthly installment payments with no payment,

9 excepting the final payment, to be less than $ 100.

10 5.4 Licensee is placed on probation for 10 years. Licensee must report in person to the

11 Board at each o f its quarterly meetings at the scheduled times for a probation interview, unless

12 otherwise directed by the Board's Compliance Officer or its Investigative Committee. In the event

13 the Board develops protocols for conducting electronic probation interviews, interviews may be

14 held electronically, at the Board’s discretion, between Licensee and the B oard’s Compliance

15 Officer (or its designee) using Board established protocols for the location and electronic

16 transmission o f the meeting. Licensee is responsible for supplying and maintaining the equipment

17 and technology necessary for him to participate in the electronic meetings. Licensee will be

18 notified i f and when such meetings are scheduled in lieu o f an in person appearance at a quarterly

19 Board meeting. After three years o f full compliance with the terms o f this Order, Licensee may

20 submit a written request to m odify the duration o f his probation.

21 5.5 Licensee m ust not prescribe stimulants, to include phentermine (Schedule IV) or

22 dextroamphetamine & amphetamine (Adderall, Schedule II) for any purpose, to include weight

23 loss or to treat attention deficit disorder or attention deficit hyperactivity disorder.

24 5.6 Licensee m ust not heat chronic pain with any DEA scheduled medications, to

25 include intrathecal pain pumps. For the purposes o f this Order, chronic pain is defined as pain

26 that persist or progresses over a period o f time greater than 30 days. Licensee may prescribe

27 DEA scheduled medications for patients who are enrolled in hospice or have a life expectancy o f

1 less than six months. Licensee m ust certify on the written prescription that the patient is a

2 hospice patient.

3 5.7 Licensee m ay treat acute or intermittent pain, with short acting opiates, for no

4 more than 30 days per patient in a calendar year in an amount not to exceed 50 morphine

5 equivalent dose (MED) per day. In addition, Licensee must not combine benzodiazepines or

6 muscle relaxants with Schedule II or III medications.

7 5.8 W ithin 30 days o f the effective date o f this Order, Licensee m ust contract with

8 CPEP for the development o f an education plan which is focused on Licensee’s family medicine

9 practice. The cost o f the development o f an education plan must be borne by the Licensee.

10 Licensee must sign all necessary releases to allow full communication and exchange o f

11 documents and reports between the Board and CPEP. Licensee must ensure CPEP submits the

12 education plan reports directly to the Board.

13 5.9 Upon approval o f the educational plan by the Board’s Medical Director, Licensee

14 must successfully complete the CPEP education plan, including any post-education evaluation,

15 within 18 months from the date the educational plan is approved. All costs associated w ith the

16 approved education plan m ust be borne by Licensee. Licensee must sign all necessary releases

17 to allow full communication and exchange o f documents and reports between the Board and

18 CPEP. Licensee must keep the Board apprised o f his compliance with the CPEP education plan

19 throughout the duration o f plan completion.

20 5.10 Licensee must provide the Board with written proof from CPEP upon successful

21 completion o f the approved education plan, including successful completion o f any post-

22 education evaluation, as defined above.

23 5.31 Within six months o f the effective date o f this Order, Licensee m ust complete a

24 course on medical documentation that has been pre-approved by the Board’s Medical Director.

25 5.12 After three years o f continued compliance with all terms o f this Order, Licensee

26 may submit a written request to m odify the terms o f this Order. Granting o f any modification

27 requests rests solely with the Board. Licensee will be notified in writing if and when any

28 modifications are granted.

5.13 The Interim Stipulated Orders o f July 6, 2016, and December 18, 2017, terminate

effective the date the Board Chair signs this Stipulated Order.

5.14 Licensee’s medical practice is subject to random, no notice chart audits and office

visits by Board designees.

5.15 Licensee m ust inform the Compliance Section o f the Board o f any and all practice

sites, as well as any changes in practice address(es), employment, or practice status.

Additionally, Licensee m ust notify the Compliance Section o f any changes in contact

information within 10 business days.

5.16 Licensee stipulates and agrees that this Order becomes effective the date it is

signed by the Board Chair.

5.17 Licensee m ust obey all federal and Oregon state laws and regulations pertaining

to the practice o f medicine.

5.18 Licensee stipulates and agrees that any violation o f the terms o f this Order shall

be grounds for further disciplinary action under ORS 677.190(17).

Licensee understands that this Order is a public record and is a disciplinary action that is

reportable to the National Practitioner Data Bank and the Federation of State Medical Boards.

5.

Licensee and the Board agree to resolve this matter by the entry of this Stipulated Order

subject to the following terms and conditions:

5.1 Licensee is reprimanded.

5.2 Licensee must consult with a surgeon who has been pre-approved by the Board’s

Medical Director prior to any surgery. The consultation must include a discussion of indications

for surgery, risks, benefits, patient selection and coraorbidities, and must be documented in the

patient chart.

5.3 Licensee must have another surgeon, who has been pre-approved by the Board’s

Medical Director, present to assist during any surgeries in which the pre-surgical consult

identifies that it is more likely than not that complications will arise.

5.4 Licensee must have another surgeon who has been pre-approved by the Board’s

Medical Director available for all other surgeries that do not fall under term 5.3.

5.5 On a monthly basis, Licensee must submit a report to the Board that identifies:

5.5.1 All surgeries performed during the preceding one month period;

5.5.2 All surgeries during the preceding month in which another surgeon was

engaged to assist based on the pre-surgical consultation, as well as identifying the

assisting surgeon in each case;

5.5.3 All surgeries during the preceding month in which an assistant surgeon or

consulting surgeon was brought in after die surgery was begun, as well as identifying the

surgeon in each case;

5.5.4 All surgeries during the preceding month that required blood transfusion

within 72 hours of surgery;

5.5.5 All post-operative surgical infections or infections of the intra-abdominal

region during the preceding month that occurred within 10 days of surgery;

5.6 Licensee must report to the Board the following items within 10 days of

becoming aware of them:

5.6.1 All surgeries requiring re-operation;

5.6.2 Any instances in which a hospital re-admission was required within 30

days of a surgery that was performed after the effective date of this Order;

5.6.3 All surgical transfers that occur in which a surgery was begun by

Licensee;

5.6.4 All patient deaths in which the death occurs during or within 60 days of a

surgery performed since the effective date of this Order.

5.7 Licensee may, after 12 months of successful compliance with the terms of this

Order, request the Board to modify or terminate the terms of this Order. The Board may require

such a request to be accompanied by supportive recommendations from a specified number of

Licensee’s pre-approved consulting or assisting surgeons as determined by the Board’s Medical

Director. The Board, in considering Licensee’s request, may also seek retrospective review of

surgeries performed by Licensee as determined by the Board’s Medical Director.

5.8 The Interim Stipulated Order, dated December 12, 2017, terminates upon the

effective date of this Order.

5.9 Licensee stipulates and agrees that this Order becomes effective the date it is

On January 4,2018, John William Griffin, MD (Licensee) entered into a Corrective

Action Agreement with the Oregon Medical Board (Board). This Agreement placed conditions

on Licensee’s Oregon medical license. On July 23,2018, Licensee submitted documentation

that he has successfully completed all terms of this Agreement and requested that this Agreement

be terminated.

The Board has reviewed the documentation submitted by Licensee and has determined

that Licensee has successfully complied with all of the terms of this Agreement. The Board

terminates the January 4, 2018, Corrective Action Agreement, effective the date this Order is

12 the Board to modify Term 4.3 of this Order, which reads:

existing patient. For the purposes o f this Order, chronic pain is defined as pain that persists or

jpm grcsses over a period o f tim e greater than 30 days.

3.2 L icensee m ust im m ediately begin to taper opioid m edications for any chronic pain

patient with a m orphine equivalent dose (M ED) over 90 by at least 10% per m onth until patien t’s

1 MBD is 90 or [css. A lternatively, Licensee may transfer the cure o f any patient w ith an MBD

2 over 90 to another physician. L icensee may continue to prescribe greater than 90 M ED for j

3 chronic pain for patients who are currently enrolled in hospice o r w ho are currently receiving end

4 o f life care. Licensee m ust certify on the written prescription that the patient is a hospice patient

5 or receiving end o f life care.

6 3.3 Licensee may treat patients for acute pain for no m ore than 30 days per year, with ■

7 a maximum MBD o f 50. The year begins the date this O rder becom es effective. j

8 3.4 For patients taking benzodiazepines and opioids (to include buprcnorphine or . -|

9 buprenorphine/naloxone), Licensee m ust begin to taper benzodiazepines a fte r op io ids have becjn 1

10 tapered to 90 MBD or less. B enzodiazepines must be tapered by at least 10% p er m onth until the

1 1 patient is weaned o ff benzodiazepines. Alternatively, Licensee may transfer the care o f any

12 patient for whom he is prescribing benzodiazepines and opioids to another physician. Licensee

13 may continue to prescribe benzodiazepines to patients who arc currently enro lled in hospice or

14 who are currently receiving end o f life carc. Licensee must certify on tiic w ritten prescription I

15 that the patient is a hospice patient or receiving end o f life care.

16 3.5 Licensee must not concom itantly prescribe opioids w ith benzodiazepines

17 following tapering as outlined in term s 3.2 and 3.4.

18 3.6 Licensee m ust not concom itantly prescribe opioids w ith carisoprodol (Soma).

19 3.7 Licensee- m ust com ply w ith OAR 847-015-0010 when prescrib ing Schedule 111 or

20 IV controlled substances for the purpose o f weight loss. ,,

21 3.8 Licensee understands that violating any term o f this O rder will be grounds for '

22 disciplinary action under ORS 677.190(17).

23 3.9 Licensee understands this Order becomes effective the date she signs it.

25 At the conclusion o f the B oard’s investigation, the Board will decide w hether to close the

contingent upon Licensee agreeing to the following conditions:

4.1 Within six months from the signing of this Agreement by the Board Chair,

Licensee must successfully complete a course on medical professionalism that is pre-approved

by the Board’s Medical Director. These courses may not be used to satisfy the Board’s

continuing education requirement.
