MARY'S COUNTY, MARYLAND, TO ADOPT LOCAL AMENDMENTS TO THE MARYLAND BUILDING PERFORMANCE STANDARDS WHEREAS, 5 13-906 of the Local Government Article of the Annotated Code of Mavyland enables the Commissioners of St. Mary's County to adopt, amend and enforce a build~ng code to provide for the construction, ma~ntenance and repair of any and all buildings and structures located rn or to be located in St. Mary's County, and WHEREAS, pursuant to 512-503 and $12-505 of the Public Safeety Article of the Annotated Code of Maryland, the Maryland Budding Performance Standards apply to each burlding or structure in the State, and each local jurisd~ct~on 1s required to enforce the most current version of the Standards and any local amendments to the Standards; and WHEREAS, pursuant to 5 12-503 of the Public Safety Article of the Annofated Code of Maryland, the State of Maryland adopted, effectlve as of January 1, 20 15, the 20 15 versions of the International Building Code (heremafter "IBC"), ~ncluding the International Residential Code for One- and Two-family Dwellings (hereinafler "IRC") and the International Energy Conservation Code (hereinafter "IEEC"), with the nlodifications incorporated by the Maryland Department of Housing and Comrnunrty Development, as the Maryland Building Performance Standards; and WHEREAS, pursuant to 8 12-504 of the Public Safety Article of the Annotated Code of Maryland, local jurisdictions may adopt amendments to the Maryland Building Performance Standards; and WHEREAS, the Comm~ssioners of St. Mary's County held a public hearing on June 9, 2015, for the purpose of receiving public testimony and to consider local amendments to the Maryland Budding Performance Standards after not~ce was published in the Enterprise, a local newspaper of general circulation in St. Mary's County, Maryland, on May 22, 2015, and May 29,2015; and WHEREAS, the Comn~issionersof St. Mary's County finds that amendments to Maryland Budding Performance Standards would be in best ~nterest of the health, safety and welfare of the citizens of St. Mary's County,

TO AMEND CHAPTER 203 OF THE CODE O F ST. MARY'S COUNTY, MARYLAND, TO ADOPT LOCAL AMENDMENTS TO THE MARYLAND BUILDING PERFORMANCE STANDARDS

WHEREAS, 5 13-906 of the Local Government Article of the Annotated Code of Mavyland enables the Commissioners of St. Mary's County to adopt, amend and enforce a build~ng code to provide for the construction, ma~ntenance and repair of any and all buildings and structures located rn or to be located in St. Mary's County, and

WHEREAS, pursuant to 512-503 and $12-505 of the Public Safeety Article of the Annotated Code of Maryland, the Maryland Budding Performance Standards apply to each burlding or structure in the State, and each local jurisd~ct~on 1s required to enforce the most current version of the Standards and any local amendments to the Standards; and

WHEREAS, pursuant to 5 12-503 of the Public Safety Article of the Annofated Code of Maryland, the State of Maryland adopted, effectlve as of January 1, 20 15, the 20 15 versions of the International Building Code (heremafter "IBC"), ~ncluding the International Residential Code for One- and Two-family Dwellings (hereinafler "IRC") and the International Energy Conservation Code (hereinafter "IEEC"), with the nlodifications incorporated by the Maryland Department of Housing and Comrnunrty Development, as the Maryland Building Performance Standards; and

NOW THEREFORE, BE IT ORDAINED by the Cornmissloners of St. Mary's County, that:

SECTION I. Chapter 203, Sec 203-1 1 of the Code of St. Mary S Cozmty is amended to read as follows:

Sec. 203-1 1. - Adoption of standards.

The Maryland Building Performance Standards, as amended by the State of Maryland (COMAR 05.02.07), is amended to read as follows:

Such repairs shall not include the cutting away of any wall, part~tion or portion thereof, the removal or cutting of any structural beam or load-bearing support or the removal or change of any required means of egress, or rearrangement of parts of a stmctwe affecting the egress requirements; nor shall ordinary repairs include addition to, alteration of, replacement or relocation of any standpipe, water supply, sewer drainage, drain Icadcr, gas, soil, waste, vent or similar piping electric wiring or other work affecting public health or general safety.

[A] 105.3.2 Time limitation of application. An application for a permit for any proposed work shall bc deemed to have been abandoned 12 months after the date of filing, unless such application has been pursued in good hith or a pennit has been issued; except that the buildlng official is authorized to grant one extension of time for an addltlonal period of 12 months. The extcnsion shall be requested in writing and justifiable cause demonstrated.

[A] 105.5 Expiration. The concrete foundation wall inspection shall be made prlor to placing concrete, when the forms are placed on eke footing and reinforcing steel, structural straps, and ~mbeds are In place. [A] 110.3.5 Foundation backfill inspection. 'The foundation backfill inspection is to be performed on ail foundation walls with habitable or usable space prior to back filling with acceptable soil to verify drainage and water proofing systems. A foundation inspection is also performed on all foundations in the regulated flood plain to verifL compliance with NFIP and FEMA standards

[A] 110.3.6 Framing inspection. The framing inspection is to be performed after all plumbing/gas, mechanical, electrical work has been roughed-in, all interior framing draWfire stopp~ng, exterior doors and windows have been installed and the structure IS

weather tight. Exception: decks and detached accessory structures without plurnbrng or electric on the condition that all framing is vlsible at time of final inspection.

[A] 110.3.7 Structure tie down inspection, The structure tie down inspection is to be performed before the exterior finishes are applied (vlnyl siding, wood slding, bnck, stucco) unless the tie downs are installed in the interlor of the structure. The tie downs must be placed within 12 inches of each corner and max~murn of cvery 48 ~nches on center for the roof truss/rafter down to the footing. Tie downs must be rated at 1,000 Ibs. minimum per connection, llsted and approved for such application.

[A] 110.3.8 Insulation inspection. The insulation inspection is to be performed when all insulation, vapor barriers, caulking and weather stripping is in place. Exception: structures, which are exempt from Chapter 13.

[A] 110.3.10 Final inspection. [Add:] Proper posting of E-911 address shall be installed and verified at this time.

SECTION 202. DEFlNI.TIONS

Agriculture Building. Any bulldlng used In Agr~culture, defined as the use of land for the production and primary processing of food and fibers for sale, ~ncluding cultlvatlng, dairy~ng, hort~culture, pasturing, flor~culture, s~lverculture, viticulture, an~rnal and poultry husbandry, and such incidental accessory facllities such as greenhouse and nurseries,

Lot. A "Lot" as defined in the St. Mary 3 County Comprehensive Zoning Ordinance.

1301.1.1 Criteria. Buildings shall be designed and constructed in accordance with the 20 15 International Energy Conservation Code.

1809.5 Frost protection. Except where otherwise protected from frost, foundations and other permanent supports of buildings and structures shall be protected from Cost by one or more of the following methods.

1 Extending below the fiost line (20 inches below grade) to bottom of foot~ng, 2. Constructing In accordance with ASCE 32, or 3 . Erect~ng on solid rock

Exception: Free-standing build~ngs meeting all of the following conditions shall not be requlred to be protected

1. Assigned to Risk Category I, in accordance with Section 1604.5; 2. Area of 300 square feet or less for light-fiame construction or 300

square feet or less -For other than light-frame construction; and 3. Eave height of 10 feet (3048mni) or less.

Shallow foundations shall not bear on frozen soil unless such frozen condition i s of a permanent character.

3103.1 General. The provisions of Sections 3103.1 through 3103.4 shall apply to a structure erected for a period of less than 180 days. Tents and other membrane structures erected for a period of less than 180 days shall comply with the State of Maryland Fire (NFPA 1) and Life Safety Cade (NFPA 101). Those erected for a longer period of time shall comply with applicable sections of this code.

1. An automatic residential fire sprinkler system shall not be required for addition or alterations to exist~ng bulldings that are not already provided with an automatic residential sprinkler system.

2. An automatic residential fire sprinkler system shall not be required for one and two family dwellings that are:

R502.1.1 Sawn lumber: Sawn lumber shall be identified by a grade mark of an accredited lumber grading or inspection agency and have design values certified by an accreditation body that complies with DOC PS 20. In lieu of a grade mark, a certificate of inspection issued by a lumber grading or inspection agency meeting the requirements of this section shall be accepted. A grade mark or certification is not required for owner-occupied construction if the lumber is cut full size and the construction otherwise complies with this code.
