1 Page 1 of9 GOVERNMENT OF BALOCHISTAN Secondary Education Department (Inquiry) Dated Quetta the :221::l May, 2017 ORDER No. SO(Inq.)Misc:/Kachhi/2017 /Edn./ 59 9~ It! s= An inquiry was conducted to determine the genuineness of appointment and to procure proof of physical existence of the persons whose names were reported in Finance Department's letter No. FD.SO(XIII-T)/19-1/2016553-55 dated zo- October, 2016. In order to ensure compliance with Article 10A of the Constitution and adherence to the principles laid down in the various judgments of the Superior Courts, relating to natural justice, it was decided that due and reasonable notice would be given t0 4 these persons and due process would be followed. To ensure due notice, notices were simultaneously issued via post and through public advertisement in newspapers having wide circulation i.e. Daily Mashriq dated 12.05.2017. Publication as notice in the newspaper ensured that due notice was served upon every person whose name appeared in the list. Further, notices were also served through Deputy Commissioner and the District Education Officer District Kachhi. To ensure the 2 nd component i.e. due process, the persons, whose names appeared in the Finance Department's letter, were informed well in time before the personal hearing to arrangeand ensure their attendance before the inquiry committee and to present requisite documents about which these persons were also informed through notices. Attendance was compulsorily required to ensurethat each person is given ample opportunity to present his or her case and prove his or her physical existence. This was done to ensure that he or she is not condemned unheard as required under the principles of natural justice. The inquiry committee remained ill Sibi from 15.05.2017 to 16.05.2017 and was approachable without any restriction of time i.e. any person whose name appeared in the list could approach the inquiry committee during these two days at any time ofhis or her convenience. Being satisfied with the process, opportunity and notice afforded to each person, it can be safely and logically concluded that those who failed to appear before the committee within the prescribed time are physically non-existent. They were never bonafide employees of Education Department and therefore, this fact entails a clear case of fraud and forgery and further calls for criminal action and recovery from the beneficiaries of all paid emoluments from the Government exchequer.
