Court Case #2 Defense Lawyers1st PeriodOpening StatementMay it please the Court, and you, ladies and gentlemen of the Jury: our defense is in the favor of the narrator of The Yellow Wallpaper by Charlotte Perkins Gilman, first published in 1899. Contrary to what the prosecution of the narrator may believe, she, the author of the diary entries in The Yellow Wallpaper, is in fact not defeated by her insanity, and she should not in any way be locked away in an arcane insane asylum. Basing an argument, whether for either the prosecution or the defense, is never easily done when only one primary source is available. In knowledge of that light, we must take what the narrator writes in her diary to be true indications of her state of mind, her well-being, and her role as a woman in the late 19th century.The narrator, based on what we can discern from her diary, is a well-to-do upper middle class woman who is financially secure, thanks to her husbands occupation as a physician of high standing. However, she is falsely diagnosed of a temporary nervous depression, resulting in her confinement to the nursery room where the sole activity that she is permitted is to lie in bed and to take the relevant medicinesphosphates and tonics. According to the prosecution, the narrators case has escalated to the point where she is now accused of being a victim of her own insanity and should, as a result, be sent to an insane asylum. These mere accusations of insanity, however, do not serve as evidence, and we will argue for her triumph, despite the oppressive patriarchal society in which she lives, beyond a reasonable doubt, with evidence.What will the evidence show? It will show through the textual evidence of her own diary that the narrator does indeed triumph in the end. It will show that her entire diary up until the dramatic conclusion clearly divulges the daily struggles that she has to face, from the patriarchal oppression and domination that is instituted by her husband John to the inner conflictions with herself. Most importantly, it will show how the narrator eventually overcomes her limitations and is triumphant in the end. Based on this evidence and that which shall presented at a later point, I shall ask and expect you to return a verdict that she is triumphant and should not be sentenced to live out the rest of her days in an insane asylum.
