and
political
turmoil,

strongvoice. TheFoundationisworkingtogatherasnapshotofourmembersandtoexaminethe
impactofthenewHoursofService(HOS)rulechangestopresentbeforetheSmallBusiness
Administration.
Asyouwellknow,oneofthemostcontentiousissuesthisyearhasbeenthetwonewHOSregulation
changesthatwereimplementedbyFMCSAbeginningonJuly1,2013.Severallargemotorcarriersand
executiveshavespokenoutagainstthenewrulechanges,however,theAssociationwantstohearyour
opinion,thesmallbusinessowner,thedriver,thepersonwhotrulyrepresentstheindustry. Therefore,
weare
asking
asample
of
members
to
complete
an
online
survey
about
their
experiences
and
views
as
owneroperatorsandprofessionaldriversonthenewHOSregulations.

ExecutiveSummaryBackgroundInDecember2011,theFederalMotorCarrierSafetyAdministration(FMCSA)announcedproposed
changestothe2003hoursofserviceregulation. After18months,onJuly1,2013,theAgency
promulgatedthenewHOSrulechanges,whichweredesignedtoimprovesafetyforthemotoringpublic
byreducingtruckdriverfatigue. AccordingtoFMCSAsfinalrule,1thepurposeoftheruleistolimit
theabilityofdriverstoworkthemaximumnumberofhourscurrentlyallowed,orclosetothe
maximum,onacontinuingbasistoreducethepossibilityofdriverfatigue. TheAgencyclaimedthatthe
newHOSregulationswouldsave19livesandpreventapproximately560injurieseachyear.
TheformerU.S.TransportationSecretaryRayLaHoodstated,Safetyisourhighestpriority. Theserules
makecommonsense,datadrivenchangestoreducetruckdriverfatigueandimprovesafetyforevery
traveleronourhighwaysandroads. FMCSAsnewhoursofservicefinalrule:
Limitsthemaximumaverageworkweekfortruckdriversto70hours. Adrivermaynotdriveafter60/70hoursondutyina7/8consecutivedayperiod;
Truckdriverswhoreachthe70hoursmaximumofdrivingwithinaweek(168hours)areallowedtorestartiftheyrestfor34consecutivehours,includingatleasttwoperiodsfrom1a.m.to5
a.m.attheirhometerminal. The34hourrestartcanonlybeusedonceperweek,168hours,
andismeasuredfromthebeginningofthepreviousrestart;and
Truckdriversarerequiredtotakea30minutebreakduringthefirsteighthoursofashift,whichdoesnotstopthe14hourondutywindow.
SummaryThroughouttheregulatoryprocess,theOwnerOperatorIndependentDriversAssociation(OOIDA)has
beeninconstantoppositiontothenewHOSrulechanges. TheU.S.TransportationSecretaryRay
LaHoodannounced,Theserulesmakecommonsense. However,theAssociationrespectively
disagrees. ToddSpencer,theexecutivevicepresidentofOOIDA,hassaid,Collectively,thesechanges
willhaveadramaticeffectonthelivesandlivelihoodsofsmallbusinesstruckers,changesthatare
unwelcomeandunnecessary.2
OOIDAisthelargest,nationaltradeassociationrepresentingtheinterestsofsmallbusinesstrucking
professionals
and
professional
truck
drivers.
OOIDA
is
a
non
for
profit
corporation
incorporated
in
1973
andcurrentlyhasmorethan150,000membersfromacrossall50statesandCanada. TheAssociations
membersconsistmainlyofonetruckowneroperators,whorepresenthalfthetotalnumberofactive
motorcarriersoperatingintheUnitedStates. Assuch,theAssociationdoesnotbelievethenewHOS
regulationsmakecommonsense,butjusttheopposite.

Therefore,theAssociation,utilizingtheOODIAFoundation,designedandimplementedasurvey
entitled,OOIDANewHOSRegulationsSurvey,inordertogatherasnapshotofhowtherulechanges
haveaffectedthesmallbusinessowner,theprofessionaldriver,andthepeoplewhotrulydrivethe
economyandrepresentthetruckingindustry. Theresultswerebothenlighteningandinteresting.

TheSurveyResultsTheOOIDAFoundation,theresearchandeducationarmoftheAssociation,emailedthehoursofservice
surveytoitsmembersinOctober2013,whichgeneratedoverfourthousandresponses. Thesurvey
incorporatedfourteenquestionsonthenewHOSrulechangesandincludedasectionfortruckdriver
comments.
Fromthe
research
analysis,
the
Foundation
discovered
the
data
largely
agreed
with
Mr.
Spencerscomment,andthattherulechangeshavehadadramaticeffectonthelivesandlivelihoodsof
smallbusinesstruckersandprofessionaldrivers.
TheFederalMotorCarrierSafetyAdministrationannouncedthepurposeoftherulechangeswasto
reducethepossibilityoftruckdriverfatigue,however,thedatashowsdifferently. Approximately53
percentoftherespondentssaidthenewregulationsdidnotdecreasenorincreasetheirfatigue,but
instead,theyfeltthesameasbefore. Whereas46percentstatedtheyactuallyfeltmorefatigued.
Manycommentssupportedthisconclusionwithmemberssayingthenewrulescausedmorefatigue,
lesshometime,lessflexibility,andlessmoney. Anothermembersaid,Thenew30minuterulehas
hadno
positive
effect
on
reducing
my
fatigue.
Further
comments
stated,
there
will
be
more
driver
fatiguebecauseofthisrule,notlessbecausedriverswilltrytocramasmanymilesandhoursofdriving
inaspossiblebecausetheycanonlygetaresetonceinasevendayperiod.
Inaddition,thenew34hourrestartprovisionhasshowntobeveryproblematicfortheAssociations
members. Infact,79percentoftherespondentsclaimedtheonerestartperweekhasaffectedtheir
useofthe34hourrestart,with31percentstatingtheyhavebeensignificantlyimpacted. Ihavent
usedthenewrestart. Ivechosentousetherecapbecauseofthetwooptions,itallowsmemore
flexibility. Othercomments:
Inolongergeta34hourreset. Igethomeforabout40hours,butIdontgetthetwo15timeperiods,sonowIhavetorecapallthetime.
Therestrictivenatureofonlyusingtheresetonceevery168hoursnotonlyhasdecreasedthenumberofhoursandmilesIcandrivebutwhenI'dnormallybeoffweekends,nowifI
experienceadelayingettinghomemyresetkeepsgettingpushedbackfurtherandthrowing
offmyschedule.
Iusedthe34hrrestarteveryweekendanditgavememoretimetoworkthrutheweek,whichincreasedmyproductivityandgavememorehometime.Withthenewchangesthatyoucan
onlytake
it
after
168
hrs
has
elapsed,
means
Ihave
to
watch
my
time
even
closer.
Causing
more
stressastheweekendsarealmostdeadformybusiness.Isometimeshavetotakethetimeoff
awayfromhome.Bottomlineiseverydriverdeservestohavealifeawayfromthetruck.This
haseffectivelytakenFamilyTimeaway.

The1a.m.to5a.m.parthassetmebackahalfdayonmyrouteseveraltimesandhavingtotake168hoursbetweenrestartsisabsolutelyridiculous.Thepeoplecomingupwiththeseideas
havenocluewhattheyaredoing.
Further,the
one
34
hour
restart
per
week
provision
has
caused
56%
of
the
respondents
to
lose
mileage
andloadshauledperweek,andanother65percenthavelostincome. Manymembersdislikedthe
inflexibilitybecauseofthenewprovision. Onseveraloccasions,membershadlongwaitperiods
betweenloadsbutwereunabletoutilizetherestarteitherbecausethe34hoursdidnotcovertwo
periodsbetween1a.m.and5a.m.,orbecause168hourshadnotelapsedsincetheirpreviousrestart.
Ingeneral,thisforcedmemberstolosetimeathome,whichcausedthemtotakeonshorterhaulsand
reducedtheirincome.
Thenew34hourrestartallowsnoflexibilityformetochangemyschedulinghourstomatchmyworkload.WherebeforeIcouldrestduetoshipper/receiverdelays,weather,orwhatever,
now
it's
run,
run,
run
till
7
days
have
passed
then
get
a
rest
or
slow
down
till
hours
catch
up.
Sinceshippersandreceiverscontrolmyhoursofservice,mytimeisnolongerasflexible,Imustenterlargercities/moretrafficareasinthemorning&eveningrushhourtimesinsteadof
regulatingmyowntimeandworkingaroundtraffic. Thereisnoexcusefornotbeingabletouse
morethanone34hourrestart,andthe1/2hroffinthemiddleofthedayjustmakesonemore
tiredwhenhemustdriveafterthattime.
Underthenewrules,whenIamdetainedforextendedperiodsbetweenloads,Igetplentyofrestbutnottheabilitytorestartmyhoursuntiltheapprovedtimeoneweekfromthestartof
myprevious
restart.
Then
when
that
time
arrives,
Ihave
to
waste
2more
days
to
get
arestart.
Idonothaveaweeklyroutine. Ioftenhave12daysbetweenloads. Ineedthe34hrrestartbecausethereareoftengapswhereIamnot"gettinganyhoursback",therefore,Icannotdrive
andhavetotaketherestart. Itwaseasytogetarestart,butnowwiththe1amto5am
restriction,itisdifficultsinceIprimarilydriveatnight. IfIhada34hrsrestartonMonday,then
have34hoursoffonThursday,IamasrestedasIwasonMonday,andISHOULDregainmy70,
sounproductive!
Other
members
mentioned
that
the
new
34
hour
restart
provision
was
unsafe
because
it
forced
them
to
driveduringrushhourtraffic. Theresultofthe34hourrestartrequiring2periodsfrom1am5am
insuresthatIamALWAYSdrivingintheheaviestrushhourtrafficonMondaymornings. Definitelynot
safer,inmyopinion.
Thenewregulationsaddedamandatory30minutebreakduringthe14hourworkday,whichrequiresa
truckdrivertotakeatleastonebreakaftereighthourofondutytime. Themandatorybreakhas
impacted86percentoftherespondents,andover60percentstatedthattheiroperationswereeither

moderatelyorsignificantlyaffectedbytheregulation. Numeroustruckdriverscommentedthatthis
newrulewasunnecessaryandunsafe.
Frequently,membersstatedtheyfeltmorefatiguedbecauseofthemandatorybreak. Members
scarcelyusedthe30minutebreaktosleep,butinstead,simplysatinthetruckwaitingfortheirbreakto
end.
Perhapsone
of
the
biggest
concerns
was
taking
the
time
to
find
parking
just
in
order
to
take
the
30minutebreak. Mostofthetimemy30minutesturnsinto60minutesormorebythetimeyoufind
parkingandgetbackontheroad. Onememberstatedthehalfhourbreakhasincreasedstress,cut
downtimetodrive,cutdownontheabilitytofindaparkingspot,andextendedmyday,increasing
fatigue.
Anotherareaofconcernwiththemandatorybreakwassafetyandstress. Somememberstalkedabout
achangeintheirdrivinghabitsanddaytodayoperationsbecauseofthemandatorybreak. One
membercommentedthatthenewruleshavenotreducedstressandfatigue,buttheyveincreased
both. Anotherdriverstated,The30minutemandatedbreakhasextendedmyworkweekandhas
addedstresstomydailyroutine.
Afewmembersconfessedthatbecauseofthenewmandatorybreak,theywereforcedtodrivefaster
andlongerthantheyusetoinordertomaketheirdeliverytimes. Onememberinparticularsaid,Inow
driveabout5milesperhourfasterinordertomakeupforthe30minutemandatorybreak.
ItisimportanttonotethatteamandnightdriverswerebothaffectedinparticularwiththenewHOS
regulationchanges. Thenighttimedriverscommentedthattheywerebeingdiscriminatedagainst,while
teamdriversstatedthatitwashardfortheiroperationstofunctionproperly. Bothsetsofdriversstated
thatthenew34hourrestartregulationforcedthemtotakeoffatleast48hours,thereforecausinga
significantdropoffinproductivity. Inaddition,bothsaidthatthenewrulesincreasedtheirfatigue.
Nighttimedrivers
also
discussed
adifficulty
to
find
adequate
safe
parking
for
their
30
minute
break.
ThemajorityofrespondentsstatedthattheyhavebeennegativelyimpactedbythenewHOS
regulations. Someoftheaffectsincluded:

youchangeit. Thetwolargestresponseswerechangingthe34hourregulationsbacktothe2003
regulation(46%)andeliminatingthe14hourrunningclockprovision(30%).
