Part time support staff bargaining unit

4. (1) Subject to subsection (2), the part timesupport staff bargaining unit includes,

(a) all persons regularly employed by anemployer for not more than 24 hours a weekin positions or classifications in the office,clerical, technical, health care, maintenance,building service, shipping, transportation,cafeteria and nursery staff; and

(b) all persons employed by an employer for aproject of a nonrecurring kind in positions orclassifications in the office, clerical, technical,health care, maintenance, building service,shipping, transportation, cafeteria andnursery staff.

(a) foremen or supervisors;

(b) persons above the rank of foreman orsupervisor;

Definition

5. In this Schedule,

"person employed in a managerial orconfidential capacity" means a person who,

(a) is involved in the formulation oforganization objectives and policy in relationto the development and administration ofprograms of the employer or in theformulation of budgets of the employer,

(b) spends a significant portion of his or hertime in the supervision of employees,

(c) is required by reason of his or her dutiesor responsibilities to deal formally on behalf ofthe employer with a grievance of anemployee,

(d) is employed in a position confidential toany person described in clause (a), (b) or (c),

(e) is employed in a confidential capacity in

matters relating to employee relations,

(f) is not otherwise described in clauses (a) to (e) but who,in the opinion of the Ontario Labour Relations Board,should not be included in a bargaining unit by reason of hisor her duties and responsibilities to the employer.

This voting constituency includes all employees (including dependentcontractors) who were in the bargaining unit who had an employmentrelationship with the Employer on the Application Date at the top of this Notice,and those employees employed during the 2015-2016 academic year.Employees having an employment relationship include employees on maternityleave, sick leave, vacation, workers' compensation, lay-off, etc. so long as thereis a reasonable expectation of their return to employment.

If employees believe they are eligible to vote, or have any question aboutwhether they are eligible to vote, they should attend a vote poll and identifythemselves to the Board s Vote Officer who is conducting the vote. If anemployee's eligibility to vote is unclear or disputed, the employee will be givenan opportunity to mark a ballot, but it will be segregated. This means that, untilthe employee s eligibility to vote has been determined, or agreed upon, theballot will be sealed in a separate, double envelope system to protect theemployee s identity and preserve the employee s right to secrecy.

Vous devez signifier votre nonc d observations aux autres partiesavant de le d poser aupr s de la Commission.

N crivez pas la commission dans le seul but de faire part de votre appui (oude votre opposition) au syndicat. Vous aurez la possibilit de vous exprimer cesujet au moment du scrutin.
