President Saviano and Trustees:

On November 25, 2019, the Plan, Zoning and Development Commission held a publichearing to consider a request from Petitioner, Village of Elmwood Park, to amend the text of theZoning Ordinance, by amending Section 1412.02 (Definitions), Section 1407.03 (Permitted andSpecial Uses in Business, Commercial and Mixed Use Districts), Section 1408.06K.4.a (Off-Street Parking, High Volume Commercial Uses) and 1407.04 (Special Conditions), in order toprohibit cannabis business establishments throughout the Village of Elmwood Park, except toallow one special use permit for an adult use cannabis dispensaiy organization that operates anexisting medical cannabis dispensary.

Following testimony, questions and discussion during the public hearing, and discussionamongst the Commissioners after the public hearing concluded. Commissioner Caponigri made amotion, second by Commissioner Lanzito to recommend that the President and Board of Trusteesapprove the text amendments as presented. All members present voted in favor of the motion, andthe motion carried.

Therefore, the Plan, Zoning and Development Commission recommends the approval ofthe proposed text amendments.

Members present: Peter Volpe, Carmen Forte Jr, Bina Conte, Anthony Lanzito and ChrisCaponigri and Gabe Caporale. Secretary Carmen Forte Jr. read thepurpose of the hearing which is to consider a request from Petitioner, FloraMedex, LLC,forzoning relief to operate an adult use cannabis dispensary organization at the addresscommonly known as 7943-79S5 and 7959 W. Grand Avenue, Elmwood Park, Illinois.The Petitioner is requesting a special use permit to operate the facility in a C-l district,pursuant to Zoning Ordinance Section 1407,03(A)[1)PINs: 12-25-319-003-0000; 12-25-319-004-0000; 12-25-319-005-0000;12-25-319-OS3-0000; 12-25-319-054-0000.

Clerk Pesko confirmed that all statutory requirements were followed with regard to noticeof the specified request. Notice was published in the November 7, 2019 edition of the ElmLeaves and posted in the lobby of Village Hall for the past two (2) weeks. Notice wasmailed to residents within 250 ft, of the subject property via USPS using labels provided bythe petitioner. One written comment was received through the Village Manager's office,

Commissioner Volpe invited the petitioner to approach the board and be sworn in. Mr. Nick

Standiford of Schain Banks, representing FloraMedex, came forward. Mr, Standiford

presented his testimony and requested approval of a special use permit to operate an adult

use cannabis dispensary in a C-l district, FloraMedex is already licensed by the State of

Illinois and will be the onlydispensaryin the village if approved. Mr. Standiford summarized

the documents that were presented to the commissioners. He explained that FIoraMedex

may purchase 7959 Grand for either expansion or parking in the future. Chairman Volpe

opened the hearing to questions or comments from the commissioners. Questions included

the possibility of future interior expansion, on premises consumption of cannabis and

security in and around the facility. Mr. Standiford asked if a representative from Cresco

Labs could answer some questions. Mr. John Sullivan from Cresco Labs came forward to be

sworn in. Mr. Sullivan answered questions regarding projected sales, tax revenue and

additional security. Chairman Volpe opened the floor to public comment. Ms. Anna Orlinski,

793 2 Grand Avenue expressed her concerns regarding this establishment and if it is good forthe residents ofEImwood Park. Chairman Volpe thanked Ms, Orlinski for her comments.

With no other comments or questions from the public, a motion was made by Commissioner

Caponigri and seconded by Commissioner Caporale to adjourn the public hearing. Motion

carried. Public hearing adjourned at 7:46pm.

Secretary Carmen Forte Jr. read the purpose of the hearingwhich is to consider a requestfrom Petitioner, Village of Elmwood Park, to amend the text of the Zoning Ordinance, byamending Section 1412.02 (Definitions), Section 1407,03 (Permitted and Special Uses inBusiness, Commercial and Mixed Use Districts], Section 1408,06K.4.a (Off-Street Parking,High Volume Commercial Uses) and 1407,04 (Special Conditions), in order to prohibitcannabis business establishments throughout the Village ofElmwood Park, except to allowone special use permit for an adult use cannabis dispensary organization that operates anexisting medical cannabis dispensary.

Clerk Pesko confirmed that all statutory requirements were followed with regard to noticeof the specified request. Notice was published in the November 7,2019 edition of the ElmLeaves and posted in the lobby of Village Hall for the past two (2) weeks.

Commissioner Votpe invited the petitioner to approach the board and be sworn in.

Mr. Adam Durkin, Village Attorney came forward. Mr. Durkin stated this text amendment is

needed to change the Village code to prohibit adult use cannabis dispensaries except to allow

one special use permit for an adult use cannabis dispensary in Elmwood Park that had a

medical dispensary license before the end of 2019, Trustee Zivoj'novic stated this ordinance

is one of the most restrictive ordinances in the local areas, Questions from the

commissioners concerning the amendment included location and parking restrictions.

Mr, Durkin stated the text amendment will open the door for a special use application to be

submitted to the Village for an adult use cannabis dispensary,

Chairman Volpe opened the floor to public comment. Ms. Anna Orlinski of 7932 GrandAvenue approached the commission. She started to question Mr. Durkin regarding thespecial use permit for the dispensary. Chairman Volpe asked her to wait for the next publichearing to address FtoraMedex directly in regards to her concerns. She agreed,

Applicant/ FloraMedex, LLC (Applicant"), respectfully requests that the Village of

Elmwood Park Plan/ Zoning Commission {"PZ") make die following written findings of fact

and sliall transmit same together with its recommendation to the Village of EImwood Park

President and Board of Trustees ( Board ) for final action/ and states as follows:

The site is situated among retail and other commercial uses along the Grand

Avenue corridor, A retail sale-only dispensary is compatible with the other

businesses located in the surrounding area. The traffic generated by the facility is

consistent with other retail uses, and the site is already designed for a high-

customer h-affic use. FloraMedex expects the dxspensaty will be a regional draw,

bringing people to the Village and its Grand Avenue corridor/ thus benefiting the

other uses in the vicinity of the facility.

will be protected

The facility will be operated in accordance with State and Village regulations and

will be subject to State licensing throughout its operation. FloraMedex is an

experienced dispensary operator and it will implement operation systems and

security measures that; will ensure the facility will be operated in a safe and

appropriate manner. No on"site consumption of cannabis is permitted at the

facility,

The site location in the Grand Avenue corridor is ideal for a dispensary use. The

site is situated among other the commercial uses that are prevalent along the

Grand Avenue corridor. The proposed dlspensary is a reiail-only use which is

compatible with the other retail and commercial uses in the vicinity of the site.

The proposed dispensary is also consistent with the Village s Comprehensive

Ptan/ which envisions "indush'ial mixed use at this location. There are other

mixed uses to the east of the site/ which include commercial and residential uses.

The site conforms to the setbacks requirements of the State law and the Village's

Zoning Otdinance from schools.

Utilities, access roads/ drainage and other necessary facilities already exist at the

site. No additional improvements are needed for these facilities.

Both ingtess and egress alteady exist at the site. Theire is enough ingress and

egress for customers of the dispensary. The h-affic generated by the dispensary

will not create undue congestion in the public sheets/ and it will be consistent

with h-affic geneirated by other retail uses. Accordingly, the facility will not be a

detriment to public health, safety, and welfare.

c. Will not cmse substtwtwl injury to the vulife of other property m the neighborhood in which

itis to belocated.

As the retail use of the dispensaty is consistent with other existing uses in the

vicinity/ property values within the neighborhood will not be negatively affected.

The facility will be regulated by the State of Illinois/ and it will be required to

operate in accordance with the stringent regulations created for dispensary uses.

The dispensary use is compatible with, and outwardly indistinguishable from/ the

other retail and commetcial uses in the vicinity of tihe site. The Villages

Comprehensive Plan envisions an "Industrial Mixed-Use" which is consistent

with the proposed use. The dispensary is expected to draw customers from a large

area, thus bringing people to the Villagers Grand Avenue corridor. Accordingly,

the property values of neighboring properties will not be negatively affected.

d. Such special use shall confonn tn the applicable regulations of the distnct w wliich it is to he

located.

The application for the special use demonstrates that the requirements of the

applicable the C-l General Commercial Zoning Uisttict; are satisfied. ]n addition,

the site satisfies the Villagers setback requirements from school uses.

WHEREFORE, Applicant, FIoraMedex, LLC/ respectfully requests that the PZ make the

dforementionect written findings of fact and shall transmit same together with its

recommendation to the Board for final action.

Floramedex, LLC (the "Applicant") intends to operate an adult use cannabis disp&nsingorganization as defined by the Zoning Code of the Village ofBlmwood Park (the "Zoning Code")and continue its current operations as a medical cannabis dispensing organization. The Applicantis requesting a special use permit in the C-l District for Spmnal Condition Code No, 1407,04. TheApplicant is licensed as an adult use camiabis dispensing organization by tbc Illinois Departmentof Financial and Professional Regulation ("IDFPR") to sell cannabis for adult use beginningJanuary 1,2020.

WHEREAS, the President and Board of Trustees of the Village of Elmwood Park (the

"Village") have determined that it is advisable, necessary, and in the best interest of the Village

to amend Section 1412.02, entitled "Definitions," of Chapter 1412, entitled "Rules and

Definitions," of the Zoning Code of the Village ofEItnwood Park (the "Zoning Code") regarding

definitions ofcannabis and caimabis-related terms.

NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of

the Village ofElmwood Park, Cook County, Illinois, as follows;

Sticdpn 1. Section 1412,02, entitled "Definitions," of Chapter 1412, entitled "Rules

and Definitions," of the Zoning Code is hereby amended by adding the following definitions in

their proper alphabetical order, as follows:

ADULT USE CANNABIS DISPENSING ORGANIZATION: A facility operated by anorganization or business that is licensed by the Illinois Department of Financial and ProfessionalRegulation to acquire cannabis from licensed cannabis business establishments for the purpose ofselling or dispensing cannabis, cannabis-infused products, cannabis seeds, paraphernalia, orrelated supplies to purchasers or to qualified registered medical camiabis patients and caregivers,per the Camiabis Regulation and Tax Act. A facility that only acquires and dispenses medicaloannabis to registered medical cannabis patients shall be considered a Medical CannabisDispensing Organization, as defined herein.

CANNABIS: Marijuana, hashish, and other substances that are identified as including any partsof the plant Cannabis sativa and including derivatives or subspeoies, such as indica, of all strainsof cannabls, whether growing or not; the seeds thereof, the resin extracted from any part of theplant; and any compound, manufacture, salt, derivative, mixture, or preparation of the plant, itsseeds, or resin, including tetrahydrocannabinol (THC) and all other naturally producedcannabinol derivatives, whether produced directly or indirectly by extraction; however,"cannabis" does not include the mature stalks of the plant, Hber produced from the stalks, oil or

"Cannabis" does not includeindustrial hemp as defined and authorized under ihe Industrial Hemp Act. "Canmbis" alsomeans concentrate and cannabis"!nfused products,

CANNABIS BUStNESS ESTABl.lSHMENT: A cultivation center, craft grower, processingorganization, dispensing organization, infuser organization or tmnsporting organization.

CANNABIS CONCRNI'BATE: A product derived from cannabis that is produced by extractingcannabinoids from the plant through the use of propylenc glycol, glycerin, butter, olive oil orother typical cooking fats; water, ice, or dry ice> or Wane, propane, C02, ethanol, orisopropanol. The use of any other solvent is expressly prohibited unless and until it is approvedby the Department of Agriculture.

CANNABJS CRAFT GROWBR: A facility operated by an organization or business that islicensed by the IlUnols Department of Agriculture to cultivate, dry, cure and package cannabisand perform other necessary activities to make cannabis available for sale at a dispensingorganization or use at a processing organization, per the Cannabis Regulation and Tax Act.

CANNABIS CULTIVATION CENTER: A facility operated by an organization or business thatis licensed by the Illinois Department of Agriculture to cultivate, process, transport, and performother necessary activities to provide cannabis and cannabls-infased products to licensed cannabisbusiness establishments, per the Cannabis Regulation and Tax Act,

CANNABIS-INFUSED PRODUCT: A beverage, food, oil, ointment, tincture, topicalformulation, or another product containing caimabis that is not intended to be smoked,

CANNABIS INPUSER ORGANIZATION OR INEUSER: A facility operated by anorganization or business that is licensed by the Illinois Department of Agriculture to directlyincorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis-infused product, per the Camiabis Regulation and Tax. Act.

CANNABIS PROCESS1NO ORaANlZA'HON: A facility operated by an organization orbusiness that is licensed by the Illinois Department of AgricutUn'e to either extract constituentchemicals or compounds to produce cannabis concentrate or incorporate cannabis or cannabisconcentrate into a product formulation to produce a cannabis product, per the CannabisRegulation and Tax Act.

follows:

Prior to the authorization for a special use, and the granting of a special use permit, specialconditions where identified in section 1407.03 of this appendix shall be required In addition tocompliance with the requirements for satisfactory plans, specifications, public hearings and otherconditions which may be required. The following list of special conditions are identified by codenumbers corresponding to those which appear in section 1407.03 of this appendix in connectionwith specific special uses:

1, Such special use may be permitted on a lot which is located more than one hundred feet(100') from a residence district.

2. Such special use may be permitted where the owner satisfactorily establishes that there willbe no appreciable traffic congestion or hazard to pedestrian safety.

3, Such special use may be permitted where not more than five (5) persons will be employed onthe premises.

4. Such special use may be permitted above the ground floor.

5. Such special use may be permitted on a lot which is not less than ten thuusand (10,000)square feet in area.

6. Such special use may be permitted provided the total floor area does not exceed twenty fivethousand (25,000) square feet and provided that specifications verifying conformance to theperformance standards are approved by the director of code administration.

7. Such special use may be pemiitted only on lots which are not immediately adjacent andcontiguous to a residential district or to an established non-conforming residential use. Forthe purpose of this paragraph, the term "immediately adjacent and contiguous to" shall notinclude properties separated by a dedicated street or alley.

8. Such special use may be permitted with a front/coraer side yard from zero feet (0') to lessthan thirty feet (30!), provided the director of code administration determines the requiredsetback, having taken into account factors such as the established setbacks on adjacent lots,and the amount of off street parking to be created by such use.

9. Such special use may be permitted only for a Medical Cannabis Dlspensary Organization, asdefined in this Code, which, by December 31, 2019, held a valid registmlion under theCompassionate Use of Medical Cannabis Pilot Program, and continues to operate a medicalcannabis dispensary at the same location.

10, Only one such special use for an Adult Use Cannabis Dispensary Organization may bepermitted within the Village ofElmwood Park.

11, Consumption ofcannabis and cannabis-in fused products on the premises shall be prohibited.

12. Such special use may only be permitted subject to the execution of a DevelopmentAgreem&nt with the Village ofEInrwood Park.

Section 5. The corporate authorities of the Village intend that this Ordinance will be

made part of the Zoning Code and that sections of this Ordinance can be renumbered or

reiettered and the word "Ordinance" can be changed to "Section," "Article," Chapter" or some

other appropriate word or phrase to accomplish codification, and regardless of whether this

Ordinance is ever codified, the Ordinance can be renumbered or relettered and typograpl-iical

errors can be corrected with the authorization of the Village Attorney, or his or her designee.

Section 6. All parts of the Village Code in conflict with the terms or provisions of

this Ordinance shall be and the same are hereby amended or repealed to the extent of such

conflict, and said Village Code and all other existing ordinances shall otherwise remain in full

force and effect.

Section 7. If any section, subsection, paragraph, sentence, clause or phrase of this

Ordinance or any part thereof is, for any reason, held to be unconstitutional or invalid or

ineffective by any court of competent jurisdiction, such decision shall not affect the validity or

effectiveness of the remaining portions of this Ordinance, or any part thereof. The corporate

authorities hereby declare that they would have passed each section, subsection, subdivision,

paragraph, sentence, clause or phrase thereof irrespective of the fact that any one or more

sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared

unconstitutional) invalid or ineffective.
