REQUEST FOR PROPOSALS

DESCRIPTION OF WORK The City of Milwaukee Department of Neighborhood Services contracts for the razing and removal of various types of buildings. On an annual basis, based on past experience, DNS contracts for the demolition and/or deconstruction of approximately 60 single family dwellings, 80 two family dwellings, 10 multifamily dwellings, 10 mixed-use buildings and 15 commercial buildings. Prior to the advertising for bids for the demolition or deconstruction of structures, it must first be ascertained if asbestos and/or other hazardous materials requiring special removal techniques are present in each building. Proposals are being solicited from qualified firms to perform site inspections of each property. The site inspection will entail inspecting both the interior and exterior of each property for asbestos, solid hazardous wastes and stored hazardous materials, and supplying the City of Milwaukee with a written report indicating the presence of asbestos and/or other hazardous materials, their type, location and accurate square and/or linear footage. The site inspection will include, when requested by the City, testing painted concrete and masonry surfaces for the presence of lead and supplying the City of Milwaukee with a written report indicating the quantity, location and accurate square footages. Cost estimates for removing any confirmed asbestos containing material, lead impacted areas and/or other hazardous material shall be provided separately from each type-written or electronically submitted report. The successful proposer will be awarded a 12-month contract. The contract may be extended for four additional 12-month periods at the option of the Department. If the contract should be renewed after its initial one-year term, the rate of payment shall be increased effective the first day on any such renewal term in the ratio that the Milwaukee Consumer Price Index has changed from the initial date of the contract or from the date of the last rate adjustment.

SELECTION CRITERIA Before a firm will be awarded a contract, the firm must have supplied to the City of Milwaukee Department of Neighborhood Services the firm's resume with business references and an outline of the training and qualifications of the personnel who will be performing the inspections and proof of insurance as outlined in this Request for Proposals. All proposals shall include information about your firm's capabilities and past experiences, particularly relative to the type being undertaken in this project. All proposals shall include a sample of an asbestos report, a sample of a lead report and a pre-demolition environmental checklist. Persons conducting inspections for asbestos must be certified by the Wisconsin Department of Health Services. Proof of certifications must be included in the proposal. Any other information which will demonstrate abilities to perform the required services should also be included. A contract, if awarded, will be awarded to the successful proposer based on cost of services, training and experience and the ability to meet the City’s needs. Proposals will be evaluated using the following percentages: Cost of services 40% Experience of firm for providing services of similar scope and size. 25% Ability to meet City needs. 35% (estimated time for performance, sample of reports and environmental checklist, sample of invoice) Ability to meet SBE requirements Pass/Fail

REQUIREMENTS AND CONDITIONS A. GENERAL The asbestos inspection work performed under this contract shall consist of the identification, measuring, quantifying, testing and estimating the cost of removal of RACM, Category I and Category II non-friable asbestos containing materials. Requests for pre-deconstruction inspections must include sampling of all materials suspected to contain Category I and Category II non-friable asbestos as well as other materials normally assumed to contain Category I and Category II non-friable asbestos. This is to minimize worker exposure and to maximize reuse, repurpose and recycling of materials. The lead inspection work performed under this contract shall consist of the identification, measuring, quantifying, testing of lead impacted painted concrete and masonry surfaces when service is requested by City. Contractor will also be responsible for notifying DNS of the presence and approximate areas of painted masonry surfaces when found when service not requested. The hazardous material inspection performed under this contract shall consist of the cataloging of any hazardous materials on the site to include location, quantity, type and how stored. Besides asbestos, hazardous materials may include but not be limited to: ♦ CFC’s (chlorofluorocarbons) ♦ HCFC’s (hydrochlorofluorocarbons) ♦ Lead ♦ Mercury ♦ PCB’s (polychlorinated biphenyls) ♦ Batteries ♦ Oil, petroleum based products ♦ Tires On request, contractor must be able to assist DNS inspectors in identification of possible additional asbestos containing materials or other hazardous materials when discovered during the demolition or deconstruction process.

B. SCOPE OF WORK The work under this contract shall be done in accordance with the current City of Milwaukee Health Department's Asbestos Inspection and Sampling Protocol (copy attached) and the Pre-demolition Environmental Checklist and Guide for solid hazardous waste (copy attached). Contractor must provide separate typewritten reports for each structure on the parcel that includes the information required per Wisconsin Department of Natural Resources document PUB AM-401 2010, Asbestos Building Inspection Report Guidelines (copy included): http://dnr.wi.gov/files/PDF/pubs/am/AM401.pdf Additionally, Reports must include: 1. The name, address and contact person of the laboratory providing the

analysis. 2. A listing of all other hazardous wastes, their type, location in building and approximate quantities. 3. A map of the structure indicating sampling locations and locations of other hazardous wastes identified in the report. Contractor must also submit an electronic copy of each report via email to the department. Reports must be submitted in either Microsoft Word Document or PDF format. Contractor's invoice must list address of structure inspected and breakdown of costs incurred. Contractor must provide a cost estimate for the removal and disposal of any confirmed asbestos or hazardous materials.

On request, Contractor must provide clearance testing after an asbestos abatement activity has been completed. A report of the results of all clearance testing shall be prepared and submitted to the Department. The City of M ilwaukee w ill pay only 50 percent of the contractor’s labor charges for w ritten reports w ith sample results that are not provided w ithin the time the Proposer indicated in this Request for Proposals. The City does not w aive any other legal recourse available to it for failure of the Contractor to timely perform.

C. Insurance

A. General Requirements A certificate of insurance acceptable to City evidencing the insurance requirements is to be provided to the Commissioner. Certification shall state that the insurance policies issued to the Contractor meet the requirements as outlined below. All certificates are to be provided prior to final execution of this Contract. If the Contractor does not comply with this provision of the Contract, the City of Milwaukee has the authority to declare this Contract terminated. The City, as an additional insured, shall be provided with at least 30 days written notice of cancellation, non-renewal or material limitation of coverage of any and all insurance policies required by this contract for any reason, including non-payment of premium. This should be accomplished through the addition of an endorsement to the policy/ies providing Earlier Notice of Cancellation or Non-Renewal. Such endorsement must contain the following stipulation:

We will mail notice of cancellation (including for nonpayment of premium), non-renewal or material limitation of coverage to the organization shown in the schedule above. We will mail the notice at least 30 days before the effective date of our action.

Insurance companies must be acceptable to City and must have a current A.M. Best rating of A- VIII or better. All policies shall be written on an occurrence form. If subcontractors are used, each must meet all of the requirements herein. B. Coverage must be equivalent to ISO form CG0001 or better. . The City of Milwaukee shall be added as an additional insured using ISO form CG2026 or its equivalent. . Coverage shall be modified to include a Waiver of Subrogation Endorsement in favor of City including its directors, officers, agents, employees and volunteers. . The policy shall include independent contractors (owners/contractors protective) and contractual liability. . Coverage will apply on a primary and non-contributory basis. We suggest the following wording: “If you have agreed in a written contract that this policy will be primary and without right of contribution from any insurance in force for an Additional Insured for liability arising out of your operations, and the contract was executed prior to the bodily injury, property damage, personal injury or advertising injury, then this insurance will be primary over, and we will not seek contribution from, such insurance.” . Coverage shall apply to the risks associated with or arising out of the services provided under this contract, including but not limited to asbestos abatement, lead abatement and air, ground or water pollution.

(3) Auto Liability Combined Single Limit $1,000,000 each accident Uninsured/Underinsured Motorists $1,000,000 each accident Medical Expense $ 5,000 each person . Coverage shall be modified to include a Waiver of Subrogation Endorsement in favor of City including its directors, officers, agents, employees and volunteers. . If the Contractor owns or leases any vehicles, coverage must be for Any Auto (Symbol 1). If there are no owned or leased vehicles then coverage must be for Hired and Non-Owned Autos (Symbols 8 and 9). . Coverage shall include contractual liability for risks assumed in this contract. (4) Umbrella (Excess) Liability $5,000,000 per occurrence Umbrella (excess) Liability $5,000,000 aggregate . The Umbrella Liability insurance shall provide coverage excess of the Employer’s Liability, Commercial General Liability and Auto Liability Coverages. C. Worker's Compensation Insurance The Contractor shall carry or require that there be carried Worker's Compensation insurance for all employees and those of any subcontractors engaged in work at the site, in accordance with State of Wisconsin Worker's Compensation Laws, Chapter 102, Stats. D. Proof of Coverage Before a contract will be awarded to it, the Contractor shall submit evidence of the insurance coverage required above to the Commissioner for review and approval. The policies shall be scheduled on approved forms, and approved as to form and execution by the City Attorney's Office. New policies from other companies shall be provided in place of those disapproved. Such insurance shall be carried with financially responsible insurance companies, licensed in the State and approved by the City Attorney, and shall be kept in force until the Contractor's work is accepted by the Commissioner. Contracts of insurance (covering all operations under this contract) which expire before the completion of all work to be performed under this contract shall be renewed and extended at least up through and including the date of such completion and evidence submitted to the Commissioner for approval E. The Contractor's policies of insurance, except for Worker's Compensation, shall specifically name the City of Milwaukee as an additional insured. The said insurance carrier shall be authorized to sell insurance in the State of Wisconsin and shall submit its agent's license with the certificate. Such certificate of insurance shall also have affixed thereto an affidavit setting forth that no officer, official or employee of the City has any interest, directly or indirectly, in any premium, commission or fee, or furnishing of such certificate of insurance. Any insurance provision listed herein requiring a change in the types or amounts of coverages previously required of contractors shall become effective on the next policy renewal date for all existing policies in effect on the date the contract is entered into. E. Indemnification The Contractor shall indemnify, defend and hold harmless the City of Milwaukee, its officers, employees, and agents, against all liability for damages occasioned by the digging up, use or occupancy of the street, alley, highway, public grounds, and private grounds, or which may result therefrom, or which may result in any way from the negligence or carelessness of the Contractor or the Contractor's agents, employees, or workers, by reason of the elements, unforeseen or unusual difficulties, obstructions, or obstacles encountered in the prosecution of the work. Further, the Contractor shall indemnify and hold the city harmless for all claims and liabilities, actions, causes of action, and liens for materials furnished or labor performed in the execution of the work and from all costs, charges, and expenses incurred in defending such suits or actions and from and against all claims and liabilities for injury or damage to persons or property emanating from the acts, errors, omissions and negligence of the Contractor, including but not limited to defective or careless work methods.

D. ERRORS AND OMISSIONS The asbestos consultant contractor will be responsible for payment of costs incurred above and beyond the minimum costs previously paid for similar types of abatement when clearly visible asbestos-containing or other hazardous materials are not identified in the initial inspection. The City of Milwaukee will grant the contractor an opportunity to review and recommend solutions when clearly visible asbestos-containing or other hazardous materials are not identified in the initial inspection. The City of Milwaukee reserves the right to make the final decision on corrective action. E. CONFLICT OF INTEREST By submitting a proposal, the proposer agrees that neither the proposer, nor any officer, partner, agent or employee of the proposer, shall have any affiliation with, or financial interest in, a company performing demolition services for the City or a company performing asbestos abatement activities or removal of hazardous materials in conjunction with demolition services for the City. This includes, but is not limited to, asbestos abatement, lead abatement, tank assessment or removal, waste tire hauling and disposal. F. COLLUSIVE AGREEMENTS Each contractor must execute and include with the proposal an affidavit in the form provided to the effect that contractor has not colluded with any other person, firm or corporation in regard to any proposal submitted. G. EQUAL EMPLOYMENT OPPORTUNITY Contractor agrees to not discriminate against any qualified employee or qualified applicant for employment because of sex, race, religion, color, national origin or ancestry, age, disability, lawful source of income, marital status, sexual orientation, gender identity or expression, past or present membership in the military service, familial status, or based upon affiliation with, or perceived affiliation with any of these protected categories, and Contractor also agrees to include a similar provision in all subcontracts. Contractor must agree that they will comply with all applicable requirements of the Americans with Disabilities Act of 1990, 42 U.S.C. ss. 12101 et seq.

H. PROMPT PAYMENT It is the City's policy to pay all invoices within 30 days. If the City does not make payment within 45 days after receipt of properly completed supporting payment and other required contract documentation, the City shall pay simple interest beginning with the 31st calendar day at the rate of one percent per month (unless the amount due is subject to a good-faith dispute and, before the 45th day of receipt, notice of the dispute is sent to the contractor by first-class mail, personally delivered, or sent in accordance with the notice provisions in the contract). If there are subcontractors, consistent with s.66.0135(3), Wis. Stats., the prime contractor must pay the subcontractors for satisfactory work within seven days of the contractor's receipt of payment from the City of Milwaukee, or seven days from receipt of a properly submitted and approved invoice from the subcontractor, whichever is later. If the contractor fails to make timely payment to a subcontractor, the contractor shall pay interest at the rate of 12 percent per year, compounded monthly, beginning with the 8th calendar day. Reference Common Council File No. 101137 adopted January 2011. I. Introduction This packet was developed by the City of Milwaukee Department of Neighborhood Services and City of Milwaukee Health Department with assistance from the Department of Natural Resources and Milwaukee area environmental consultants and asbestos abatement contractors. This packet was developed to be used by property owners, general contractors, consultants, inspectors and asbestos abatement contractors for the purpose of defining inspection and sampling requirements related to the identification of asbestos containing materials prior to undertaking demolition and renovation activities in buildings. Situations may exist which are not described in this packet. In these cases the user must contact the specific government agency for clarification and guidance to avoid penalties. Asbestos Inspection and Sampling Protocol for Building Areas to be Renovated or Demolished

Prior to beginning demolition, renovation or salvage activities in any building, the building owner or contractor shall, at a minimum, inspect the building areas to be disturbed for asbestos containing materials using the following protocol. Furthermore, when the project involves demolition of any building or renovation or salvage activities in a commercial building or in a residential building with three or more living units the inspection must be conducted by an inspector who holds a valid asbestos inspector certification card issued by the State of Wisconsin Department of Health Services. A copy of this inspection report must be on the site at all times renovation or demolition activities are in progress. Definitions: Asbestos containing material (ACM) - means any friable material which contains detectable asbestos (including trace amounts) when analyzed by polarized light microscopy (PLM). Should PLM results for a sample of friable material indicate the presence of asbestos but further analysis by point counting methods reveals the asbestos content is not greater than 1%, that sample need not be considered an asbestos containing material. Asbestos containing material also means any non-friable material containing more than 1 % asbestos when analyzed by PLM. Asbestos debris - means pieces of ACM that can be identified by color, texture or composition. Asbestos debris also means dust, if the dust is determined by a certified inspector to be ACM. Demolition - means the wrecking of any building or portion of a building where a load supporting structural member is removed. Friable - means a material that when dry can be crumbled, pulverized or reduced to a powder by hand pressure. Homogeneous area - means an area of surfacing material, thermal system insulation or miscellaneous material that is uniform in color and texture. Plaster and drywall systems may be considered homogeneous if surface color (paint) is the only discernable variable. Miscellaneous material - means building material on structural members or fixtures that is not surfacing material or thermal system insulation. Miscellaneous materials include but are not limited to floor tile, mastics, paper backing of resilient flooring or sheet goods, grouts, ceiling tiles, drywall panels, joint compound, roofing materials, transite and resilient siding, flexible duct connectors, and mortars. Renovation - means any alteration, modification or replacement of any part or component of a building or structure.

Surfacing material - means material that is sprayed on, troweled on or otherwise applied to surfaces, such as acoustical or decorative coatings on walls or ceilings, stucco, fireproofing materials on structural members, or other materials on surfaces for acoustical, decorative fireproofing, or other purposes. Plaster is considered a surfacing material. Thermal system insulation - means material applied to pipes, fittings, boilers, breaching, tanks, ducts or other structural components to prevent heat loss or gain or water condensation. Inspection Procedure Step 1 Locate and quantify all homogeneous areas of surfacing materials, thermal system insulation and miscellaneous materials in areas to be demolished or renovated. Note any possible asbestos debris that is present due to deterioration or damage in the above areas. Unless assumed to be ACM, all types of floor tiles in all layers must be inspected and sampled. Whenever necessary, destructive sampling must be done to access ducts and/or pipes in walls or chases and in areas above suspended ceilings to determine if ACM is present. Step 2 Obtain randomly distributed samples from each homogeneous area as listed in Table I. A material may be assumed to be ACM without sampling or based on the analytical results of fewer samples. Step 3 Analysis of samples shall be performed by persons or laboratories with proficiency demonstrated by current successful participation in a nationally recognized testing program such as the National Voluntary Laboratory Accreditation Program (NVLAP) or the National Institute for Standards and Technology (NIST) or the Round Robin for bulk samples administered by the American Industrial Hygiene Association (AIHA) or an equivalent nationally recognized round robin testing program. For renovation projects, composite sample results for drywall/joint compound systems should be obtained in addition to the individual component results for the purpose of determining WDNR reporting requirements and appropriate permit exemption fees. Any acoustical or decorative coatings on any substrate shall be tested as a surfacing material independent of the substrate. Step 4 Tabulate results by property address. Show the location and square or linear footage of each homogeneous area. Quantify all assumed materials such as floor tile and resilient roofing and siding as ACM (note multiple layers). If ducts and pipes inside walls could not be visually inspected, they must be assumed ACM. The inspector's name, address, phone number, certification number and date of inspection must appear on each report.

Example of minimum sampling requirement A residential duplex to be demolished for approved landfill disposal is found to contain 4,000 square feet of plaster walls and ceilings that appear homogeneous. The plaster is composed of a thick dark gray layer and a thin light gray layer. In addition, 2,200 square feet of drywall is present which appears to be homogeneous as judged by cross sectional appearance and type of joint compound applied. An acoustical surfacing material has been applied to 210 square feet of a dry wall ceiling. One by one ceiling tiles were found on an additional 160 square feet. Three layers of non-friable floor tile (144 square feet each) are present. The roofing is more than one layer of resilient shingle. No insulating materials were present on the furnace, ducts, pipes and no other suspected ACM was found on the property. The following samples would be taken during the pre-demolition inspection. All ACM and presumed ACM must be removed prior to intentionally burning a building for any purpose. **Backing paper on resilient sheet goods or flooring is considered a friable material and must be sampled prior to renovation/demolition activities. If the paper contains more than 1% asbestos, then it must be removed prior to activities that would disturb the material. ***Composite Samples of dry wall/joint compound systems are required for demolitions, however, all renovations and partial or hand demolitions require individual, non-composite testing of dry wall and joint compound to properly access potential public and worker exposure.
