SEIU LOCAL 521 - OFFICIAL ELECTION NOTICE RULES

AND PROCEDURES FOR 2017 CEO SPECIAL ELECTION

PREAMBLE

1. All Election Committee members and candidates will receive a copy of the

election rules. These rules will also be posted on the Local 521 website:

www.seiu521.org.

2. These election rules and procedures were approved by the SEIU 521 Officers on

November 16, 2016, and must be followed by candidates, members, and staff.

3. Candidates should be aware that Department of Labor election guidelines forbid

the use of union or employer resources in election campaigns. Campaigning at

worksites during work hours and use of employer or Local 521 email is a violation

under Department of Labor guidelines (see "Campaigning" and "Union/Employer

Resources" listed in this document).

4. These election rules and procedures are in effect for the 2017 special election of a

CEO to serve for the remainder of the Executive Board term of March 1, 2017 -

February 28, 2019.

SECTION 1: NOTICE OF ELECTION

All members shall be notified of an election not less than 90 days prior to the

commencement of voting, and notified of nominations no less than 30 days before their

close [521CBL VIII.4]1. The notice reads as follows:

“OFFICIAL ANNOUNCEMENT: From January 24-31, 2017, a special election will be held to

elect SEIU Local 521’s Chief Elected Officer to fill the remaining two years of the 2016-2019

term of office. Members will also be voting on amendments to the 521 Localwide Bylaws.

Luisa Blue was elected by the International Union to a full-time position in Washington D.C

in May 2016. Under our bylaws, SEIU 521 must hold a special election to fill the remainder

of her term of office. We have scheduled seven days of voting, from January 24-31, 2017,

for members to select the person who they believe would best manage and lead our union

for the remainder of Luisa's term. There will be voting locations at worksites throughout the

Local; exact locations to come.

questions. Download the nomination petition from www.seiu521.org or call your Local 521

office to have one sent to you.”

SECTION 2: NOMINATION PETITIONS

Petition forms are available for download from Local 521 website: www.seiu521.org.

They may also be picked up at your staffed Local Union office (or from your worksite

organizer when available).

a. Nomination petitions require signatures from 25 members in good standing

from any 521 chapter. Fee payers and inactive members are ineligible to

sign. Extra signature spaces are provided in the event that one or more

individuals who signed were ineligible to do so. [521CBL VIII.1].

b. A member may nominate her/himself and sign her/his own petition.

Signatures may be collected on more than one petition form. [521CBL VIII.1]

SECTION 3: NOMINATION MEETING

A nomination meeting is scheduled for Thursday, December 8, 2016 at 5:30 p.m.

Via video conference in the San Jose, Fresno, Salinas, Bakersfield and Visalia offices.

At this meeting, a nomination and the required second may be made by members in

good standing eligible to vote for the CEO.

a. Membership eligibility will be checked at the door by administrative staff.

Fee payers must sign a membership card to enter into the meeting.

b. Members working in areas receiving a mail ballot [Section 18.c of this document]

whose work location has fewer than 25 members can mail their nomination

petition to SEIU Local 521’s San Jose office to be submitted to the

nomination meeting. Petitions must be postmarked by December 1, 2016.

Notices explaining the process were sent to members in October 2016.

SECTION 4: ELECTION COMMITTEE

A three-member committee was appointed by the President and approved by the

Executive Board at the June 25, 2016 meeting.

a. The Election Committee will not be candidates for, nor actively campaign for,

any nominee or candidate for CEO during the term of their appointment.

b. The Election Committee has established these rules and procedures for fair

and democratic elections in accordance with the local bylaws, the bylaws of

the International Union and labor law, including method of balloting,

overseeing tabulation of results and certifying of election results. [521CBL

c. The Election Committee may, as appropriate, be assisted by Local Union

staff and counsel in performing administrative and clerical functions, although

at all times the Election Committee should be responsible for the conduct of

the election. [SEIUEG pg.4]

d. The committee may select a chair and keep a record of all its decisions.

Candidates, who due to their own conduct or the conduct of their campaigns,

are found to be in violation of the election rules face the possibility of being

declared ineligible by the Election Committee.

SECTION 5: ELECTION ADMINISTRATOR

The Local 521 Election Committee has authorized the contracting of the services of an

Election Administrator who is responsible for the conduct of the election in accordance

with these rules, and in consultation with the Election Committee as appropriate. The

American Arbitration Association (AAA) has been selected by the Executive Board at

the June 2016 meeting. The Election Administrator’s duties will include:

a. Prepare ballot types for the various voting locations; numerically coding the

membership list and preparing the ballot packets.

b. Local Union administrative staff will work with the Election Administrator to

verify union membership and ID ballot type for voting purposes.

c. The Election Administrator is responsible for receiving and securing ballots

during the entire voting process from January 24, 2017 to January 31, 2017.

d. Vote Count: The vote count is scheduled for January 31, 2017 at 5:00 pm.

The vote count will be conducted by AAA at Local 521 San Jose office

located at 2302 Zanker Road, San Jose 95131. Offices w/ video conference

will be able to see the vote count live. The process will consist of the

Election Administrator scanning the ballots under the observation of the

Election Committee members, providing the certification of results

at the end of the vote count, and retaining all ballots and related files for a

one-year period.

SECTION 6: QUALIFICATION OF CANDIDATES

A person is eligible to be a candidate for office of the Local Union if they have been

a member in continuous good standing in the Local Union for at least two years

immediately preceding nominations and have, during all of that time, paid the full

dues required for working members of the Local Union within each month when

due. (Effective October 1, 2016 thru October 31, 2016.) [SEIUCB Article VX, Section 2]

a. The two-year requirement is waived if the candidate has been a full dues-

paying member in good standing since the time of affiliation of their chapter.

i. Definition of “Continuous Good Standing”: "Continuous good standing"

means that the member has paid all dues and other financial

obligations on or before the last day of each month when due.

ii. A member who falls behind in their dues and then makes retroactive

dues payments does not satisfy this requirement. [SEIUCB Article XIII,

Section 2]

iii. The good standing of a member should be determined by using the

most recent records reflecting the payment of dues. Because

nominations may be conducted in the middle of a month and members

have until the end of the month to pay their dues, good standing

should be determined based upon the last complete month for which

the Local Union has records. [SEIUCB]

b. In accordance with International Union Bylaws, a member who wishes to be

a candidate for any office of the Local Union shall not have been convicted of

an applicable felony [LMRDA] [521CBL VIII.3]

c. Local Union employees are eligible to run for the office of Chief Elected

Officer. If a member of the Local Union has previously been an employee,

time spent as an employee shall be counted toward the two year

membership requirement if the person was a member of the Local Union

when employed by the Local Union and was paying full dues. [521CBL VIII.3]

d. Write-in candidates and proxy voting shall not be permitted in any Local

Union election. [521CBL VIII.6]

e. If only one (1) eligible candidate is nominated for an office they shall be

deemed duly elected.

SECTION 7: ACCEPTANCE OF NOMINATION A candidate who has been properly nominated must sign and submit the Acceptance of

Nomination form no later than 5:00 p.m., Wednesday, December 28, 2016, according

to election rules, in order to have her/his name placed on the ballot. A candidate is

considered bona fide upon signing and completing said form.

SECTION 8: ELECTION CHALLENGES DURING NOMINATION AND CAMPAIGNING

PERIOD

Any challenge or protest concerning the conduct of the nomination and campaigning

period must be submitted in writing within 48 hours of the incident to

[email protected]. The Elections Committee will respond to the protest within 48

hours of receipt.

SECTION 9: CANDIDATE STATEMENTS

a. Candidate statements are optional. A candidate may submit a statement of

up to 75 words in length that will be included in the candidate booklet. It is

the candidate’s responsibility to submit their statement by the deadline.

Candidates must provide a soft copy via email. Candidates may email their

statements to [email protected]. Statements must be received by

5:00pm January 4, 2017. MS Word format is preferred. Statements sent only

as hard copies (whether typed or handwritten; via U.S. mail, fax or hand

delivery) will be photocopied and added into the booklet as is.

b. Local 521 will include the candidate's full name, job classification,

chapter/employer, and years of service with Local 521; this information is not

part of the 75-word count.

c. Candidate statements will be published exactly how they were provided by

the candidate. Local 521 will NOT edit, clarify, spell-check or correct any

statement. Statements exceeding 75 words will be cut off at the 75-word limit

for the booklet. It is the candidate’s responsibility to make sure everything is

worded and spelled correctly, and the word limit is adhered to.

d. A candidate may also electronically submit a statement of up to 500 words in

length that will be posted in the elections area of the Local 521 website. 500-

word statements must also meet the deadline of 5:00pm January 4, 2017.

If the candidate statement exceeds the 500 word limit, it will be

cut off at 500 words.

A candidate who wishes to have her/his statement translated into

another language must provide their own translated version at

their expense.

e. Candidate Statement Booklets: Candidates will be provided 10 candidate

booklets (one commemorative color copy and 9 black/white copies).

Booklets will also be posted on Local 521 website, and mailed to members

who receive a mail ballot. Additional booklets can be purchased at

candidate’s request. Submit request in writing to [email protected].

Indicate the number of copies; define color or black/white and when booklets

are needed. Allow 24 hours for each request. Local 521 will invoice the

candidate for copying and labor. Payment of additional booklets must be

made at time of request.

SECTION 10: CANDIDATE PHOTOS

Candidates are welcome to submit headshots (electronic files only). Photos must be

submitted electronically via email to [email protected]. Submission of headshot

must also meet the candidate statement deadline of Wednesday, January 4, 2017 by

5:00 pm. Full body shots are not allowed. Acceptable electronic photo formats are

JPEG, GIF, and TIFF. Local Union staff will be available to take a photo of any candidate

at a STAFFED Local Union office Monday thru Friday, 9:00 to 3:00, from November 14,

2016 thru December 28, 2016 (excluding weekends and holidays) BY APPOINTMENT

ONLY.

SECTION 11: CANDIDATE LISTING

Candidates will be listed on the ballot in ALPHABETICAL ORDER by their last name.

SECTION 12: UNION/EMPLOYER RESOURCES

Section 401(g) of the LMRDA prohibits the use of any employer or union funds to

promote the candidacy of any person to union office. This prohibition applies to in-kind

contributions, as well as cash contributions and expenditures. It applies to indirect as

well as direct expenditures and contributions. The monetary value of the union or

employer funds or resources involved is not significant. Any expenditure on behalf of a

candidate, even if the amount is small, is a violation and constitutes grounds to set

aside an election. [SEIUEG: pg. 18]

a. The use of union and employer funds (including cash, facilities, employer

email, equipment, supplies, and campaigning on time paid for by the union or

employer) to support any candidate is prohibited.

b. No candidate or prospective candidate may solicit or accept financial support

or any other direct or indirect support of any kind from any non-member of

Service Employees International Union.

c. Local 521 Chapter, Bargaining Unit, Caucus, and Committee newsletters,

publications, e-mails, and social media (Facebook, Twitter, etc.) cannot

feature or provide unusual coverage of candidates during the election period,

but chapters/bargaining units are encouraged to remind members to vote

and publish the election schedule in newsletters.

SECTION 13: INSPECTION OF VOTER LIST

A bona fide candidate has a right to inspect (but not photograph or copy in any manner)

the list of members eligible to vote for that office between December 12, 2016 and

January 12, 2017. Requests to review the list must be made by Appointment Only.

SECTION 14: CAMPAIGN LITERATURE / ROBOCALLS

A candidate has the right to mail campaign literature to members eligible to vote for that

office entirely at the candidate's expense. [521CBL VIII.8] To exercise this right, a

candidate must use a mailing house approved by the Election Committee. Upon

payment by the candidate in advance, the mailing house will order lists from the Local

Union office. To make arrangements for mailing assistance, contact Pam Rodgers,

Administrative Director: email your requests to: [email protected].

a. The cost of a list and Robocalls will be a $50 setup fee and $.02 per name

for each type of request. All such campaign materials must state that they

are solely paid for by the candidate. For Robocalls, we will work with the

candidate to get the message uploaded. A disclaimer will be required to

indicate which candidate has paid for the call.

SECTION 15: CAMPAIGNING – CANDIDATES

Local 521 will not discriminate in favor of or against any candidate in any Local or

Chapter election. For example, if a candidate is invited to speak at a union meeting, all

candidates for the same position should be invited to speak at the same meeting.

a. Candidates must campaign on their own time, which may include paid

vacation time.

b. Candidates must limit their campaigning to the non-work time of the

members; for example, breaks or lunches, before or after work.

c. Candidates cannot use any SEIU/Local 521/Community First logos or Local

521 letterhead for their campaign materials.

SECTION 16: CAMPAIGNING – UNION STAFF

While performing their duties, all Local Union staff must remain uninvolved and neutral

in relation to candidate endorsements and campaign activities.

a. To balance the rights of Union staff who are Local Union members, to run for

office and participate in local wide elections with the potentially unfair

advantage they may have by virtue of their temporary or permanent role as

staff in the union, there must be strict adherence to the DOL Rules.

b. The appearance of violations must be strictly avoided. Therefore, the Local

Union has established strict rules and policies to monitor and to implement

the Department of Labor laws as they pertain to staff participation in Local

wide elections.

c. Staff must be on pre-approved time off for campaigning. They will be

required to sign a document stating that they understand the rules and will

abide by the rules. Violation of the campaign election rules could lead to

possible discipline up to and including termination.

d. Any activities they perform on behalf of themselves or another candidate

must be clearly understood as their own position, not that of the Local Union.

e. During the election cycle, the Election Committee and Trustees will be

available to answer questions, complaints and concerns about any such

possible infractions and will take immediate action where necessary.

SECTION 17: BALLOT PROCEDURES FOR ON-SITE AND MAIL BALLOT

a. On-Site Voting Method

Balloting for Local Union Offices will be held at Local Union offices and/or worksite

polling stations, in such a manner that facilitates the widest practicable participation

by members. [521CBL VIII.7]

Voter Identification: Members will be verified to confirm their membership

eligibility prior to receiving an actual ballot. [SEIUEG: pg. 24]

b. Polling Stations

Scheduled voting times will be strictly adhered to, except that anyone waiting in line

at the polling place at the end of the voting period will be allowed to vote. No

campaigning is allowed within 25 feet of a polling station in operation. [SEIUEG p.27]

In some locations such as a library or courthouse, no campaigning is

allowed in the building whatsoever. In that case, all campaigning must be

done outside of the facility.

c. Election Observers

A candidate may designate one or more persons to observe of all phases of the

election process. A designee must be a Union member or may be the candidate

her/himself. [LMRDA Sec. 401 (e)]

d. Double Voting

In the event that more than one vote has been cast by a voter, none of the ballots of

that voter shall be counted.

e. Mail-In Ballots

Members who work greater than 60 minutes away, or retired members living more

than 60 minutes from their nearest voting location, will be mailed ballots with a

return mail envelope. Mail-in ballots must be received by AAA by 5:00pm on

January 30, 2017 to be included in the vote count. Mail ballots will be sent to:

f. Mail Ballot & Duplicate Ballot requests: AAA has provided a toll-free phone number

for ballot resolution which is available Monday - Friday, from 9 a.m. to 5 p.m. (PST).

If a member requires a replacement ballot, they should contact AAA at 800-273-

0726 for further assistance.

SECTION 18: BALLOT PROCEDURES FOR CERTIFICATION

a) Certification of Election

The candidate for office receiving the most votes shall be certified by the AAA &

Election Committee as the winner.

b) Plurality vs. Majority

The candidate receiving the most votes wins. If there’s a tie, then there will be a runoff

election as soon as possible.

c) Runoff Election

A notice of runoff election must be mailed to each member at least 15 days prior to the

rerun of election.

i. A runoff election will be required for the seat of Chief Elected Officer.

ii. Election results of the runoff will be posted to the membership on the Local 521

website and via email blast on the next business day and published in the

current newsletters.

SECTION 19: BALLOT COUNT

All ballots will be delivered to the Local 521 office at 2302 Zanker Road, San Jose CA

95131 in time for the vote count to be held on January 31, 2017 at 5:00pm. The ballots will

be opened and counted by the Election Administrator in consultation with Election

Committee. Candidates, members, Local 521 staff/counsel and approved Election

Administrator are permitted in the vote count area.

a. Candidates may also send an observer to witness the count on their behalf.

SECTION 20: CHALLENGED BALLOTS

In the event any ballots are challenged by candidates or observers or the Election

Committee at the counting of ballots, said challenged ballots shall be set aside prior to

opening and counting of unchallenged ballots, and the Election Administrator in

consultation with the Election Committee shall determine the validity of the challenges.

Unresolved challenged ballots insufficient in number to affect the election results shall not

be counted.

SECTION 21: ELECTION PROTESTS – POST-ELECTION

Any challenge or protest concerning the conduct of the election must be submitted in

writing within (5) five calendar days of the election results. Election challenges should cite

specific facts set forth of the challenge or protest.

a. Election challenges must be received by the Election Committee c/o SEIU Local

521, 2302 Zanker Road, San Jose CA 95131 no later than 5:00 p.m. on February 5,

2017. The committee will investigate challenges and issue a report no later than

February 10, 2017. Untimely challenges or protests will not be considered.

Challenges to the election will be considered only if they cite specific violations of

election rules and procedures and/or the Local 521 bylaws, and if the alleged

violation may have affected the outcome of the election.

b. The officers who are elected will be sworn in and take office at the time provided for

in the Local 521 Bylaws even when a protest has been filed over the election. The

filing of a protest does not stay the normal process for certifying the election results

and for swearing in new officers. If the protest is ultimately sustained, the final

decision will dictate whether a new election should be held or whether different

individuals should assume office. If a new election is ordered, the officers who won

the contested election will continue in office until the rerun election has been

completed, at which time the winners in the re-off election, if different, should be

sworn in and assume office.

SECTION 22: TRUSTEES - ELECTION OVERSIGHT FOR ELECTIONS AND APPEALS

The Trustees of the Local Union shall act as judge in all matters arising from the

election procedures of the Local Union and shall hear all protests of an election. Any

challenge or protest must be submitted in writing within (5) five calendar days of the

election results. The Trustees shall have up to an additional 5 (five) calendar days

after a protest is received to research the protest and render a decision. Members

not satisfied with a ruling of the Trustees on an election matter may appeal such

ruling to the International President within fifteen (15) days of the ruling. If a decision

has not been rendered on a protest or challenge by the time the Officers and

Delegates are to be installed, the elected member shall be sworn-in, take office, and

serve until such time as a contrary decision is rendered. [521CBL VIII.10].

SECTION 23: ADDITIONAL RULES AND PROVISIONS

The Election Committee and the Election Administrator may establish other procedural

provisions as may be necessary for the proper conduct of this election. Candidates and

their supporters are urged to adhere to these rules and procedures, as proven violations

may cause election results to be set aside.
