Medicines are one of the main health resources for preventing and fighting diseases, as well as for promoting quality of life. However, as peacefully recognized by all, the information concerning the medicine safety is limited at the time of its authorization and, despite the efforts of the regulatory agencies to ensure the full description of the safety profile, several methodological factors have

been making impossible for such goal to be achieved in full. These factors are related to trial limitations and include the limited duration of the exposure and follow-up, the limited number of participants, the restricted population in terms of age, gender, ethnicity, comorbidities and medication, as well as statistical problems associated with the research of multiple effects. Therefore, a medicine will present multiple and individual implicit risks, which will vary in terms of severity, effects on the patient and impact on public health, and much of these risks are only detected and characterized during the post-marketing phase.

Thus, monitoring medicines in the post-marketing authorization phase is an extremely important instrument for guaranteeing their quality, efficacy and safety, and also contributes for safeguarding public health. Moreover, as described in the report of the World Health Organization (WHO), World Alliance for Patient Safety, “the ability and capacity of the programs to improve the safety of the patient depend on their capacity to gather the most complete information on adverse reactions to medicines, so that it serves as source of knowledge and basis for future preventive actions”.

Implementing a systematic risk assessment of a medicine is part of the pharmacovigilance efforts to promote a positive balance between benefits and risks, something that can be achieved by increasing the benefits and reducing the risks.

This is the scope of the present guide whose purpose is to establish the requirements for the operation of a pharmacovigilance system.

Therefore,

In the exercise of the power conferred by paragraph a) of article 29 of law no. 14/VIII/2012 of July 11 that approves the RJERI, as amended by law no. 103/VIII/2016 of January 6, in conjunction with paragraph f) of article 9 and paragraph e) of no. 1 of article 22 of the annex of Decree-Law no. 22/2013 of May 31, which approves the ARFA Statutes, and with paragraph c) of no. 4 of article 7 of Decree-Law no. 17/2017 of April 17 that institutes the National Pharmacovigilance System and defines the rules for its structure and operation, at the ordinary meeting of December 5, 2017, the Board of Directors decided the following:

1. It is approved the pharmacovigilance regulations whose text is attached to the present deliberation and is an integral part of it.

2. This deliberation enters into force 30 days following its publication.

3. The entities to which the present regulations apply have 180 days, as from the date of entry into force of this deliberation, to create the conditions set forth.

PHARMACOVIGILANCE REGULATIONS

1. Purpose

These regulations set forth the procedures that aim at the compliance with legal responsibilities and requirements concerning the monitoring of medicine safety, as well as any other change to the benefit-risk relationship.

2. Scope

The regulations apply to the holders of marketing authorization (MA), pharmaceutical sector operators or its legal representatives.

3. Definitions/Abbreviations

Medicine abuse: intentional and excessive use of medicinal products, whether persistent or sporadic, associated with harmful physical or psychological consequences.

Risk minimization activities: a public health intervention that is intended to prevent or reduce the likelihood of an adverse reaction associated with the exposure to a medicine to occur, or even reduce its severity.

Routine risk minimization activities: activities intended to alert and inform of an adverse reaction, in order to reduce the likelihood of its occurrence or to minimize its severity, should it occur. For instance, changes to the medicine information or alteration of its legal status.

Additional risk minimization activities: non-routine risk minimization activity set up to reduce the likelihood of an adverse reaction to occur or to minimize its severity, should it occur. For instance, trainings on how to administer a medicine or additional educational materials.

Benefit-risk assessment: assessment of the positive therapeutic effects of a medicine in view of the risks to public health and related to its safety, quality and efficacy.

Company Core Data Sheet (CCDS): a document prepared by the holders of marketing authorization (MA) that includes, besides information about safety, material related to the indication, dosage, pharmacology and other information concerning the medicine.

International Date of Birth (IDB) – date of the medicine’s first authorization worldwide.

Pharmacovigilance Data Cut-off Date (PCD) – date of conclusion of the collection of data for writing the periodic safety report (PSR).

Medication errors: any unintentional error that occurs in the prescription, dispensing, or administration of a medicine that results in or may result in harm to the patient.

Other states: any other country where the medicine is marketed.

Occupational exposure: it refers to the exposure to a medicine as a result of professional occupation.

Pharmacovigilance: the science and activities related to the detection, evaluation, understanding and prevention of adverse reactions or any problem that relates to medicines.

Package Leaflet (PL): written information that accompanies the medicine and is intended for the user, so its language is clearer and more understandable.

Missing information: information concerning a medicine safety that is not available at the time of the authorization and represents a limitation of the safety data.

Medicine Reference Information (MRI): document prepared by the holder of MA with safety information, preferably the CCDS and, in its absence, the summary of the medicine characteristics (SMC).

Misuse: it refers to situations in which the medicine is used outside the scope of the authorized information, in an intentional and inappropriate way.

Spontaneous reporting: some kind of communication requested from the company, regulatory agency or other organization that describes a suspected adverse reaction in the patient, who took one or more medicines, and does not come from a study or any collection of schematic data.

Sector operators: an individual or corporate entity who carries out the activity of manufacturing, importing, distributing or dispensing medicines for human use.

Risk Management Plan (RMP): detailed description of the risk management system of a specific medicine.

Target population (treatment): patients that can be treated using the medicine, according to the indication(s) and contraindication(s) provided for in the approved information of the medicine.

Safety problem: an identified risk, a potential risk or important information that was unknown previously.

Adverse Reaction to Medicines (ARM) or adverse reaction: a harmful reaction to a medicine. This includes reactions arising from the use of medicines within or beyond the terms of the marketing authorization (overdose, use not compliant with indications, medication errors, lack of efficacy, misuse or abuse) or due to occupational exposure.

Severe adverse reaction: any adverse reaction that leads to death, is life-threatening, requires hospitalization or prolonged hospitalization, persistent or significant disability, resulting in congenital anomaly or regarded as clinically important.

Unexpected adverse reaction: any adverse reaction whose nature, severity, intensity or consequence is incompatible with the information contained in the summary of product characteristics and the package leaflet.

Periodic Safety Report (PSR): periodic and up-to-date communication of safety information on the worldwide use of each medicine, together with a scientific assessment of the risks and benefits thereof.

the relevant information that derives from the medicine assessment. Consequently, it represents the conditions and specifications according to which the medicine was approved by the competent authority. Any change to the contents of the SMC requires prior approval by the competent authority. The SMC is the informative basis for the health professionals, which is necessary for a safe and efficient use of the medicine.

Legal representative: any duly authorized individual or

corporate entity that, together with the holder of MA, accounts for one or more medicines in the national market.

Identified risk: an unfavorable occurrence for which there is

proper evidence of an association with the medicine.

Potential risk: an unfavorable occurrence where it is suspected that the risk is associated with a medicine of interest. In the meantime, such association has not yet been confirmed.

Signal: information that derives from one or several sources,

including observational and experimental studies, and that suggests a new association, or new information about a known association between an intervention and an event or a group of related events, whether adverse of beneficial, whose likelihood is considered to be sufficient to justify a research.

Pharmacovigilance system: a system that is used by the holder

of MA and competent authorities in order to fulfill the tasks and responsibilities related to pharmacovigilance, and that allows for the safety follow-up of the authorized medicines and the detection of changes to the relevant benefit-risk relationship.

Risk management system: a set of pharmacovigilance interventions

and activities that is intended to identify, characterize, prevent or minimize the risks associated with medicines, including the assessment of the effectiveness of such interventions and activities.

Overdose: it refers to the administration or taking of a quantity of

the medicine that is above the recommended dose according to the medicine’s authorized information.

MA holder: an individual or corporate entity that holds a MA

certificate for one or more medicines.

Off-label use: it refers to situations in which the medicine is intentionally used for a purpose that is not authorized according to the product information.

4. System requirements

The operation of a pharmacovigilance system implies requirements

that include the existence of an organizational structure, human resources with a description of the responsibilities, processes and procedures, management and traceability of information.

4.1. Human Resources and Organizational Structure

4.1.1 – The person responsible for pharmacovigilance and his/her

duties must be designated, ensuring that such person has technical autonomy to promote, maintain and improve the compliance with the obligations. The designation must be duly documented.

4.1.2 – The person responsible for pharmacovigilance must have

the proper theoretical and practical knowledge to carry out the pharmacovigilance activities, being responsible for the setup and maintenance of the pharmacovigilance system.

4.1.3 – In his/her absence, the person responsible for

pharmacovigilance must be replaced by someone duly qualified and trained for carrying out the duties. The replacement must be duly documented.

4.1.4 – For the holder of MA, the person responsible for pharmacovigilance shall:

a) Be available in a permanent and continuous manner;

b) Have an overview of the safety profile of the medicine(s) and any emergent safety problem;

c) Be aware of any conditions or obligations to be adopted as part of the marketing authorizations and other commitments related to the safety or safe use of the medicines;

d) Ensure the execution of the pharmacovigilance activities, as well as the submission and delivery of all the documents related to pharmacovigilance, according to the legal requirements.

4.1.5 – The person responsible for pharmacovigilance must guarantee a response to any request for information made by the National Pharmacovigilance Center (NPC), which the latter considers to be necessary for the evaluation of the medicine.

4.1.6 – The following documents concerning the person responsible for pharmacovigilance must be submitted to NPC:

▪ Curriculum vitae

▪ Position of the person responsible for pharmacovigilance within the organization

▪ Contact details

▪ Contact details of the replacement

4.2. Processes and Procedures

The procedures required for the operation of the pharmacovigilance system are:

4.2.1. The collection and management of information on suspected ARMs and DRPs;

2.2.2. The staff training on pharmacovigilance;

4.2.3. The preparation of risk management plans (RMPs);

4.2.4. The preparation of periodic safety reports (PSRs);

5.5.5. The generation and assessment of pharmacovigilance signals.

The requirement for collection and management of information on suspected ARMs/DRPs and the staff training on pharmacovigilance apply to the holders of MA, pharmaceutical sector operators or their legal representatives.

The preparation of the RMP, PSR and the generation and assessment of signals apply only to the holders of MA or their legal representative.

The activities related to each of the aforesaid procedures are described next.

4.2.1. The collection and management of information on suspected ARMs and DRPs

2 – To immediately notify the NPC of all the suspected ARMs or DRPs that occur in Cabo Verde, as well as the severe occurrences in other States, including the suspicions detected by means of complaints or any other way;

3 – To report the notifications of suspected ARMs and DRPs electronically, by mail, telephone, fax or any other mean, as soon as possible, but no later than seven days after receiving the information for the severe ARMs.

4 – To ensure the minimum information for reporting a suspected ARM, namely:

a) Patient identification (initials, age and gender);

b) Description of the suspected ARM;

c) Name of the suspected medicine;

d) Identification and contact details of the notifier. 5 – To ensure that only the cases with minimum information

must be reported. In the absence of the aforesaid elements, the notification is considered to be incomplete and ineligible for submission to the NPC, but it must be registered nonetheless. In the cases that are considered as ineligible, measures must be taken to obtain the missing elements, and these situations must be duly documented.

the notified cases is obtained and submitted to the NPC:

a) Manufacturer of the medicine;

b) Batch number of the medicine;

c) Concomitant medicines;

d) Comorbidities;

e) Development of the ARM

7 – To ensure the minimum information for reporting a suspected DRP, namely:

a) Description of the problem;

b) Name of the medicine;

c) Batch number of the medicine;

d) Expiry date;

e) Identification and contact details of the notifier

8 – If the holder of MA becomes aware of information that constitutes a notification of ARM or DRP from a non-medical source, for instance, websites, blogs, newspapers and other mass media, this information must be managed as spontaneous reporting.

9 – For notifying cases of overdose, medication errors, abuse, misuse and off-label use, in which there was no adverse reaction (harmful, non-intentional reaction to a medicine), the notifications must not be submitted as ARM notifications, although these cases must always be reported if a higher occurrence is found. For the holders of MA, these cases must be registered and included in the periodic safety reports, as applicable.

10 – To pass on to NPC any relevant data for the benefit-risk assessment, namely data from post-authorization safety studies. This requirement applies only to the holders of MA or their legal representatives.

4.2.2. The staff training on pharmacovigilance

1 – All the professionals involved in the pharmacovigilance activities must receive initial and continuous training. For the holders of MA, the training must reflect the tasks and responsibility of each professional;

2 – To keep a detailed record of the training on pharmacovigilance. The holders of MA must ensure the existence of a training plan, which must be based on the assessment of the formative needs.

3 – To establish the mechanisms for assessing the impact of the formative actions.

4 – To gather information on the pharmacovigilance procedure for the professionals with no specific task or responsibility in terms of pharmacovigilance, but whose activities may have an impact on the system. Such activities may include, but are not limited to, those related to complaints and product returns, sales and marketing, regulatory affairs, legal affairs and audits.

4.2.3. The preparation of risk management plans (RMPs)

1 – The holder of MA undertakes to provide the NPC with the RMP, which must contain the detailed analysis of the medicine risks and the measures to manage and minimize such risks.

2 – The duly updated RMP is submitted:

a) Immediately after the request;

b) Upon the request to grant a MA;

c) Whenever there is a change to the benefit-risk relationship of the medicine (for instance, new indication, new contraindication).

3 – The holder of MA must prepare and submit the RMP according to annex 1 – Risk Management Plan (see www.arfa.gov.cv).

4.2.4. The preparation of periodic safety reports (PSRs) 1 – The holder of MA undertakes to provide the NPC with the PSR, which must contain the adverse reactions that occurred, and also a scientific evaluation of the benefit-risk relationship of the medicine.

2 – The duly updated PSR is submitted:

a) Immediately after the request;

b) Upon the renewal of the MA;

c) Every three years after the renewal.

3 – For medicines whose MA has been granted by recognition of the MA from other State, the holder of MA may request the date harmonization for submitting the PSR with the calendar of the country that acknowledged the MA.

4 – After the renewal, ARFA may determine specific rules concerning the deadlines for the notification of the PSR, including an extended or shorter deadline whether the benefit-risk relationship is positive or called into question, respectively.

5 – Generic medicines, homeopathic medicines, plant-based medicines and medicines with well-established use are free from presentation of the PSR, but it may be requested whenever a new risk so justifies nonetheless.

6 – The holder of MA must prepare and submit the PSR according to annex 2 – Periodic Safety Reports (see www.arfa.gov.cv).

4.2.5. The generation and assessment of pharmacovigilance signals

1 – The holders of MA or their legal representatives must check the data from the literature, clinical trials, epidemiological studies and ARM notification database regularly, in order to assess information that may characterize a signal.

2 – The frequency of monitoring must be at least once a month, and it must be proportional to the identified risk, potential risk and the need for additional information.

3 – The holders of MA or their legal representatives must trigger the procedures for the research related to the detected signal.

4 – The holders of MA or their legal representatives must inform ARFA of any safety problem arising from the signal detection activities that may have a considerable impact on the benefit-risk balance of a medicine, or an impact on public health.

5 – The holders of MA or their legal representatives must keep a record of the signal detection activities.

Without prejudice to the aforesaid procedures, the entities to which the present regulations apply must implement self-inspection actions as follows:

1. Self-inspections must be carried out according to the plan that was defined and approved, in order to monitor the implementation and compliance with the standards of the regulations, as well as to define and keep up with the corrective and preventive actions.

2. Self-inspections must be performed in an impartial manner and by personnel qualified for such purpose.

3. One must keep records of the performed self-inspections, including comments and the corresponding corrective and preventive actions set forth.

5. Principles for preparation

The wording of the RMP and PSR must be preferably in Portuguese and, if not possible, in English. However, if it is submitted in English, the abstract must be written in Portuguese.

It must be submitted to NPC in electronic format, with the corresponding cover page, or by e-mail.

In general, all the parts of the RMP must be submitted, although, under certain circumstances, as referred to below, bearing in mind the concept of proportionality, some parts or modules may be dismissed, notwithstanding the possibility of then being requested by the competent authority.

1. The transfer, as a donation, of the property to the Government of Cabo Verde is carried out according to the provisions of paragraph h), no. 2 of article 81 of law no. 134/IV/95 of July 3.

Exclusive purpose

1. The property, which is the object of the concession, is intended

1. The property, municipal heritage, which is the object of the swap

referred to in paragraph a) of no. 1 of the previous article, is located at Avenida 12 de Setembro, with 5800.00 square meters, and is confronted to the North with a street, to the South with an existing building, to the East with the Adérito Sena Municipal Stadium and to the West with a street, as identified in the attached location plan, which is now integral part of this deliberation.

2. The properties, which belong to Fonseca & Santos, Lda, are located at Avenida Capitão Ambrósio, the first one measuring 536.4 square meters and confronted to the North with a street, to the South with a road, to the East with the Baptista de Sousa Hospital and to the West with the proposed lot, being registered in the Land Registry of the Municipality of Nossa Senhora da Luz under the number 20908/0 and described in the Registry Office of S. Article 3

Permissive law and agreement

1. The transfers, in the form of swap and donation, of the

properties to Fonseca & Santos, Lda and the Government of Cabo Verde, respectively, are carried out according to the provisions of paragraph h), no. 2 of article 81 of law no. 134/IV/95 of July 3.

2. The transfer of the properties for the intended purpose is

subject to the swap and donation agreements, respectively, and to specific standards set forth in the concessions determined by law.

Article 4

Exclusive purpose

1. The properties, which are the object of the donation, are

intended exclusively for a new hospital infrastructure annexed to the existing facilities of the “Dr. Baptista de Sousa” Hospital, and they must not be used for any other purpose without the prior consent of the granting entity.

2. The exclusive purpose set forth in this standard must be

taken into account in the donation agreement.

Effects

This deliberation takes effect immediately, without prejudice to the obligation of its publication in the Official Bulletin.
