1. GENERAL INFORMATION

Sealed item rate Tenders in 2 parts ( Part – I: Technical Bid & Part – II: Financial Bid ) are invited by the

Controller General of Patents, Designs and Trademarks (CGPDTM) on behalf of the President of India for

“Request for proposal (RFP) for Empanelment of Architect / Consultant for Construction, Maintenance and renovation Work of the premises of The Patent Office, Kolkata” from approved and

eligible Architect / Consultant at the addresses mentioned in paragraph 2 (d) below on the terms and

conditions mentioned in the tender document and the contract agreement.

2. GENERAL CONDITIONS

(a) NAME AND ADDRESS OF THE AUTHORITY

(e) However, the Office of the Controller General of Patents, Designs and Trade Marks reserves the right to cancel, amend or withdraw the tender at any stage, without assigning any reasons whatsoever.

3. SCOPE OF WORK

The scope of work , at the discretion of authority, may include –

1. Technical survey of the works, i.e. construction, maintenance and renovation work of the premises of the Patent Office, Kolkata including (a) Complete re-orientation of the air conditioning system of the building floor-wise with parity to altered

seating layout of the officials and preferably adoption of VRF system for efficient energy measure.

(b) Modifications of the firefighting system in accordance to the provisions of the Codes and/or observations of appropriate Authority / Nabadiganta Industrial Township Authority. (c) Repairing and construction of ground floor of the Eastern side of the building as damaged due to sinking and breaking of the floor. (d) Any other work of construction, maintenance and renovation of the IPO Building (e) Solar Power System (f) Sewerage and waste disposal (g) Pump and plumbing works (h) Any other work deemed necessary related to construction and maintenance of The Patent Office, Kolkata.

2. Preparation of requisite specifications. 3. Preparation of Detailed Project Report (DPR), Preparation of tender document and assisting this Office in

finalizing the bidder according to GFR, 2017, followed by periodic supervision of the work and certification required, if any.

4. To suggest a realistic action plan for way ahead. 5. Any other related works requiring Consultancy of Architects to get NOC from competent authorities

whenever required.

4. ELIGIBILITY CRITERIA

This invitation to submit Proposal to the RFP is open to those Architect / Consultants who meet the following criteria:

Eligibility of Architect / Consultants for Empanelment

Architect / Consultants, registered under the requisite act can apply for this assignment. (Document

proof is required to attach, e.g. registration certificate by competent authority like central and State Govt. authorities)

Architect / Consultants with good governing practices will be given importance in the selection process (The Board Members should not be affiliated to any political and religious groups; the entity should not be black listed by any government departments or funding agency)

Architect / Consultants should have at least 5 years’ experience in similar areas that involve construction work including HVAC, Fire Fighting, electrical installations

Architect / Consultants having similar work experience with Government will be added advantage

Architect / Consultants must have necessary infrastructure (software and hardware facilities) that will be required for this assignment.

Architect / Consultants should enclose the list of the core team members as the specified Performa given in Annexure–III

Architect / Consultants having relevance of Education & Experience of Core team members to applied area is preferred.

Core team members of Architect / Consultants should have at least 5 years of work experience and also be able of Reading, writing & speaking Knowledge of English & Bengali.

Organization should have average annual turnover of 20 lakhs for last three financial years, (2014-15, 2015-16, 2016-17) duly supported by balance sheet certified by Chartered Accountant. Common Information for all Subject Architect / Consultants:

The Subject Specialists / Consultants shall be empanelled by The Patent office, Kolkata. Empanelment shall be initially for a period of 3 years, which may renewed for further, if required, on

the basis of the performance review only Consortium or Joint Venture application is not eligible for this purpose The Patent office, Kolkata reserves right to accept / reject all or any offer without assigning any

reason thereof.

5. SUBMISSION OF PROPOSAL:

Proposal should be in clearly sealed and marked envelope with following identification: “Application For Empanelment of Architects / Consultants for Construction, Maintenance and Renovation Work”. Envelope should contain all the detail mentioned in Annexure –II & III. The proposal must also contain a covering letter duly signed by the authorized person as per format of this tender. The Patent Office, Bouddhik Sampada Bhavan, CP-2, Sec-V, Salt Lake Kolkata-700091 shall accept the proposal through Speed / Registered Post and hand delivery within stipulated time of receiving. The proposal received after due date and time shall not be entertained by The Patent Office, Kolkata and no communication shall be done by The Patent Office, Kolkata in this regard. The Patent Office, Kolkata will not be responsible for loss or delay in postal transit. An Architect / Consultant is eligible to submit only one Proposal. An architect / Consultant applying individually or as a member of a consortium shall not be entitled to submit another proposal either individually or as a member of any consortium, as the case may be. The bidders are advised to visit the site, i.e., the details of the premises in every relevant aspects before tendering. It shall be presumed that while quoting, the tenderer has taken due note of the working conditions

6. TERMS OF PAYMENT :

The terms of payment will be as per the Payment Schedule mentioned in Financial Proposal : Financial Offer enclosed herewith. Necessary tax/duty will be affected at prevailing Govt. rates at the time of payment.

7. PROCESS OF SELECTION :

i. The Patent Office, Kolkata will constitute a Screening Committee for evaluation of the proposals. On the occasion of conflict in selection method, the decision made by the Screening Committee shall be final and no communication in this regard shall be entertained.

ii. Screening Committee shall open the Proposals at a time, date and venue specified in the tender document and in the presence of the bidders who choose to attend.

iii. The final selection of the Architect / Consultants shall primarily be based on data and documents submitted along with the bid. Any canvassing and malpractices will lead to disqualification of the tenderer.

iv. After selection, a Letter of Award (the “LOA”) shall be issued, in duplicate, by The Patent Office, Kolkata to the Selected Architect / Consultants and the Selected Architect / Consultants will sign and return the duplicate copy of the LOA in acknowledgement thereof, within15 (Fifteen) days of the receipt of the LOA.

v. If successful Architect / Consultant thus fails to sign the contract as stipulated, The Patent Office, Kolkata reserves the right to offer the contract to the next lowest bidder.

vi. O/o The CGPDTM does not bind itself to accept the lowest or any tender and reserves the right to reject any or all tenders without assigning any reason.

vii. O/o The CGPDTM will not pay any expense, whatsoever incurred by tenderer for the preparation and submission of tenders.

ix. This notice inviting tender, will form part of the contract agreement to be executed by the successful tenderer with The Patent Office, Kolkata.

x. All the correspondence on the tender shall be addressed to The Administrative Officer, Patent Office, Bouddhik Sampada Bhawan, CP – 2, Sector – V, Salt Lake City, Kolkata – 700 091 and any communication addressed to anyone else shall not in any manner to be binding upon The Patent Office, Kolkata.

xi. Even though the applicants may meet the above criteria, they are subject to be disqualified at any stage if they have:

a) Made misleading or false representation in the form, statement and attachments submitted at any stage and/ or

b) Record of poor performance such as abandoning the work, not properly completing the contract, inordinate delays in completion, litigation history, or financial failures, etc.

c) Found to have been black listed in any other work

8. RIGHT TO REJECT ANY OR ALL PROPOSALS:

Notwithstanding anything contained in this RFP, The Patent Office, Kolkata reserves the right to accept or reject any Proposal and to annul the Selection Process and reject all Proposals, at any time without any liability or any obligation for such acceptance, rejection or annulment, and without assigning any reasons thereof.

The Patent Office, Kolkata reserves the right to reject any Proposal if:

- The application is not covered in proper sealed cover with superscription as indicated in section - 5 - Not in prescribed form and not containing all required details or containing wrong information - Not properly signed & stamped - Proposal is sent by fax, telegram or email - Not received by office of The Patent Office, Kolkata on / before last date of submission

9. CONFIDENTIALITY

The information supplied by The Patent Office, Kolkata and/or, the data collected during given assignment and final report shall remain the sole property of The Patent Office, Kolkata and the Subject Specialists/Consultant is not authorized to divulge the information or publish findings in any form without the prior written permission from The Patent Office, Kolkata. If any non-compliance is found, The Patent Office, Kolkata may take action against the Subject Specialists/Consultant. All drawing(s) / Design(s) made by the specialists/consultants during the assignment will be the sole property of The Patent Office, Kolkata

10. RESTRICTION ON TRANSFER OF RIGHTS

The rights and liabilities will not be assigned or transferred (fully or partially) by the Subject

Specialists/Consultant, without the consent in writing to The Patent Office, Kolkata to any other persons, firm or organization. Transfer of assignment or subletting of assignment as above without prior written approval of The Patent Office, Kolkata shall be void. The Patent Office, Kolkata may transfer its rights and obligations to any other person, firm or organization as and when deemed fit and necessary by the authority.

If it is found that the Subject Specialists/Consultant (Individual/Institutes) has assigned particular work to some other Subject Specialists/Consultant/sub-contractor, without approval and prior notice to The Patent Office, Kolkata then The Patent Office, Kolkata reserves a right to reject any such work carried out at anytime and will not make any payment.

11. AMENDMENT OF RFP

At any time prior to the dead line for submission of Proposal, The Patent Office, Kolkata may, for

any reason, whether at its own initiative or in response to any clarifications requested by a Subject Specialists/Consultant, modify the RFP document by the issuance of Amendment.

All such amendments will be notified in writing through fax or e-mail to all architect / Consultants who have been issued the RFP document or who have already submitted bid. The amendments will also be posted on the website along with the revised RFP containing the amendments and will be binding on all Subject Specialists/Consultants.

In order to afford the Architect /Consultants a reasonable time for taking an amendment into account, or for any other reason, The Patent Office, Kolkata may, in its sole discretion, extend the Proposal Due Date.

12. PENALTY & TERMINATION OF CONTRACT (Will be levied when assignment/work shall be given to Subject Specialists/Consultant/s and the contract value will be decided)

Penalty: Penalty on the empanelled Subject Specialists/Consultant can be imposed by The Patent Office, Kolkata concerned at the rate of 1% of the awarded contract value per month of the delayed period and maximum to10% of the total work allotted by The Patent Office, Kolkata.

Termination: The Contract of the Empanelled Subject Specialists/Consultant with the The Patent Office, Kolkata will be terminated in the following ways: i. The term of Contract expires; ii. Termination of Contract by The Patent Office, Kolkata due to non-performance during

the execution of Project: 1. Performance is below expected level. 2. Non adherence to the time lines of the Project. 3. Quality of work is not satisfactory.

The Patent Office, Kolkata shall terminate the contract on evidence of persistent non-

performance by the Subject Specialists/Consultant by giving one month notice. In emergent situation, if arisen, the notice period may be shorter in duration and will be at the sole discretion of the Patent Office.

The Patent Office, Kolkata also reserves the right to assign the assignment/work to other

empanelled Subject Specialist/Consultant and split the work among more than one empanelled Subject Specialists/Consultants.

13. DIFFICULTIES AND DISPUTES:

Any difficulties or disputes that may arise on account to interpretation or implementation of this agreement shall be referred to Controller General of Patent Design and Trademark, Mumbai. If amicable solution could not be arrived at then the dispute or difficulties shall be placed before High level Authorities whose decision shall be final and binding to both the parties to this agreement. This entire contract is subject to competent court at Kolkata Jurisdiction only.

DISCLAIMER

The purpose of this RFP document is to provide the information to eligible Architect / Consultants for the formulation of their proposals.

Each Architect/Consultants should conduct its own investigations and analysis and should examine the accuracy, reliability and completeness of the information in this RFP document and wherever necessary, may obtain independent advice from appropriate sources.

The Patent Office may select Architect/Consultants from the proposals received in response

to the RFP as per the objectives laid down.

Architect / Consultants shall bear all costs associated with the preparation and submission of their proposals and contract negotiations. The Patent Office, Kolkata is not bound to accept any proposal and reserves the right to terminate the selection process without assigning any reasons at any time prior to contract award, without thereby incurring any liability to the Architect /Consultants.

A meeting with shortlisted Architect /Consultants may be conducted prior to finalization of the contract, in the office of Deputy Controller of Patents & Designs and HO (The Patent Office, Kolkata) for clarifications to the written queries and also present the expectations.

It may be noted that The Patent Office, Kolkata is neither bound to respond to all the queries raised by a prospective respondent nor to assign any reason thereof. No written reply to the queries will be made by The Patent Office, Kolkata.

The Patent Office, Kolkata reserve right to accept all or one or more offer for var ious work s as required t im e to t im e and the same way The Patent Office, Kolkata reserves right to reject such offer/s without assigning any reasons thereof.

If any payment is made for Preparation and submission of Contract Drawings, Tender BOQ with schedule of rates & amount with rate analysis covering all items of works, specifications etc.in respect of the defined services required and the same tender is not carried out in the same financial year, the documents submitted thereof may be considered for floating the same tender document subsequently without awarding any further subsequent payment in this regard to the party for which the payment has already been made previously..

Controller General of Patents, Designs and Trademarks (CGPDTM), invites sealed Request for Proposal (RFP) for Empanelment of Architect I Consultants for Consultancy Services for design of different services for Construction, Maintenance and Renovation work of The premises of IPO, Kolkata

For the purpose of the above criteria, construction and maintenance works of Buildings I Office etc. with sanitary, plumbing, electrical & allied works carried out by bidder (for Government I Semi-Governments I Undertakings I Autonomous I Statutory Bodies I Local Bodies I Private Bodies) shall be considered for Technical & Financial Bids.

Following minimum documents should accompany along with the sealed offer for qualifying the eligibility criteria :

1. Basic information about the organizations, viz. contact person, name, designation, address,

contact no. etc. 2. Proof of experience justifying the qualifying criteria i.e. Work Order etc. duly self-attested. 3. Copies of valid Trade License, PAN Card, GST etc. 4. Balance Sheets & Profit and Loss Account/ Audit Reports for last three years. 5. List of competent personnel employed with the organization. 6. The tender documents issued to the bidders duly signed and sealed in each page along with all

the above documents shall be put in a sealed envelope superscribing – Tender Notice No. and Technical Bid(Part-I). Price Bid(Part-II): Tender of the bidders found eligible in Part-I (Technical Bid) only will be opened.

7. The soft copy of the tender document can be obtained from the cash section of the Patent Office, Kolkata. The tender document can also be downloaded from the Website: http://ipindia.nic.in and http://www.tenders.gov.in

Interested parties should submit their complete details as mentioned above on or before 03/11/2017 by 1:00 P.M. at the IPO Office Kolkata . The applicant should apply for the work as noted in the table, indicating name of the work, etc.. on the body of the envelope. CGPDTM reserves the rights accept or reject any or all bids received, or terminate the entire process at any stage without assigning any reason whatsoever & without paying any compensation.

(c) On completion of the scope of work as provided in the contract to the satisfaction of the Patent Office, Kolkata.

(d) Providing Completion certificate of the assigned work.

specific work/job, the corresponding payment (for Sl. No. 4) will be made on compliance of clause (c) and (d) of Sl. No. 4
