(On motion of SP Mem. Tiongco and seconded by SP Mem. Castro)

A RESOLUTION REQUESTING CITY MAYOR ARLENE ARCILLAS-NAZARENO TO STRONGLY IMPLEMENT THE PRIVELEGES AND INCENTIVES OF PERSONS WITH DISABIUTY AND DISSEMINATION OF PROPER INFORMATION TO ALL ESTABUSHMENTS, INSTITUTIONS AND OTHER CONCERNS AS PROVIDED BY RA 9442 AND FOR OTHER PURPOSES.

WHEREAS, Section 16 of RA 7160, that every local government unit shall exercise the powers expressly granted, those necessarily implied there from, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare;

.WHEREAS, Section 17 (a), Local Government Units shall endeavor to be self-reliant and shall continue exercising the powers and discharging the duties and functions amently vested upon them;

WHEREAS, Section 17 of the same code, Local Government Units shall also discharge the functions and responsibilities of national agencies and offices devolved to them pursuant to this code;

WHEREAS, Section 17 of the same code, Local Government Units shall likewise exercise such other powers and discharge such other functions and responsibilities as are necessary, appropriate, or incidental to efficient and effective provisions of the basic services;

WHEREAS, among the basic services which include programs and projects on child and youth welfare, family and community welfare, women's welfare, welfare of the elderly and disabled persons;

WHEREAS, Section 1 (8) of RA 9442, other privileges and incentives is hereby added to RA 7277, otherwise known as the "Magna Carta for Disabled Persons"; j t{a,/ ib

WHEREAS, Section 1 (8) of RA 9442, other privileges and incentives is hereby added to RA 7277, · otherwise known as the "Magna carta for Disabled Persons";

WHEREAS, there is a need for the City Government of Santa Rosa, through the City Mayor, to disseminate proper information to all establishments, institutions and other related concerns and all persons violating shall be punished/penalized under Rule VI Section 9 of the provisions of the act;

NOW, THEREFORE, the City Council, has RESOLVED, as it hereby RESOLVES to request City Mayor Arlene Arcillas-Nazareno to strongly implement the privileges and incentives of persons with disability and to disseminate proper information of this resolution to all establishments and other concern as follows:

(a) At least twenty percent (20%) discount from all establishments relative to the utilization of all services in hotels and similar lodging establishments, restaurants and recreation centers for the exclusive use or enjoyments of persons with disability;

(b) A minimum of twenty percent (20%) discount on admission fees charged by theaters, cinema houses, concert halls, circuses, carnivals and other similar places of culture, leisure and amusement for the exclusive of enjoyment of persons with disability;

(c) At least twenty percent (20%) discount for the purchase of medicines in all drugstores for the exclusive use or enjoyment of persons with disability;

( d) At least twenty percent (20%) discount on medical and dental services including diagnostic and laboratory fees such as, but not limited to x-rays, computerize tomography scans and blood test, in all government facilities, subject to guidelines to be issued by the Department of Health (DOH), in coordination with the Philippine Health Insurance Corporation (PHILHEALTH);

(e) At least twenty percent (20%) discount on medical and dental services including diagnostic and laboratory fees, and professional fees of attending doctor in an private hospitals and medical facilities, in accordance with the rules and regulations to be Issued by the DOH, in coordination with the PHILHEAL TH;

(f) At least twenty percent (20%) discount in public railways, skyways and bus fare for the exclusive use and enjoyment of person with disability;

(g) Educational assistance to persons with disability, for them to pursue primary, secondary, tertiary, post tertiary, as well as vocational or technical education, in both public and private schools, through· the provision of scholarship, grants, financial aids, subsidies and other incentives to qualified persons with disability, including support for books, learning material, and uniform allowance to the extent feasible: Provided, that persons with disability shall meet minimum admission requirements;

(h) To the extent practicable and feasible, the continuance of the same benefits and privileges given by the Government Service Insurance System (GSIS), Social Security System (SSS), and PAG-IBIG, as the case may be, as are enjoyed by those in actual service;

(i) to the extent possible, the government may grant special discounts in special programs for persons with disability on purchase of basic commodities, subject to guidelines to be issued for the purpose by the Department of Trade and Industry (DTI) and the Department of Agriculture (DA); and

(j) Provision of express lanes for . persons with disability in all commercial and government establishments; in the absence thereof, priority shall be given to them.

The above mentioned privileges are available only the persons with disability who are Filipino Citizens upon submission of any of the following as proof of his/her entitlement thereto:

(I) An identification card issued by the city or municipal mayor or the barangay captain of the place and Persons with Disability (ID) issued by the City Social Welfare Development (CSWD) where the persons with disability resides;

(II) The passport of the persons with disability concerned; or

(Ill) Transportation discount fare Identification card (ID) issued by the National Council for the of Disabled Persons (NCWDP).

Furthermore, the City Council resolves that It shall provide through appropriate legislative measures the necessary support to the City Mayor to ensure and fast track the implementation of the privileges and incentives of persons with disability and to promote equality of public service in the City of Santa Rosa, Laguna.
