HE IT E N A C T E D by the High Commissioner for Palestine, with the advice of the Advisory Council I hereof :-

,Short titt 1. This Ordinance may be cited as l ia 1 Whi te Phosphorus Matches Prohibition Ordinance, 1925

Definition. 2. For the purposes of this Ordinance the expression "winte phosphorus" means the substance usually known as Whi l e or Yellow Phosphorus.

Prohibition of use of wliite phosphorus in manufacture of matches.

Prohibition of sale and import.

H. (1) No person shall make or cause to be made matches in the ma kin!;• of which white phosphorus is used.

(2) The occupier of any factory in which the manu.lach.ire of malches is carried on shall at any time allow any police officer, or any other officer authorised by the High Commissioner in that behalf, to take for analysis sufficient samples of any muterial in use or mixed for use. ;.Provided that the occupier may, at any time when the sample is taken, and on providing- the necessary appliances, require such police or other officer to divide the sample so taken into two parts and to mark, seal and deliver to him one part.

•4. No person shall

(a) sell or offer or expose for sale, or have in lus possession for purposes of sale;

(b) import or attempt to import into Palestine,

anv matches made with white phosphorus.

Penalties. 5. Any person who contravenes the provisions of this Ordinance shall be punishable with a fine not exceeding £ E . 20; and all white phosphorus or materials containing white phosphorus or matches made with while phosphorus found in the posses­sion or under the control of any such person may be seized by any Police Officer and may be forfeited or destroyed by order of the Court convicting the offender.

Certificate of 6. (1) A t the hearing of any proceedings with regard Analyst. to any sample taken under this Ordinance, or any part of such

sample, which sample or [)art is alleged to have been analysed by the Government Analyst, or with regard to the lot from which such sample was taken, the production of a certificate purporting to be signed by the Government Analyst shall, without proof of the signature, be sufficient evidence -

(a) of the identity of the thing analysed;

(b) of the result of the analysis; and

(c) of the matters stated in such certificate,

unless the defendant, by at least seven clear days' notice i n wri t ing delivered to the informant, and by a like seven clear-days' notice delivered, with a witness fee ot £ E . 1, to the said Analyst, requires that the said Analyst shall attend as a witness.

( 2 ) In any case where the attendance of the Analyst is required as mentioned in this Section, the Court may. in addition to any other order as to costs, make such order• as it deems proper as to the witness lee paid to the Analyst and as to the expenses of and [lie romunoralion to he paid for the analysis.

A n Ordinance 1.0 amend the Charitable Trusts Ordinance, 1924

B E IT E N A C T E D by the High Commissioner for Palestine, with the advice of the Advisory Council thereof:-

1. This Ordinance may be cited as the Charitable Trusts Short title and (Amendment) Ordinance, 1925, and shall be construed as one c ״ 0 p 1 1 • " ^ 1 0 1 1 • with the Charitable Trusts Ordinance, 1924, (hereinafter called the principal Ordinance) and it may be cited together with the principal Ordinance as the Charitable Trusts Ordinance, 1924-25.

3. The word "exchange" shall be inserted after the Amendment of word "se l l " in sub-section (!) and after the word "sale" in ac t i on •12. sub-section (4) of Section ! 2 of the principal Ordinance.

4. Section 25 of the principal Ordinance is hereby re- Alteration 1״ pealed ; and the following provisions shall be substituted Iherefore: ac t ion t>5.

(1) Trust property shall be deemed to be vesled in all the trustees jointly.

(2) Where trust property consists of slock, shares, or securities or of immovable properly or any interest therein or of any other property transferable in any hook or register, it shall be registered in the names of all the trustees.

(3) On the death or discharge of one of co-trustees, the trust survives and the trust properly remains vested in the surviving or continuing trustees unless the instrument of trust expressly declares otherwise.

(4) Where trust property transferable in any book or register is registered in the names of two or more cotrustees and is expressed to be so registered upon a joint account, the registering authority sit all upon pi oof of the death or discharge of any •trustee amend the register accordingly and the trust property shall continue registered in the names of the surviving or continuing trustees or trustee only.

(5) Where upon I he death of any trustee any interest in the trust properly or in any part thereof has by the effect of any law regulating succession to property become vested in any •person or persons who have not been appointed trustees thereof, such person or persons shall, ])ending any appointment of new trustees., hold such property upon the trust declared and shall be liable for any breach of trust as though I hey had been duly appointed Iruslees and had accepted the trusteeship.

Amendment of (1) .5׳ Sub-section (T) of Section 32 of the principal Section 3C2. Ordinance is hereby repealed and the following provisions shall

be substituted Ihorelbr.

,In the following cases, namely (1־)

(a) where if is uncertain in whom the title to any trust property is vested : or

(b) where a trustee or any other person in whom the title of Irusl. property is vested has been required in wri t ing to transfer the properly by or on behalf of a person entitled to require such transfer, and has wilfully •refused, or neglected to transfer the properly for twenty-eight days a l loc the date of the requirement; or

(c) w h e r e a Irusleo or other person in whom the trust property is vested is a minor or is out of Palestine or cannot be found; or

(d) where i l is otherwise convenient to vest the trust property in any other person;

the Court may make an Order (in this Ordinance called a vesting• Order) vesting' the property of any such person in any such manner or to any s u c h extent as the Court may direct.

(2) There shal l be added to Section 32 Ihe following sub-sec l ion : - .

(3) Where a vesting Order may be made under this Section, the Court may, if it is more convenient, appoint a person to transfer the •properly; and a trans:er by that person in confor­mity with (lie Order shall.have the same effect as an Order under this Section, and every person so appointed shall for the purpose of all transactions, proceedings and formalities incidental to the transfer, have all the power and capacities of the trustee or other person in whom the trust properly was vested an i shall be deemed to be the authorised aiforney of such trustee or other person for the ,purpose1 aforesaid.

Kepeal of (־>. (!) Subsect ion (!) of Section 34 of the principal Section 31 (•]>. Ordinance is hereby repealed.

(2) The marginal note of Section 34 shall read ' 'Registration of immovable irust properly".

Ihe Court shall not be debarred from exerci­sing any of its powers by the absence of evidence of the former constitution of the trust i f it shall be of opinion in all the circumstances of the case that the trust in fact exists or ought to be deemed to exist."

9. Sub-section (3) of Section 38־" of the principal Ordinance Amendment of shall read as follows:- • Section 38 <fl).

(3) Where property in Palestine is held on trust by a foreign corporation and the corporation has failed to register, the Attorney General may apply to !he Court for the appointment of a Irusfee as though there were no existing trustee.

B E IT E N A C T E D by the High Commissioner for Palestine, wi l l ! lite advice of the Advisory Council thereof:-

1. This Ordinance may be cited as the Public Trustee of Short title. Charities Ordinance, 1925.

2. In this Ordinance, unless I he context otherwise Definitions, requires:

"Private Irusfee" means a trustee other than I he Public Trustee of Charities.

"Expenses" includes costs and charges.

"Prescr ibed" means prescribed by rules under this Ordinance.

"Religious Court" means a Moslem Religious Court or the Court ol a Religious Community having jurisdiction under Articles 52 and 54 of the Palestine Order in Council , 1922.

3. If shall be lawful for the High Commission! r lo appoint Office of Public an oflieer called the Public Trustee of Charities, who shall ^ | ״ ^ f

have capacity to acquire and hold immovable and movable ' properly of every description, lo enter into any contracts, to execute any deeds, and to sue and be sued under the above name. Fie shall have an official seal.

4. (!) Subjecl to and in accordance with !lie provisions of this Ordinance and the rules made thereunder, the .Public Trustee of Charities !nay, if he thinks fit, act

(a) •as Custodian Trustee alone, or

(b) as an ordinary OuMee, either alone . o r jointly with any person or body of persons, and shall have all the same powers, duties and ]labilities, and shall be entitled to the same rights and immunities, and shall be subject to the same control ; nd orders of the Court, as a private trustee acting• in the same capacity has, is entitled, or is subject to under any existing or future Ordinance now or hereafter in force in Palestine.

(2• The Public Trustee of Charities may decline, either absolutely or except on the prescribed conditions, to accept any trust.

(3) The Public Trustee of Charities shall not accept any !rust save a !rust for charitable purposes within ' Ihe mea­ning of Section 2 of the Charitable Trusts Ordinance 24*11׳.

Appointment to 5. (1) Subjec(-fo the nile> made under this Ordinance, he Custodian the Publ ic Trustee of Charities may, if he consents to act as J 1 , ״ s t ( , f ' • such, and whether or not the number of trustees has been

reduced below the original number, be appointed to be Custo­dian Trustee of any !rust:

(a) by order of !he Com f made on the application of any person on whose application the Court may order the appointment of a new trustee; or

(b) by •!he ieslalor or other creator of any (rust; or

(c) by the person having power to appoint new trustees.

(2) W h e r e 1 the Public Trustee of Charities is appoin­ted to' be Custodian Trustee of any trust:

(a) the trust property shall be transferred to the Custodian Trustee as if he were the sole trustee, and for that purpose vesting Orders may, when necessary, be made under the Charitable 'Trusts Ordinance, 1924-25׳;

(b) the management of the trust properly and the exercise of any power or discretion exercisable bv the. trustees under the trust shall remain vested in the trustees other than the Custodian Trustee (which trustees are hereinafter referred to its the "managing trustees");

(c) as between the Custodian Trustee and the ma­naging trustees, and subject ;rod without prejudice to the rights of l i ny other persons, the Custodian Trustee shall have the custody of ail securities and. documents of title relating to the trust property, but the managing trustees shall have free access I hereto and shall be entitled to take copies thereof or extracts therefrom;

(d) the. Custodian Trustee shall concur in and per­form all acts necessary to enable the managing trustees to exercise their powers of management or any other power or discretion vested in them (including the power to pay money or securities into Court), unless the matter in which he is re­quested to concur is a breach of trust, or involves a personal liability upon him in 'respect of calls or otherwise, but unless he so concurs the Custodian Trustee shall not be liable for any act or default on the part of the managing trustees or any of them;

to) all sums payable to 01׳ out 01׳ the income or capital of the trust property shall be paid to o r by the Custo­dian Trustee; provided Ihat the Custodian Trustee may allow the dividends and oilier income derived from the trust pro­perty to be paid to the managing trustees or to such person as they may direct, and in such cases shall be exonerated from seeing; to the application thereof, and shall not be. answerable for any• loss or- misapplication;

' ( f ) the power of appointing new trustees, when exercisable by the trustees, .shall.be exercisable by the mana­ging Irusfees alone but the Custodian Trustee shall have the same power of applying to the Court for the appointment of a new trustee as any oilier trustee;

(g) the Custodian Trustee, if he acts in good faith,, shall not be liable for accepting as correct, and acting upon the faith of any wr i the statement by the managing trustees as to any matter of fact, upon which the title to I he trust property or any part thereof may depend, nor for any acting upon any legal advice obtained by the managing trustees independently or the Custodian-Trustee;

(h) the Court may, on the application of either the Cusfodiau Trustee or any of the managing trustees, and on proof to its satisfaction that it is expedient to terminate the Custodian Trusteeship, make an order for that purpose, and the Court may thereupon make such orders and give such di ­rections as under the circumstances may seem to the Court to be expedient.

may be so appended whether the will or instrument creating the trust was made or came info operation before or after the passing of this Ordinance and either as an original or as a new trustee, or as an additional trustee, in the same cases, and in the same maimer, and by the same persons or Court as if he were a private trustee, with this addition, that, though the trustees originally appointed were two or more, the Public Trustee of Charities may be appointed sole trustee, notwithstanding that in the instrument creating the trust it was provided that the number of trustees should never be less than a certain number exceeding one.

7. (1) The general revenue of Palestine shall be liable lo make good all sums required to discharge any linbility winch the Public Trustee of Charities, if be were a private trustee, would bo personally liable to discharge, except where the liability is one to which neither the Public Trustee of Charities nor any of his officers has in any way contributed, and which neither he nor any of his officers could by the exercise of rea­sonable diligence have averted; and in that case the Public Trustee of Charities shall not, nor shall the general revenue of Palestine, be subject to any liability.

(2) A l l sums payable in pursuance of this Section out of the general revenue of Palestine shall be charged on and issued out of that fund.

(S. (I) The High Commissioner shall appoint a lit person Officers and to the office of Public Trustee of Charities who shall receive ( ) i m ' ( ' s • such salary or fees, and be appointed on such terms as the High Commissioner may determine.

(2) The High Commissioner shall appoint such per­sons to be officers of the Publ ic Trustee of Charities as"he may consider necessary, and those officers shall bold office upon such terms and be remunerated at such rates and in such manner as the High Commissioner may determine.

9. (1) Thei'e shall be charged in respect of the duties of the Publ ic Trustee of Charities the scale of fees contained in the Schedule to this (.)rdinance. Such scale of fees may from time to fimo be altered, varied or amended by order of the High Commissioner in Exocuiive Council .

(2) Any expenses which might be retained or paid out of the trust property if the Public Trustee of Charities were a prívale Irusiee shall be so retained or paid.

(3) A l l such fees shall be appropriated to the use of the !(cnerai revenue of Palestine.

Mode of action ot Public Trustee of Charities.

10. el) The Public Trustee of Charities shall not, nor shall any of his officers, acl under Ibis Ordinance for !( 1ward except as provided by Ibis Ordinance.

(2) The Public Trustee of Charities may, subject to the rules made under this Ordinance, employ for the purpose of any trust such advocates, bankers, accountants and hr<•kers, or other persons as ho may consider necessary, and in deter­mining Ihe persons lo be so employed in relation to any trust the Public Trustee of Charities shall have regard to the inter­ests of the trust, but, subject to this, shall, whenever practic­able, lake into consideration the wishes of Die creator of !he trust and of the oilier trustees (if any) either expressed or as implied by the practice of the creator of the trust or in Iho •previous management of the trust.

(3) The entry of the Public Trustee of Charities by that name-in the books of a company shall not constitute notice of a trust, and a company shall not be entitled to object to enter the name on its books by reason only that the Public Trustee of Charities is a corporation; and in dealing with pro­perty, the !'act that Ihe person or one of the persons dealt with is the Public. Trustee of Charities shall not of ilseif constitute notice of a trust.

Rules.

11. (1) Upon application made to a Religious Court by any person charged with the administration, or any person en­titled to the benefit of a W a k f or religious endowment, of a charitable nature within the jurisdiction of the Court, such Court may remove existing trustees and appoint the Public Trustee of Charities as an ordinary trustee of Ihe W a k f or. re­ligious endowment.

(2) The Religious Court may upon exercising juris­diction under this Section make any consequential orders as to vesting of the tru'd. property or otherwise, requisite for the carrying out of the appointment; and the Wakf or religious endowment shall thenceforth be deemed to be a charitable trust within the meaning of the Charitable Trust Ordinance 1924-25 and the provisions thereof shall apply thereto.

12. Nothing in I his Ordinance shall make effective any appointment of the Public Trustee of Charities as trustee of any trust, W a k f or religious endowment unless in each case he has consented to accept the trusteeship.

13. The High Commissioner i n Executive Counci l may make and when made vary or revoke rules for carrying into effect the objects of tins Ordinance, and in particular for all or any of the following purposes, that is to say:

(a) establishing tlx! office of Public Trustee of Cha­rities and prescribing the trusts or duties he is authorised fo accept or undertake, and the security, if any, to be given by him and his officers;

(b) the transfer to and from the Public Trustee of Charities of any property;

(c) the accounts to be kept and an audit thereof;

(d) the establishment and regulation of any branch office;

(e) the form and manner in which notices shall be given;

(f) specifying the investments in which the Pub l i c Trustee of Charities may invest trust funds.

S C H E D U L E O F F E E S .

O n Capital .

Upon the acceptance of (he trust, a fee at the following rates shall be applicable:-

Fo r each day or part of the day during which the Publ ic Trustee of Charities shall be required to be away from his headquarters for the purpose of inspection or any other business in connection with a charitable Irust, in addition to his actual expenses for fares and transport and other disbursements in connection with such inspection or other business £ E . 1 per day.

8. In addition to the foregoing charges there shall also he chargeable and payable all disbursements by the Public Trustee properly made in connec­tion with the administration of the trust.

The Mining Ordinance, No. 19 of 1025, which was pub­lished as a Rill in the Extraordinary Gazette of fhe 15th December, 1924, is hereby promulgated in the form in which it appeared, subject to the following amendments, and shall be in force as from the date of the1 publication- of this Order.

I. The second paragraph of Section 2 (10 shall be de­leted.

־ 2 . The first sentence'of Section 2 (q» shall be deleted.

3. In Section 2 (u) the words "or corporation" shall be substituted for the words "or other juridical person".

4. Section 2 (y) shall read: "To explore" mean• s to con­duct a geological survey with a view to ascertaining the pro­bable presence or absence of minerals or other information as to the nature and structure of the earth's crust and the distri­bution of surface and underground water.

f). The following paragraphs shall be added to Section 3:

"Nothing in this Ordinance shall be deemed to derogate from the rights of the High Commissioner with regard to minerals in solution or mineral springs".

1 0 . In Section 1 0 (1) the words "which shall not be un-• reasonally withheld" shall be inserted after the word "Controller".

Section 11 (b) shall read: "for the purpose of such prospecting dig trenches, and generally make necessary exca­vations which shall not, except with the special permission of the Controller, exceed two metress in depth, and sink shafts, with the like permission, to a depth not exceeding 10 metres; but shall not dri l l or fake any other steps which may have the object or direct result of minerals being won".

12 . In Section 13 (1) the word "general" shall be inser-'-ted before the word "directions" in line 4.

13 . Section 13 (2) shall read:

14. Section 17 shall read:

"The Controller may in his absolute discretion grant one Person may hold or more licences to the same person including a person entit- m ^ e ° n e

led to or holding a licence under Section ! 2 hereof; provided licence 0 m f e

that the Controller shall not grant a prospecting licence to a person who does not hold directly or through his agent a pros­pecting or exploration permit in respect of each area for which application for a licence is made".

15. In Section 22 (1) the words "which shall not be unreasonably withheld" shall be inserted after the word "Controller".

16. In Section 51 (!) t ' i e word "s ix" shall be substituted for "three" in line 2 .

17. The first sentence of Section 54 (1) shall read: "The holder of a forfeited right, and the lessee of a surrendered or forfeited leasse shall, within three months or such further period as the Controller may in wri t ing allow, remove surface works, erections, plant, machinery or other mining appliances on the area the subject of the mining interest surrendered or forfeited." '

18. In •Sec! ion 57 (2) the word "therein" shall be subs­tituted for " i n " after the word "practice'* i n line 2 .

19. Section 85 shall read:

20. In Regulations-Part I, A . 0, the las( sentence shall read: "The Controller shall give his reasons for refusing a renewal."

21. In Regulation 3f> (9) the word "economic ' shall be deleted before flic word "frees" and in (.10) (he word "protected" shall be deleted before "tree."

22. In Regulations-Part .11, 48, the last sentence shall read:

"SueI׳i steps shall be taken as the Inspector may required with a view to preventing the presence of flies and infection by the parasite of miner's anaemia."

23. In the annex to Schedule I, Form 8 of the mining lease the last word in clause 1׳ shall be "!hereunder."
