New York Cracks Down On Synthetic Drugs New York Gov. Andrew Cuomo announced last week new enforcement actions to combat the illegal sale of K2 and other synthetic drugs The State will vigorously pursue all civil and criminal remedies against businesses that sell the illegal substances, often disguised as potpourri or incense. “The evolution of synthetic drugs is an alarming public health risk—but we are on the front lines of the battle,” Cuomo said. “The state will continue to identify emerging compounds that put users in danger and aggressively chase down sellers of these toxic substances." New York will vigorously pursue all available civil, criminal and administrative remedies against any business or business owner found to be manufacturing, possessing for sale or selling illegal synthetic drugs. Under current law, an owner of an establishment, as well as any other person possessing, distributing, selling or offering prohibited synthetic drugs for sale, will face a fine up to $500 and/or up to 15 days in jail. Civil penalties include a fine up to $2,000 per violation. Synthetic cannabinoids are marketed as legal and typically consist of plant material coated by chemicals, which are supposed to mimic THC, the active chemical compound in marijuana. The drugs are marketed as incense, herbal mixtures or potpourri to mask their true purpose. Street names for substances include Spice, K2, Green Giant, Smacked, Wicked X, AK-47, Geeked Up, Ninja, Caution, Red Giant and Keisha Kole. In recent years the prevalence of the use of so-called synthetic drugs has been increasing in many communities across the country. Some independent retailers have been selling these illegal products under the table. Unfortunately, some press reports have erroneously implied that many reputable convenience retailers have been selling these illegal products as well. We support legislation by U.S. Rep. Charlie Dent (R-PA) that targets the producers and distributors of these drugs by making it easier for the Drug Enforcement Administration to target and penalize them. Nothing in this legislation would have a negative impact on reputable convenience stores.

Schenectady County Ups Minimum Tobacco Buying Age To 21 Schenectady County has become the sixth locality in the Empire State to raise the legal tobacco buying age from 18 to 21, the Times-Union reports. This week, the county legislature approved the ban, which will go into effect Sept. 1. The minimum legal sale age (MLSA) for tobacco products in New York City and Suffolk, Albany, Schenectady, Chautauqua and Cortland counties is 21 years of age, and the MLSA in Nassau and Onondaga counties is 19 years of age. Majority Leader Gary Hughes said he wanted New York to raise the state tobacco buying age to 21. Hughes also dismissed concerns from local businesses about the impact of lost revenue, adding that he thought those retailers would be able to compensate with sales from other categories. He pointed out that local law enforcement would work with retailers. “There will be a period of time when the enforcement will be advisory and not punitive,” Hughes said. The two dissenting votes came from Cathy Gatta and Holly Vellano. Gatta didn’t vote for the ban because she wanted the focus to be on targeting young teens with antismoking information. Vellano voted no because, “for me, it’s a freedom of choice issue.” FDA's CTP Wins Latest Ruling In Tobacco Violations Challenge The latest legal round over tobacco inspection violations has gone to the Food and Drug Administration (FDA). On June 30, the U.S. Department of Health and Human Services' Departmental Appeals Board (DAB) issued a final decision finding in favor of the FDA's Center for Tobacco Products (CTP) in a case brought by CTP against the tobacco retailer Orton Oil Co., dba Orton's Bagley. The ruling overturns a decision by an administration law judge in which the tobacco retailer repeatedly sold tobacco products to a minor and failed to verify the age of a tobacco product purchaser by means of photographic identification. According to the agency, the DAB held it was reasonable and permissible for CTP to count each time the retailer failed to comply with a tobacco regulation as a violation of the federal Food, Drug, and Cosmetic Act. In addition, the board found that the law does not require a hearing before CTP issues a warning letter and that the administrative law judge lacked authority to issue a judicial warning letter. The respondent has until Aug. 29 to appeal the latest ruling. In February, Administrative Law Judge Lewis T. Booker Jr. ruled in favor of NACS, the Association for Convenience & Fuel Retailing and Orton Motor when they challenged CTP's practice of issuing several tobacco violations for a single transaction, as CSNews Online previously reported. According to NACS, its members have been concerned that retailers have been cited for multiple violations of the

Tobacco Control Act in a single transaction — for example, failing to check ID and making an underage sale — and/or a single inspection. In addition, retailers raised concerns that they have not had the right to a hearing to challenge a violation the first time they receive one from the CTP. Booker ruled in favor of Orton on both of these matters. He decided that Orton's failure to check an ID and sale of the product to an underage individual in one transaction amounted to one violation of the Tobacco Control Act. CTP had alleged they equaled two violations. The judge also ruled that this was Orton's first violation. The company had received a warning letter for a 2013 violation; however, it was not given a chance to ask for a hearing, Booker ruled. FDA's Deeming Rule Goes Into Effect The 90-day countdown has ticked down and the Food and Drug Administration's (FDA) deeming rule and its regulations for electronic cigarettes and cigars are now effective. The agency released the final deeming rule on May 5 and published it in the Federal Register on May 10, starting the countdown. The rule also extends the FDA's regulatory authority to hookah tobacco and pipe tobacco, as CSNews Online previously reported. The regulations for the newly deemed tobacco products include: • Not allowing products to be sold to persons under the

age of 18 (both in person and online); • Requiring age verification by photo ID; • Not allowing the selling of covered tobacco products in

vending machines (unless in an adult-only facility); and • Not allowing the distribution of free samples. The finalized rule also requires manufacturers of all newly regulated products to show that the products meet the applicable public health standard set forth in the law and to receive marketing authorization from the FDA, unless the product was on the market as of Feb. 15, 2007. Under staggered timelines, the FDA expects manufacturers will continue selling their products for up to two years while they submit a new tobacco product application — and an additional year while the agency reviews the application. However, that Feb. 15, 2007 grandfather — or predicate — date has been a sticking point for many in the e-cigarette and vapor industry. "The bad news is Aug.8 of this year marks the beginning of a two-year countdown to FDA prohibition of 99.9 percent of vapor products on the market. If we do not succeed in changing the FDA's arbitrary predicate date of Feb. 15, 2007, the vapor industry will shrink to almost nothing beginning Aug. 8, 2018," said Gregory Conley, president of the American Vaping Association. Conley added industry advocates are working on the legislative and legal fronts to change the grandfather date.

In the latest legal effort, TechFreedom and the National Center for Public Policy Research filed an amicus brief in support of the challenge to the FDA's new regulation of e-cigarettes being brought by Nicopure Labs, a manufacturer of e-cigarette liquid. According to the brief, the FDA's deeming rule fails to consider the scientific evidence readily available to the agency regarding the safety and the public health benefits of e-cigarettes. "E-cig technology has grown by leaps and bounds since the FDA's arbitrary predicate date in 2007," said Evan Swarztrauber, communications director at TechFreedom. "Setting a standard using technology from nearly a decade ago is absurd and highly stifling to innovation. The FDA should issue evidence-based regulations that address legitimate safety concerns without hindering products that improve consumer health by providing a less harmful alternative, rather than implementing a 'Mother, may I innovate?' approach that's become all too common among regulatory agencies." Added Jeff Stier, senior fellow at the National Center for Public Policy Research, "Instead of developing science-based standards which would reduce harm, the FDA directly admitted it didn't understand or evaluate the potential benefits or harms of e-cigarettes. Without that science, it relied on the 'precautionary principle' standard, in direct conflict with the evidence-based standard required by Congress." EPA Research Shows Moderate Or Severe Corrosion In Diesel USTs In a report released this week on corrosion inside diesel fuel underground storage tanks (UST), the U.S. Environmental Protection Agency (EPA) found moderate or severe corrosion that could affect metal components inside both steel and fiberglass underground tank systems, according to the report. Corrosion inside USTs can cause equipment failure by preventing proper operation of release detection and prevention equipment. If left unchecked, corrosion could cause UST system failures and releases, which could lead to groundwater contamination. EPA’s report shows that 35 of 42 of the USTs studied, or 83%, exhibited moderate or severe corrosion, but less than 25% of owners were aware of corrosion prior to the internal inspection. Although EPA cannot project the actual percentage of USTs storing diesel that are affected by corrosion nationwide, the agency is alerting owners of USTs storing diesel fuel about risks from corrosion. EPA’s notification recommends owners check inside their tank systems and further investigate the condition of their diesel fuel tanks. Owners’ awareness and early actions could help protect them from higher repair costs and help protect the environment from contamination from releases. EPA’s UST website provides information on actions tank owners can take to minimize corrosion and associated risks.

Scientific evidence has not identified a specific cause of corrosion in diesel tanks, although microbiologically-influenced corrosion is suspected to be involved. NACS has been engaged with industry stakeholders evaluating the corrosion of ULSD storage tanks for nearly 10 years. The EPA study of 42 UST systems is the most extensive site evaluation of this issue conducted to date and is a clear indication that ULSD tank system corrosion, which seemed random and inconsistent years ago, may indeed be more pervasive. EPA’s report should be considered by retailers as a valuable resource and a notification to pay close attention to diesel tank systems in order to head off potential issues before they become problems. Update On New Jersey’s Proposed Increase Of 23¢ On Motor Fuel Taxes It was announced that the New Jersey Senate and Assembly leaders had reached an agreement on a gas tax hike proposal, which looked similar the original initiative. This plan would raise the gas tax 23¢ per gallon and eliminate the estate tax. However, industry was asking the legislature to consider a smaller gas tax increases of 18¢ per gallon, as opposed to 23¢. The reason is due in part to the way that New York calculates our motor fuels taxes. When this the process began, and gas prices were higher than they currently are, New York’s gas taxes were 33¢ - 35¢ higher than what New Jersey residents were paying, therefore it was expected that even with a 23¢ gas tax increase, we would still maintain a 10¢ - 12¢ advantage over New York. However, gas prices down at the $2.00 mark, a 23¢ increase would bring New Jersey’s advantage down to less than 5¢ per gallon. Station owners in NJ are very concerned by this, they calling for a lesser tax so that stations in Northern NJ counties can keep the gasoline volume and associated convenience store sales coming from New York customers. The original proposed increase was 40¢ a gallon. Due to lobbying by the services stations the increase proposal is now down to 23¢. There is a proposal not to raise the gas tax at all right now, but to borrow funds for two more years as they’ve been doing for the last five, and then in January of 2018, raising the gas tax by 26 cents, with NO TAX CUTS AT ALL! The Republican Governor and raising the motor fuel tax would be less difficult. The increase in the tax could be coupled with removing the restriction against self-service. This would reduce the labor cost to service stations and presumable pass on the saving to the motorist. The increase in New Jersey’s motor fuel taxes would be a bad thing for NJ dealers but a good think for New York services station especially those on the NJ border like Staten Island and Rockland County. BLE Devices Detected At Dallas Fuel Dispensers A local Dallas news station reports that police have uncovered Bluetooth skimming devices from five gas stations.

The Dallas Police Department’s Financial Crimes Unit has recovered five devices that capture credit/debit card information, as well as the PIN and zip code, of cards used at gas pumps. These devices were inserted inside of the pumps and therefore not identifiable to customers, and the data is transmitted to a laptop located in a vehicle on the station’s lot or in a nearby lot. Lt. Tony Crawford told the news source that what makes these skimming devices “scary” is the Bluetooth capability, meaning the thief does not have to retrieve the device to recover the data. To prevent skimming from occurring, the police department says that businesses should physically inspect pumps on a regular basis and place tamper evident seals on them. "When it gets to the point where the bad guy doesn't even have to be there to get the information, it's disconcerting," Crawford said. Crawford noted that the thieves break into the pump with one of several keys used by station attendants or federal and state officials conducting inspections. "As technology advances, so should your knowledge of how to protect yourself from high-tech criminal behavior," Crawford said. Skimming is a top concern for fuel retailers. NACS (in conjunction with Conexxus) and The Pinnacle Corporation have launched the SkimDefend app that works alongside tamper-evident NACS WeCare decals. Together, the decals and app help retailers identify potential security breaches when fuel dispensers or other unattended PIN-entry devices are opened to install skimming mechanisms. Convenience store operators can download the SkimDefend app free of charge for Apple and Android mobile devices, and the NACS WeCare decals can be purchased at nacsonline.com. Weights And Measures Adopts Diesel Gallon Equivalents For CNG Earlier last month, the National Conference on Weights and Measures (NCWM) held its annual meeting in Denver. During the meeting, the conference adopted a proposal that would allow fuel retailers to advertise and sell Compressed Natural Gas (CNG) in diesel gallon equivalents (DGEs)—defined as 6.384 pounds or 2.894 kilograms of CNG. Many retailers who sell or are thinking about selling CNG as a vehicle fuel want to be able to post the prices for consumers in a manner that consumers can understand and allows them to make a comparison with other fuel options, such as gasoline or diesel fuels. The amendment adopted by the NCWM will allow just that. Last year, Congress passed legislation that would align the Internal Revenue Service’s (IRS) definition of gasoline gallon equivalent (GGE) to match the NCWM definition. However, this legislation did not address the issue of DGEs. Due to the divergence of the two definitions of DGE (that of the IRS versus the NCWM), NACS advocated for a NCWM solution to remedy any potential litigation risks, similar to

those faced by retailers in automatic temperature compensation suits. In addition, the NCWM rejected a proposal that would have changed the diesel dispenser filter regulation from a required 30-micron filter to a 10-micron filter. Many fuel retailing businesses are concerned that changing to the more expensive 10-micron filter will not significantly reduce the clogging problems to warrant the added cost of a new filter requirement. Also, using a 10-micron filter will slow the flow rate to such an extent that it will take longer for customers to fill up their vehicles with diesel fuel. Those supporting moving to a 10-micron filter believe that this will significantly improve the overall quality of diesel fuel and should be part of a retailer’s overall maintenance plan. New Mexico Enables Play At The Pump Lottery Continuing its rollout of Play at the Pump technology, Linq3 announced a partnership with the New Mexico lottery that allows convenience stores in the state to offer customers the ability to buy Powerball and Mega Millions tickets directly from the fuel dispenser. Play at the Pump brings the lottery to consumers who swipe their debit card at the gas pump, allowing them to purchase lottery draw games. Players who provide phone numbers receive Quick Pick lottery numbers and win notifications directly on their mobile phone. “Each time we secure a new partnership, it’s a victory for the c-store retailer and their customers,” said Daniel Cage, Linq3 president and founder. “From age verification to redeeming low-tier winnings directly back to the consumer’s debit card, retailers automate it all directly from the fuel pump. Playing Powerball or Mega Millions has never been easier.” “The world is changing and lottery players have told us they want more convenient ways to buy our jackpot games,” said David Barden, New Mexico Lottery CEO. “We look forward to seeing how it works and the benefits it brings players through improved accessibility.” New Mexico is another step for Linq3 as the company continues its expansion across the United States. Play at the Pump is now integrated in both Gilbarco’s Passport and Verifone’s Commander gas pump POS/forecourt controller systems, with NCR’s RPOS to be an addition by the end of 2016. These three POS/controller systems support 95% of the U.S. gas retail sector. Low Fuel Prices Prop Up Car Sales Expect new light vehicle sales to hold steady at 17.7 million in 2016, thanks in part to low fuel prices, which help reduce the cost of ownership, according to the National Automobile Dealers Association. Also, fuel-guzzling trucks remain popular this year due to the drop in oil prices, the trade group pointed out. Low gasoline and diesel prices allow consumers to spend more on new cars and trucks, said NADA Chief Economist Steven Szakaly at the Center for Automotive

"For 2016, light trucks will account for about 59% of the new-vehicle sales market and cars will account for 41%," he said. "Leases are increasing, which now account for more than 34% of the market." However, most of the pent-up demand following the nation's economic slump has been satisfied, and as a result he said he expects new vehicle sales to dip next year. "We've had six straight years of steadily rising sales, which has been a fantastic period of growth, and vehicles per household have returned to the same level prior to the Great Recession," said Szakaly. "For 2017, we expect new-vehicle sales to reach 17.1 million units." --Donna Harris, [email protected] --Copyright, Oil Price Information Service U.S. Senators Voice Concerns To USDA On SNAP Proposal 47 senators sent a bipartisan letter to the U.S. Department of Agriculture (USDA) urging the agency to revise its proposed rule altering retailer eligibility requirements in the Supplemental Nutrition Assistance Program (SNAP). The letter, spearheaded by Senate Agriculture Chairman Pat Roberts (R-KS) and Ranking Member Debbie Stabenow (D-MI), raises concerns that the proposed SNAP regulations would make it overly burdensome for small-format retailers to participate in the program, which will have a drastic impact on access for beneficiaries. “Many SNAP recipients in communities with limited access to large grocery stores rely upon small-format stores, including neighborhood stores, drugstores and convenience stores, for SNAP purchases,” states the letter. When Congress changed the SNAP retailer eligibility requirements in the 2014 Farm Bill, it balanced the need to increase SNAP beneficiaries’ access to nutrient-rich foods while ensuring the stocking requirements were achievable for small-format retailers. Members of Congress realized that many SNAP beneficiaries depend on small stores for food access and wanted to keep them in the program. Ignoring this carefully crafted balance, the proposed rule released in February contains problematic provisions for retailers that were never considered by Congress—and lawmakers are concerned. According to the senators, “The cost and burden of complying with the proposed rule could be too high for these retailers to continue participating in SNAP. This would result in the exact opposite of what is intended—it would reduce access to healthy food for SNAP participants.” The Senate letter echoes concerns shared by more than 20 members of the Congressional Black Caucus and 161 members of the House of Representatives, who sent letters to the USDA this spring.

Avoid The EMV Chip Transaction? The Wall Street Journal published an article this week that touches on not just the speed of service associated with an EMV chip-card transaction, but also inadequacies of EMV in the United States. Unlike the rest of the industrialized world, EMV in the U.S. does not require a PIN for increased consumer security. “Yes, there are serious security benefits to chip cards, and the transactions will get drastically faster, from what I have seen. But the real payoff? The technology that supports chip cards is also laying the groundwork for the death of all plastic cards. Smartphones will replace our wallets once and for all,” writes Joanna Stern of the Wall Street Journal. From a consumer perspective, the WSJ piece leans toward mobile payments at the point of sale (Apple Pay, Samsung Pay, Android Pay), not just for the faster transaction speed but for an extra layer of security with fingerprint authentication. “In other countries, chip cards require a PIN, too. U.S. banks opted against it for credit cards since they feared an even tougher transition for merchants and card holders,” writes the news source. The WSJ also raises the issue of consumer adoption regarding store-specific mobile apps. “[I]f the future is having 50 different store apps on my phone, count me out,” Stern writes. While citing the pros versus cons, the WSJ says that EMV-supported POS terminals could lead to future adoption of mobile payment capabilities. For the retailers, upgrading to new EMV terminals puts “the hardware in place to support mobile payments,” Randy Vanderhoof, director of the U.S. Payments Forum, told the news source. However, he notes that on the flip side, many merchants have had to put mobile implementation on hold so they could take care of EMV certification. Vehicles Breakdown In Record Numbers In Spite of Technology Advances AAA Rescued 32 Million Vehicles In 2015, An All-Time-High; Newer Vehicles Worst Despite advances in vehicle technology, including maintenance reminders and other dashboard alerts designed to mitigate roadside trouble, AAA rescued a record-breaking 32 million drivers in 2015, a new study shows. Vehicles less than five years old in particular experienced a higher proportion of tire and key-related problems than older vehicles, calling into question the trend of eliminating the spare tire and moving to keyless electronic ignitions. “New technology can’t solve some of the bugaboos and neglected maintenance items that sideline late model vehicles,” said Robert Sinclair, Jr., manager of media relations for AAA Northeast. “Low profile tires are highly susceptible to damage, especially when they’re underinflated and hit a pothole, even though many newer cars have tire pressure warning systems. Keyless ignitions can zap battery life and more than a half-million drivers ran out of gas last year,” Sinclair said.

New vehicle owners may be unaware of some new vehicle design features that may leave them vulnerable by the roadside. Many new vehicles come with no spare tire to reduce weight and improve fuel economy substituting inflator kits that only work in few flat tire situations. Also, keyless ignition systems can drain the vehicle’s battery if the “key” is stored too close to the vehicle and the electronics don’t go to “sleep”. This can leave the battery dead and the vehicle locked. Also, if the “key” is left in the vehicle with the engine running, the car can lock itself, leaving the driver stranded. Finally, in spite of nearly all new vehicles being equipped with low fuel warning alerts and range estimations, a higher proportion of drivers are using the systems to push the limits between fill-ups. Other key findings from the analysis of AAA’s 2015 roadside assistance data include: • Dead batteries, flat tires and keys locked in the vehicle

remain the top roadside assistance requests • Vehicles less than five years old have a higher

proportion of tire, key and fuel related breakdowns • Vehicles between six and 10 years old have the highest

proportion of battery problems with most batteries lasting three to five years.

• Roadside assistance calls peak during summer (8.3 million) followed by winter (8.1 million), fall (7.8 million) and spring (7.7 million).

• Drivers are most likely to call AAA for help on Mondays and least likely to call on Sundays

• Drivers in the West have the most breakdowns, followed by the South, the Northeast and the Midwest.

• AAA rescued more than four million drivers locked out of their cars.

To help prevent breakdowns, AAA recommends: • Check for a spare: Before purchasing a vehicle, check

that it includes a spare tire. If not, consider adding one as an option.

• Check tires: At least once a month, check the tire pressure to ensure proper inflation.

• Lockouts: Motorists need to take special care of their “smart keys” and keyless entry fobs. Always take the key when exiting the vehicle, avoid exposing the keyless entry remote or key fob to water and replace the battery at the manufacturer’s recommended interval.

• Battery: AAA recommends that drivers have their vehicle’s battery tested when it reaches three years of age and on an annual basis thereafter.

• Pack an emergency kit: A recent AAA survey found that more than 40 percent of motorists do not carry and emergency kit in their vehicle. A well-stocked emergency kit should include a mobile phone and car charger, a flashlight with extra batteries, a first-aid kit, drinking water, extra snacks/food for travelers and pets, battery booster cables and emergency flares or reflectors.

U.S. Transportation Secretary Anthony Foxx said, “With as high as a 50 percent chance of a dangerous air bag inflator rupture in a crash, these vehicles are unsafe and need to be repaired immediately. Folks should not drive these vehicles unless they are going straight to a dealer to have them repaired immediately, free of charge.” Those vehicle drivers who do have outstanding recalls should contact their nearest dealer to schedule a no-cost immediate repair.
