• Rising: Plaintiff Preliminary Injunction Win Rates in trademark cases nationwide have risen from around 60% in 2000 to almost 70% in 2013

• Falling: Defendant Preliminary Injunction Win Rates over the same period fell slightly (30% to 25%), with much variation year-to-year
