Dear Mr. Williams,
Attached for your review and approval is our Mninq Notice of intent (MNOI) for the abovecaptioned 40 acre reconfigured mining application. This MNOI shall replace the ConstructionNotice of Intent (ONOl) that have previously been transmitted to you.The surface mine shall be stripped of overburden and the topsoil segregated for use in platingthe slopes of the pit for vegetation. The balance of the spoil material shall be used to constructearthen berms around the perimeter of the pit. The berms will be constructed so as to precludestorm water from entering the pit.Construction and excavation of the pit will be in such a configuration with grade changes thatonly the incidental storm water and ground water will flow to a temporary sump at the lowestelevation in the pit. OVERVIEWIntroduction
This document is the Storm Water Pollution Prevention Plan (SWPPP) forproperty owner and operator, W. C. Fore, LLC, Post Office Box 3058, Gulfport,Mississippi 39505, for the surface mining pit known as “Shaw Road Pit”, a 40-acre site located in Gulfport, Harrison County, Mississippi.The purpose of this application is to allow W. C. Fore, LLC, Gulfport, Mississippi,the property owner and operator, to enlarge an existing surface mining site thatwas established and operational in 1973 to a total mining area of 40.0 acres. Thisexisting pit was created to provide imported fill material for the State Aid Project,County Farm Road.
The existing haul road shall be utilized for ingress and egress. This haul road shallbe reconstructed to become a stabilized all weather construction entrance foringress and egress of all construction traffic. The buffer zones shall remain in theirnatural vegetative state around the periphery of the site. Only those trees andvegetative growth will be removed that will impede the location and excavationprocesses of this surface mining pit. Storm water in the buffer zones will follow theexisting natural watercourse. Disturbed areas caused by construction or miningactivities shall be temporarily or permanently seeded as the circumstances direct.ln the interim, sedimentation and erosion controls shall be put in place as needed.Flow of surface water into the mine will be controlled by the use of erosion controlstructures.
1. Clearing and excavation of the surface mining pit will be in a west to eastdirection. The removed topsoil shall be stockpiled and the overburden willbe used to construct the perimeter berm of the mined area. The berm willbe constructed and elevated above the existing natural ground. This raisedlevee will preclude storm water from entering the mined area from thesurrounding property. A temporary sump basin shall be located in thesoutheast area of the surface mining operation. The purpose of this

HarrIson County, Mlsslsslppltemporary sump Is to collect sediment and Incidental stormwater tailing intothe mining pit. No impounded stormwater or sediment shall leave themining pit. All storm water and ground water shall be contained within theconfines of the mining pit. The earthen berms comprised of the strippedoverburden around the periphery of the excavated areas shall preclude themingling of the storm water outside the pit area and the groundwater/stormwater from the excavation.
Storm water falling outside the pit area shall drain from the area through existingnatural watercourses. Ultimately the receiving waters of the State of Mississippiwill be the Little Biloxi River to the north and north east of the project area throughunnamed tributaries. In its undeveloped state the surface mining pit areaencompasses the 50-foot elevation, the highest point in the area and stormwaterpresently appears to flow to all points of the compass.The Storm Water Permit shall be displayed in a conspicuous location to enablepublic review.
This Plan is the criteria for compliance with regulations set forth by theEnvironmental Protection Agency, 40 CFR, Parts 122, 123 and 124, NationalPollutant Discharge Elimination System Application Reaulations for Storm WaterManagement for Construction Activities.
Oblective
The purpose and objective of this Storm Water Pollution Prevention Plan is tomeet the requirements of the State of Mississippi and the U. S. EnvironmentalProtection Agency for the control and mitigation of pollutants to storm waterdischarges associated with this surface mining operation for sand and clay.A ditch was cut allowing stormwater from the pit are to flow into what appears tobe wetlands. This ditch has been filled in and the ditch perimeter has beenbermed to preclude any additional stormwater from flowing out of the pit.

GENERAL REQUiREMENTS
This Storm Water Pollution Prevention Plan consists of certain major activities andcontrols appropriate for surface mining activities.
Implementation
1. Install stabihzed construction entrance.
2. Install erosion control structures as needed.3. Perform stripping activities: Topsoil shall be stockpiled for future plating ofthe slopes and the overburden shall be used to construct the berms aroundthe perimeter of the mining site. Clearing and excavation of the surfacemining pit will be in a west to east direction. The topsoil shall be removedand stockpiled. The overburden will be used to construct the perimeterberm of the mined area. The berm will be constructed and elevated abovethe existing natural ground. This raised levee will preclude storm wateroutside the pit zone from entering the mined area. Storm water shall drainaway from the site through existing natural watercourses and elevationchanges. A temporary sump basin shall be located in the southeast area ofeach phase of the surface mining operation. The purpose of this temporarysump is to collect sediment and stormwater falling into the mining pit. Allincidental storm water entering the mining operation and ground water willnot leave the pit and shall not be discharged into the waters of the State ofMississippi.
4. The general configuration of the mining operation and the constructiontechniques of the surface mining area has been arranged to minimize anyimpact to the adjacent lands.

Hamson County, MississippiErosion and Sediment ControlsMine development will proceed in the planned sequence and every attempt will bemade to prevent erosion. All disturbed areas will be managed and revegetated assoon as practicable after construction activities. Where apphcable, disturbedareas will be stabilized by temporary seeding, permanent seeding, mulchingand/or vegetative buffer strips as each case dictates.
Structural Practices
In addition to vegetative practices referenced above, certain structural erosioncontrol measures shall be implemented as needed. The measures includediverting flows from exposed soils, storing flows or otherwise limiting runoff fromexposed areas. Other structural methods will include straw bale dikes, silt fences,earth dikes, brush barriers, drainage swates, check dams, outlet protection,detention/retention basins, sediment traps, temporary sediment basins orequivalent sediment controls.
1. Construct the sediment I detention pond with the spoils from the excavationto be used in berms.
2. Divert upslope surface water around disturbed areas of the site as shown infigure 1, Diversion Dikes.
3. Limit the exposure of the disturbed area to the shortest amount of time aspracticable.
4. Minimize the amount of surface area that must be disturbed at one time.5. Implement the best management practices to mitigate adverse impactsfrom storm water runoff. Shown in Figures 2, 3, 4, 5 and 6.
Erosion and sediment controls consisting of vegetative and structural practicesshall be designed to preserve vegetation or timely revegetated disturbed areasand divert from exposed soils or otherwise limit runoff from exposed areas.

Harrison County, MississippiControls shall be placed to minimize off-site vehicle tracking of sediments.Controls shall be implemented as needed to retain storm water in the on-sitedetention pond to prevent adverse impact to receiving streams. When work is notbeing performed in a disturbed area, appropriate temporary andlor vegetative andstructural practices shall be initiated.
Any of the following erosion and sedimentation control measures may be used tocontrol/reduce pollutants in storm water.
• Temporary Seeding• Sedimentation Basin
• Permanent Seeding• Check Dams
• Mulching• Straw Bale Dikes
• Sod Stabilization• Earth and/or Sandbag Dikes
• Vegetative Buffer Strips • Brush Barriers• Grassy Swales
• Subsurface Drains• Modification of Contours • Pipe Slope Drains• Silt Fences
• Storm Drain Inlet Protection• Detention Basin
• Drainage Swales• Sediment Traps
• Rock Outlet ProtectionA rain gauge shall be set up on site during mining operations. The rain gauge shall be locatedin the vicinity of the mining pit. Within twenty-four hours after commencement of a rainfallevent greater than or equal to a Two Year 24 Hour Storm Event (6 inches), an inspection of allcontrols and other SWPPP requirements shall be performed during the permit coverage incompliance with Part IV.B of the permit.
Other controls of importance may include, but are not limited to:

1. Topsoil will be removed from the area to be mined and used to plate diversion dikesand berms.
2. Preserving existing vegetation and revegetating disturbed soil as soon as possible tolimit the exposure time of the disturbed area.
3. Surface area that must be disturbed will be minimized.4. Management practices to mitigate adverse impacts from storm water runoff are, but notlimited to, interceptor dikes and swales, hay bales, brush barriers, silt fences, andsediment traps. Figures 1, 2, 3, 4, 5 and 6.
5. Structurally sound dams and levees will be constructed for impoundments.6. Encompassing various stockpiles such as fill or topsoil materials with silt fence and orhay bales.
7. Properly maintaining, cleaning, repairing the site, and erosion prevention controls.
Inspection RequirementsInspection of all temporary and vegetative, erosion and sediment controls, and other protectivemeasures and SWPPP requirements will be performed during the permit coverage.
After each significant rainfall, but not less than once a week all disturbed areas, erosion andsediment controls shall be inspected.At least once every month:
1. Within twenty-four hours after commencement of a rainfall event greater than or equalto a Two Year 24 Hour Storm Event (6 inches).2. As often as necessary ensure that appropriate erosion and sediment controls havebeen properly constructed and maintained.
Maintenance
1. All needed repairs shall be made within 24 hours.

Hamson County, Mississippi2. Remove sediment from inlet protection devices and silt fences when accumulated silthas attained 50 percent capacity.3. Reseed, fertilize and mulch as needed.
Post ConstructionUpon completion of mining activities, post construction control measures shall include on-siteinfiltration, flow attenuation in vegetated swales and natural depressions and retentionstructures. Velocity dissipation devices may be required at the outfall of these structures andalong the outfall channels provide non-erosive flows.
REPORTING
Inspections will be reported on copies of the forms provided. The report form shall besubmitted semi-annually, postmarked not later than the 2&’ day of July or January for eachsix-month period. All records, reports and information resulting from activities required by thispermit shall be retained of at least three years from the date of the MNOI, inspection or report.The inspection report is attached at the end of ihs SWPPP. This form shaii be dupiicated asnecessary.
NONCOMPLIANCE REPORTiNG
1. Anticipated Noncompliance: The Mississippi Office of Pollution Control (OPC) will begiven at least ten days advance notice, if possible, before any planned noncompliancewith permit requirements.2. Unanticipated Noncompliance: The Mississippi Office of Pollution Control (OPC) shallbe notified orally within 24 hours from the time that the operator becomes aware of theunanticipated noncompliance. A written report will be provided to the OPC within fiveworking days from the time the operator becomes aware of the circumstances. Thereport shall describe the cause, the exact dates and times, steps taken or planned toreduce, eliminate, or prevent reoccurrence and, if the noncompliance has not ceased,the anticipated time for correction.

TERMINATION of REPORTING & PERMIT COVERAGE
Upon successful completion of all permanent erosion control and sediment controls for acovered project, a certification of the same will be submitted to the Mississippi Office ofPollution Control. Inspections shall continue for at least two months beyond completion. Ifcontrols have been successful during these two months, reporting and permit coverage isautomatically terminated unless notified by OPC within thirty days of receiving the finalinspection report.

Federal Storm Water Regulations. 40 CFR 122.26(b)(14)(iii), require mines with storm water discharges tohave NPDES storm water permit coverage. Therefore operating a mine without the needed coverage violatesState Law, sections 49-17-1 through 49-17-43, which includes significant penalties.Enclosed is a Mining Notice of Intent (MNOI) form that can be used to apply for coverage under our MiningStorm Water General NPDES Permit, copy enclosed. This MNOI form must be filed at least 30 days prior tothe commencement of mining or 15 days if a Storm Water Pollution Prevention Plan (SWPPP) is already onfile. If you are operating without coverage, you may be operating in violation of the storm water regulationsand subject to potential enforcement action. The surface mine shaN be stripped of overburden and the topsoil segregated for use in plating
the slopes of the pit for vegetation. The balance of the spoil material shall be used to construct
earthen berms around the perimeter of the pit. The berms wfll be constructed so as to preclude
storm water from entering the pit.
Construction and excavation of the pit will be in such a configuration with grade changes That
only the incidental storm water and ground water wilt flow to a temporary Bump at the lowest
elevation in the pit. No storm water or ground water shall leave the surface mining pit. All storm
water shall be contained within the pit.

OVERVIEW
iNTRODUCTION
This document is the Storm Water Pollution Prevention Plan (SWPPP) forproperty owner W. C. Fore Trucking, Inc., Post Office Box 3058, Gulfport,Mississippi 39505, of the surface mining pit known as ‘Shaw Road Pit”, a 40-acresite located fri Gulfport, Harrison County, Mississippi.
The purpose of this application is to allow W. C. Fore Trucking, Inc., ulfport,Mississippi, the property owner, to enlarge an existing surface mining site that wasestablished and operational in 1973 to a total mining area of 40.0 acres. Thisexisting pit was created to provide imported fill material for the State Aid Project,County Farm Road.
The existing haul road shall be utilized for ingress and egress. This haul road shallbe reconstructed to become a stabilized all weather construction entrance foringress and egress of all construction traffic. The buffer zones shall remain in theirnatural vegetative state around the periphery of the site. Only those trees andvegetative growth will be removed that will impede the location and excavationprocesses of this surface mining pit. Storm water in the buffer zones will follow thenatural watercourse. Disturbed areas caused by construction or mining activitiesshall be temporarily or permanently seeded as the circumstances direct. In theinterim, sedimentation and erosion controls shall be put in place as needed. Flowof surface water into the mine will be controlled by the use of erosion controlstructures.
1. Clearing and excavation of the surface mining pit will be in an west to eastdirection. The removed topsoil shall be stockpiled and the overburden willbe used to construct the perimeter berm of the mined area. The berm willbe constructed and elevated above the existing natural ground. This raisedlevee will preclude storm water from entering the mined area. A temporarysump basin shall be located in the southeast area of the surface mining

operation. The purpose of this temporary sump is to collect sediment and
incidental stormwater falling into the mining pit. No impounded stormwater
or sediment shall leave the mine pit. All storm water and ground water shall
be contahied within the confines of the mining pit. The earthen berms
comprised of the stripped overburden around the periphery of the
excavated areas shall preclude the mingling of the storm water outside the
pit area and the ground waterlstormwater from the excavation,
Storm water falling outside the pit area shall drain from the area through existing
natural watercourses. Ultimately the receiving waters of the State of Mississippi
will be Little Biloxi River to the south and south east of the project area through
unnamed tributaries. In its undeveloped state the surface mining pit area
encompasses the 50-foot elevation, the highest point in the area and stormwater
appears to flow to all points of the compass.
The Storm Water Permit shall be displayed in a conspicuous location to enable
public review.
This Plan is the criteria for compliance with regulations set forth by the
Environmental Protection Agency, 40 CFR, Parts 122, 123 and 124, National
Pollutant Dichpre Elimination System Aoolication Fequlations for Storm Water
Management for Construction Activities.
OBJECTiVE
The Purpose of this Storm Water Pollution Prevention Plan is to meet the
requirements of the State of Mississippi and the Environmental Protection Agency
for the control and mitigation of pollutants to storm water discharges associated
with this surface mining operation for sand and clays

General Reauirements
This Storm Water Pollution Prevention Plan consists of certain major activities andcontrols appropriate for surface mining activities.
Implementation
1. Install stabilized construction entrance.
2. Install erosion control structures as needed.
3. Perform stripping activities. Topsoil shall be stockpiled for future plating ofthe slopes and the overburden shall be used to construct the berms aroundthe perimeter of the mining site. Clearing and excavation of the surfacemining pit will be in an east to west direction. The topsoil shall be removedand stockpiled. The overburden will be used to construct the perimeterberm of the mined area. The berm will be constructed and elevated abovethe existing natural ground. This raised levee will preclude storm wateroutside the pit zone from entering the mined area. Storm water shall drainaway from the site through existing natural watercourses and elevationchanges. A temporary sump basin shall be located in the southwest area ofeach phase of the surface mining operation. The purpose of this temporarysump is to collect sediment and stormwater falling into the mining pit. Allincidental storm water entering the mining operation and ground water willnot leave the pit and shall not be discharged into the waters of the State ofMississippi.
4. The general configuration of the mining operation and the constructiontechniques of the surface mining area has been arranged to minimize anyimpact to the adjacent lands.

Erosion and Sediment Controls:
Mine development will proceed in the planned sequence and every attempt will be
made to prevent erosion. All disturbed areas will be managed and revegetated as
soon as practicable after construction activities. Where applicable, disturbed
areas will be stabilized by temporary seeding, permanent seeding, mulching
and/or vegetative buffer strips as each case dictates.
Structural Practices
In addition to vegetative practices referenced above, certain structural erosion
control measures shall be Implemented as needed. The measures include
diverting flows from exposed soils, storing flows or otherwise limiting runoff from
exposed areas. Other structural methods will include straw bale dikes, silt fences,
earth dikes, brush barriers, drainage swales, check dams, outlet protection,
detention/retention basins, sediment traps, temporary sediment basins or
equivalent sediment controls.
1. Construct the sediment I detention pond with the spoils from the excavation
to be used in berms.
2. Divert upslope surface water around disturbed areas of the site as shown in
figure 1, Diversion Dikes.
3. Limit the exposure of the disturbed area to the shortest amount of time as
practicable.
4. Minimize the amount of surface area that must be disturbed at one time.
5. Implement the best management practices to mitigate adverse impacts
from storm water runoff. Shown in Figures 2, 3, 4, 5 and 6.
Erosion and sediment controls consisting of vegetative and structural practices
shall be designed to preserve vegetation or timely revegetated disturbed areas
and divert from exposed soils or otherwise limit runoff from exposed areas.

Controls shall be placed to minimize off-site vehicle tracking of sediments.
Controls shall be implemented as needed to retain storm water in an on-sitedetention pond to prevent adverse impact to receMng streams. When work is notbeing performed in a disturbed area, appropriate temporary and I or vegetativeand structural practices shall be initiated.
Any of the following erosion and sedimentation control measures may be used tocontrol I reduce pollutants in storm water.

A rain gauge shall be set up on site during mining operations. The rain gauge shallbe located in the vicinity of the mining pit. Within twenty-four hours aftercommencement of a rainfall event greater than or equal to a Two Year 24 HourStorm Event (6 inches), an inspection of all controls and other SWPPP requirementsshall be performed during the permit coverage in compliance with Part IV. B of thepermit.
Other controls of importance may include, but are not limited to:

1. Topsoil will be removed from the area to be mined and used to plate diversiondikes and berms.
2. Preserving existing vegetation and revegetating disturbed soil as soon aspossible to limit the exposure time of the disturbed area.
3. Surface area that must be disturbed will be minimized.
4. Management practices to mitigate adverse impacts from storm water runoffare, but not limited to, interceptor dikes and swales, hay bales, brush barriers,silt fences and sediment traps. Figures 1, 2, 3, 4, 5 and 6.
5. Structurally sound dams and levees will be constructed for impoundments.
6. Encompassing various stockpiles such as fill or topsoil materials with haybales or silt fence.
7. Properly maintaining, cleaning, repairing the site and erosion preventioncontrols.
INSPECTION. REQUIREMENTS:
Inspection of all temporary and vegetative, erosion and sediment controls and otherprotective measures and SWPPP requirements will be performed during the permitcoverage.
After each significant rainfall, but not less than once a week all disturbed areas,erosion and sediment controls shall be inspected.At least once every month:
1. WIthin twenty-four hours after commencement of a rainfall event greater thanor equal to a Two Year 24 Hour Storm Event (6 inches).
2. As often as necessary ensure that appropriate erosion and sediment controlshave been properly constructed and maintained.

MAI NTENANCE
1. All needed repairs shall be made within 24 hours.2. Remove sediment from inlet protection devices and silt fences when
accumulated silt has attained 50 percent capacity.3. Reseed, fertilize and mulch as needed.
POST CONSTRUCTION
Upon completion of mining activities, post construction control measures shallinclude orisite infiltration, flow attenuation in vegetated swales and naturaldepressions and retention structures. Velocity dissipation devices may be required atthe outfall of these structures and along the outfall channels provide non-erosiveflows.
REPQRTiN
Inspections will be reported on copies of the forms provided. The report form shall besubmitted semi-annually, postmarked not later than the 28th day of July or Januaryfor each six-month period. All records, reports and information resulting fromactivities required by this permit shall be retained of at least three years from thedate of the MNOI, inspection or report. The inspection report is attached at the endof this SWPPP. This form shall be duplicated as necessary.
NONCOMPLIANCE REPORTING1. Anticloated Noncompliance: The Mississippi Office of Pollution Control (OPC)
will be given at least ten days advance notice, if possible, before any plannednoncompliance with permit requirements.
2. Unanticioated Noncompliance; The Mississippi Office of Pollution Control(OPC) shall be notified orally within 24 hours from the time that Alton or Vickiebelancey becomes aware of the unanticipated noncompliance. A writtenreport will be provided the OPC within five working days from the time theoperator becomes aware of the circumstances. The report shall describe thecause, the exact dates and times, steps taken or planned to reduce, eliminate,

or prevent reoccurrence and, if the noncompliance has not ceased, theanticipated time for correction.
TERMINATION of REPORTiNG and PERMiT COVERAGEUpon successful completion of all permanent erosion control and sediment controlsfor a covered project, a certification of the same will be submitted to the MississippiOffice of Pollution Control. Inspections shall continue for at least two months beyondcompletion. if controls have been successful during these two months, reporting andpermit coverage is automatically terminated unless notified by OPC within thirty daysof receiving the final inspection report.

Attached for your review and approval is our MininQ Notice of Intent (MNOI) for the abovecaptioned 40 acre mining application. This MNOI shall replace the Construction Notice of Intent(CNOI) that was transmitted on August 11, 2004
The surface mine shall be stripped of overburden and the topsoil segregated for use in platingthe slopes of the pit for vegetation. The balance of the spoil material shall be used to constructearthen berms around the perimeter of the pit, The bernie will be constructed so as to precludestorm water from entering the pit.
Construction and excavation of the pit will be in such a configuration with grade changes thatonly the incidental storm water and ground water will flow to a temporary sump at the lowestelevation in the pit. No storm water or ground water shall leave the surface mining pit. All stormwater shall be contained within the pit.

On the 1st of September 2004, 1 investigated the complaint, and learned the county zoning commission sent letters toresidents informing them Mr. Fore was making arrangements to mine 40 acres of his property off Shaw Rd.. Mis.Pluniiner who lives next to the property said the dirt would be used as land fill for the Gulfport Docks. The kcalresidents put together a petition to try and stop the mining operations, sighting contamination issues from a nearh>hazardous waste storage site. The hazardous waste site in question stores creosote waste on the property next to thesite to be mined. I approached the site and stopped at the property line due to warning signs, however, I could see themonitoring wells and a recovery system only 100 yards up hill from the fence line. I can not determine if the propertyis contaminated or not. The complainant will bring the issue to the Zoning Administrator at the public hearingSeptember the 16th, and hopes to have the MI)EQ aware ofthis issue as well. I spoke to Billy Warden at the centraloffice about Mr. Fore’s permit #-MSR321396, informed him about the nearby waste site, and that a complaint hasbeen filed, which he noted.
Mrs. Regina Plummer is heading this effort on behalf of residents in the area. Their concerns are: the soil mined couldbe contaminated harming aquatic life; the mining could draw contaminated water away from the recovery plantspossibly entering their wells, and the added dust could cause health problems for the elderly in this heavily populatedarea.
Attached is the Remedial Action Plan of the Lyman Site for consideration by the permitting commission.

The surface mine shall be stripped of overburden and the topsoil segregated for use In platingthe slopes of the pit for vegetation. The balance of the spoil material shall be used to constructearthen berms around the perimeter of the pit. The berms will be constructed so as to precludestorm water from entering the pit.

OVERVIEW
Introthsctlon
This document is the Storm Water Pollution Prevention Plan (SVVPPP) for
property owner and operator, W. C. Fore, LLC. Post Office Box 3058, Gulfport,
Mississippi 39505, for the surface mining pit known as “Shaw Road Pit a 40-
acre site located in Gulfport, Harrison County, Mississippi.
The purpose of this application is to allow W. C. Fore, LLC, Gulfport, Mississippi,
the property owner and operator, to enlarge an existing surface mining site that
was established and operational in 1973 to a total mining area of 40.0 acres. This
existing pit was created to provide imported fill material for the State Aid Project,
County Farm Road.
The existing haul road shall be utilized for ingress and egress. This haul road shall
be reconstructed to become a stabilized all weather construction entrance for
ingress and egress of alt construction traffic. The buffer zones shall remain in their
natural vegetative state around the periphery of the site. Only those trees and
vegetative growth will be removed that will impede the location and excavation
processes of this surface mining pit. Storm water in the buffer zones will follow the
existing natural watercourse. Disturbed areas caused by construction or mining
activities shall be temporarily or permanently seeded as the circumstances direct.
In the interim, sedimentation and erosion controls shall be put in place as needed.
Flow of surface water into the mine will be controlled by the use of erosion control
structures.
1. Clearing and excavation of the surface mining pit will be in a west to east
direction. The removed topsoil shall be stockpiled and the overburden will
be used to construct the perimeter berm of the mined area. The berm will
be constructed and elevated above the existing natural ground. This raised
levee will preclude storm water from entering the mined area from the
surrounding property. A temporary sump basin shall be located in the
southeast area of the surface mining operation. The purpose of this

temporary sump is to collect sediment and incidental storrnwater failing intothe mining pit. No impounded stormweter or sediment shall leave themirnng pit. All storm water and ground water shall be contained within theconfines of the mining pit. The earthen bernie comprised of the stripped
overburden around the periphery of the excavated areas shall preclude the
mingling of the storm water outside the pit area and the ground
wateristormwater from the excavation.
Storm water falling outside the pit area shall drain from the area through existing
natural watercourses. Ultimately the receiving waters of the State of Mississippiwill be the Little Biloxi River to the north and north east of the project area throughunnamed tributaries. In its undeveloped state the surface mining pit area
encompasses the 50-foot elevation, the highest point in the area and stormwater
presently appears to flow to all points of the compass.
The Storm Water Permit shall be displayed in a conspicuous location to enable
public review.
This Plan is the criteria for comphance with regulations set forth by the
Environmental Protection Agency, 40 CER, Parts 122, 123 and 124, Nationai

The purpose and objective of this Storm Water Pollution Prevention Plan is tomeet the requirements of the State of Mississippi and the U. S. EnvironmentalProtection Agency for the control and mitigation of pollutants to storm waterdischarges associated with this surface mining operation for sand and clay.
A ditch was cut allowing stormwater from the pit are to flow into what appears tobe wetlands. This ditch has been filled in and the ditch perimeter has beenbermed to preclude any additional stormwater from flowing out of the pit.

GENERAL REQUIREMENTS
This Storm Water Pollution Prevention Plan consists of certain major activities and
controls appropriate for surface mining activities.
ftnplementation
1. Install stabilized construction entrance.
2. Install erosion control structures as needed.
3. Perform stripping activities: Topsoil shall be stockpiled for future plating of
the slopes and the overburden shall be used to construct the berms around
the perimeter of the mining site. Clearing and excavation of the surface
mining pit will be in a west to east direction. The topsoil shall be removed
and stockpiled. The overburden will be used to construct the perimeter
berm of the mined area. The berm will be constructed and elevated above
the existing natural ground. This raised levee will preclude storm water
outside the pit zone from entering the mined area. Storm water shall drain
away from the site through existing natural watercourses and elevation
changes A temporary sump basin shall be located in the southeast area of
each phase of the surface mining operation. The purpose of this temporary
sump is to collect sediment and stormwater falling into the mining pit. All
incidental storm water entering the mining operation and ground water will
not leave the pit and shall not be discharged into the waters of the State of
Mississippi.
4. The general configuration of the mining operation and the construction
techniques of the surface mining area has been arranged to minimize any
impact to the adjacent lands.

Mine development will proceed in the planned sequence and every attempt will be
made to prevent erosion. All disturbed areas will be managed and revegetated as
soon as practicable after construction activities. Where applicable, disturbed
areas will be stabthzed by temporary seeding, permanent seeding, mulching
andlor vegetative buffer strips as each case dictates.

In addition to vegetative practices referenced above, certain structural erosion
control measures shall be implemented as needed. The measures include
diverting flows from exposed soils, storing flows or otherwise limiting runoff from
exposed areas. Other structural methods will include straw bale dikes, silt fences,
earth dikes, brush barriers, drainage swales, check dams, outlet protection,
detentionlretention basins, sediment traps, temporary sediment basins or
equivalent sediment controls.
1. Construct the sediment I detention pond with the spoils from the excavation
to be used in berms.
2. Divert upsiope surface water around disturbed areas of the site as shown in
figure 1 Diversion Dikes.
3. Limit the exposure of the disturbed area to the shortest amount of time as
practicable.
4. Minimize the amount of surface area that must be disturbed at one time.
5. Implement the best management practices to mitigate adverse impacts
from storm water runoff. Shown in Figures 2, 3. 4, 5 and 6.
Erosion and sediment controls consisting of vegetative and structural practices
shall be designed to preserve vegetation or timely revegetated disturbed areas
and divert from exposed soils or otherwise limit runoff from exposed areas.

Controls shall be placed to minimize off-site vehicle tracking of sediments.
Controls shall be implemented as needed to retain storm water in the on-site
detention pond to prevent adverse impact to receiving streams. When work is not
being performed in a disturbed area, appropnate temporary and/or vegetative and
structural practices shalt be initiated.
Any of the following erosion and sedimentation control measures may be used to
control/reduce pollutants in storm water
• Temporary Seeding • Sedimentation Basin
• Permanent Seeding • Check Dams
• Mulching • Straw Bale Dikes
• Sod Stabilization • Earth and/or Sandbag Dikes
• Vegetative Buffer Strips • Brush Barriers
• Grassy Swales • Subsurface Drains

• Silt Pences • Storm Drain Inlet Protection
• Detention Basin • Drainage Swales
• Sediment Traps • Rock Outlet Protection
A rain gauge shall be set up on site during mining operations. The rain gauge shall be located
in the vicinity of the mining pit. Within twenty-four hours after commencement of a rainfall
event greater than or equal to a Two Year 24 Hour Storm Event (6 inches), an inspection of all
controls and other SWPPP requirements shall be performed during the permit coverage in
compliance with Pai-t IVB of the permit.
Other controls of importance may include, but are not limited to:

1. Topsoil will be removed from the area to be mined and used to plate diversion dikes
and berms.
2. Preserving existing vegetation and revegetating disturbed soil as soon as possible to
limit the exposure time of the disturbed area.
3. Surface area that must be disturbed will be minimized.
4. Management practices to mitigate adverse impacts from storm water runoff are, but not
limited to, interceptor dikes and swales, hay bales, brush barriers, silt fences, and
sediment traps, Figures 1, 2, 3, 4, 5 and 6.
5. Structurally sound dams and levees will be constructed for impoundments.
6. Encompassing various stockpiles such as fill or topsoil materials with silt fence and or
hay bales.
7. Properly maintaining, cleaning, repairing the site, and erosion prevention controls.
!aspection flegufreniyrgsInspection of all temporary and vegetative, erosion and sediment controls, and other protective
measures and SWPPP requirements will be performed during the permit coverage.
After each significant rainfall, but not less than once a week all disturbed areas, erosion and
sediment controls shall be inspected.
At least once every month:
1. Within twenty-four hours after commencement of a rainfall event greater than or equal
to a Two Year 24 Hour Storm Event (6 inches).
2. As often as necessary ensure that appropriate erosion and sediment controls have
been properly constructed and maintained.

has attained 50 percent capacity.
3. Reseed, fertilize and mulch as needed.

Upon completion of mining activities, post construction control measures shall include on-site
infiltration, flow attenuation in vegetated swales and natural depressions and retention
structures, Velocity dissipation devices may be required at the outfall of these structures and
along the outfall channels provide non-erosive flows.
REPORTING
Inspections will be reported on copies of the forms provided. The report form shall be
submitted semi-annually, postmarked not later than the 28th day of July or January for each
six-month period. All records, reports and information resulting from activities required by this
permit shall be retained of at least three years from the date of the MNOI, inspection or report.
The inspection report is attached at the eno of this SWPPP. This form shall be dupiicated as
necessary.
NONCOMPLIANCE REPORTING
1. Anticipated Noncompliance: The Mississippi Office of Pollution Control (OPC) will be
given at least ten days advance notice, if possible, before any planned noncompliance
with permit requirements.
2. Unnticipaed Noncomoliance: The Mississippi Office of Pollution Control (OPC) shall
be notified orally within 24 hours from the time that the operator becomes aware of the
unanticipated noncompliance. A written report will be provided to the OPC within five
working days from the time the operator becomes aware of the circumstances. The
report shall describe the cause, the exact dates and times, steps taken or planned to
reduce, eliminate, or prevent reoccurrence and, if the noncompliance has not ceased,
the anticipated time for correction.

TERMINATION of REPORTING & PERMIT COVERAGE
Upon successful completion of all permanent erosion control and sediment controls for a
covered project, a certification of the same will be submitted to the Mississippi Office of
Pollution Control. Inspections shall continue for at least two months beyond completion. If
controls have been successful during these two months, reporting and permit coverage is
automatically terminated unless notified by OPC within thirty days of receiving the final
inspection report.

Dirt pit denied; landowner to appeal decisionBy ANITA LEE
GUIFPORT - After the Harrison County Board of Supervisors unanimously rejected a 40-acre dirt pit off Shaw Road,residents applauded, but landowner W.C. Fore said he would appeal the decision to Circuit Court.
Fore said the land off Shaw Road is the only property he owns that contains the sand he must supply for expansion atthe State Port in Gulfport. His attorney, Britt Singletary, expects the case to be heard in 90 to 120 days.
Residents packed the boardroom to object to the pit on the narrow, rural road.
‘We’re happy,” said David Reeves, a fourth-generation resident. “We think the supervisors made the right decision. Theylistened to the voice of the people. I’m very impressed.”
Supervisor Larry Benefield offered the motion to reject Fore’s application for a conditional-use permit. Benefield saidShaw Road wasn’t built for heavy truck traffic. It is not on the county’s list of roads that allow trucks over 40,000pounds. Loaded dump trucks weigh twice that much.
Residents feared an increase in accidents because the road has a sharp curve and is only a little over 18 feet wide.School buses also travel Shaw Road. Heavy trucks, they said, would tear up the rural road.
Fore offered concessions: He would keep trucks off the road while buses run, would hire a safety officer to oversee histruck traffic, would add pull-offs in three places on each side of the road, would put up signs about the truck traffic andwould take care of road repairs.
About 300 trucks a day would have traveled 1.4 miles of Shaw Road to and from Mississippi Highway 53.
The Planning Commission approved Fore’s application, but residents appealed the decision.
Benefield said some places along the road do not have enough rights of way for pull-offs.
Supervisor William Martin said: “I don’t see this being the right place to do it. Any time you’ve got to have pull-offs,that’s a problem.”
Supervisor Marlin Ladner opposed the pit based on the public safety risk. Supervisors, he said, needed to err on the sideof caution.

GULFPORT - Harrison County residents in the Shaw Road area must sacrifice for the State Port at Gulfport expansion,the Planning Commission decided Wednesday.
County commission members voted 3-1 to allow W.C. Fore Trucking to mine sand from 40 acres on Shaw Road. ReillyMorse, an attorney who represents David Reeves and other Shaw Road residents, said the decision will be appealed tothe Board of Supervisors.
Fore also must win approval from the state Department of Environmental Quality, which has a detailed regulatoryprocess.
If the pit is allowed, residents will live with 150 round trips by dump trucks every weekday, and 75 trips on Saturdays,along the narrow rural roadway. The trucks will travel 1.4 miles of Shaw Road north of Mississippi 53.

The Department of Environmental Quality (Department) has reviewed the submittedNotice of Intent (NOT) for coverage under the Statewide General Permit for storm waterdischarges from mining operations and other environmental data relative to the proposedproject. Based on the available information, the Department has determined that ahydrogeologic study should be performed to determine any potential impact the proposedmining project may have on the nearby groundwater remediation project at CavenhamForest Industries, Inc., Lyman Site No. 2. The required study should be conducted by aregistered professional engineer and/or professional geologist registered with the state ofMississippi, who is independent of the parties involved in the project.
Additionally, the Department has determined that an individual NPDES permit would bemore appropriate for the proposed project. Therefore, please find the enclosed EPAForm 1 and Form 2D. These applications should be completed as required and submittedto the Department.
Included with the individual application forms, a full site development plan should besubmitted. The site development plan should include a site map indicating all propertyboundaries, storm water controls, mining area, equipment staging areas, siteingress/egress, and any other information pertinent to the site development. The narrativeshould detail the total depth to be mined, the groundwater depths identified during thehydrogeologic study, anticipated amount of groundwater/storm water to be maintainedwithin the mining area, run-on control measures and any other information related to theoverall management of the mining site.
