DESCRIPTION: The applicant would like to sell a small parcel to a person in order to construct a large cold storage building. OBSERVATIONS: The 1.5-acre parcel is located between Highway 151 and Greenway Road. The property has limited residential development due to the Noise Overlay District (NOD) of Highway 151. The NOD requires residences to be a minimum of 200 feet away from a divided highway. The property is only 175 feet wide. The property consists entirely of Class I & II soils. Division of property for two (2) separate buildable residential sites

Location: West of 9280 County Highway Y

Description: The petitioner would like to divide the existing vacant residential lot into 2 lots for sale. The proposed lots would be one acre in size each. Applicant proposes a joint driveway to service both proposed lots. Observations: The property is just east of the Blackhawk Fields Subdivision. The owner previously divided the property in 2003, but no home was ever built on the subject property. The home on the adjoining RH-1 lot has an existing septic system easement on the subject property located on the eastern boundary (see attached CSM). Having 2 active drain fields on the proposed easterly 1 acre lot could pose water quality concerns and limit the ability to site a replacement system, should the need arise in the future. Dane County Highway Dept: Highways has indicated support for a joint driveway to serve both lots. Town Plan: The property is located in the Rural Development Planning Area. Although this area allows for residential housing having a minimum lot size of 1-acre, the second policy listed for this planning area states the following: “Strongly discourage the rezoning of land or approval of new subdivisions where there are at least five years of supply of unsold rural lots in major subdivisions in the Town…” (emphasis from town plan). Staff: A review of the South Central Wisconsin Multiple Listing Service documents over 70 vacant lots currently for sale in the town of Roxbury. Less than 10 of the 58 available residential lots in the adjacent Blackhawk Fields subdivision have been developed in the 4+ years since the subdivision was platted. None of the lots in the Bavarian Village subdivision have been developed. It appears that there is currently well over 5 years’ supply of vacant residential lots for sale in the town (see attached Table 9 from town plan). Town: Approved with no conditions.

Description: The petitioner is requesting a change of zoning in order to correct an outstanding zoning violation with regards to the construction of a 2160 square foot accessory building. In November 2009, a zoning permit was issued for the construction a residential accessory building on the property. The foundation was installed in October 2010. On September 2012, a site inspection was conducted prior to the expiration of the zoning permit. The site inspection revealed that the building was not constructed per approved plans. A second floor addition was added to the west side of the building and the exterior wall height was increased. These alterations made the building exceed the 16-foot maximum height requirement of an accessory building in the A-1 Agriculture Zoning District. Observations: The parcel size is 0.7 acres that was created prior to the adoption of the Land Division ordinances. There is an existing single-family residence on the property. No sensitive environmental features observed. Town Plan: Property is located in the “Residential” land use district. The Residential land use district allows for institutional, mixed, use, and research/development land uses. Staff: On initial conversations with the landowner, Mr. Ballweg stated that the building would be used as part of his construction business, Mid Towne Construction. Currently, Mr. Ballweg stated that the building would be used solely for residential purposes. Staff suggests postponing the petition until the landowner decides on corrective actions for the non-conforming accessory building. Town: Pending.

Observations: There is an existing apple orchard on the property. Prospective buyer will continue to operate the orchard. No sensitive environmental features observed. Town Plan: The property is located in the town’s Agricultural Preservation Area. Staff: Proposed salt-water shrimp operation is an agricultural use. The town and county comprehensive plans support innovative agricultural operations like that proposed by the prospective buyer. Proposal is consistent with town / county plan policies.
