NOTIFICATION OF INTENT TO SUBMIT APPLICATIONS FOR A MINING RIGHT, INTEGRATED ENVIRONMENTAL AUTHORISATION AND WASTE MANAGEMENT LICENCE, AND A WATER USE LICENCE FOR PURPOSES OF CONDUCTING THE PROPOSED OPENCAST COAL AND UNDERGROUND MINING OPERATION, LIMPOPO PROVINCE
STAKEHOLDER INVITATION TO REGISTER AND COMMENT
Notice is hereby given in terms of the Mineral and Petroleum Resources Development Act, 2002 (Act 28 of 2002) (MPRDA), the National Environmental Management Act, 1998 (Act 107 of 1998) (NEMA), the NEMA Environmental Impact Assessment Regulations, 2014, the National Environmental Management: Waste Act, 2008 (Act 59 of 2008) (NEM:WA) and the National Water Act, 1998 (Act 36 of 1998) (NWA) and the Water Use Licence Application and Appeals Regulations, 2017 that Universal Coal Development V (Pty) Ltd (UCDV) intends to apply for a Mining Right and associated integrated Environmental Authorisation (EA) and Waste Management Licence (WML), and Water Use Licence (WUL) for purposes of conducting coal mining on Farm Cygnus 549 MS in the Limpopo Province. UCDV was granted a Prospecting Right (LP30/5/1/1/2/1276PR) over the Cygnus 549 MS property, and is currently applying for a mining right in respect of coal mining at the property. The project triggers activities listed in terms of Listing Notices 1 (Activities 9, 10, 12, 24, 27, and 56), Listing Notice 2 (Activities 4, 6, 15, 17 and 21) and Listing Notice 3 (Activities 4, 10, 12 and 18) of the NEMA (as amended) and will require an Environmental Authorisation (EA) from the Department of Mineral Resources (DMR), Limpopo Province. The project also triggers activities listed in GNR921 (Category A: activities 10 and 12, Category B: activities 1 and 10 and Category C) and will require a WML from the DMR. Accordingly, a full Scoping and Environmental Impact Reporting process in respect of the integrated EA/WML application will be followed. SRK Consulting (South Africa) (Pty) Ltd (SRK Consulting) was appointed by UCDV as the independent environmental consultants to undertake the integrated EA/WML process. This integrated application will be submitted simultaneously with the application for the mining right to the DMR, as required in terms of section 22 of the MPRDA. A WUL application will also be submitted to the Department of Water and Sanitation (DWS) and will be aligned and integrated with the process for obtaining the integrated EA/WML and the Mining Right.

1. Project Description
All the required mine infrastructure for the proposed operation will be established on the LP30/5/1/1/2/1276PR. prospecting area, specifically on the south-western side of the farm Cygnus 549MS ("Project Area").

1.1 Mine Infrastructure
All the required mine infrastructure for the Project Area will be established on the LP30/5/1/1/2/1276PR. prospecting area, specifically on the south-western side of the Project Area as shown in Appendix A. The required project will include:
• One opencast block which will be mined for a period of eight years by using the truck and shovel opencast method of mining for a period of eight years;
• Once opencast reserves have been depleted, an underground mining operation will be implemented for four years;
• Three proposed waste dump sites, one each for topsoil, soft waste material and hard waste material, will be utilised to minimise the hauling of overburden material over excessive distances;
• The Coal Handling Preparation Plant (CHPP);
• Discard Dump;
• Buildings including workshops, change house-lamp room, offices, stores, contractors’ laydown area and parking;
• A pollution control dam and trenches;
• Stormwater management infrastructure;
• Power Supply infrastructure including a switching yard and electrical powerlines;
• A package Wastewater Treatment Plant;
• Access road which will be constructed, running from R584 to the mine and open cast area; and
• Diversion of the road to the south of the property. The Life of Mine (LOM) for the Cygnus operations is approximately 12 years.
1.2 Water Use Licence Application
The proposed Mine also requires a Water Use Licence (WUL) for water uses as defined in Section 21 of the National Water Act, 1998 (Act 36 of 1998) (NWA). Table 1 provides a summary of water uses required for the project. Table 1: Water Uses to be applied for

Section 21 (g) Disposing coal slurry and discard, pollution control dams and dust suppression
Section 21 (j) Removal of water from underground
2. Project Location
The proposed project is located within Makhado Local Municipality of the Vhembe District Municipality in the Limpopo Province, some 120 km to the north of Polokwane and to the east of Alldays. The project site may be reached via an all-weather gravel road that branches off from the tar road (road R584) between Alldays and Waterpoort. The Project Area is approximately (~) 50 km by road from Alldays and about 30 km by road from Waterpoort. The nearest sizeable town is Makhado (Louis Trichardt) some 80 km by road to the southeast. The nearest accessible railway siding is at Waterpoort, ~ 30 km southeast. The property details are provided in Table 2 and a map of the affected and adjacent properties are included in Appendix B. 3. Process to be followed
GNR982 of the NEMA stipulates that all activities listed in Listing Notice 2 require that a full Environmental Impact Assessment (EIA) including Scoping and Impact Assessment be followed. An Integrated Environmental Process will be followed for the proposed Cygnus MRA Project. A summary of the process to be followed is provided in Figure 1.

AVAILABILITY OF THE DRAFT SCOPING REPORT FOR REVIEW AND COMMENT
Notice is hereby given that the Draft Scoping Report will be available for comment. The comment period will run for a period of 30 calendar days from 3 April 2019 to 8 May 2019. An application for a mining right with respect to coal and the associated integrated application for an Environmental Authorisation (EA) and Waste Management Licence (WML) has been submitted to the Department of Mineral Resources (DMR), Limpopo Province in accordance with the Mineral and Petroleum Resources Development Act, 2002 (Act 28 of 2002) (MPRDA), the National Environmental Management Act (Act No. 107 of 1998) (NEMA) and the National Environmental Management: Waste Act, 2008 (Act 59 of 2008) (NEM:WA). An application for an Integrated Water Use Licence (IWUL) for the proposed Cygnus Coal Mine will be submitted to the Department Water and Sanitation (DWS) in terms of the National Water Act, 1998 (Act 36 of 1998).The Integrated Water and Waste Management Plan (IWWMP) will be made available for review and comment with the Environmental Impact Assessment Report once the Scoping Report has been approved by the DMR.
Draft Scoping Report available for comment The Draft Scoping Report serves as the first phase of the overall Environmental Impact Assessment process and provides stakeholders with the basic legal framework relevant to the proposed project. It provides the opportunity to identify and engage with Interested and Affected Parties (I&APs) and assess the receiving environment in terms of current state and determine potential positive or negative impacts. The Scoping Phase also provides the team with an opportunity to consider feasible alternatives as stakeholder issues and concerns are taken into consideration.

Notice is hereby given that the Draft Environmental Impact Assessment and Environmental Management Programme Report (EIA/EMPr Report) for the proposed Cygnus Coal Mine is available for public review and comment. This Report will be available for a 30-day commenting period (from 20 August 2019 to 18 September 2019).
