State Grant Funds for a Family Literacy Program,Act 143 of 1986 for Program Year 1998-99

Act 143 of 1986, as approved by the General Assemblyof the Commonwealth of Pennsylvania and signed intolaw on October 22, 1986, established the PennsylvaniaAdult Literacy Education Grant Program. A portion of theappropriation has been set aside for family literacydefined in the act as: ‘‘An educational program designedto provide literacy training for adults, educational ser-vices for children and activities for parents and childrentogether, at the same or at different sites.’’

The purpose of the Pennsylvania Family Literacy Pro-gram is to break the cycle of poverty and illiteracythrough an intergenerational instructional program, toimprove the educational opportunities for children andadults by integrating early childhood and adult educationfor parents into a unified family program, and to imple-ment collaborative relationships that build on existingcommunity resources creating a new range of services.The program shall also assist children and adults to meetchallenging education performance standards.

The Secretary shall consider, but not be limited to, thefollowing factors when evaluating proposals for adultliteracy instruction programs:

1) Percentage of eligible adults expected to be enrolledfor instruction who are receiving either State or Federalpublic assistance, or who are unemployed workers ordisplaced homemakers.

2) Percentage of eligible adults in any local area whodo not have certificates of graduation from a secondaryschool and who are not currently enrolled in adultliteracy education programs.

3) Percentage of eligible adults expected to be enrolledwho are members of minority groups.

4) Percentage of eligible adults with less than a fifthgrade reading level to be served.

Eligible applicants include literacy councils, libraries,local education agencies, community colleges, and publicand private nonprofit agencies, organizations and institu-tions. Priority consideration will be given to applicationsthat will conduct programs that expect to enroll highnumbers of eligible adults who are receiving publicassistance; do not have high school diplomas; are mem-bers of minority groups; and/or have less than a 5th gradereading level. Priority also will be given to programs thatprovide client outreach and referral activities that arecoordinated with other adult education literacy programsand early childhood education programs, county assist-

ance offices, social service agencies, offices of employmentsecurity, Job Training Partnership Act (JTPA) programs,and other community groups or agencies that provideservices and assistance to persons in need of basicliteracy skills.

Program applicants are required to collaborate withother local educational agencies and community-basedorganizations. Applicants should seek organizations withdemonstrated and documented quality in providing adultliteracy, early childhood education or parenting educationbuilding on existing community services and not duplicat-ing services available in the community. Potential part-ners include adult education agencies, Head Start, FamilyCenters, and/or school district based K—4 programs.Given the limited size of the grant and the large numberof other local, State and Federal programs focused onadult literacy or early childhood education, it is criticalthat applicants use these funds as the link to provide acomprehensive family literacy program created fromamong these various sources of support. The Programrequires that applicants coordinate with some organiza-tions for service delivery and collaborate with others forprogram planning. Working together with other agenciesand building community partnerships is essential to theprogram’s success. Interagency relationships may developalong a continuum of restructuring and redefining phi-losophies, roles and expectations.

Grant awards will range from $60,000 to $80,000 for aunit of family literacy. Each unit must serve a minimumof 20 families in the required four components for familyliteracy programs. Adult services of up to 25 hours perweek must be made available in order to meet welfare towork requirements for welfare recipients that are incompliance with local welfare-to-work requirements.

The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters ofthis Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standardsand regulations the Department of Environmental Protection (Department) proposes to issue a permit to discharge,subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

Where indicated, the EPA, Region III, Regional Administrator has waived his right to review or object to this proposedpermit action under the waiver provision 40 CFR Section 123.6E.

Persons wishing to comment on the proposed permit are invited to submit a statement to the Field Office indicated asthe office responsible, within 30 days from the date of this public notice. Comments received within this 30-day periodwill be considered in the formulation of the final determinations regarding this application. Responses should include thename, address and telephone number of the writer and a concise statement to inform the Field Office of the exact basis ofa comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers thepublic response significant.

Following the 30-day comment period, the Water Management Program Managers will make a final determinationregarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which timethis determination may be appealed to the Environmental Hearing Board.

The application and related documents, proposed effluent limitations and special conditions, comments received andother information are on file and may be inspected and arrangements made for copying at the Field Office indicatedabove the application.

Preamble 1

Acknowledgment of Notices of Intent to Remediatesubmitted under the Land Recycling and Envi-ronmental Remediation Standards Act (35 P. S.§§ 6026.101—6026.908).

Sections 302 and 303 of the Land Recycling andEnvironmental Remediation Standards Act require theDepartment of Environmental Protection (Department) topublish in the Pennsylvania Bulletin an acknowledgmentnoting receipt of any Notices of Intent to Remediate. Anacknowledgment of the receipt of a Notice of Intent toRemediate identifies a site where a person proposes to, orhas been required to, respond to a release of a regulatedsubstance at a site. Persons intending to use the back-ground or Statewide health standard to remediate a sitemust file a Notice of Intent to Remediate with theDepartment. A Notice of Intent to Remediate filed withthe Department must provide a brief description of thelocation of the site, a list of known contaminants at thesite, the proposed remediation measures for the site and adescription of the intended future use of the site. Sections 304 and 305 of the Land Recycling andEnvironmental Remediation Standards Act require theDepartment of Environmental Protection to publish in thePennsylvania Bulletin an acknowledgment noting receiptof any Notices of Intent to Remediate. An acknowledg-ment of the receipt of a Notice of Intent to Remediate isused to identify a site where a person proposes to, or hasbeen required to, respond to a release of a regulatedsubstance at a site. Persons intending to use a site-specific standard or who intend to remediate a site in aSpecial Industrial Area must file a Notice of Intent toRemediate with the Department. A Notice of Intent toRemediate filed with the Department provides a briefdescription of the location of the site, a list of knowncontaminants at the site, the proposed remediation mea-sures for the site and a description of the intended futureuse of the site. A person who demonstrates attainment ofone or a combination of the cleanup standards identifiedunder the act will be relieved of further liability for theremediation of the site for any contamination identified inreports submitted to and approved by the Departmentand shall not be subject to citizen suits or other contribu-tion actions brought by responsible persons not partici-pating in the remediation.

Under sections 304(n)(1)(ii) and 305(c)(2) of the act,there is a 30-day public and municipal comment periodfor sites proposed for remediation using a site-specificcleanup standard, in whole or in part, and for sitesdetermined to be located in Special Industrial Areas. Thisperiod begins when a summary of the Notice of Intent toRemediate is published in a newspaper of general circula-tion in the area by the person conducting remediation.For the sites identified, a municipality may request to beinvolved in the development of the remediation and reuseplans for the site if the request is made within 30 days ofthe date specified. During this comment period a munici-pality may request that the person identified, as the

tribution Facilities

Under 25 Pa. Code § 127.424, the Department ofEnvironmental Protection (Department) is providing no-tice of its intent to issue synthetic minor State-onlyoperating permits to the gasoline distribution facilitiesshown below. These facilities have the physical andoperation capacity to emit major source amounts ofregulated pollutants, but are not considered majorsources because the owners or operators of these facilitieshave taken Federally enforceable emission limits belowmajor source thresholds to avoid requirements of Title IIIand/or Title V of the Clean Air Act. The Federallyenforceable emission restrictions apply to the gasolinethroughput for each facility.

To qualify as an area source for Title III purposes or anonmajor source under Title V in moderate ozone nonat-tainment areas, the maximum allowable emissions (aftercontrols) shall be less than 50 tons per year of volatileorganic compounds (VOCs) and 10 tons of a singlehazardous air pollutant (HAP) or 25 tons per year of anycombination of HAPs. The HAP emissions from thesefacilities include benzene, hexane, toluene, xylene andmethyl-tertiary butyl-ether (MTBE). For purposes of TitleV, other pollutants including carbon monoxide, sulfurdioxide, nitrogen oxides and PM-10 must also be emittedbelow the major source thresholds (see ‘‘Title V facility’’definition in 25 Pa. Code § 121.1).

The Department will issue the synthetic minor permitsno later than June 15, 1998. As a result the gasolinedistribution maximum achievable control technology(MACT) standard in 40 CFR Part 63, Subpart R will notapply to the gasoline bulk terminals and/or pipelinebreakout stations listed in this notice. Title V operatingpermits will not be issued to these facilities. Copies of the‘‘synthetic minor’’ application, the proposed permit andother relevant documents are available for public inspec-tion during normal business hours in the Department’sregional offices identified in this notice.

Any person wishing to provide the Department withadditional information which they believe should be con-sidered prior to the issuance of these synthetic minorpermits may submit the information to the appropriateDepartment’s Regional Office. CNGT has retarded the ignition timing by four degreesrelative to standard timing on an Ingersoll Rand JVG-6internal combustion engine used for moving natural gasthrough the facility’s dehydration system. In addition, anoperating limit of 500 hours per year has been acceptedfor the company’s Caterpillar G3512 internal combustionengine which is used for auxiliary electric power genera-tion. These actions satisfy the presumptive RACT require-ments pursuant to 25 Pa. Code § 129.93 for theseengines.

The following final reports were submitted to theDepartment of Environmental Protection underthe Land Recycling and Environmental Remedia-tion Standards Act (35 P. S. §§ 6026.101—6026.908).

Provisions of Chapter 3 of the Land Recycling andEnvironmental Remediation Standards Act require theDepartment of Environmental Protection to publish in thePennsylvania Bulletin a notice of submission of any finalreports. A final report is submitted to document cleanupof a release of a regulated substance at a site to one ofthe Act’s remediation standards. A final report provides adescription of the site investigation to characterize thenature and extent of contaminants in environmentalmedia, the basis for selecting the environmental media ofconcern, documentation supporting the selection of resi-dential or nonresidential exposure factors, a description ofthe remediation performed, and summaries of samplingmethodology and analytical results which demonstratethat the remediation has attained the cleanup standardselected.

Pennsylvania Wetland Replacement Project

The Department of Environmental Protection has pre-sented the following wetland restoration projects to theEnvironmental Review Committee for review and concur-rence. Authorization for these projects has been receivedand construction is anticipated during June, July andAugust of 1998. These wetland restoration projects arefunded by the Pennsylvania Wetland ReplacementProject, a jointly managed fund between the Departmentof Environmental Protection and the National Fish andWildlife Foundation. Project No. S11B31-002—The objectives of the Hem-lock Council of Girl Scouts’ Golden Pond wetland restora-tion project are to provide environmental education oppor-tunities for the Girl Scout Camp and to provide aquatichabitat. This one acre wetland restoration in Subbasin 11,(the Upper Juanita River watershed), is an integral partof a Conservation Reserve Program plan. The restorationwill include blocking an existing field drain that wasoriginally installed to divert water off the site, and theconstruction of a small berm to retain water. The projectis located in West Township, Huntingdon County.(Franklinville, PA Quadrangle, N: 1.1 inches, W: 0.4 inch)

Project No. D02E09-001—Sponsored by the BucksCounty Audubon Society, the primary objective of the 1acre Honey Hollow wetland restoration in Subbasin 2, theCentral Delaware River watershed, is to provide environ-mental education opportunities about wetlands at a wellestablished environmental education center. The centerhas a pond and a creek, but presently no wetland. Theproject will be designed to have areas of saturated soil toareas of 3-8’’ of standing water. After the site is con-structed, the Center, in cooperation with the CountyConservation District and the Department will design aplanting scheme and the site will be planted by students.The project is located in Solebury Township, BucksCounty. (Buckingham, PA Quadrangle, N: 22.0 inches, W:1.9 inches)

Project No. O20C10-001—The objectives of the 3.9acre wetland restoration sponsored by Ron Layton inSubbasin 20, the Ohio River watershed, are to providewildlife habitat and improve water quality in theConoquenessing Creek by intercepting, filtering, andcleansing runoff from adjacent cultivated areas. Theproject is located on the Layton farm in West Township,Butler County. (Evans City, PA Quadrangle, N: 9.4 inches,W: 7.0 inches)

Project No. O16A25-001—The primary objective ofthe wetland restoration sponsored by Jack Pfadt is torestore 2.9 acres of prior converted cropland in Subbasin16, the Upper Allegheny River watershed. The wetlandwill provide habitat for waterfowl and act as a buffer tothe West Branch French Creek by trapping nutrients andsediment thereby improving water quality. The project islocated on the Pfadt farm in Venango Township, ErieCounty. (Wattsburg, PA Quadrangle, N: 8.4 inches, W: 4.0inches)

Project No. 16C53-001—The objective of the restora-tion of 5 acres of riparian floodplain depression sponsoredby John Wiley farm in Subbasin 16, the Upper AlleghenyRiver watershed, is to improve water quality in theOswayo Creek by trapping nutrients and sediment. Addi-

tionally the wetland will help detain flows in smallsummer storms, and provide critical aquatic habitat in apredominately agricultural area. The project is located onthe Wiley farm in Sharon Township, Potter County.(Shinglehouse, PA Quadrangle, N: 11.3 inches, W: 4.0inches)

Proposed Monitoring Plan Revisions; Notice ofAvailability

The Department of Environmental Protection, Bureauof Air Quality, is proposing to revise its ambient airpollution monitoring system and is seeking comments onthis proposal.

The Environmental Protection Agency (EPA) has estab-lished new standards for fine particles (under 2.5 micronsin size). States will need to measure the amount of fineparticles to which their citizens are exposed. The Depart-ment of Environmental Protection (Department) is pro-posing to install new PM2.5 monitors to fulfill this need.The Department has also taken this opportunity toreview the Commonwealth’s entire air quality monitoringprogram in order to propose necessary changes that willmake the program more effective. The current monitoringprogram exceeds minimum EPA requirements, consis-tently measures levels for many pollutants well belowFederal health based standards, and measures for totalsuspended particulate (TSP) for which a Federal standardno longer exists. The Department is proposing to restruc-ture the program to measure the pollutants most likely toviolate the National Ambient Air Quality Standards(NAAQS).

On April 22, 1998, the Office of Surface Mining Recla-mation and Enforcement (OSM), Department of Interiorpublished in the Federal Register its findings regarding aprogram amendment to Pennsylvania’s permanent miningregulatory program submitted by the Pennsylvania De-

partment of Environmental Protection. By the act ofDecember 7, 1994 (P. L. 792, No. 114), the GeneralAssembly amended Pennsylvania’s Coal Refuse DisposalControl Act (CRDCA). These amendments were submittedto OSM for approval as an amendment to Pennsylvania’spermanent regulatory program for coal mining.

The CRCDA prohibits the disposal of coal refuse within100 feet of the bank of a stream. However, it authorizesthe Department to grant a variance to allow disposal ofcoal refuse within this buffer zone if the operator demon-strates to the Department that there will be ‘‘no signifi-cant adverse hydrologic or water quality impacts.’’

In approving the program amendment, the Secretary ofthe United States Department of the Interior found thatthe word ‘‘significant’’ in section 6.1(h)(5) of the CRDCA,as it pertains to granting of variances to the 100-footstream buffer zone, was inconsistent with Federal law.

Section 15.1 of the Coal Refuse Disposal Control Actprovides, in pertinent part:

‘‘In order to maintain primary jurisdiction over sur-face coal mining in Pennsylvania, the departmentshall suspend implementation of any provision of thisact found to be inconsistent with Federal law by theSecretary of the United States Department of theInterior under section 505 of the Surface MiningControl and Reclamation Act of 1977 (Public Law95-87, 30 U.S.C. § 1201 et seq.) or the Administratorof the Environmental Protection Agency under sec-tion 402 of the Federal Water Pollution Control Act(62 Stat. 1155, 33 U.S.C. § 1251 et seq.).’’

section 15.1 of the Coal Refuse Disposal Control Act (52P. S. § 30.65a), the Department suspended implementa-tion of the word ‘‘significant’’ found in section 6.1(h)(5) ofthe Coal Refuse Disposal Control Act.

Under section 227-A of the Fiscal Code (72 P. S. § 227-A) (relating to administration powers and duties), theDepartment of Revenue (Department) announces the low-est cost of the stamping agent, wholesaler and retailer,respectively, effective upon publication of this notice, asfollows:

The Department considers these costs as presumptiveminimum costs. Cigarette stamping agents, wholesalersand retailers are prohibited from selling cigarettes at aprice lower then their respective presumptive minimumcosts. These costs are listed on a per carton basis, tenpacks of cigarettes per carton, 20 cigarettes per pack. Todetermine the presumptive minimum price per pack ofcigarettes, one should divide the costs listed above by tenand round to the nearest hundredth of a percent. Forexample, the presumptive minimum price of a pack ofcigarettes sold by a retailer to a consumer is $1.93 forpremium brands ($19.23/10), $1.63 for generic brands($16.25/10).

Cigarette dealers who either sell cigarettes under adifferent packaging setup (that is, eight packs per carton)or sell cigarettes that do not qualify as premium orgeneric brands (that is, subgeneric, foreign or specialtycigarettes) as described above are prohibited from sellingcigarettes at a price lower than the cost of the stampingagent, cost of the wholesaler or cost of the retailer,respectively, as further defined and explained in 61Pa. Code Part I, Subpart B, Article III (relating tocigarette and beverage taxes).

Cigarette dealers wishing to prove a cost different fromthe Department’s presumptive costs stated above mustfollow the procedures listed in 61 Pa. Code Chapter 76(relating to unfair sales of cigarettes).

Retention of Engineering Firms

Berks, Carbon, Lehigh, Monroe, Northampton andSchuylkill Counties

Project Reference No. 08430AG2200The Department of Transportation will retain three (3)

separate engineering firms for three (3) separate Open-End Contracts for various engineering and/or environ-mental services on various projects located in EngineeringDistrict 5-0, that is Berks, Carbon, Lehigh, Monroe,Northampton and Schuylkill Counties. Each Contract willbe for a sixty (60) month period with projects assigned onan as-needed basis. The maximum amount of each Open-End Contract will be $1.0 million. The major emphasiswill be on highway final design work.

The Department will establish an order of ranking of aminimum of seven (7) firms for the purpose of negotiatingthe Open-End Contracts based on the Department’sevaluation of the letters of interest received in responseto this solicitation. The ranking will be establisheddirectly from the letters of interest. Technical proposalswill not be requested prior to the establishment of theranking.

The following factors, listed in order of importance, willbe considered by the Department during the evaluation ofthe firms submitting letters of interest:

a. Ability to package and present the Letter of Interestin accordance with the ‘‘General Requirements and Infor-mation’’ section.

b. Past record of performance (timeliness, responsive-ness, quality, cost control, and ability to meet schedules.

c. Diversity of experience and technical competence.

d. Location of consultant in respect to the District.

e. Relative size of firm to size of potential assignmentsthat may be completed under these contracts.

The work and services required under these Contractsmay encompass a wide range of environmental studiesand engineering efforts with the possibility of severaldifferent types of projects with short completion schedulesbeing assigned concurrently. The anticipated types ofprojects include, but not limited to, bridge replacementsor bridge rehabilitation with minor approach work, envi-ronmental studies, roadway betterments (3R type,) minorcapital improvement projects (bridges or roadway), rail-road grade crossing projects, and minor location studies,etc.

The engineering work and services which may berequired under these Contracts include, but are notlimited to, perform field surveys; plot topography andcross sections; prepare submission for utility verificationand relocations engineering; prepare all pertinent submis-

sions and materials necessary for the Department toprepare the application to PUC and for the PUC fieldconference; attend and supply any required informationfor all PUC meetings and hearings during the design ofthe project; develop erosion control details and narrative;prepare right of way plans; complete structure designsincluding type, size and location reports, core boringlayouts and foundation designs and reports; developtraffic control plans with narratives; conduct soils investi-gations and prepare soils reports; investigate utility in-volvement on projects; provide material for and partici-pate in value engineering reviews; coordinate contactswith railroad officials and procure railroad related costs,permits, and insurance; collect signal timing, accidentdata and other traffic flow data; document engineeringstudy findings and activities; alternative analysis toassess impacts and mitigation; prepare roadway plans forin-house bridge designs and prepare construction plans,specifications, and estimates.

The areas of environmental study required under theseContracts may include, but are not limited to: air quality;noise; energy; vibration; hazardous waste; surface waterand ground water quality; surface water and groundwater hydrology; terrestrial ecology including threatenedand endangered species; wetlands; soils; geology; farm-lands; visual quality; socio-economic resources; culturalresources; Section 4(f) Evaluations; early coordinationand; scoping correspondence; meeting minutes; publicmeeting and hearing presentations; visualization materi-als, handouts and displays; technical basis reports (TBRs)and/or technical files; NEPA environmental documents;Section 106 documents; mitigation plans and reports;wetland and floodplain findings; and preliminary engi-neering plans, and remote sensing/mapping innovations.The format and content of all documents will be consis-tent with applicable State and Federal regulations, poli-cies and guidelines.

The engineering services and environmental studiesidentified above are the general work activities that canbe expected under these Open-End Contracts. A morespecific and project-related Scope of Work will be outlinedfor each individual Work Order developed under theseOpen-End Contracts.

and Allegheny Counties. The design of this project isexpected to have an overall duration of approximatelythirty-six (36) months with shorter, varying schedules forindividual phases. This Agreement will be administeredby Engineering District 12-0. The estimated constructioncost of the project is $20.0 million.

The selected engineering firm will be required toprovide a variety of engineering services including thefollowing: environmental studies for environmental docu-ment preparation and public involvement; preliminaryengineering studies involving field survey, utility contacts,H&H studies, joint permit preparation; line, grade andtypical section development; type, size and location sub-missions; geologic studies; erosion and sedimentationcontrol plans and narratives; hydraulic computations;safety reviews; and Step 9 submission final design activi-ties including drainage and highway lighting design,right-of-way and traffic control plans, foundation submis-sions, structure designs and plan preparation, variousfield and office meetings, and plans, specifications, andestimate preparation; and services during constructionincluding shop drawing review, construction consultation,plans recordation and project management.

The Department is seeking a moderate to large, multi-disciplined engineering firm with multi-span bridge de-sign capability.

Proposing DBE firms must be certified at the time ofsubmission of the Letter of Interest. If the selected firmfails to meet the established DBE participation goal, itshall be required to demonstrate its good faith efforts toattain the goal.

Each Letter of Interest must include the followinginformation and the information must be packaged andpresented in the following order:

1. Transmittal Letter (Maximum of two (2) 8 1/2� x 11�typed pages, one side)

The subject heading of the transmittal letter mustinclude the project reference number for which the appli-cant wishes to be considered, the firm’s legal name,fictitious name (if applicable), and the firm’s federalidentification number. If the project advertisement indi-cated the Department will retain an engineering firm forthe project, the applicant must indicate in the body oftheir transmittal letter the names and Professional Engi-neer License Number of individuals who are directingheads or employees of the firm who have responsiblecharge of the firm’s engineering activities, and whosenames and seals shall be stamped on all plans, specifica-tions, plats, and reports issued by the firm.

2. Project Organizational Chart (one page, one side,maximum size 11� x 17�)

This Chart must show key staff from the prime andeach subconsultant and their area of responsibility.

3. Standard Form 255, ‘‘Architect-Engineer and Re-lated Services Questionnaire for Specific Project’’ (oneForm 255 for the project team)

The Standard Form 255 must be signed, dated, andfilled out in its entirety, including Item No. 6 listing theproposed subconsultants and the type of work or servicethey will perform on the project.

Under Item 4 of this form, Column A must specify onlythe number of subconsultant personnel and Column Bmust specify only the number of prime consultant person-nel to be assigned to work on this project referencenumber. Do not include the total personnel for either thesubconsultant or prime consultant under Item 4 unlessthe total personnel are necessary to provide the requiredwork and services.

The prime and each subconsultant may include no morethan one page each for Items 10 and 11.

If a Disadvantaged Business Enterprise (DBE) goal isspecified for the project, the DBE must be currentlycertified by the Department of Transportation, and thename of the DBE and the work to be performed must beindicated in Item No. 6. If a Woman Business Enterprise(WBE) firm is substituted for the DBE, the WBE firmmust also be presently certified by the Department ofTransportation and indicated in Item 6.

4. Standard Form 254, ‘‘Architect-Engineer for RelatedServices Questionnaire’’

A Standard Form 254, not more than one (1) year oldas of the date of this advertisement, must accompanyeach Letter of Interest for the firm, each party to a JointVenture, and for each subconsultant the firm or JointVenture is proposing to use for the performance ofprofessional services regardless of whether thesubconsultant is an individual, a college professor, or a

Company, unless an acceptable Standard Form 254 forthe prime and each subconsultant/subcontractor is on filein both the Bureau of Design and the EngineeringDistrict Office or Central Office Bureau identified in theindividual project advertisement.

If the Standard Form 254 is not submitted with theLetter of Interest, the transmittal letter shall indicate thedates that the Standard Forms 254 were submitted to theBureau of Design and appropriate Engineering District/Central Office Bureau.

These Forms must be assembled with the prime’s formfirst, followed by the form for each subconsultant in thesame order as the subconsultants appear in Item 6 ofForm 255.

5. Workload Projection Graph (Not required for Con-struction Inspection Services)

Separate Workload Projection Graphs for the prime andeach subconsultant shown in Item 6 of the Form 255must be included and must indicate the firm’s currentand anticipated workload compared to the anticipatedcapacity available for the next two-year time frame. TheWorkload Projection Graphs must be submitted for theoffice(s) where the work would be performed and mustonly include the personnel classifications required forproviding the advertised services and work.

6. Authorization Letters (For Construction InspectionsServices, if required)

If the advertisement requires a letter signed by indi-viduals giving their approval to use their name in theLetter of Interest, the letters from proposed prime em-ployees must be first, followed by subconsultant employ-ees, in the same order as shown in Item 6 of Form 255.

7. Registration To Do Business

Firms with out-of-state headquarters or corporationsnot incorporated in Pennsylvania must include, with eachLetter of Interest, a copy of their registration to dobusiness in the Commonwealth as provided by the De-partment of State. Consideration of Change to Special RegulationDesignation Kettle Creek, Potter County

At its April 1998 meeting, the Fish and Boat Commis-sion (Commission) approved guidelines with regard toencouraging public participation on possible changes tothe designation of stream sections for special regulationprograms. Under 58 Pa. Code Chapter 65, the Commis-sion designates certain streams and stream sections asbeing subject to special trout fishing regulations. Thesedesignations are effective after Commission approvalwhen they are posted at the site and a notice is publishedin the Pennsylvania Bulletin. Under the new guidelines, anotice concerning the proposed designation or redesigna-tion of a stream section under special regulations ordi-narily will be published in the Pennsylvania Bulletinbefore the matter is reviewed by the Commissioners.

A Commissioner has asked the staff to publish a noticeand solicit public input on his concept for a possiblechange to special regulations on a 1.7 mile section ofKettle Creek, Potter County. Accordingly, notice is herebygiven that the Fish and Boat Commission, acting under58 Pa. Code Ch. 65, may consider the deletion of a sectionof Kettle Creek from 500 ft. downstream of SR0144upstream a distance of 1.7 miles from the list of DelayedHarvest Artificial Lures Only areas designated under 58Pa. Code § 65.6. Instead, the Commission may be askedto consider placing this section under Delayed HarvestFly Fishing Only Regulations, (58 Pa. Code § 65.2).

This section of Kettle Creek is located on Commissionproperty. At the July 1970 Commission meeting, theCommission voted to acquire the Thompson tract alongKettle Creek. This is the property surrounding the specialregulations area. During the May 1971 Commission meet-ing, the Commission voted to approve a special regulationarea on Kettle Creek along the entire 1.7 mile distance ofthe newly acquired Thompson tract. Under the so-called‘‘fish-for-fun program,’’ this water was stocked severaltimes throughout the spring and summer. Regulationsprovided for year-round angling and the harvest of onetrout per day, 20 inches in length or longer. Gear wasrestricted to flies only and fishing hours extended from 1hour before sunrise to 1 hour after sunset. This regula-tory option was discontinued prior to the 1981 season infavor of more resource-based program options.

Starting in 1981, this section was managed under the,then, fly-fishing-only option of the catch-and-release pro-gram. The catch-and-release program as we know it today(barbless hook, artificial lures only) went into effect forthe 1984 season. At that time (1984) three of the formercatch-and-release (FFO waters) were moved into theno-harvest, FFO program (Spring, Kettle, and LittleLehigh Creeks). Because it was made an exception in1984, Kettle Creek regulations were essentially un-changed: barbless fly-fishing-only, season open yeararound with no harvest permitted. During the periodfrom 1981 until 1988, this area was managed as a ClassA wild trout fishery with no stocking as inventoryinformation recorded a brown trout biomass of 84.45kg/ha in 1981.

Biomass steadily declined from 51.77 kg/ha in 1982 to alow of 16.64 kg/ha in 1984. The 1984 estimate wasconducted during the summer that followed the February1984 St. Valentine’s Day flood. Subsequent inventories

conducted during 1985 and 1986 recorded biomass ClassB wild brown trout populations lower than the levels thathad been observed prior to flooding. Mediocre habitat,combined with an unstable environment (flood, droughtand elevated summer water temperatures) were limitingfactors constraining the wild trout populations.

Management recommendations in 1987 were to proposeregulation changes to artificial lures only and to stockthis section as a ‘‘Class B’’ catch-and-release area. There-fore, from 1988 through 1997, this stream section wasmanaged as a stocked biomass Class B water under thecatch-and-release program (at the time, one of only threestocked Class B catch-and-release areas in the state).Catch-and-release regulations provided for year-roundangling with no harvest. Tackle was restricted to the useof barbless flies and artificial lures only. Since 1988,fishing with artificial lures and spinning gear has beenpermitted on this section of Kettle Creek.

Recent inventories (1994 and 1997) confirmed that thissection no longer supports the biomass Class B wildbrown trout densities that were recorded during themid-1980s. Therefore, if the provision of a recreationalsport fishery is desired under special regulations, stockingis necessary and management under the Delayed Har-vest, Artificial Lures Only program was deemed the mostappropriate regulatory option for this biomass Class Cfishery. The Commission voted to change this section to adelayed-harvest, artificial lures only area (58 Pa. Code§ 65.5) starting in January 1998. This decision wasconfirmed after considering input from a public meetingat the site and publication of a notice inviting publicinput. The Commission staff continue to believe thatdelayed-harvest artificial lures only regulations are ap-propriate for this stream section in accordance with thetrout management plan and resource-based regulatoryoptions.

Delayed Harvest Artificial Lures Only regulations pro-vide for a limited harvest period from June 15 throughLabor Day and an elongated no harvest period from theday after Labor Day until the following June 15. Duringthe harvest period, an elevated minimum length limit (9inches) and reduced creel limit (3 trout/day) is applied toensure that emphasis remains on recreation rather thanharvest. Fishing hours extend from 1 hour before sunriseto 1 hour after sunset and tackle is restricted to the useof artificial lures only (which includes the use of flies andstreamers). Under this option multiple stockings occur asthis section is stocked twice during the spring and once inOctober to provide additional catch-and-release anglingduring the fall.

This stream section has been managed under an artifi-cial lures only option (including flies and streamers) forthe past 11 seasons. Few, if any, angler conflicts due totackle have been reported. As part of the 1991 TroutAngler Telephone Survey, anglers were asked a series ofquestions pertaining to their attitudes and opinions ofspecial regulations areas. When asked if all delayedharvest areas should permit spinners and artificial luresas well as flies, overall, 60.5% agreed with this conceptand 33.2% disagreed.

Kettle Creek is a popular destination stream for flyfishers, and some anglers have contacted Commissionersto ask that the Commission consider changing the regula-tions on the delayed-harvest section to permit use of fliesonly. On the other hand, the Commission has receivedinput from other anglers who generally oppose restrictingtrout waters to fly-fishing. There is a good deal of publicinterest in this subject, and, in response to a suggestion

from one of our Commissioners, we are seeking publicinput. Imposition of a fly-fishing only restriction on thisstream section would change 11 seasons of past practiceand would be contrary to the special trout fishing regula-tions on most other publicly-owned or controlled streamsto which special restrictions apply. In recent years, thetrend, consistent with resource-based considerations andresearch on hooking mortality, has been to expand fishingopportunities to include the use of artificial lures only.

The Fish and Boat Commission is soliciting publicinput concerning a possible designation that may beproposed to change a 1.7 mile section of Kettle Creekfrom delayed-harvest (artificial lures only) regulations todelayed-harvest (fly-fishing only) regulations. On April 25, 1998, the Pennsylvania Fish and BoatCommission (Commission) published a notice of proposedrulemaking at 28 Pa.B. 1954 (April 25, 1998), seekingpublic comments, objections or suggestions about a pro-posed amendment that would impose mandatory boatingeducation for operators of personal watercraft. Specifi-cally, the Commission sought public comments on aproposed amendment to 58 Pa. Code § 109.3 (relating topersonal watercraft) that provides that effective January1, 2000, a person may not operate a personal watercrafton the waters of this Commonwealth unless the personhas obtained a boating safety education certificate.
