AGENCY: Farm Service Agency, USDA.ACTION: Notice.

Background
The 2006 grain harvest is expected toexceed available commercial grainstorage space in certain areas. USWA
grain licensees may request, throughFSA, licensing of temporary grainstorage space under the USWA (7 U.S.C.241 et. seq.) under the terms announcedin this notice.
Temporary Grain StorageRequirements
Upon written application, the USWAwill continue to authorize and licensethe use of temporary grain storage space.Such space may be used from the timeof initial licensing until July 1, 2007.Temporary grain storage structures must
be operated in conjunction with aUSWA-licensed grain warehouse.
In addition:1. An asphalt, concrete, or other
approved base material must be used.2. Rigid self-supporting sidewalls
must be used.3. Aeration must be provided.4. Acceptable covering, as determined
by FSA, must be provided.5. Grain must be fully insured for all
losses.6. Warehouse operators must meet all
financial and bonding requirements ofthe USWA.
7. Warehouse operators mustmaintain a separate record of all grain
stored in temporary grain storage spaceand must account for such grain in theDaily Position Record.

Warehouse Operators Liability
The authorization and licensing oftemporary grain storage space does notrelieve warehouse operators of theirobligations under the USWA or 7 CFRpart 735.
Warehouse operators are responsiblefor the quantity and quality of grainstored in temporary grain storage spaceto the same extent as their liability forlicensed grain storage space. All grainstored in temporary grain storage spaceis considered a part of the warehouseoperators commingled grain inventory.
The Department of Agriculturestrongly recommends that warehouseoperators review their warehousesecurity plans and conduct a prudentrisk assessment in connection with theapplication of temporary grain storagespace. Warehouse operators may wantto pay particular attention to threats thatmay not have been consideredsignificant in the past and considerrestricting access to facilities toauthorized personnel only.
Limitation
Licensing of temporary grain storage
is limited to wheat, corn, and grainsorghum.
