THE PROPOSAL

The proposal seeks to construct a two bedroom dwelling at 184 Locarno Rd, Clydesdale. The proposed house site is located on the eastern side of the ridgeline of the subject site. The dwelling would achieve a 75m set back from the eastern boundary and 65m from the southern boundary. It will be set back more than 175 metres from the main road and more than 270 from the nearest dwelling.

The house is proposed to be single storey with walls clad and roofed in colorbond in muted tones. The house comprises 2 bedrooms, open plan living and dining area and two bathrooms and laundry.

The dwelling will have a stand alone power supply, with water tanks and an onsite wastewater disposal system installed (Refer to LCA).

Access to the site will be from Locarno Road which joins the HepburnNewstead Rd to the north east.

The land falls within the Farming Zone and is affected by the Bushfire Management Overlay (BMO), Land Subject to Inundation Overlay (LSIO) and the Environment Significance Overlay (ES01)

REQUIREMENT FOR A PLANNING PERMIT

The trigger for a panning permit are buildings and works in under the Zoning and Overlays affecting the site. A planning permit is required for a dwelling in the Farming Zone a s the Hot is smaller than 20 hectares.

THE OBJECTIVES OF THE PLANNING SCHEME

The objectives of the farming zone include:

To provide for the use o f land for agriculture.

To encourage the retention o f productive agricultural land.

To ensure that nonagricultural uses, including dwellings, do not adversely affect the use

o f land for agriculture.

To encourage the retention o f employment and population to support rural communities.

To encourage use and development o f land based on comprehensive and sustainable land management practices and infrastructure provision

The proposal meets the objectives of the zone. The Hot is a small parcel which is mostly woodland. The site has How agricultural productivity and has not been farmed for many years. The proposed use of the Hot for a dwelling will not result in the loss of productive agricultural Hand or adversely affect the use of the site or surrounding Hand for agriculture. Lots surrounding the site have dwellings on smaller Hots and are effectively used for rural Hiving, consistent with the proposal.

Li The State Planning Policy Framework and the Local Planning Policy Framework,

including the Municipal Strategic Statement and local planning policies.

While the MSS does not list Clydesdale a s a settlement, the policy does recognise the diversity o f settlement patterns in the Shire [which] offers a range o f important lifestyle and development opportunities. The proposal seeks to construct a dwelling in a settled part of the shire that is consistent with the surrounding Hand use and settlement pattern

Any Regional Catchment Strategy and associated plan applying to the land.

- The capability o f the land to accommodate the proposed use or development, including the disposal of effluent.

The LCA provided addresses the issues of onsite waste water and concludes there is adequate on site capacity

The owners seek to retain woodland on site. They will harness and dispose of water on site. They will use the cleared area around the existing dwelling to grow food producing plants while retaining on site biodiversity

Dwelling issues

Whether the dwelling will result in the loss or fragmentation o f productive agricultural land.

As the site is of low agricultural value, it will not remove land form agricultural production

Whether the dwelling will be adversely affected by agricultural activities on adjacent and nearby land due to dust, noise, odour, use o f chemicals and farm machinery, traffic and hours of operation.

Surrounding land and site itself is of low agricultural value and productivity. There are no existing farming operations on the site or adjacent land that would be adversely affected the proposed dwelling. Higher value agricultural and to the south and east is separated by roads and a buffer of woodland on steep terrain

As shown on Figure 2, adjacent lots already have dwellings. It is not considered the proposal will lead to a proliferation of dwellings on surrounding land

Environmental issues
