1. Executive Summary
TheNorthWalesSchoolsandPublicBuildingsContractorFramework(NWSPBCF)ispartofanumberofCollaborationProgrammesbetweenthesixNorthWalesAuthorities(DenbighshireCountyCouncil,ConwyCountyBoroughCouncil,FlintshireCountyCouncil,GwyneddCouncil,WrexhamCountyBoroughCouncil,YnysMonCountyCouncil)toaddresstheProgrammeforWales’priorities.Itisthefirstgenerationoflocalauthority-drivenConstructionFrameworkinNorthWalesandwillserveasacatalystforchangingthewaythatConstructionprojectsareprocuredintheregion.
TheFrameworkhasbeenestablishedfortheefficientdeliveryofthe“21stCenturySchoolsProgramme”withanapproximatecombinedvalueof£200million.
Delivering“CommunityBenefits”isattheheartofboththeprocurementapproachandthecoordinationoftheinvestmentintothe21stCenturySchoolsProgramme,withaviewtounlockingwidereconomic,socialandenvironmentalregeneration.ThereisacoresetofCommunityBenefitprincipleswhichhavebeenagreedbythesixNorthWalesAuthorities,whowilleachworkinpartnershipwiththesuccessfulContractorstoensurethatthesearedelivered.
TheFrameworkhasbeenbuiltonanethosofopennessandflexibility,achievedthroughcontinuousengagementandtwowaycommunicationsbetweentheAuthoritiesandContractors/suppliers.TheFrameworkmayalsobeutilisedbyotherpublicsectorbodiesacrosstheregion.Listcanbefoundatappendix1.

Purpose of this document
ThepurposeofthisguideistogiveclientsaquickunderstandingoftheFramework’sprocessesandethos.
TogiveaclearguidanceofhowtheFrameworkshouldbeusedandtheprinciplesonwhichitwillbemanaged.
ParticipatingauthoritiesandotherpublicsectorbodiesshoulddeveloptheirownindividualworkingproceduresthatcomplywiththeirowncontractualprocedurerulesandtheFrameworkprinciples.
FrameworkdocumentationisdevelopedcollaborativelybytheFrameworkManagementTeamandtheOperationalManagementBoard.
AllFrameworkdocumentationwillbesubjecttoregularreviewanddevelopmentandwillbeavailableelectronically.
Benefits
ThereareanumberofpotentialbenefitstobeachievedbyusingthisFrameworknamely:
• TheFrameworkhasalreadycarriedoutatenderprocesswhichisfullycompliantwithUKandEuropeanProcurementLaw-therebysavingyouvaluabletimeandresourceswithgreatlyreducedprocurementtimescales.Thereisnoneedtoadvertisetherequirementsandtherearenominimumtimeperiodswithintheprocesstowhichyoumustadhere.
• Theopportunitytohaveaforumforlearning,developingandimprovingthewayinwhichparticipatingauthoritiesandotherpublicsectorbodiesdeliverConstructionprojects,encouragingcollaboration.
• ContractorslistedontheFrameworkagreementhavealreadybeenassessedfortheiroperational,technicalandprofessionalconformanceandcapabilities.
• Pre-agreedtermsandconditionsareimbeddedintotheFrameworkagreement.
• TheMiniTenderprocedureensuresthatprojectscangetunderwayquicklyandefficiently.
• Frameworksupport,withthemonitoringofContractorsthroughKPIs,benchmarkingagainstindustrystandardsandencouragingcontinuousimprovement.
• Forumsandspecialinterestgroupstoencouragesharedlearning,skillsandknowledge.

TheFrameworkagreementwillbecentrallymanagedandmonitoredbyDenbighshireCountyCouncil.
ThroughthegovernancestructurethebenefitsoftheFrameworkwillbemonitored.Anannualperformancereportwillbeproducedtohighlightprogressagainstmilestonesanddeliveryofbenefits.

2. The Framework Agreement
Background
TheFrameworkisacollaborativeprojectfundedWelshGovernmentDepartmentforEducationandSkills.TheimplementationwasledbyDenbighshireandFlintshireCountyCouncilsonbehalfofthe6NorthWalesauthorities.
Aspartofthe21stCenturySchoolsProgrammeoneofthekeyrequirementsisthatlocalauthoritiesaretoprocureallproposedConstructionworksthrougharegionalcollaborativeprocurementapproachhencetheneedtocreateaNorthWalesFramework.
AlongsidetheregionalFramework,theprinciplesadoptedthroughtheFrameworkwillbeappliedtoprojectsvaluedbelowtheOJEUthresholdacrosstheregion.Thiswillensureconsistency,drivedeliveryofthecommunitybenefits,developcontinuousimprovementandsetnewbenchmarksforbestpractice.
Aim, Vision and Objectives

AFrameworkManagerisinplaceforthedurationoftheFrameworktoensurethat:
• TherewillbeacommitmenttobestpracticeandcollaborationbetweenallorganisationsinvolvedinaProject.
• Theuserswill,undertheirrespectiveProjects,championbestpracticeindesign,teamworking,innovation,HealthandSafetyandsustainabilityanddemandanappropriatelytrainedandqualifiedworkforce.
• Theprojectteamidentifiesandmanagesprojectriskfromtheoutset.
• “CommunityBenefits”aredeliveredbyboththeuserandContractorsinaccordancetotheEmploymentsandSkillsandCommunityBenefitsPlansrespectively.
• TheFrameworkwillbemonitoredtoensurecompliancee.g.Reviewingmini-tenderdocumentsusedbyusersandContractors.
• KPIdatawillbecollectedperiodicallyforallprojectsandreportsproducedaccordingly.Datawillalsobeusedforreportingandanalysingpurposes.

Workshops and Training
IntroductorymeetingsprovidingsupportandguidanceonhowtousetheFrameworkwillbeheldbytheFrameworkManagementTeamtoensureallparticipatingbodiesareawareoftheprocessandoperationsoftheFramework.
Thesetrainingsessionswillbeheldinadiscussionformatwherepracticaladviceandguidancewillbegivenandwillprovideanopportunityforuserstocontributeideas.
InadditiontothesesessionsworkshopsandothergroupsessionswillbeheldastheFrameworkprogresses.

3. Framework Operation
UsersconsideringusingtheFrameworkshould,inthefirstinstance,contacttheFrameworkManagertoarrangeaninitialmeetingtodiscusstheproposedprojectandwayforward.
TheFrameworkManagerwillprovideinformationonhowtoaccesstheFrameworkandprovidetemplatesandguidanceontheminitenderprocess.
IfaPublicSectorbodynamedontheFrameworkwishestousetheFramework,theymustsigntheFramework’sCharter(Appendix2)andcomplywiththeFrameworkAgreement.

DesignandbuildProjectswillinvolveearlystagedesigndutiesbeingundertakenbytherelevantusertoset-outtheemployer’srequirements.Theemployer’srequirementdocumentwillthenbepresentedtotherelevantContractorswiththemini-tenderdocumentation.
Followingthecompletionofthemini-tenderprocess,theremainingdesignwillbecompletedbythesuccessfulContractor,eitherutilisingtherelevantusersnovateddesignteam,orthroughtheContractor’spreferreddesignteam.
Full design Mini-Tenders
FulldesignProjectswillinvolvethemajorityofthedesigndutiesbeingundertakenbytherelevantuser(eitherin-houseorviaadesignconsultant).TheprojectdesignwillbepresentedtotherelevantContractorswiththemini-tenderdocumentation.
WhereafulldesignapproachisconsideredappropriatebytherelevantuseritislessimportanttoengagetheselectedContractorasearlyinthedesignprocess,asthedesignrolewillnottransfertotheContractor.
Early Contractor Involvement
ECIoftenresultsinamorecompleteapproachtodesign,withtheexperienceofboththedesignerandtheContractortakenintoaccountearlyinthedesignprocess.ThiscanresultinlowerprojectcostsandsaferworkingpracticesandappliestoD&Bandfulldesignroutes.
Accordingly,priortoeachmini-tender,workshopsmaybeheldwhereECIcanbeintroducedtothedesignprocesswithoutunfairbiasbeinggiventooneormorepotentialContractors.
WorkshopsmaybeheldatanyRIBAstagepriortoamini-tender,howevertheearliertheContractorisinvolvedintheprocess,themorelikelihoodtheirinfluencewillproduceameasurableeffectonthedesignprocess.
ECImayalsooccursoonafterMiniTender,asContractorscouldbebroughtonboardandjointhedesignprocess.
Novation
Itisenvisagedthatinmostcasestheinitialprojectbriefwillbeset-outbytheuser.Insomecases,whereadesignandbuildtypeapproachisdesired,thedesignresponsibilitymaytransfertotheContractoratapointwhichsuitstheprocurementmethod,theprojectprogramme,andtheusersrequirements.
SomeusersmayopttotransfertheirappointeddesignteamtotheContractorfortheremainderofaProject.

4. Quality
Principles
OneofthekeyobjectivesoftheFrameworkistoimproveprojectdeliverybymonitoringindividualprojectperformanceinareassuchascostandtime.
ProjectReviewmeetingswilltakeplaceperiodicallytoassesstheevolutionoftheprojects,thiswillalignwiththeprojectprogramme.
ThenumberofReviewswilldependonthecomplexityoftheproject.
Itisparamountthatallstakeholders,includingtheuser,designers,Contractors,keysub-Contractorsandend-users,participateintheseReviewsinlinewiththeethosoftheFrameworkofanopencollaborativeapproachthatleadstoconstructivechallenge.
KeyPerformanceIndicator(KPI)measurementsarecollectedperiodicallyandatthefinalReviewofeveryprojectorprogrammeofwork.
Data Management
TheFrameworkManagementTeamwillregularlycollectinformationontheprojectsinordertotracktrendsandperformance.Thisdatawillthenbeusedtobenchmarkagainstotherprojects,Constructionindustrydataandotherusersdata.
TheKPIenginewillprovidethemechanismforcollectingtheperformancedataofeachcontractor,projectanduser.
DatawillbecollatedandregularreportsissuedontheFrameworkperformance.
Process
ThefollowingguidancedefinestheminimumFrameworkrequirements.TheReviewsarenotintendedtoduplicateorreplacemoreextensiveQualityAssuranceprocessesthatmayalreadybeinoperationbytheuser.
Fit to proceed to contractor appointment
ToengagewiththecontractorfromanearlystageisthemostefficientwaytousetheFramework,however,therearecasesinwhichthereisnocertaintyofwhethertheprojectwillgoahead.Inthesesituationsitisimportanttomanagetheamountandthepossibilityofabortivework.
Tomanagethissituationitisimportanttoconsiderthefollowingpriortoprocurement.

InadditiontoKPIdata,lessonslearnedinformationwillberequireddetailingwhatwentwellandnotsowell.Questionnaireswillbeusedtogaininformationfromtheusers.
AsummaryoftheprojectalongwithphotographswillalsoberequiredsothatthesecanbeusedinFrameworkpublications.
People and Customer Satisfaction Review
Questionnaireshavebeencreatedtocollectdatafromprojects.Thesearetobecompletedassoonaspossibleaftertheprojectcompletiondata.
Thesequestionnaireswillcollectcontractorperformance,clientteamperformanceandFrameworkmanagementperformance.

TheFrameworkmanagementteamhavedevelopedaperformancemeasurementsystemandthiswillbeavailableviaanonlinesystem.
ContractorsmustreportonanyProjectawardedundertheFrameworkthroughthissystem.ThedatawillbecollatedonaregularbasisbythesystemandwillbemanagedbytheFrameworkManagerwhowillliaisedirectlywiththerelevantContractor(s)andthedelegatedProjectManagerforeachuserandreportthedatatotheOMBandSMB.
Monthlydatacollectionwillensurethatanyslippagesinperformanceareidentifiedsufficientlyearlysothatactioncanbetakentorectifyslippagesandensurecontinuousimprovement.
Value of KPIs and Review
TheKPIswillbeusedtomonitortheperformanceofeachContractorappointedundertheFrameworkbutalsothereisabuiltinopportunityfor360degreeReviewwherebythedelegatedProjectManagerforaProjectandtherelevantusercanbeassessedonparticularareassothattheuserseachhavetheopportunitytoidentifyareasforimprovementandnotrepeaterrorsormistakes.
ThisdatawillbesharedattheOMBlevelsothatnewwaysofoperating,bestpracticeandspecialareasofdevelopmentcanbeidentified.Theseresults,wherenecessary,willalsobereportedtotheSMB.AlistofKPIscanbefoundatappendix3.
Special Interest Groups, Improvement Groups and Community Benefits Steering Group
Thesegroupsaredynamic,openforumstofacilitateandpromoteapartnershiprelationshipbetweentheFrameworkUsersandtheContractorswiththeaimtoimproveprocedures,shareknowledgeandbestpractice.
WorkshopswillimprovethewayweworktogetherfocusingontheFrameworkobjectives,tosharethedifferentapproachestowardssolvingproblemsandfindingbetterwaystowork.InitiallythesegroupswillhighlightimprovementswhichcanbeincorporatedintotheFrameworkoperationprocess.

TheFrameworkManagerwillundertakeprojectchecksonaregularbasisandkeepcontrolovertheprojectsaccessingtheFrameworktoensurethattheprojectspendremainsunderthetotalvalueoftheFramework.TherewillalsoberegularcheckstomakesurethattheFrameworkisoperatingwithinguidelines,topromoteitsuseandtodelivertangiblebenefits.
