I. That this House notes that:

(a) Tuesday, 5 June is World Environment Day,

(b) the theme of the 2018 World Environment Day is "Beat Plastic Pollution",

( c) plastic pollution is having a huge impact on the planet, with 13 million tonnes of plastic leaking into our oceans each year, resulting in the deaths of one million seabirds and I 00,000 marine mammals,

(d) the environment in New South Wales is under unprecedented stress and many species are at risk of extinction from key threatening processes such as clearing of native vegetation, invasive species and climate change.

(e) the Government has engaged in what can only be described as ecocide, by gutting the laws that protect the environment from land clearing, weakening the National Parks and Wildlife Service and giving mining companies free reign over our land and water.

2. That this House calls on the Government to stop its war on the environment and recognise that without a healthy environment, we are all stuffed.

1. That this House notes that the road transport industry consistently tops the list of Australia's most dangerous industry; with

a. 330 people are killed in incidents involving heavy vehicles and 5,350 people injured at the rate of31 per day; and

b. Academic, judicial, government and coronial studies citing economic factors - principally the power imbalance between transport purchasers, or clients, and transport suppliers -which results in unsafe remuneration systems, and perverse incentives for heavy vehicle operators.

Successive New South Wales Governments has responded to the heavy vehicle industry safety crisis by implementing, with bi-partisan support, supply chain regulatory models based on the 'Chain of Responsibility' in road transport and workplace health and safety laws.

Coles is one of Australia's two biggest retailers, responsible for the purchase of tens of thousands of trucking movements each year; and

The Transport Workers Union of Australia is a registered organisation of employees, as well as one of Australia's largest small business organisations; and

On 23 May 2018 Coles and the Transport Workers' Union of Australia signed a memorandum of understanding establishing five principles to conclude a Coles - TW[J Supply Chain Safety and Fairness Charter and a memorandum of understanding to ensure on demand workers are not disadvantaged in terms of safety, fairness and engagement as the on-demand economy evolves.

That this House express its support for each statement of principles and the finalisation of a Supply Chain Safety and Fairness Charter.

1. That this House notes: a. Don Craigie and Allan Clarke have been indefatigable in their work trying to

achieve justice in the unsolved murder case of Mark Haines, an Aboriginal teenager who was found dead on the train tracks south of Tamworth 30 years ago;

b. Don Craigie is Mark's uncle and one of his last remaining relatives who has spent

the last 30 years demanding answers from the police, from politicians and from

the local community; c. · Allan Clarke's diligent reporting over the last 5 years has given a public voice to

the family, uncovered witnesses and evidence that the original police investigation failed to investigate and highlighted the injustices that too many First Nations

people face when it comes to unsolved murders.

2. That this house congratulates Don Craigie's tireless commitment and Allan Clarke's consistent reporting for playing a significant role in Mark's case being re-opened by the NSW Police State Crime Command and moving his family a step closer to justice.,

3. That this house commits to a criminal justice system that is open and fair to all regardless

of their race, wealth, religion or status.

(a) the great work of the Skills Exchange Program which is a key element of Landcom's Research and Learning function, which demonstrates Landcom's strong commitment to lifelong learning and social sustainability and whichis one of several initiatives Landcom is progressing with TAFE NSW under the Landcom/TAFE Framework Agreement which was signed in 2017,

(b) the establishment of the Skills Exchange Program seeks to provide clear pathways for local people to access local jobs, in collaboration with job placement providers and employers, the focus is on recruiting the long term unemployed and under-employed into TAFE NSW skilled progranunes to ensure they can access vital upskilling, training and relevant skilled industry work experience and ultimately, long-term employment, and

( c) that Landcom will be supporting this program by organising a facility for T AFE NSW to conduct the training and is also contractually mandating that selected contractors employ individuals who complete the Skills Exchange Program in relevant, local work.

I give notice that on the next sitting day I will move:

1. That this House notes that:

(a) the NSW Nurses and Midwives Association have declared that there is a critical shortage of midwives in New South Wales hospitals with some hospitals being accused of sending new mums home too soon after giving birth,

(b) as a consequence of this shortage, new mums and babies are not getting the care they need,

( c) new mums are being discharged from hospital 48 hours after giving birth on the condition they will have regular check-ups with their midwives,

( d) not all new mums have partners or support at home to assist them with the demands of a new baby, let alone maintaining appointments once they have been discharged, and

( e) midwives in New South Wales have indicated that they are stretched to the limit

2. That this House recognises that the NSW Nurses and Midwives Association have uncovered some very alarming figures across this state, revealing; Blacktown Hospital has 23 vacant permanent positions for midwives out of 98, Westmead Hospital has 47 full-time positions vacant, Royal North Shore has 13 and Wollongong has 10.9.

3. That this House acknowledges that there is a significant shortage in nursing enrollments in New South Wales as prospective nursing students are struggling to come up with the upfront course fees.

' 4. That this House calls on the Health Minister to acknowledge the staff shortage and

allocate the appropriate resources to meet both workforce demands and staff shortages to ensure that the care provided to both mothers and babies is never compromised.

a) Farmers and communities on the Liverpool Plains have been angered and alarmed by the comments of the Minister for Resources and Energy on 15 May 2018 in this House that Petroleum Exploration Licenses which cover the Liverpool Plains "do have a connection with the Narrabri project that is currently being investigated by Santos";

b) Locals do not trust assurances from Santos that they "have no plans to drill wells in the Liverpool Plains", especially in light of Minister Harwin's recent comments.

2. That this House calls on Minister Harwin to explain to this House how the gas licenses covering the Liverpool Plains are connected to the Narrabri project and whether the NSW Government supports a gas field on the Liverpo ,P,lains.

That this House notes that:

1. The Minister for Local Government has finally made an announcement that countbacks will be allowed instead of costly by-elections for casual vacancies in local councils, almost two years after the legislation enabling this to occur was passed by Parliament in 2016.

2. Despite the Minister's announcement, local communities will have to continue to pay for costly by-elections, and local residents will continue to have to pay fines to the Govermnent, as the Minister has also stated that the necessary regulations will not be in place until after the 2020 general round of council elections.

I give notice that on the next sitting day I will move:

1. That this House notes that:

(a) Today is World Environment Day, a day to reflect on our precious natural environment and in particular the unique marine environment and marine life that call NSW coastal waters home.

(b) The NSW community loves the coast and the marine environment as can be shown by the large numbers of surfers, fishers, divers, sailors and holiday makers that use our remarkable coastline, estuaries and ocean; and has been on display by the huge community effort in the last few days to clean up from the disastrous container ship spill off the NSW coastline that has caused tonnes of plastic and other debris to be scattered across the coastline and lost into the ocean.

(c) Our oceans and marine life are under growing threat from climate change, pollution and in particular plastic pollution, historical overfishing and coastal development.

(d) Despite these threats, after seven years of Liberal/National Government and extensive reforms to marine environment legislation:

a. the Government's own audit recommendation to expand marine park protections have not been implemented and marine protections have gone backwards,

b. The Government has failed to put in place legislated emissions reduction targets and is more than $250 million dollars underspend on climate action,

c. NSW lags the rest of the country and many jurisdictions in the world in failing to legislate to ban or reduce the use of single use plastic bags and other wasteful single use plastic items that kill and injure thousands of marine animals every year;

d. The failed shark net program continues to kill hundreds of turtle, dolphins, rays and non-threatening sharks every year in NSW with little to no public safety benefit and at the expense of more effective non-lethal means.

2. That this House caJI on the Government to:

(a) Get serious about the protection of the marine environment, preserve and expand our marine park network, take action against single use plastics, legislate to reduce the state's carbon emissions, and protect threatened marine animals by removing damaging shark nets.

1. That this House notes that:

(a) 27 May to 3 June 2018 is National Reconciliation Week,

(b) National Reconciliation week commemorates two significant milestones in the journey of Australia's reconciliation with its indigenous peoples, the successful 1967 referendum, and the High Court Mabo decision respectively,

(c) National Reconciliation Week is a time for all Australians to learn about the shared histories, cultures, and achievements of indigenous and non-indigenous Australians, and to explore how each of us can contribute to achieving reconciliation in Australia,

(d) in 2018, National Reconciliation Week follows the theme of"Don't Keep History A Mystery: Learn. Share. Grow" inviting all Australians to explore the hidden histories and cultures "beneath the surface",

( e) many Australians may be unaware of the multiplicity of indigenous histories, historical events and cultures, that existed at the time of British settlement, such as the early resistance to British "settlement" by figures such as Pemulwuy, and highly developed indigenous agricultural practices, and

(f) lasting and substantive reconciliation is vital to Australia as a nation, such as the signing of a treaty so that it can move forward and create a nation strengthened by respectful relationships between the wider Australian and Aboriginal and Torres Strait Islander peoples.

2 That this House congratulates all engaged in this national Reconciliation Week and calls on all Australians, indigenous and non-indigenous, to continue to explore ways to achieve meaningful reconciliation in Australia.

1. That this House notes that:

(a) Only 2% of new reserves to be created under the NSW Government's new Koala Plan contain high-quality koala habitat according to the Government's own modelling.

(b) 82% of the new reserves to be created under the NSW Government's Koala Plan offer no new protection to koalas because they were already designated Forest Management Zones that were part of the informal reserve system.

( c) All the reserves to be created under the Government's Koala Plan are in the hinterland, away from the coastal forests where the best koala habitat exists.

(d) Less than 2.5% of the new reserves to be created under the Government's Koala Plan over-lap with the much-needed Great Koala National Pl;lrk, which would ensure the survival ofNSW's wild koala population.

(e) Four of the new reserves to be created under the Government's Koala Plan have no records of Koalas in them, and only two have "contemporary" records of Koalas.

2. That this House call on the Government to revise its Koala Plan and immediately commit to the creation of a Great Koala National Park in the Coffs Hinterland.

( c) The paddle included stand up paddle boarders, kayakers and dragon boats,

(d) The event raised funds for the Brunswick Volunteer Marine Rescue, the Brunswick Heads Surf Life Saving Club and the Brunswick Heads Visitor Centre,

(e) The paddle showcases the very best of the seaside village- Brunswick Heads.

2. That this House congratulates and thanks Jo-Ann Spiteri for all her work in organizing this year's paddle.

3. That this House acknowledges the importance of community events to celebrate our unique and beautiful regional areas.

(b) the Association is an exclusive organisation that provides a platform for young, ultra-high-net worth business elites to network and grow their businesses in Australia,

( c) the Association aims to promote and encourage intercultural relations between Australia and China through the continuous strengthening of cultural, business, and economic ties between our two nations,

(d) the Association's mission is to maximise the potential of young Chinese­Australian entrepreneurs by connecting with like-minded peers, businesses, in order to promote healthy competition, collaboration, and enterprise, and

( e) the event was well attended with over three hundred people with guest speaker the Hon Chris Bowen Shadow Treasurer and Professor the Hon Bob Carr, and a number of members of parliament and community leaders were also in attendance.

1. That this House commends the extraordinary and v1s10nary work of Sir David Attenborough.

2. That this House notes that:

(a) Sir David Attenborough was born 8 May 1926, turning 92 years of age last month,

(b) Sir David is an English broadcaster and naturalist, best known for writing and presenting, in conjunction with the BBC Natural History Unit, the nine natural history documentary series that form the Life collection, which form a comprehensive survey of animal and plant life on Earth,

(c) in 1936, Sir David attended a lecture by Grey Owl (Archibald Belaney) at De Montfort Hall, Leicester, and was influenced by his advocacy of conservation and profound knowledge of the flora and fauna of the Canadian wilderness and by his warnings of ecological disaster should the delicate balance between them be destroyed,

( d) the idea that mankind was endangering nature by recklessly despoiling and plundering its riches was unheard of at the time, but it is one that has remained part of David Attenborough's own credo to this day.

( e) Sir David married Elizabeth Ebsworth Oriel who died in 1997, with whom he had two children, Robert and Susan,

(f) his son Robert is a senior lecturer in bioanthropology for the School of Archaeology and Anthropology at the Australian National University in Canberra,

(g) beginning with Life on Earth in 1979, Attenborough set about creating a body of work which became a benchmark of quality in wildlife film-making and influenced a generation of documentary film-makers,

(h) the series also established many of the hallmarks of the BBC's natural history output, and that by treating his subject seriously and researching the latest discoveries, Attenborough and his production team gained the trust of scientists, and

(i) in October 2014, the BBC commissioned Atlantic Productions to make a three­part, Attenborough-fronted series about the Great Barrier Reef in 2015, with the series marking the 10th project for Attenborough and Atlantic, and which saw him returning to a location he first filmed at in 1957.

3. That the House notes the following statement by Sir David Attenborough arising from observing the Reef 58 years since the first time: "The Great Barrier Reef is in grave danger. The twin perils brought by climate change - an increase in the temperature of the ocean and in its acidity - threaten its very existence."

(a) on Saturday 26 May 2018, over 400 guests attended a 21st Birthday Gala Dinner celebrating 21 years of research excellence at the Westmead Institute for Medical Research (WIMR),

(b) the celebration was joined by Nobel Laureate Professor Peter Doherty AC; the Honourable Brad Hazzard, Minister for Health, the Honourable Ernest Wong MLC, Dr Geoff Lee MP, councillor Pierre Esber, mayor and other councillors of Parramatta Council,

( c) this was a fundraising event for new genomics equipment to support their researchers across a range of disciplines, including cancer, diabetes and cardiovascular disease to understand how our genes and DNA affect disease, and

( d) the Westmead Institute traces its origins back to the University of Sydney, established in 1852 and Westmead Hospital, established in 1978.

2. Th11t this House acknowledges that WIMR is one of the largest medical research institutes in Australia and their researchers are world leaders in breast and ovarian cancer, melanoma and leukemia, diabetes, major infectious diseases including HIV; autoimmune diseases including multiple sclerosis; kidney, liver, heart, respiratory and eye diseases; mental health and neuroscience.

3. That this House congratulates Professor Tony Cunningham, Executive Director together with members of the Insitute Board of Directors for their immense effort in making the institute home to more than 45 research centres, and the commitment and hard work of the researches in making enormous contributions to dical advancement in Australia.

1. That this House notes that:

a) On 5 June 2018 charges under Section 201 of the Crimes Act 1900 against Bev Smiles, Stephanie Luke and Bruce Hughes for 'interfering with equipment belonging to a mine' and 'rendering useless a road belonging to a mine' were dismissed in court due to insufficient evidence;

b) These charges follow their arrest on 12 April 2017 after peacefully protesting outside Peabody Energy's Wilpinjong coaJ. mine in the Upper Hunter Valley;

c) Bev, Stephanie and Bruce were the first people to be charged under the draconian anti-protest laws introduced in 2016 and faced a possible 7 year jail sentence for standing up to protect their community;

d) In his decision the Judge said that if the police had instead brought the charge that they had 'interfered with equipment associated with a mine' they probably would have been found guilty and may have faced jail due to the breadth of the definition of the term 'associated with'.

e) The judge also said that because the defendants were found not guilty he did not have to consider the issue of whether the laws breach the implied freedom of political communication and so this issue remains untested.

2. That this House expresses its alarm that three upstanding members of the community could have been jailed under current laws for simply be standing on the road for a few hours engaged in peaceful protest.

3. That this House agrees that Section 201 of the Crimes Act 1900 as currently written is clearly overreach, trespasses on the implied right to free'.!9:m" of political

(a) the former Oatley Bowling Club, which closed in 2006, was located on several parcels of land that were purchased by the then Hurstville City Council in 1944 and 1945 "for Park purposes",

(b) the site is currently classified as "General community use" and is adjacent to the Myles Dunphy Reserve, which is a haven for locally endangered animal species and _one of the last examples of Sydney Turpentine Ironbark forest,

( c) there is currently a planning proposal submitted by Georges River Council to remove the community use zoning and allow a development that will result in a loss of public open space,

( d) local community groups, including Friends of Oatley and the Oatley Flora and Fauna Conservation Society, have expressed deep concerns about the loss of public space as well as the impact that the development would have on the Myles Dunphy Reserve, and

( e) public green spaces, like the Myles Dunphy Reserve, are so precious because they are a haven for plants and animals especially at a time when climate change is biting, and provide a place for recreation, leisure and contemplation which are vital for our physical and mental well-being.

2. That this House calls on the Minister for Planning to reject the gateway determination for the former Oatley Bowling Club site and protect the area in perpetuity as public recreational space in public hands.

1. That this House notes that:

(a) the Port Stephens Graffiti Action Team, made up of volunteers, has worked tirelessly since May 2009 with Port Stephens Council and the Police to remove and prevent graffiti in the Tomaree Peninsula region,

(b) the team was founded by the late Keith Brabham with the assistance of then Councillor Sally Dover due to the then increase of graffiti in the area, and its cost to the community,

( c) Ted Bickford, the "Graffiti Buster" from Foster inspired the formation of the group,

( d) the team includes representatives from each area of the Tomaree Peninsula, from Fingal Bay, Shoal Bay, Nelson Bay, Corlette, Salamander Bay, Soldiers Point, Boat Harbour, Anna Bay and Lemon Tree Passage,

(e) since Keith Brabham's passing, the team has been led by Mr John Bell, with Mr Ken Smith, Vice President, Ms Judy Washington, Secretary, Mr Nryan Gibson, Mr Charles Gerussi and other volunteers,

(f) each day, members inspect their area for graffiti and remove it as quickly as possible,

(g) the cost of chemicals, paint and insurance are covered by Council and equipment has been purchased with grants or proceeds from sausage sizzles run by members,

(h) Destination .Port Stephens and two of its member firms donated a trailer to the group for its equipment,

(i) the team has worked with the Police Local Area Command in Operation Eraser to apprehend serial graffiti perpetrators, a number of whom are adults, and to discourage young offenders, and;

G) a number of serial offenders, largely adults, have been apprehended and charged and a larger number of school age youth have been discouraged from involvement with them and their antisocial behaviour due to the work of the team.

2. That this House acknowledges and commends the outstanding work of the Port Stephens Graffiti Action Team for its proactive work in removing graffiti, and its monitoring and prevention measures that have resulted in a reduction of graffiti crime on the Tomaree Peninsula.

(c) the 2017-18 budget for New South Wales allocated just 0.5 per cent - or $62 million - of the transport budget to active transport, while $1, 100 per person was spent on roads, only $8 per person was put into active transport, and

( d) the United Nations recommends that 20 per cent of the transport budget should be dedicated to active transport.

2. That this House recognises the importance of sustainable modes of transport such as cycling and their positive impact on our environment and health.

3. That this House calls on the Government to massively boost funding for cycling infrastructure in the upcoming State Budget and work towards making cycling more attractive and safer for commuters by building world class facilities including separated bicycle networks, larger bicycle parking facilities at train stations and the capacity for buses and light rail to carry bicycles.

(a) the 50th Senior State Netball Championships will be held this coming Queen's Birthday weekend at Gosford Netball Courts, Adcock Park with over 90 teams from across the State's Districts competing and thousands of umpires, coaches, and spectators attending and injecting significant money into the Central Coast economy,

(b) while New South Wales Netball (previously Womens' Basketball) Association was founded in 1929 and various "Country Weekends" were held from 1949 amongst District Associations from across the State, the first official senior State Championship was held 14-16 June 1969 at Moore Park, Sydney with the Manly Warringah Open Team, Coached by Mrs Judy Borger winning the Inaugural Championship,

(c) the State and State Age Championships have injected millions of dollars into local economies across the State over the last 50 years,

( d) 2018 will be the last State and State Age Championships, with new titled and formatted Events planned for the future,

(e) major sponsors of the 2018 State Championships are ACPE, BBX, Bioglan, QBE, TAPE NSW, HCP and Woolworths,

1. That this House notes that:

a) On 31 May 2018 Port Waratah Coal Services announced that they have cancelled plans to build a fourth coal terminal at the Port of Newcastle because "the capacity of the existing coal terminals ... are likely to be sufficient to cater for future growth in coal exports";

b) In response to the announcement, a spokesperson for the Port ofNewcastle said that this "is further evidence of the need for the Port ofNewcastle, and indeed the Hunter Valley economy to diversify as rapidly as possible";

c) This is a clear admission from the coal industry that the unrealistic growth forecasts for coal exports, including in the NSW Government's Intergenerational Report, will not be realised;

d) The decision is symptomatic of a global trend away from fossil fuels and towards clean, renewable energy, as reality catches up with the great lie that we can continue to export coal in an age of climate change;

2. That this house congratulates the determined community campaigners who have spent over six years working to block T4's approval and construction;

3. That this house celebrates the decision to cancel T4 as it means that we can now open up Newcastle's port capability to more diversity rather than having it quarantined for a coal industry that is on its last legs;

4. That this House calls on the NSW government to: a) Use this decision as a catalyst to develop a serious plan for a just transition

away from the coal industry b) Fix the broken planning system which led to the terminal being approved

despite evidence that it did not stack up economically, e cirynmentally or socially. /'

b. Chris Fulton, Associate Professor in Aquatic Ecology at the Australian National University, and
