1.1TheBoardofTrusteesTheNJITActof1995(Chapter400LawsofN.J.1995;approvedJanuary10,1996)declaresthat“theexercise by the university of the powers conferred by this Act shall be deemed to be public andessentialgovernmentfunctionsnecessaryforthewelfareoftheStateandthepeopleofNewJersey.”

TheBoardofTrusteesisthegoverningboardoftheUniversityandconsistsoftheGovernor(ortheGovernor’sdesignee)andtheMayorofNewarkasexof&icionon-votingmembers, inadditiontoamaximumof15citizensoftheState,appointedbytheGovernorwiththeadviceandconsentoftheSenate.

RegularmeetingsoftheBoardareheldthroughouttheyearandareopentothepublic.AscheduleofBoardmeetings,alongwithminutesofthemeetings,resolutions,andtheBoard’sBylaws,canbeviewedontheBoard’swebsite.

1.2AdministrativeOf7icersforAcademicAffairs1.2.1ThePresidentThePresidentisthechiefexecutiveof8iceroftheUniversity. AppointedbyandsubjecttotheauthorityoftheUniversity’sBoardofTrustees,thePresidenthasprimaryresponsibilityforalleducationalandadministrativefunctionsoftheUniversity.

1.2.2TheProvostandSeniorExecutiveVicePresidentforAcademicAffairsTheProvostandSeniorExecutiveVicePresidentforAcademicAffairs(hereafter:“theProvost”)isthechiefacademicof8icerof theUniversityandservesat thepleasureof thePresident, towhomhe/shereports. TheProvostservesasActingPresidentwhenthePresidentisabsent.

1.2.3DeansDeansarethechiefacademicof8icersoftheirrespectiveCollegesorSchoolsandserveatthepleasureoftheProvost,towhomtheyreport.

1.2.4DepartmentChairpersonsAcademicDepartmentsareheadedbyChairpersonswhoreportdirectlyto,andserveatthepleasureof, theDeanof thecollege inwhich theDepartment is located. ChairpersonsareresponsiblefortheeffectiveoperationoftheirDepartmentsinaccordancewiththeFacultyHandbook,DepartmentBylaws,andcollectivebargainingagreementpolicy,whereapplicable.

1.3OrganizationalChartAcurrentorganizationalchartoftheadministrationoftheUniversitymaybefoundhere.

1.4SharedGovernanceAfter several years of planning by Faculty, Administrators, Staff, Students, andAlumni under thedirectionofProvostsIanGatleyandFadiDeek,andwiththeapprovaloftheBoardofTrusteesuponthe recommendation of President Joel Bloom, a system of shared governancewent into effect atNJITinSeptember2014.

1.4.1TheFacultySenateandtheUniversitySenateThe cornerstone of the new governance structure is a dual-senate system consisting of aFaculty Senate—replacing the Faculty Council (1966–2014) as the duly constitutedrepresentativebodyoftheNJITFaculty—whichhasresponsibilityforacademicissuesandissuesofconcerntotheFaculty,andaUniversitySenate,whichhasresponsibilityfornon-academicissues.

1.4.1.2OpennessandTransparencyExceptinspecialcircumstancesde8inedintheirconstitutionsandbylaws,theFacultySenate and the University Senate shall conduct their business atmeetings that areopen to the entire university community, and both senates shall publicize theiractivitiesandaccomplishmentsontheirwebsites:

1.4.1.3ParticipationbyStakeholdersBoth theFaculty Senate and theUniversity Senatedraw strength andwisdom fromvariousgroupsandconstituenciesthatmakeuptheUniversitycommunity,includingFaculty, Instructional Staff, administrators, staff, undergraduate and graduatestudents, and alumni. These constituent groups or stakeholders are represented bythefollowingorganizations:

1.4.1.4CommitteeStructureBoth the Faculty Senate and the University Senate rely on a committee structurewhich complements the work of other committees that report directly to thePresident,theProvost,andothersenioradministrators.

The currentmembershipof Faculty Senate standing committees canbe foundhere.ThecurrentmembershipofUniversitySenatestandingcommitteescanbefoundhere.The current membership of committees that report directly to the President, theProvost,andothersenioradministratorscanbefoundhere.

2. MeetingsoftheFaculty1.4.2.1GeneralGuidelinesforCallingandConductingFacultyMeetingsInaccordancewithSection7.3of theConstitutionof theFacultySenateandSectionV.B of the Faculty Senate Bylaws, regular meetings of the NJIT Faculty shall byconvenedandconductedbytheFacultySenateatleastonceeachsemesterinordertoconvey informationtotheFaculty,solicitFacultyopinions,andvoteonaction items,includingproposedsubstantivechangestotheFacultyHandbook.ProceduresrelatingtomeetingsoftheFacultyshallbeconductedinaccordancewiththosesectionsoftheConstitutionandBylawsoftheFacultySenate.

1.4.2.2AdditionalOf&icesThe Executive Committee of the Faculty Senate may appoint Faculty members asof8icers to assist with the administration of meetings of the Faculty, including aSecretaryof theFaculty to takeminutesandkeeprecordsandaParliamentarian toprovideguidanceonprocedure.

PARTTWOTHEFACULTYANDINSTRUCTIONALSTAFF

2.1GeneralStatementsonFaculty2.1.1MaintenanceofAcademicStandardsThe role of the Faculty is integral to shared university governance. It is the Faculty’sresponsibility to oversee and maintain appropriate academic curricular standards. Incooperation with the university administration, the Faculty assures stakeholders thatstudentsareheldtostandardscommensuratewiththedegreestheypursue.Workingwithinthe structure of degree programs, Faculty members maintain, and periodically adjust,requirementsandstandardsfordegrees.

2.1.2ExpectationsforInstruction,ScholarlyResearch,andServiceEffectiveinstruction,scholarlyresearch,andcommunityservicearetheresponsibilityoftheFaculty.To this end,Facultymembersare expectedto performappropriate instructionbyhelping students understandcurrent practicewithin their disciplines.Asmembersof thelargeracademiccommunity,Facultymembersareexpectedtocontributethroughresearchand scholarlyactivities to the advancementof their disciplines.Facultymembersare alsoexpectedtoparticipateinvariedserviceactivitieswhichstrengthentheuniversity.

To ensure that the activities of Faculty are known and recognized, Facultymembers arerequired to 8ile annual reports. University administration is responsible for designing thereportingprocesssothatFacultycontributionsarerecognized.

2.1.3FacultyRightsIn order for Faculty to ful8ill the expectations that derive from their positionswithin theuniversity, they shouldbe providedwith an environmentconducive to teaching, scholarlyresearch, and service. Faculty should expect to undertake a level of teaching, scholarlyresearch,andservicecomparabletothatofFacultyinbenchmarkuniversities.

Facultymembersworkwithinanenvironmentofacademicfreedom,includingfreedomfromexternalpressurestoconformtorestrictedintellectual,pedagogical,orpoliticalorientationsto their duties. Faculty should be able to participate in governance activities, such asmembership in Faculty Senate and collective bargaining through the Professional Staff

Association,withouthindrance.

Faculty members should have access to privileges traditionally associated with researchuniversities. Such privileges include sabbatical leaves and leaves of absence, as well assupport forgrantapplications,grantadministration,and travelrelatedtoconferences andresearchactivities.

2.1.4ProfessionalStaffAssociationInaccordancewithChapter303,PublicLawsof1968,theRulesandRegulationsofthePublicEmploymentRelationsCommission(PERC),theuniversityhasof8iciallyrecognizedtheNJITProfessional Staff Association (PSA) as the exclusive representative for collectivenegotiationsonbehalfofallfull-timeteachingandadministrativepersonnelwhoqualifyformembershipintheAssociation. FurtherinformationabouttheNJITPSAmaybeobtainedatthePSAwebsite.

2.2MembershipintheFaculty2.2.1.MembershipintheFacultyThe Faculty consists of all individuals holding the ranks of Assistant Professor, AssociateProfessor,Professor,andDistinguishedProfessoratNJIT,includingadministratorswhoholdthoseranks.Aspresidingof8iceroftheUniversity,thePresidentisamemberoftheFaculty.As noted in Section 2.3.4, Faculty from other universities who serve as Chairpersons ofFederated Departments are considered members of the NJIT Faculty for the duration oftheirterms.

2.2.2VotingMembershipatFacultyMeetingsThe voting membership at Faculty meetings consists of all members of the Faculty asde8ined in Section 2.2.1 above as well as certain administrators who do not otherwisequalifyasmembersoftheFaculty.TheseadministratorsaretheVicePresidentforAcademicSupportandStudentAffairs,theDeanofStudents,theUniversityLibrarian,andanyotherswhoareagreeduponbythePresidentoftheUniversityandtheExecutiveCommitteeoftheFacultySenate.

2.3De7initionofFacultyRanks2.3.1Tenure-TrackFacultyRanks2.3.1.1AssistantProfessorThis position is intended primarily for individuals near the start of their academiccareers, who are expected to make substantial contributions to the University inteaching,scholarlyresearch,andservice.AssistantProfessorsserveaperiodof time,normallynottoexceedsevenyears,whilebeingconsideredforpromotionandtenure.AnAssistantProfessormayberecommendedforpromotionbeforebecomingeligiblefor tenure. A recommendation for tenure of an Assistant Professor must beaccompaniedbyarecommendationforpromotiontoAssociateProfessor.

2.3.1.2AssociateProfessorThispositionisintendedforindividualswhohaveestablishedarecordofexcellenceinteaching, scholarly research, and service. An individual may be appointed as anuntenuredAssociateProfessorwithatenureeligibilitydatespeci8iedorasatenuredAssociateProfessor.AnAssociateProfessormay be recommendedfor promotion inanyyearsubsequenttoinitialappointment.

2.3.1.3Professor

This position is intended for individuals who have built a sustained record ofexcellence in teaching, scholarly research, and service, andwhose accomplishmentsarenationallyrecognizedintheir8ield(s)ofexpertise.

2.3.1.4DistinguishedProfessorThispositionisintendedforindividualswhoseaccomplishmentssigni8icantlyexceedthoseofProfessors,and includea sustainedrecordofnationallyand internationallyrecognizedpreeminenceintheirfield(s)ofexpertise.

Note: The term “scholarly research” may be taken to include alternativedemonstrationsofindividualachievementindisciplinesandsub-disciplinesinwhichdifferentstandardsprevail,suchastheproductionofabodyoforiginal,creative,andprofessionally recognized work by Faculty with 8ields of expertise in architecture,theater,creativewriting,andthearts.

2.3.2Sponsored/EndowedChairsThese externally-funded positions are intended for individuals with notable records andexpertiseinaspeci8ic8ieldofacademicresearch.TheholderofasponsoredchairmayormaynotbetenuredattheUniversity.

2.3.3ProfessorsEmeriti2.3.3.1De8initionandCriteriaofEmeritiStatusFacultymemberswhohaveservedtheUniversitywithdistinctionmaybegrantedthehonorarytitleofProfessorEmeritusorProfessorEmeritauponretirement.ProfessorsEmeritidonothavevotingprivilegesatDepartmentandFacultyMeetings.

2.3.3.2ProcedureforAwardingEmeritiStatusRecommendations for awarding this title originate in the Department or AcademicUnitinwhichtheretireehasaprimaryaf8iliation,throughaprocedurearticulatedintheDepartmentBylaws.RecommendationsaresenttotheappropriateDeanandthento the Provost for approval. Immediately after granting approval, the Provost shallnotifytheretireeofhis/herappointment.

2.3.3.3AppealProcessFacultymemberswhohavenotreceivednoti8icationofappointmenttoEmeritistatusbytheendofthesecondsemesterfollowingthedateoftheirretirementmaysubmitan appeal in writing to the Provost, indicating the reasons why they believe theyqualify for Emeriti status according to the policy and procedures stated in Section2.3.3 in the Faculty Handbook and in their Department’s bylaws. Within 8ifteenbusiness days after receiving such an appeal, the Provost shall make a decision inwriting(withcopiestotheDepartmentChairpersonandtheDean)aboutwhethertoacceptorrejecttheappeal,includinghis/herreason(s)forthedecision.

2.3.4AssociateFacultyMembersThis designation is granted to all Faculty from other universities who are members ofFederatedDepartments,asde8inedinSection3.4.AssociateFacultyMembershavetherightto attend NJIT Faculty meetings with voice, but not vote. However, Faculty from otheruniversitieswhoserveasChairpersonsofFederatedDepartmentsarefullvotingmembersoftheNJITFacultyforthedurationoftheirtermsasChairpersons.

2.3.5GraduateFacultyAll NJIT Facultymembers aremembers of the Graduate Faculty. For the rules governingadmissionofotherstotheGraduateFaculty,alongwithinformationabouttheprivilegesand

responsibilitiesofGraduateFacultymembership,seetheGuidelinesforGraduateFacultyatNJIT. TheGuidelines forGraduate Faculty atNJITmaybe amendedby the Faculty SenatewiththeapprovaloftheProvost.

2.4FacultyAppointmentsandAf7iliations 2.4.1FacultyAppointments

2.4.1.1SearchProcess2.4.1.1.1GeneralGuidelinesAllFacultyhiringmustbeincompliancewithDepartmentandUniversitygoals.Equal employment opportunity considerations shall be a component of allFacultysearchesandrecruitmentprocedures.For further information,seetheUniversity’sFacultySearchandSelectionGuidelines.

2.4.1.1.2FacultySearchesWhen a Faculty positionbecomes available in a Department, the DepartmentChairperson oversees the hiring process, which includes establishing anappropriatelydiverseDepartmentsearch committee;searching for candidates(including targeted recruitment practices); screening applicants; invitingpromising candidates to the campus for presentations and meetings withmembersoftheDepartment,appropriateFacultyoutsidetheDepartment,andtheadministration(normallyincludingtheDean);obtainingexternalreferences;solicitingopinionsfrommembersoftheDepartmentandothers;andconveningthe Department P&T Committee to determine appropriate Faculty rank andtenure status of 8inalists, as well as to make the 8inal decision about whichcandidate(s)torecommendforappointment.(DepartmentBylawsmayspecifythe roles of the Chairperson and other Faculty in the Department in thisprocess.) At the end of the process, the Department sends the Dean arecommendation,alongwitharankedlistofotheracceptablecandidates fromthesearch.AftertheDeanhasconferredwiththeDepartmentChairpersonandapproved one or more candidates for hire, a recommendation is sent to theProvost.

2.4.1.2AppointmentLetterAnofferofaFacultypositionbecomesof8icialonlywhenanappointmentletterissenttoacandidatefromtheProvost.Theappointmentlettercontainsimportantdetailsonthe offer, including Faculty rank, tenure status (see Section 2.4.1.3), departmentalaf8iliation(s), salary, and information about additional resources that may be madeavailable to the candidate upon hire. In the event that—after a reasonable andspeci8iedperiod of time, duringwhich the terms in the appointment lettermay berenegotiatedtothemutualagreementofbothparties—acandidatedeclinestoacceptanoffer,ordoesnotreplywithinaspeci8iedperiodof time,theProvostmaysendanew appointment letter to the next candidate in the ranked list approved by theDepartmentandtheDean—andsoonuntilacandidateacceptsanofferbysigningtheoriginalorarevisedappointmentletterfromtheProvostandreturningittoNJIT.

2.4.1.3TenureStatusuponAppointmentWhenanewFacultymemberishiredwithouttenure,theappointmentletterfromtheProvostspeci8iesthedetailsof tenureeligibility.AnewFacultymemberhiredat therank of Associate Professor or Professor may be appointed with tenure with theapprovaloftheDepartmentP&TCommittee,theDean,andtheProvost.Insuchcases,the appointment letter from the Provost speci8ies that the appointment is beingofferedwithtenure,although(asinallcases)theawardoftenureisultimatelymadebytheBoardofTrusteesupontherecommendationofthePresident.

2.4.1.4AppointmentattheRankofDistinguishedProfessorAppointment at the rank of Distinguished Professor requires the approval of theDistinguishedProfessorsCommittee(seeSection4.4.4).

2.4.2PolicyonChangeofDepartmentAf\iliationInmostcasesFacultyappointmentsaremadetoaspecificDepartmentorAcademicUnitatNJIT,which is a Facultymember’s primary af8iliation. Facultymembersmay change theirDepartmentorAcademicUnitaf8iliationif theirrequestisapprovedbythePromotionandTenureCommitteeofthereceivingDepartmentorAcademicUnit,bytheDean(orDeans,ifthechangeinvolvestwodifferentCollegesorSchools),andbytheProvost.

2.4.3JointAppointmentsInpursuit ofmultidisciplinaryactivities in teaching, scholarly research, orboth, aFacultymembermayseekajointappointmentinmorethanoneDepartmentorAcademicUnit.

2.4.3.1ApplicationandApprovalProcessforJointAppointmentsA request for a joint appointment shall be initiated by the Faculty member andaddressed to the Chairpersons of both Departments or Academic Units. To beimplemented, the request must be supported by both Chairpersons, by bothDepartmentP&TCommittees,bytheDeanoftheCollegeorSchool(orbybothDeans,ifmorethanoneCollegeorSchoolisinvolved),andbytheProvost.Uponapproval,theProvostshallsendalettercontainingthetermsofthejointappointmenttotheFacultymember,copiedtotheaffectedChairperson(s)andDean(s).

2.4.3.2PrimaryandSecondaryAf&iliationEachjointappointmentinvolvesaprimaryandasecondaryaf8iliation,whichmustbespecifiedatthetimethejointappointmentismade.

2.4.3.2.1 Promotion and Tenure, Sabbatical Leaves, and Performance-BasedSalaryIncreasesThe Department or Academic Unit with which a Faculty member has a primaryaffiliationis responsiblefor evaluationsandrecommendationsforpromotionandtenure, sabbatical leaves, and performance-based salary increases. TheDepartmentorAcademicUnitwithwhichaFacultymemberhasasecondaryaffiliationcontributes to these processes through recommendations to the primaryDepartmentorAcademicUnit.

2.4.3.2.2TeachingandResearchTeachingassignmentsandresearchprogramsforFacultywithjointappointmentsare negotiated between the Faculty member and the Chairpersons of bothDepartmentsorAcademicUnits.

2.4.3.2.3CommitteesandMeetingsAFacultymemberwithajointappointmentisexpectedtoserveoncommitteesandattendmeetingsintheDepartmentorAcademicUnitwithwhichhe/shehasaprimary af8iliation. Service on committees and attendance at meetings in theDepartmentorAcademicUnitinwhichhe/shehasasecondaryaffiliationisvoluntary,buttheFacultymembershouldbeinvitedtoDepartmentmeetings. FacultymemberswithjointappointmentsdonothavevotingrightsinDepartmentsorAcademicUnitsinwhichtheyhavesecondaryaffiliationsunlesstheDepartmentbylawsspecifythattheydo.

2.4.3.3JointAppointmentwithaResearchCenterorInterdisciplinaryProgram

AFacultymembermayrequestajointappointmentwithaResearchCenterorwithaninterdisciplinaryprogram. Insuchcases theapplicationandapprovalprocess is thesame as in Section 2.4.3.1, except that the Director of the Research Center orinterdisciplinaryprogramassumestheroleoftheChairpersonoftheDepartmentorAcademicUnitwheretheFacultymemberhasasecondaryaf8iliation. Insuchcases,theFacultymember, theChairpersonof theDepartmentorAcademicUnit inwhichtheFacultymemberhashis/herprimaryaf8iliation,andtheDirectoroftheResearchCenter or interdisciplinary program jointly determine the responsibilities of theFaculty member, and the Director provides input regarding promotion and tenure,sabbaticalleaves,andperformance-basedsalaryincreases.

2.4.3.4JointAppointmentoutsideNJITArequestforajointappointmentwithaDepartmentorprogramatanothercollegeoruniversitynotFederatedwithNJITshallbereviewedandnegotiatedonanindividualbasis.

2.4.3.5ContinuationandDissolutionofJointAppointmentsContinuation of a joint appointment is by common agreement of all the partiesinvolvedintheapplicationandapprovalprocess. Dissolutionofajointappointmentshall occur if any of those parties requests it, with the Provost making a 8inaljudgment in case of disagreement among the parties. If a joint appointment isdissolved, the Faculty member remains a member of the Department or AcademicUnitinwhichhe/shehasaprimaryaf8iliation.

2.5.2InstructionalStaffPositionsUniversityLecturerThisfull-time,non-tenure-trackpositionisdesignedtosupporttheinstructionalroleoftheFaculty and to provide a degree of 8lexibility, allowing the University to achieve its goals.Intendedprimarilyasateachingposition,thepositionofUniversityLecturercanbeusedto8illanadministrativepositioninspecialcircumstances.BothevaluationandconsiderationforadvancementaremanagedbytheDepartmentorAcademicUnitofappointment,subjecttoprovisionscontainedintheCollectiveAgreementbetweenNJITandthePSA.

SeniorUniversityLecturerThisfull-timenontenure-trackpositionisreservedforUniversityLecturerswhoserecordofsustainedinstructionalexcellencewarrantsadvancementtoaseniorrank.Bothevaluationand considerationfor advancementaremanagedby theDepartment or Academic Unit ofappointment,subjecttoprovisionscontainedinthecollectiveagreementbetweenNJITandthePSA.

VisitingProfessor(includingVisitingAssistantProfessor,VisitingAssociateProfessor,VisitingProfessor,andVisitingDistinguishedProfessor)These full-time positions are temporary appointments, normally designed for individuals

Af8iliated Faculty Members areappointedtothree-year,renewabletermsontherecommendationoftheChairpersonofanacademicDepartmentor theDirectorof a degreeprogram,subject to the approvalof theappropriate School or College Dean and the Provost. At the discretion of the University,Af8iliatedFacultyMembersmayappearonDepartmentorprogramwebsites,may identifythemselvesasAf8iliatedFacultyMembersoutsideNJIT,andmaybegrantedaccesstospecificresourcesatNJIT,suchas libraryprivilegesandguestparkingprivilegeswhentheyareoncampusforrelevantactivities.

ProfessorofPracticeThis full-time or part-time non-tenure-track position is intended for accomplishedprofessionalswhopossessstate-of-the-artexpertiseincontemporarypracticein8ieldssuchasbusiness,industry,government,thearts,andtheprofessions.Appointmentsaremadeforone semester or one year in accordance with the policies and procedures of the hiringDepartment or Academic Unit, and may be extended for up to three years based on anannualreviewbytheDepartmentorAcademicUnit.

PARTTHREEACADEMICUNITSANDTHEIRADMINISTRATION

3.1Colleges,Schools,andDepartmentsAsaresearchUniversity,NJITisstructuredintotraditionalAcademicUnits:Colleges(orSchools)andDepartments.Thereare sixColleges, 8ive ofwhichare the locusof regularFaculty appointments.EachCollegeisledbyaDean,reportingtotheProvost.theNewarkCollegeofEngineering(NCE),theCollege of Science and LiberalArts (CSLA), and the Collegeof ComputingSciences (CCS) containmultiple academic Departments, each headed by a Department Chairperson. The College ofArchitectureandDesign(CoAD)consistsofaSchoolofArchitectureandaSchoolofArt+Design.TheSchoolofManagement(SoM)consistsofasingleAcademicUnit.TheAlbertDormanHonorsCollege(ADHC)isdesignedtomeettheneedsofHonorsstudents.ThoughitisledbyaDean,therearenoFacultyappointmentsinADHC.

3.2DepartmentBylaws

Note: “Department Bylaws” refers to bylaws of academic Departments as well as to bylaws ofCollegesorSchoolsthatdonotcontainDepartments.

3.2.1PurposeofDepartmentBylawsEachDepartmentshalloperateaccordingtobylawswhichsetforthitsorganizationandtheproceduresforconductingitsinternalaffairs, includingvotingmembership,administrativestructure, procedures for calling and conducting Department meetings, Departmentcommittees, procedures for nominating Faculty for Emeritus/Emerita status, and theprocedure for amending the bylaws. Department Bylaws are intended to foster andencourage the widest possible degree of Faculty participation in the governance of theDepartment,createanatmospherethat isconducivetoopenandcollegialdiscussionofallmajor issuesaffectingthedailyoperationand futuredevelopmentof theDepartment,andprovide opportunities for service and for professional growth in teaching and researchwithinthespectrumof theDepartment’s activitiesforeveryFacultymemberina fairandequitableway.

3.2.2DefaultandCustomizedDepartmentBylawsThe Faculty Senate and the Provost shall formulate andmaintainDefaultDepartmentBylawswhich shall be posted on the Provost’s website. Each Department shall either adopt theDefaultDepartmentBylawsoradoptcustomizedDepartmentBylawsof itsownconstructionwhichconformtotheformatoftheDefaultDepartmentBylaws.

3.2.3AdoptionandAmendmentofDepartmentBylawsOnly Faculty (asde8ined in Section2.2.1)with a primary af8iliation in theDepartment orAcademic Unit are eligible to vote for adoption or amendment of Department Bylaws,inclusive of Faculty who are on leave (subject to University personnel policies andregulations),butexclusiveofFacultywhoholdadministrativepositionsatthelevelofDeanorabove.AdoptionoramendmentofDepartmentBylawsrequiresatwo-thirdsmajorityofthe votes cast at a duly constituted Department meeting. The proposed bylaws oramendmentsmustbedistributedtotheDepartmentmembersinwritingatleasttenbusinessdaysbeforethevote.

3.2.4ReviewofDepartmentBylawsbytheDeanandtheFacultySenateFollowingadoptionoramendmentofDepartmentBylaws,theDepartmentChairpersonshallsubmit the newor revisedbylaws (inwhich amendments to existingbylawsappear as trackchanges)totheDean,thePresidentoftheFacultySenate,andtheProvost.TheDeanandtheFacultySenateshallreviewthebylawsforconformitywiththeFacultyHandbookandotherApprovedUniversityPolicy(includingtheCollectiveAgreementbetweenNJITandthePSAandanyotherpoliciesadoptedbytheFacultyandapprovedbytheBoardofTrustees)andsubmittheirwrittenreviewstotheProvost(copiedtotheDepartmentChairperson)within8ifteen business days after receiving the new or revised bylaws from the Department.Department Bylaws shall not con8lict with or contravene any provisions of ApprovedUniversityPolicy.

3.2.5RoleoftheFacultySenateinFacilitatingApprovalTheFacultySenateshall,uponrequest,provideassistancetoacademicDepartmentsforthepurposeofattainingapprovaloftheirDepartmentBylaws.

3.2.6ApprovalofDepartmentBylawsbytheProvostAfterreceivingthereviewsfromtheDeanandtheFacultySenate, theProvostshallreviewthebylaws.IftheProvostdeterminesthatthebylawsareacceptable,theProvostshall,withinfifteenbusinessdaysafterreceivingthereviewsofthebylawsfromtheFacultySenateandtheDean, provide the DepartmentChairpersonwith written notice (copied to theDean and thePresidentofFacultySenate)thattheDepartmentBylawsareapprovedassubmitted.

IftheProvostdeterminesthatanypartoftheDepartmentBylawsisunacceptable,theProvostshall,within fifteenbusinessdays,provide theDepartmentChairpersonwithawrittennoticesettingfortheachunacceptablepassage,withanexplanationoftheproblem(s). TheProvostshall also send a copy of this correspondence to the Dean and the President of the FacultySenate.

After receiving this correspondence, the Department may prepare revisions and submitthemtotheProvost.DepartmentBylawsshallgointoeffectuponapprovalbytheProvost.

3.2.7PostingofApprovedBylawsThebylaws of eachDepartment, after being adoptedby theDepartment and approved by theProvost,shallbepostedontheDepartment'swebsite,andarecordshallalsobekeptintheProvost'soffice.DepartmentBylawsshouldshowthedateof8inalapprovalbytheDepartmentandbythe Provost in their current form under the heading at the top in the following format:“ApprovedbytheDepartmenton[date]”and“ApprovedbytheProvoston[date].”

3.3SelectionandAppointmentofDepartmentChairpersons3.3.1PrincipleofChairSelectionDepartmentChairpersonsarenominatedbytheirDepartmentsandappointedbytheDeanoftheCollege.

3.3.2TermofDepartmentChairpersons3.3.2.1StandardTermThestandardtermofaDepartmentChairpersonisthreeyears,beginningonJuly1oftheyearinwhichtheelectionoccursandendingonJune30threeyearslater.

3.3.2.2ShortenedorLengthenedTermIfanelectionoccursbecauseaDepartmentChairpersonhasnotcompletedhis/herterm,thentheappointmenttakeseffectimmediately,butthetermofappointmentisconsideredtobethreeyearsfromJuly1ofthatcalendaryear.

3.3.2.3ConsecutiveTermsandTermLimitsDepartmentchairpersonsarenormallylimitedtothreeconsecutiveterms.ADepartmentchairpersonwhoseekstobeacandidateforreelectiontoafourth(orhigher)consecutivetermrequiresauthorizationbyatwo-thirdsvoteofallFacultyintheDepartmentwhoareeligibletovote,includingthoseonleave(seeSection3.3.4).Insuchcases,theDepartmentChairpersonmustinformtheDeanofhis/herintentiontorunforanothertermasDepartmentChairpersonbyMarch15ofthelastyearofhis/herthird(orhigher)consecutiveterm.ByMarch31theDeanorganizesaspecialreferendumontheDepartmentChairperson'seligibilitytorunforanotherterm,usinganonymouselectronicvoting.

3.3.3EligibilitytoServeasDepartmentChairpersonAlltenuredFacultywithaprimaryaffiliationinaDepartmentatorabovetherankofAssociateProfessor are eligible to serve as Department Chairperson, except those who hold anadministrativepositionatorabovethelevelofAssociateDean.

3.3.4EligibilitytoVoteintheChairSelectionProcessOnly Faculty (as de8ined in Section 2.2.1) with a primary affiliation in a Department areeligible to vote for Department Chairperson, inclusive of Department Faculty on leave(subject to University personnel policies and regulations), but exclusive of DepartmentFacultywhoholdadministrativepositionsatthelevelofDeanorabove.

3.3.5ProceduresforSelectingaDepartmentChairperson

3.3.5.1StandardProcedureThe Standard Procedure is used unless the Alternative Procedure (as outlined inSection3.3.5.2)hasbeenauthorizedbytheDeanoftheCollege,inconsultationwiththeDepartment.

3.3.5.1.1 Appointment of the Elections Coordinator (EC) andTiming of the SelectionProcessWhen the position of Department Chairperson is about to become vacant—eitherbecausethe termof the currentChairpersonis expiringorbecausethecurrent Chairperson is unable to complete his/her term—the Dean of theCollege noti8ies the Provost, who selects an Elections Coordinator (EC) fromoutside the Department to oversee the process. In the event that a currentChairperson’sterminendingonJune30,theappointmentoftheECmustoccurnolaterthanApril1ofthatyear.

The election procedure shall normally conclude within twenty-8ive businessdaysoftheEC’sappointment.TheDeanshouldbeconsultedifthistimeframerequiresanextension.

3.3.5.1.2PreparationoftheListofEligibleCandidatesWithin8ivebusinessdaysofappointment,theECcirculatestoalleligiblevotingFaculty in the Department a list of all Faculty who are eligible to serve asDepartmentChairperson.Nolaterthan8ivebusinessdaysfromthedateofthisdistribution, eligible Faculty members who wish to be candidates forDepartmentChairpersonmustnotifytheECinwritingoftheirintention.

If a Departmentwishes to select its Chairpersons by means of rotation, thisobjective can be achieved, as long as the process is clearly described in theDepartmentBylaws.

3.3.5.1.3TheElectionProcessWithin tenbusinessdaysofbeing appointed, the EC distributes the 8inal list ofcandidates to all Faculty in the Departmentwho are eligible to vote. The ECsupervisesageneralelectionbysecretballotaccordingtooneofthefollowingprocedures: (1) voting at a Department meeting; (2) voting by anonymouspaperballotsinsealedenvelopes;or(3)electronicvoting,usingananonymouselectronic voting program. If the voting procedure is not speci8ied in aDepartment’s bylaws, it is determined by the EC from among these threeoptions.Whichevervotingprocedureisused,allFacultywhoareeligibletovotemusthavetheopportunitytodoso.

IfthevoteoccursataDepartmentmeeting,eligibleFacultymustbegiven8ivebusinessdaysnoti8icationof the location,dateand timeof themeeting. If thevoteoccursbypaperballotorelectronically,thenthevotingwindowmustbeatleast 8ive business days. Clear instructions onwhere to deposit paper ballotsmust be provided.With anymethod of voting, the EC shall determinewhere,when,andhowballotswillbecounted,andshallprovidethisinformationtoalleligiblevoters.

3.3.5.1.4DeterminationoftheDepartment’sNomineeAcandidatewhoisselectedbyamajorityofthetotalnumberofeligiblevotersin the Department (not just a majority of the votes cast) is declared theDepartment’snominee, and theEC forwardshis/hername to theDeanof theCollegeforapproval.

If,inthecaseofthreeormorecandidates,nocandidatewinsenoughvotestobetheDepartment’snominee,theECpromptlyconductsarun-offelectionbetweenthetwocandidateswiththehighestnumberofvotes,usingthesamemethodofvotingasintheoriginalelection.

IfnocandidatewinsenoughvotestobetheDepartment’snomineeinageneralelectionwithfewerthanthreecandidatesorinarun-offelectionbetweentwocandidates,theECshallconductanewgeneralelectiononetime,withanewlistofeligiblecandidates,usingthesameselectionprocessandmethodofvotingasintheoriginalelection.

3.3.5.1.5AppointmentbytheDeanThe Dean has sole authority to appoint the Department’s nominee as theDepartmentChairperson. If theDeanchoosesnottoappointtheDepartment’snominee,thecaseisremandedtotheProvost.IftheProvostcannotbringabouta resolution, the Provost and the Dean determine whether the Departmentshouldholdanewelection foran internalDepartmentChairpersonaccordingtotheStandardProcedure(Section3.3.5.1)orconductasearchforaninternalor external Department Chairperson according to the Alternative Procedure(Section 3.3.5.2). An Interim Department Chairperson may be appointed ifnecessary(Section3.3.6).

3.3.5.1.6DepartmentalFailuretoNominateaCandidateIfaDepartmentfailstonominateacandidatethroughtheproceduresoutlinedinSections3.3.5.1.1–3.3.5.1.4,theDeanappointstheDepartmentChairperson,withtheapprovaloftheProvost.

3.3.5.2AlternativeProcedureThe Alternative Procedure is only used when the Dean, in consultation with theDepartment, has authorized a search for a new Department Chairperson. In suchsearches, both internal and external candidates are eligible to apply. Except wherenoted below, such searches follow the guidelines for Faculty searches set down inSection2.4.1.

3.3.5.2.1FormationofaSearchCommitteeTheDepartmentelectsaSearchCommittee,normallyconsistingof8iveFacultymembers. Faculty from other Departments and representatives from otherstakeholder groupsmaybe included in the SearchCommittee, but the SearchCommitteeshouldincludeatleastoneFacultymemberfromtheDepartmentatthe ranks of Assistant Professor, Associate Professor, and Professor/Distinguished Professor unless the small size of the Department precludesdoingso.TheDeanmakesuptotwoadditionalappointmentstothecommittee.

3.3.5.2.2TheSearchProcess3.3.5.2.2.1Identi&icationofCandidatesThe Dean of the College charges the Search Committee and provides abudget for advertisingand forbringing 8inalistcandidatesto the campus.Finalist candidates meet with the Search Committee; the currentDepartment Chairperson or Interim Chairperson; the Department P&TCommittee; directors and coordinators of the Department’s programs;other Department Faculty; the Dean of the College; and, if possible, theProvost.

3.3.5.2.2.2RecommendationofCandidatesAfterthe8inalistcandidateshavevisitedthecampus,theSearchCommitteemustascertainfromtheDepartmentP&TCommitteethatcandidatesfromoutside the University qualify to be recommended for tenure uponappointment at the rank of Associate Professor or above. The SearchCommitteethenmakesits recommendationsto thedean,whoconvenesaDepartment meeting. The Department receives the Search Committee’srecommendation(s) and, after thorough consideration, determines theacceptable candidate(s) for the appointment. If any of the recommendedcandidatesarefromoutsidetheUniversity,theDepartmentP&TCommitteealsosendstheDeana recommendationtomakeahireat theappropriateFaculty rank (Associate Professor or higher), with tenure, in accordancewithSection2.4.1.3.

3.3.5.2.2.3AppointmentoftheChairpersonWith the approval of the Provost, the Dean of the College selects thesuccessful candidate from the Department’s list of nominees. If thesuccessfulcandidateisalreadyamemberoftheFacultyofNJIT,theProvostissues an appointment letter to the Chair position. If the successfulcandidate is from outside NJIT, the Provost issues an appointment letterbothtotheFacultyandtotheChairposition.AnappointmenttotheFacultyismadeunderthesametermsasotherFacultyappointments(seeSection2.4.1). Appointment to the Chair position includes the condition ofappointmenttoathree-yeartermasDepartmentChairperson.

3.3.6ActingandInterimDepartmentChairpersonsWhenthepositionofDepartmentChairpersonbecomesvacant,eitherfora 8ixedperiodoftime(e.g.,duetoillnessorasabbaticalleave)orinde8initely(e.g.,duetoresignationorlong-termdisability),theDeanof theCollege,inconsultationwiththeDepartment,appointsanActing or Interim Chairperson respectively. The Acting Chairperson serves until theChairpersonreassumesthepost.TheInterimChairpersonservesuntilappointmentofanewDepartment Chairperson, but for no longer than one year. Both Interim and ActingChairpersonsperformall the duties of the of8ice, including chairing the Department P&TCommittee.IfunforeseeablecircumstancesrequiretheextensionofanInterimChairperson’stermofof8ice,theDean,inconsultationwiththeDepartmentandwiththeapprovalof theProvost,mayrenewtheappointmentforuptooneadditionalyearfromthedateoforiginalappointmentasInterimChairperson.

3.4FederatedDepartments3.4.1BasicPrincipleofFederationUpon the recommendationof theFaculty,andwith the approvalof the administration,anacademicDepartmentorotherAcademicUnitmayfederatewithanacademicDepartmentorAcademicUnitofanotheruniversity(e.g.,RutgersUniversity,Newark)inordertoofferanexpanded program or provide better services to students and Faculty. The resulting"FederatedDepartment"existsasa full-8ledgedacademicDepartmentatbothuniversities.The appellation "FederatedDepartment" recognizes that each such Departmenthas beencreatedoutof twoseparateDepartmentsorAcademicUnits,oneatNJITand theother atanotheruniversity.

3.4.2StatusofFacultyinFederatedDepartmentsWhere a FederatedDepartment or program has been created between NJIT and anotheruniversity,theFacultymembersretainfullmembershipintheirDepartmentsattheprimaryuniversity. Recommendations regarding promotion and tenure and performance-based

salaryincreasesaremadethroughthePromotionandTenureprocessatthehomeuniversity,with input from the other university. Teaching assignments, committee activity, scholarlyresearch, leaves, support forpublicationand for travel to conferencesare all based in theDepartmentoftheprimaryuniversity.

3.4.3FormationandDissolutionofFederatedDepartmentswithRutgers-Newark3.4.3.1ProcedureforFormingFederatedDepartmentsWheneveramajorityof theFacultyinanacademicDepartmentorAcademicUnitatNJIT and amajorityof the Faculty in an academicDepartmentorAcademic Unit atRutgers-Newark each vote to establish a Federated Departmentwith each other, aproposaltofederatewillbebroughttotheNJITFacultySenateand,uponapproval,toameeting of the NJIT Faculty. The recommended federationwill be presented to theadministrationsofbothuniversitiesfor8inalapproval.

3.4.3.2ProcedureforDissolvingFederatedDepartmentsFederatedDepartmentswillreviewtheissueoffederationeverythreeyears.If,duringa review,either amajorityof themembersof anyoneunit comprisinga FederatedDepartment, or a two-thirds majority of the full membership of a FederatedDepartment, vote in favor of dissolution, the administrations of NJIT and Rutgers-Newarkwill meet to discuss themerits of, and steps to dissolve, the federation asquicklyasfeasible.Furthermore,theNJITandRutgers-NewarkadministrationsretaintheirindependentmanagerialrighttodissolveaFederatedDepartment.

3.4.4ChairpersonsofFederatedDepartmentswithRutgers-NewarkFederated Departments with Rutgers-Newark may have Department Chairpersons whoadminister the entire Federated Department or separate NJIT and Rutgers DepartmentChairpersonswhoeachhavetheauthorityandresponsibilitiesofDepartmentChairpersonsat their respective universities. Department Chairpersons of the 8irst kind are consideredmembers of the Faculty at both universities for the duration of their terms (see Section2.2.1), but Department Chairpersons of the second kind are considered members of theFacultyonlyattheirhomeuniversities.

3.4.5 PromotionandTenureProceduresforFederatedDepartmentswithRutgers-Newark

3.4.5.1TheCommitteeChairpersonTheappropriateDepartmentChairpersonofeachFederatedDepartmentshallbe theChairperson of that Department's Promotion and Tenure Committee at NJIT andPersonnelCommitteeat Rutgers-Newark. However,a Department ChairpersonfromRutgers-NewarkshallnotvotewhenNJITFacultymembersareunderconsideration,just as a Department Chairperson from NJIT shall not vote when Rutgers Facultymembersareunderconsideration.

3.4.5.2CommitteeCompositionandProcedures3.4.5.2.1NJITFacultyWhen NJIT Faculty members are under consideration by a FederatedDepartment, the membership, duties, and procedures of the FederatedDepartment's Promotion and Tenure Committee shall be in accordance withSection4.5.2,usingthecriteriainSections2.3and4.2. Inadditionto theP&TCommittee, tenuredRutgers Faculty in the FederatedDepartmentwho are ofequal or higher rank than that proposed for a candidate for appointment,reappointment,orpromotionshallbenon-votingparticipantsinthepromotionand tenureprocess. Their evaluationof the candidatewill be recorded in theform of a memorandum that will accompany the committee's formalrecommendation.

3.4.5.2.2Rutgers-NewarkFacultyWhenRutgers-NewarkFacultymembersareunderconsiderationbyaFederatedDepartment, the membership, duties, and procedures of the FederatedDepartment'sPersonnelCommittee(i.e.,P&TCommittee)shallbeinaccordancewithSectionVoftheFacultyBylawsofRutgers-Newark.TenuredNJITFacultyintheFederatedDepartmentwhoareofequalorhigherrankthanthatproposedfor a candidate for appointment, reappointment, or promotion shall be non-votingparticipantsin thepersonnelprocess; theirevaluationof the candidatewill be recorded in the form of a memorandum that will accompany thecommittee'sformalrecommendation.

3.4.5.3DeterminationofPromotionandTenure/PersonnelCommitteeandProcedures

3.4.5.3.1SpecialCircumstancesattheInceptionofaFederatedDepartmentFaculty members who are tenure-track at the inception of the FederatedDepartmentshallhavethechoiceatthebeginningoftenureevaluationofbeingevaluated only by Faculty members who would have evaluated them iffederation had not occurred, with or without vote as set forth above. If theFacultymemberchoosesthelattermethodandtheChairpersonoftheFederatedDepartmentisnotatenuredmemberofhisorherhomeinstitution,theDeanoftheCollegeinwhichthe federatedFacultymemberwasappointedshallselectoneofthetenuredmembersofthehomeinstitutiontoactasChairpersonoftheP&TCommittee.

3.4.5.3.2CircumstancesafteraFederatedDepartmentHasBeenEstablishedWithregardtoallothermembersofaFederatedDepartment,includingtenure-track Faculty hired after the inception of a Federated Department, the P&TCommitteeandproceduresoftheFederatedDepartmentshallbeineffect.

3.4.6FederatedDepartmentBylaws3.4.6.1CreationofFederatedDepartmentBylawsEach Federated Department shall devise Department Bylaws, which may notcontradict the NJIT Faculty Handbook, the corresponding document at the otheracademic institution, or the applicable collective bargaining agreements of eitheruniversity.

3.4.6.2ApprovalofFederatedDepartmentBylawsThebylawsof aFederatedDepartmentwillbe consideredtobe ineffectwhen theyhaveful8illedthestipulationsinSection3.2andtheequivalentregulationsforapprovalofDepartmentBylawsattheotheruniversity.

3.4.7StatusofFederatedDepartmentsandTheirFaculties3.4.7.1FacultyStatusintheEventofDissolutionShould a Federated Department be dissolved, NJIT Faculty shall retain full FacultystatusintheNJITDepartmentoutofwhichtheFederatedDepartmentwasformed,orinanotherappropriateDepartmentasdeterminedbyNJIT.

3.4.7.2PoliciesApplicabletoFacultyAllNJITpoliciesapplicabletoFaculty,includingcollectivebargainingagreements,willbefullyretainedforNJITFacultyinFederatedDepartments.

3.5RestructuringofAcademicUnits3.5.1Principles

Toallocateitsresourceseffectively,theUniversitymayfromtimetotimemerge,reduceordiscontinueAcademicUnits(definedinSection3.1)whentheyarenolongercentraltotheUniversity's mission or when resources must be allocated to other units deemed morecriticaltoitsmission.Suchchangesarehereafterreferredtoasrestructuring.

Although it is expected that changes in the academic structure of the University throughmerger, reduction, or discontinuance of Academic Units will occur infrequently, they arepotentially disruptive, so that procedures are needed to ensure fair treatment of Faculty,staff,andstudentshousedintheaffectedunits.TheproceduresareoutlinedinSection3.5.5.To the extent that similar issues arise in the creation of new Academic Units (includingsplittinganexistingunitintotwo),theseproceduresshouldapplytothosecasesalso.

3.5.2De\initions•“AcademicUnit”referstoadepartment,school,orcollegewithintheUniversity.• “Program reduction” refers to the elimination of part of an Academic Unit, such as asequenceofcourses,a trackorspecialty,oramajorprogramofstudywithinanAcademicUnit.• “Merger” refers to the joiningof the Faculty of two ormoreAcademic Units throughadministrativeaction,oneconsequenceofwhichcouldbeprogramreduction.• “Discontinuance”referstotheeliminationofanAcademicUnit.

3.5.3ResponsibilityandDutiesofthePresidentThe NJIT Board of Trustees has ultimate responsibility for approval of the University'smission,role,andscope,andforthedegreeprogramsofferedbytheUniversity.TheBoarddelegates to the President responsibility for administration of the University and itsprogramsof instruction,research,andservice.DecisionstorestructureAcademicUnitsarethe responsibility of the President. The President has the duty to seek the advice ofadministratorsandFacultywithintheUniversityinconsideringsuchdecisionsandtoensurethatallFacultyandstaffwhomightbeaffectedbysuchrestructuringareconsultedbeforea8inaldecisionismade,andtoensurethatthedecisiontakesintoaccounttherightsandneedsofcurrentFaculty,staff,andstudents.

3.5.4RoleoftheFacultySenateIncaseswheretheproposedrestructuringcanbeaccomplishedwithoutsigni8icant impactonFacultyappointments,theroleof theFacultySenateshallbe limitedto responsibilitiesdescribedinsection2.1oftheFacultyHandbook.Incasesthatdoresultinsignificantimpacton Faculty appointments(e.g., terminationor signi8icantchangeof dutiesof a tenuredortenuretrackappointmentbeforetheendof the timespeci8iedfor thatappointmentin theFacultyHandbook),an ad-hoccommittee(referredtohereafter as the committee)formedundertheauspicesoftheFacultySenateshallrepresentFacultyinterests,withtheintentionof ensuringappropriatereassignmentof impacted Faculty.The functionof the committeewillbetooverseetheprocedureslaidoutinSection3.5.5,step3a,toensurethattheProvostreceivesobjectiveandunbiasedinformationon thematter.Thecommitteeshallconsistofseven tenuredFacultymembers,with fourmembersappointedby theFaculty SenateandthreeappointedbytheProvost.TheProvostshallnotappointanypersonwhoiscurrentlyaDean, Assistant or Associate Dean, Assistant or Associate Provost, or Vice President. Toensurecommitteeobjectivity,duediligencewillbegivenregardingeachappointmenttothecommitteetoavoidrealorapparentcon8lictsofinterest.Inparticular,nomembersshallbeappointedfromAcademicUnitsdirectlyaffectedbytherestructuring,andnomorethantwoof the members appointed by either the Faculty Senate or the Provost shall be Facultymembers of the same college or school. The committee elects its own chairperson fromamongitsmembers.

3.5.5Procedure

When a Dean, after consultation with the Provost and any other appropriate Deans ordepartmentchairs,believesitnecessarytoconsiderrestructuringofanAcademicUnit, theprocedure herein shall be followed. In cases where the restructuring above is a merger,reduction, or discontinuanceof colleges or schools, the Provost shall perform the dutiesassignedtotheDeaninthisdocument,andthe8irstrecommendationshallbemadetothePresidentratherthantotheProvost.

1. TheDeanshallconveneameetingoftheappropriateFacultyoftheaffectedunits.AtthismeetingtheDeanshall explain the reasons for consideringrestructuringand propose theterms and conditions of any changes in Faculty status resulting from the proposedrestructuring, such as termination of Faculty positions, reassignment of Faculty,modi8ications in research or teaching assignments, changes in reporting channels, orretrainingthatwouldbeprovidedto facilitatecontinuedemploymentofFaculty.TheDeanshallasktheFacultytointroduceanyinformationinsupportofcontinuationoftheAcademicUnitor tosuggestalternatives.This informationmaybe conveyedto theDeanorallyor inwriting,individuallyoringroups,andmustbereceivedwithinareasonableperiodoftimefollowingthemeeting(normallytwoweeks).Inaddition,anyFacultymemberwithtenurewho believes that reassignment or modi8ications in research or teaching assignments istantamounttoterminationofhis/herappointmentwiththeUniversity(hereafterreferredtoasimpactedFaculty)shallinformtheDeaninwriting,providingreasonsforhis/herconcern,withinthissameperiodoftime.If,afterareasonableperiodfollowingthemeetingwiththeunitinquestion(normallytwoweeks),theDeandecidestopursuetheproposedmergerordiscontinuance,andtherearenoimpactedFaculty,heorsheshallproceedtostep2.If theDeanhasreceivedwrittenresponsesfromimpactedFaculty,heorsheshallproceedtostep2a.

2. The Dean shall convey the reasons for considering the restructuring, along with asummary of all responses received, to the Provost, Deans, and the Faculty Senate. It isexpectedthattheProvostwillconsultwiththeUCRC,GraduateCouncil,andCAAregardingacademicandadministrativeimpactoftheproposedrestructuring.Acopyofthesummaryconveyedby theDean shall be available to the Faculty in the of8ice of theAcademic Unitunder consideration.Such noti8ication is to provide opportunity to identify consequencesthatmayhavebeenoverlookedorelicitsuggestionsforalternatives.TheDeanshallallowareasonable period (normally thirty days during the fall and spring semester) for thesegroupstorespond.If,afterreceivinganyresponsesfromthesegroups,theDeandecidestoproceed with consideration of the restructuring, and no Faculty appointments are to beterminated,theDeanshallproceedtostep3.

3. TheDean shall submit a recommendationto the Provost.This recommendationshallinclude all information and advice regarding the proposed restructuring that has beenoffered by individuals or groups, including the report of the Committee and vote of theFaculty if step3ahasbeen invoked.Inall cases, theDean'srecommendation shall includeproposed provisions to allow students already enrolled to complete their degreerequirements.

4. TheProvostisresponsibleforreviewingtherecommendationforrestructuringfromtheDean,and forensuringthatall steps in theseprocedureshavebeenfollowed.TheProvostmayaskforadditionalinformationorclari8icationconcerningitemsincludedintheDean'srecommendation,andmayseekadvicefromknowledgeablepartiesoncampusorelsewhere.The Provost shallmake a 8inal recommendationto the President,which recommendationshallbemadepublic.

5. ThePresident,afterstudyingtherecommendationfromtheProvost,andobtaininganyadditionalinformation,clari8ications,oradvicethatheorshethinksnecessary, shallmake

the decision whether to restructure the Academic Units. If the President decides torestructureunits,provisionsshallbemadetoallowstudentsalreadyenrolledtocompletetheirdegreerequirements.Everyeffortwillbegivento8indingcontinuedemploymentattheUniversityforadministrative,technical,orclericalstaffmemberswhosejobsmightbelost.

2a. If theDeanhas receivedwrittennotice fromaffectedFaculty in step2, theDeanshallinformtheFacultySenate.Withinareasonableperiod(normallytwoweeks),theDeanshallconvene a secondmeeting of the Faculty of the affected units, with members of FacultySenateinvited,andconveytothemasummaryofwhateverinformationhasbeenassembledandthealternativessuggested.TheDeanshallprovideawrittenstatementexplainingplansfor all impactedFacultymembers. If the Dean’s plan is acceptedby the impactedFacultymembers,theDeanshallproceedtostep2.Otherwise,theDeanshallcontinuewithstep3a.

3a. Those impacted Faculty not satisfied by the Dean's written plan shall indicate theirconcerns to the Dean in writing within a reasonable period (normally two weeks),requestingthattherestructuringbereviewedbytheFacultySenate,andthecommitteeshallbe constituted. The purpose of the committee’s work shall be to provide objective andunbiased information on the matter to the Faculty Senate and the Provost. The FacultySenate shall request the committee to determine whether the restructuring is based onsound educational considerations. Examples of factors that may be considered includeprogramviability(basedondemandforaprogramandthepotential forgrowth),and theneedtoavoidduplication,or toeffect economiesinmanagement,or to strengthenrelatedprograms. An Academic Unit's record of excellence will be a consideration in decisionsregarding soundness of the restructuring, but will not be the sole deciding factor. Thecommitteeshallhavea summaryofalldatagatheredandshallhaveaccessto theoriginalmaterialsfromwhichthesummaryhasbeencompiled.Thecommitteeisfreetogatherothermaterial at its discretion; it may seek advice from knowledgeable parties on campus orelsewhere. Normally the committee should complete its work within thirty days. Thecommittee shall convey its report to the Faculty Senate, who then shall make arecommendation regarding acceptance. The report and the Faculty Senate acceptancerecommendationwillbepresentedtotheUniversityFacultywhowillvoteonconcurrence.Thecommittee’sreport,togetherwiththeFacultySenate’srecommendationandthevoteoftheFaculty,shallbeconveyedtotheDean,whoshallthenproceedtostep3.

PARTFOURPROMOTIONANDTENURE

4.1GeneralPrinciplesGoverningthePromotionandTenureProcessThepromotionandtenureprocessisgovernedbytheprinciplesofcollegiality,professionalism,andintegrity.Facultyunderreviewhavetherighttobetreatedrespectfullythroughouttheprocess,tobetoldclearlyandregularlywhatisexpectedoftheminordertoobtainpromotionandtenure,andtobe judged fairly at each stage of review. Faculty have the responsibility to submit all necessarymaterials in a timely fashion, including annual summaries of scholarly research, service, andteaching activities and accomplishments, and more comprehensive dossiers or portfolios thatdocumentallachievementsandcontributionsbytheFacultymemberatthetimeoftheThirdYearReview, during the period of tenure eligibility, and whenever a Faculty member is underconsiderationforpromotion.

4.2CriteriaandGroundsforAssessment4.2.1GeneralConsiderationsTobeconsideredforpromotiontoahigherrank,orfortenure,aFacultymembermustmeet

the criteria stated in Sections 2.3.1 and 4.2.2. Additional discipline-speci8ic criteria forpromotionandtenurewillbedeterminedbytheDepartmentP&TCommittees,asdescribedinSection4.5.2.3.1.

All evaluationsandall recommendationsto theProvostshallbemadeby theDepartmentandUniversityCommitteesonPromotionandTenure(P&TCommittees)andtheDeans,inaccordancewiththecurrentproceduresadoptedbytheFaculty.

4.2.2TeachingEffectiveness,ScholarlyResearch,andService4.2.2.1TeachingEffectivenessAs teaching is central to the purpose of the New Jersey Institute of Technology, itseffective practice is an essential and primary criterion in the evaluation of thequali8icationsofeveryFacultymember.

Theprincipalgroundsforassessmentincludestudentevaluations;peer evaluations;developmentofnewcourses,curricula,andcoursematerials;nominationsandawardsforteachingexcellence;evidenceofsuccessfulmentoringofstudents,asdemonstratedby senior theses and projects, master’s theses, doctoral dissertations, and otherstudentacademicaccomplishments;and letters fromformerstudentsthatmayhavebeensolicitedbytheDepartmentChairperson(seeSection4.2.3below).

4.2.2.2ScholarlyResearchAs a public research university, NJIT expects all Faculty to make substantialcontributionstoscholarlyresearch*intheir8ieldsofexpertise.

The principal grounds for assessment include peer-reviewed books, articles, bookchapters,andcreativeworks;otherpublicationsandperformancesthatarenotpeer-reviewed;citationsandpublishedreviewsofaFacultymember’sscholarlyresearch;honorsandawardsthatrecognizeaFacultymember’sscholarlyresearch;prestigious,competitive fellowships and grants; invited lectures; conference talks and posters;professionalpractice; and external peer review letters, solicited by the DepartmentChairperson, which testify to a Faculty member’s accomplishments in scholarlyresearch(seeSection4.2.3below).

4.2.2.3ServiceIn addition to teaching and research, all Faculty members are expected to makesubstantialcontributionstotheirDepartmentsanddegreeprograms,theirCollegesorSchools, and the university as a whole, as well as to their professional disciplines.Relevantservicetothecommunityisalsovalued.

TheprincipalgroundsforassessmentincludemembershiponDepartment, College/School,anduniversitycommittees;achievementsrelatingtoestablishingandrunningacademicprograms,includingprogramadministrationandrecruiting;contributionstoNJITstudentactivities,suchascareermentoring,athletics,andservingasadvisorofastudent society; participation in NJIT pre-College programs; professional service toone’s discipline(s) (especially in a leadership capacity); including involvementwithprofessional societies, service to scholarly journals, providing evaluations ofmanuscripts or applications for grant agencies (e.g., NSF, NIH, NEH) or publishers;professionalconsulting that contributes to the reputationof a Facultymember andNJIT;andpublicorcommunityservice,suchascontributionstopublicagencies;andletters from Faculty, administrators, and/or former students, solicited by theDepartment Chairperson, which testify to a Faculty member’s accomplishments in

service(seeSection4.2.3below).

4.2.3ReferenceLettersTwo categories of reference letters are used in the promotion and tenure process: (1)external peer review letters, whichmainly evaluate a Facultymember’s contributions toscholarly research, and (2) additional reference letters, which mainly evaluate a Facultymember’scontributionstoteachingandservice.

4.2.3.1ExternalPeerReviewLettersDocumentationof accomplishments in scholarly research requires reference lettersfromrecognizedexpertsinaFacultymember’s8ield(s).Suchlettersshouldbesolicitedby the Chairperson of the Department P&T Committee in consultation with themembersof theDepartmentP&TCommittee.Someof thepeerreviewersshouldbechosenfromalistsubmittedbythecandidate,whileothersshouldbeselectedbytheDepartmentP&T Committee.None should be colleaguesat NJIT. A Facultymemberunderreviewmayrequestthatcertainpotentialreviewersnotbechosen.

IftheDepartmentP&TCommitteerecommendsaFacultymemberforpromotionand/ortenure,allpeerreviewlettersthathavebeenreceivedmustbe includedwiththematerials that the Department transmits to the Dean (i.e., the Department P&TCommitteemay not include some reference letters and excludeothers). The lettersshouldbeaccompaniedbyinformationabouttheprofessionalquali8icationsofeachofthepeer reviewersandbycopiesofall communicationswith themin regardto thismatter. Peer reviewers should be assured that their letters are kept con8idential,shown only to those directly involved in the promotion and tenure process (withexceptions only in response to lawfully executed and issued subpoenas), and notshown to the candidate. After the promotion and tenure process is complete, thelettersareheldinsafekeepingbytheProvost.

4.2.3.2AdditionalReferenceLettersTheDepartmentP&TCommitteemaysolicitadditionalreferencelettersfromamongFaculty and administratorswithwhom a Facultymember has interacted closely, atNJIT or another institution. Such letters aremainly intended to testify to a Facultymember’scontributionstoinstitutionalandprofessionalserviceactivities.

TheDepartmentP&TCommitteemayalsosolicitadditionalreference letters fromaFaculty member’s former students, in order to provide evidence about a Facultymember’scontributionstoteachingandstudent-relatedserviceactivities.

AlladditionalreferencelettersmustbesolicitedbytheChairpersonoftheDepartmentP&T Committee,not by Facultymembersunder review. However, FacultymembersunderreviewmayprovidetheChairpersonwiththenamesandaddressesof,andthenature of his/her interaction with, the individuals whom they would like theChairpersontocontactforthispurpose.IfaDepartmentP&TCommitteerecommendsa Faculty member for promotion and/or tenure, all additional reference letterssolicitedinthismanner—alongwithcopiesofallcommunicationsinregardtothem—must be included among the materials sent to the Dean (i.e., the Department P&TCommitteemaynotincludesomereferencelettersandexcludeothers).

Additional reference letters from studentsmust be kept con8idential, and studentsshouldbeassuredthatthisisthecase.Otheradditionalreferencelettersmayormaynot be consideredcon8idential,depending on Departmentpolicy and arrangementswiththewriterofeachreferenceletter.

4.3Tenure4.3.1TenurePolicyAcademic tenure is granted to Facultymemberswho have demonstrated their 8itness forpermanent membership on the Faculty by means of a record of excellence in teaching,scholarly research, and service. Such Faculty are characterized not only by their pastaccomplishmentsbutalsobythepromiseofoutstandingfutureachievement.

AlthoughtenuredFacultymembersmayserveasadministrators,theirtenureappliesonlytotheirFacultyposition,nottotheiradministrativeposition.

4.3.2AwardingofTenureThe Board of Trustees grants tenure on the recommendation of the President of theUniversity.Althoughtenuremaysometimesbegrantedatthetimeofappointment,towell-quali8iedFacultywho join theuniversity at or above the rankofAssociateProfessor (seeSection2.4.1.3), tenure ismore commonlygrantedonly after a seriesof rigorous reviewsand evaluations by Department P&T Committees, Deans, the University Committee onPromotion and Tenure, and the Provost. Tenure becomes effective on the 8irst day of theacademicyearfollowingthegrantingoftenurebytheBoardofTrustees.

4.3.3Tenure-TrackPeriod(TTP)ThetermTTPshallrefertotheperiodduringwhichtheFacultymemberholdsatenure-trackappointmentatNJITpriortobeingtenured.DuringtheTTP,theFacultymemberisevaluatedfortenure.

Appointmentduring the TTP shall normally be for a period of one year at a time and issubjecttorenewal.TheTTPalwaysbeginsatthestartoftheacademicyear inthefall.Forpersonshiredatmid-year,theTTPwillcommenceatthestartofthefollowingacademicyear.

Unless theTTPhas been extendedaccording to the proceduresdiscussed below, theTTPshallnotexceedsevenyears,whichisthestandardTTPforanAssistantProfessor.DuringtheTTP, a decisionmustbe reachedto eitheraward tenureor terminateappointment.In thelattercase,aterminal-yearappointmentwouldbewithintheallowedTTP.

4.3.3.1ShortenedTenure-TrackPeriodTheTTPofuntenuredFacultywhoareappointedwithapriorrecordofteachingandresearchmaybethestandardsevenyearsorashorterperiod,butnotlessthanfouryears. In such cases, the duration of the TTP is determined at the time of hire bymutual agreement of the Provost—acting on the recommendation of the hiringDepartmentP&TCommitteeandtheDean—andthecandidateforaFacultyposition.

4.3.3.2ExtendedTenure-TrackPeriodInspecialcircumstances,suchasaneventthatseverelyimpedesaFacultymember’sabilitytoperformhis/herprofessionaldutiesforaperiodoftime(includinganillnessto a Faculty member or a member of his/her family, or primary care given to anewborn or newly adopted child), the TTP may be extended. Normally, such anextensioncan occur only onceduring theTTP and can last nomore than one year.ExceptionstothisrulecanbegrantedbytheProvost.

InordertoreceiveanextensionoftheTTP,aFacultymembermustsubmitawrittenrequesttotheDepartmentP&TCommitteeinatimelyfashion,explainingindetailthereason(s) for the request.TheDepartmentP&TCommitteereviewsthe requestandmakes a recommendation to the Dean. The Dean forwards the Faculty member’srequestandtheDepartmentP&TCommittee’srecommendation,alongwiththeDean’s

ownrecommendation,totheProvost,whoeitherauthorizesordeniestheextension.

If a request for an extension of the TTP ismade during the Third Year Review, noextensionwillbegrantedunlessthereviewresultsinreappointment.

Application for a leave of absence for personal reasons, or election to use theUniversity’s Active-Service Modi8ied-Duties Policy to care for a newborn or newlyadopted child, does not obligate an untenured Faculty member to apply for anextensionoftheTTP,nordoesitreplacetherequirementforaformal,writtenrequest,shouldtheFacultymemberdesireaTTPextension.

4.3.4TenureinRelationtoPromotionduringtheTenure-TrackPeriodUntenuredFacultymemberswhoholdtherankofAssistantProfessorarealsoevaluatedforpromotiontoAssociateProfessor(seeSections2.3.1.1–2.3.1.2)duringtheTTP.TheawardoftenureandpromotiontotherankofAssociateProfessornormallyoccursimultaneously.Inexceptionalcircumstances,anAssistantProfessormaybepromotedtoAssociateProfessorprior to receiving tenure, but an AssistantProfessor cannot receive tenureprior to beingpromotedtoAssociateProfessor.

4.3.5EligibilityforTenureTheperiodofeligibilityfor tenurerefersto thespeci8icyear(s)withintheTTP inwhichaFacultymembercanbeconsideredfor,andgranted,tenure.

4.3.5.1FacultywithaStandard(7-Year)Tenure-TrackPeriod4.3.5.1.1TenureConsiderationduringtheFifthYearA Faculty member with a 7-year TTP will be 8irst eligible for tenureconsiderationduring the 8ifthyear. If theDepartmentP&TCommitteedecidesnottorecommendaFacultymemberfortenureduringthe8ifthyear,notenurerecommendation shall be forwarded to the Dean at this time. In general,recommendation for tenure in the 8ifth year should be reserved for Facultymemberswhohaveexceptionalcredentialsbythistime.Itshouldnotbeviewedasatrialperiodforconsiderationduringthesixthyear,andthereshouldbenostigmaattachedtonotbeingrecommendedfortenureinthe8ifthyear.

4.3.5.1.2TenureConsiderationduringtheSixthYearIfaFacultymemberhasnotbeentenuredinthe8ifthyearorhadhis/herTTPextendedaccordingto the stipulationsinSection4.3.3.2, theDepartmentP&TCommitteemustforwardarecommendationtotheDeaninthesixthyear,eitherfororagainsttenure.Thesixthyearisthelastyearoftenureeligibility.

4.3.5.1.3RightofAppealandTerminalYearIf a Faculty member in the sixth year of tenure eligibility has not beenrecommendedfor tenure by his/herDepartmentP&T Committee, the Facultymember may seek reconsideration of the decision by the Department P&TCommittee (see Section 4.5.2.3.5),and then, if necessary,mayappealdirectlytotheDeanandtheUniversityCommitteeonPromotionandTenure(seeSection4.5.2.3.6).Iftenureisdenied,aterminalone-yearappointmentshallbegivenforthesubsequentyear.Thatis,thelastyearoftheTTPbecomestheterminalyear.

4.3.5.3FacultywithaShortened(4–6year)Tenure-TrackPeriodInthecaseofaFacultymemberwhoseTTPhasbeenshortenedthroughtheprocessstatedinsection4.3.3.1,the8irstyearoftenureeligibilitywillbethepenultimateyearoftheTTP(e.g.,iftheTTPisfouryears,tenureeligibilityoccursduringthethirdyear).Aformalreviewfortenuremustbeconductedatthistime,andtherecommendationoftheDepartmentP&TCommitteeshallbeforwardedtotheDean.Iftenureisdenied,aterminalone-yearappointmentshallbegivenforthesubsequentyear,subjecttotherightofappealstatedinSection4.5.2.3.6.Thatis,thelastyearoftheTTPbecomestheterminalyear.

4.3.6EvaluationofUntenuredFaculty4.3.6.1AnnualReviewA review of the progress of untenured Faculty shall be made each year by theDepartmentChairperson, in consultationwith theDepartmentP&TCommittee.Theresultof that reviewmustbe communicated to theFacultymember inwriting.TheFaculty member should be made aware of the Department P&T Committee’sexpectations for tenureandpromotion, andeveryeffort shouldbemade to suggeststrategiesforhelpingtheFacultymembertoattainthatgoal.

4.3.6.2ThirdYearReviewDuring the third year of the TTP, the Department P&T Committee carries out anintensive, documented review of a Faculty member’s progress toward tenure andpromotion. The Third Year Review evaluates all aspects of a Faculty member’sprofessionalactivitiesandaccomplishmentsandissimilartoa tenurereviewduringthe period of Tenure Eligibility, except that no reference letters are sought fromoutsideor insidetheuniversity.TheFacultymemberunderreviewshallbe formallyapprisedoftheresultsoftheThirdYearReviewbytheDepartmentChairperson,whosendsthewrittenreviewtotheDeanoftheCollege,whoforwardsittotheProvost.

If the Third Year Review establishes that satisfactory progress is being made, thereview normally includes a recommendation to the Dean for retaining the FacultymemberuntiltheperiodofTenureEligibility.IftheThirdYearReviewconcludesthataFaculty member’s progress is unsatisfactory, the Department P&T Committee mayrecommendto the Dean either to terminate the appointmentor to re-appointwithconditionsthatmustbemetinordertocontinuetheappointmentuntiltheperiodofTenureEligibility.

4.3.6.3TenureEligibilityReviewDuringtheperiodoftenureeligibility,theDepartmentP&TCommitteeshallconductan intensive documented review of a Facultymember’s quali8ications for tenure—includingexternalpeerreviewlettersandadditionalreferenceletters—andshallmakearecommendationtotheDean,inaccordancewithSection4.5.2.3.3.

4.3.7Non-ReappointmentandAppealPriortotheTenureEligibilityPeriod4.3.7.1Non-ReappointmentEveryuntenuredFacultymembershallbeconsideredforreappointmentbyhisorherDepartmentP&TCommitteeonanannualbasis.TheDepartmentrecommendationisthen submitted to the appropriate Dean, and by the Dean to the Provost. If theDepartmentrecommendationisfornon-reappointment,duetoafailureoftheFacultymember to meet the Department's performance standards regarding teaching,

scholarly research, and service, and if the Dean and Provost concur, the Facultymembershallreceiveanoticeofterminalassignmentconsistentwiththecontrollingcollectivebargainingagreement.

4.3.7.2Noti&icationandAppealIf a Department P&T Committee makes a preliminary decision to recommend anuntenuredFacultymemberfornon-reappointment,theDepartmentChairpersonmustinformtheaffectedFacultymemberpriortotakinganyfurtheraction.AtthattimetheChairpersonmust also inform the Facultymember that he or she has the right tosubmit a written appeal. If, after considering an appeal, the Department P&TCommittee votes to recommend non-reappointment, this recommendation isforwardedbytheChairpersontotheDeanandthentotheProvostina8ilecontainingawrittenstatementofthereasonsfortherecommendationandanyappealletteroftheFacultymember.This8ilemustbereviewedbyboththeDeanandtheProvostbeforeaterminalappointmentletterissenttotheFacultymember.

4.3.8StaffReductionShouldreductioninthefull-timeteachingstaffbecomenecessary,thoseholdingtenureshallbegivenpreferenceforcontinuedemploymentover thosenotholdingtenureandshallberetainedasfaraspracticableaccordingtoseniority.Intheeventstaffisrehired,tenuredstaffshallberehired8irst,accordingtoseniority.Noindividualreductionsinbasesalaryaretobemade for persons on tenure unless 8iscal exigencies warrant a salary decrease for allmembersofthestaff,andthensuchreductioninsalaryshallbeonanequitablebasis.

4.3.9RemovalProceduresIf conditions arise that, in the opinion of the President of the University, may warrantremovalof a tenuredFacultymember, theFacultymemberhas theoptionofbringing thecasebeforetheExecutiveCommitteeof theFacultySenate.Thiscommitteeshallreport totheFacultySenateatameetinginclosedsessiontodecideonacourseofaction.TheFacultySenatewill then submit its 8inal report to the Board of Trustees,whichwillmake a 8inaldetermination.

4.4Promotion4.4.1AwardingofPromotionAllacademicpromotionsareconferredbytheBoardofTrusteesontherecommendationofthe President, after a series of rigorous reviews and evaluations by Department P&TCommittees,Deans,theUniversityCommitteeonPromotionandTenure,andtheProvost.

4.4.2PromotiontoAssociateProfessorAs stated in Sections 2.3.1.1 and 4.3.4 above, the process of promotion from AssistantProfessor to Associate Professor is normally identical to the process of earning tenure,although in exceptional circumstances a Faculty member may be promoted to AssociateProfessorbeforereceivingtenure.

4.4.3PromotiontoProfessor4.4.3.1AnnualReviewFacultyattherankofAssociateProfessorareeligibleforconsiderationforpromotioneachyearandshallbereviewedannuallybytheirDepartmentP&TCommittees.

4.4.3.2RecommendationforPromotiontoProfessorIf, after a full, intensive, and documented review—including external peer reviewletters and additional reference letters—a Department P&T Committee determinesthatanAssociateProfessormeets the criteria for the rankofProfessor(see section

2.3.1.3),itmaymakearecommendationforpromotiontotheDean,inaccordancewiththeproceduresstatedinSection4.5.2.3.3.

4.4.4PromotiontoDistinguishedProfessorNominationsforpromotiontotherankofDistinguishedProfessormaybemadedirectlytotheProvostbyanymemberoftheFacultyorbyaDepartmentP&TCommittee.TheProvosttransmits such nominations to the Distinguished Professors Committee, consisting of allFacultymemberswhoholdtherankofDistinguishedProfessorexcepttheProvostandthePresident. The Distinguished Professors Committee processes and reviews all suchnominationsandsendsitsrecommendationstotheProvost,whoconferswiththePresident.ThePresidentthenmakesrecommendationsforpromotiontotheBoardofTrustees.

4.5PromotionandTenureProcedures4.5.1GuidelinesandNoti\icationsNot later than September 15 each year, the Provost shall transmit to all Faculty andInstructional Staff, academic Departments, Colleges and Schools—as well as post in anaccessiblelocation—guidelines,includinganychangesinproceduresthatmayhaveresultedfromFacultyorAdministrativeaction,thePSAContract,orAf8irmativeAction,concerning:•PromotionandTenure•Reappointmentandterminationornon-renewalofcontract•ThirdYearReviewoftenure-trackFaculty

Theseguidelinesshallspecifytheprocedurestobefollowed,andthedeadlinestobemet,inthe preparation and submission of dossiers containing the credentials of each Facultymember under review, the solicitation of external reference letters, the formulation ofdiscipline-speci8iccriteria forpromotionand tenure, theprocesses for reappointmentandtermination or non-renewal of contracts, and other relevant information. No material insupportofrecommendationsforanycategoryshallbeduebeforeOctober15.

Also not later than September 15, the of8ice of the Provost shall notify Faculty of theprocedure and deadline for completing the Faculty Annual Report, documenting theirresearch, service, and teaching activities and accomplishments for the previous academicyear.

4.5.2TheDepartmentPromotionandTenure(P&T)Committee,and theRoleof theDeans

4.5.2.1Membership4.5.2.1.1Composition4.5.2.1.1.1GeneralPrincipleofCompositioninAllAcademicUnitsTheDepartmentP&TCommitteeshall consistof all tenuredFacultywithprimary appointments in the Department, except administrators above thelevelofAssociateDean.InaCollegeorSchoolwithoutDepartments,theCollegeor School P&T Committee shall consist of all tenured Faculty with primaryappointmentsintheCollegeorSchool,exceptadministratorsabovethelevelofAssociateDean.

4.5.2.1.1.2CompositeDepartmentP&TCommitteeEachDepartmentP&TCommitteemusthaveatleastthreemembersatorabovetherankofProfessor.Ifnecessary,theDeanandtheDepartmentChairpersonshalljointlyrecommendto theProvostone (or if necessary,twoor three)eligible Facultymembers, as defined in 4.5.2.1.1.1, at or above the rank ofProfessor from outside the Department to make up the requisite three

members, normally serving three-year renewable terms. In the case ofFederated Departments, one of these individuals may be a colleague ofappropriaterankintheFederatedDepartment.AllCompositeDepartmentP&TCommitteesmustbeapprovedbytheProvost.

4.5.2.1.2Chairperson4.5.2.1.2.1Department Chairpersonas Chairperson of theDepartmentP&TCommitteeUnless subject to the exception noted in Section 4.5.2.1.2.2 below, theDepartment Chairperson, serves as the Chairperson of the DepartmentP&TCommitteeandisinvolvedindeliberationsandvotingonallmatters,regardlessofrank.

4.5.2.1.2.2 Exception When the Department Chairperson Is an AssociateProfessorAnAssociateProfessorwho is servingasDepartmentChairpersonand ishimself/herself being considered for promotion or annual review mustrecusehimself/herself fromallparticipation inhis/herowncase. Insuchinstances, the Professors and Distinguished Professors shall elect amongthemselves anActingChairpersonof theDepartmentP&TCommittee forthis purpose only. The Acting Chairperson shall assume all duties andresponsibilitiesrelatingtothesecases,includingcommunications,actions,and appeals, and his/her appointment shall end as soon as these caseshavebeenresolved.

4.5.2.1.2.3ChairpersonofaCollegeorSchoolP&TCommitteeTheP&TChairpersoninaCollegeorSchoolwithoutdepartmentsshallbeaProfessor or Distinguished Professor elected annually by the College orSchool P&T Committee. In such cases the Dean of the College or Schooldoes not participate in deliberations or voting in the P&T Committee oncasesinvolvingpromotionandtenure.TheP&TCommitteemayinvitetheDeantomakeapresentationtothecommittee.TheChairpersonoftheP&TCommittee reports to the Dean, who performs the same role in thepromotionandtenureprocessastheDeansoftheothercolleges.

4.5.2.2DutiesThe Department P&T Committee jointly makes all decisions regardingrecommendations forFacultyhiring,evaluation,promotion,tenure,and terminationornon-renewalof contractwithintheDepartment.Speci8ically theDepartmentP&TCommitteewill•ProvideadviceandconcurrencetotheDepartmentP&TCommitteeChairpersoninthehiringofFaculty.• Communicatethrough its Chairpersoneachcaseof terminationor non-renewalofcontract with the Dean of the College or School concerned before sending arecommendationtotheDean.•Reviewtherecords,includingFacultyAnnualReviews,ofallDepartmentmemberswho are candidates for promotion and/or tenure, to determine who meets therequirementsforpromotionand/ortenure.•AssisttheChairpersoninevaluatingeachFacultymemberwhoisnotamemberoftheDepartmentP&TCommittee.• ConductaThirdYearReviewof eachnon-tenuredFacultymemberduringhis/herthirdyearsincehire.•MakepromotionandtenurerecommendationstotheDeanoftheCollegeorSchool,whosendsthemtotheUniversityCommitteeonPromotionandTenure.

4.5.2.3Procedures4.5.2.3.1Compliance,CriteriaandCon8identialityAlldecisionsonpromotionandtenuremustbeincompliancewithDepartmentanduniversitygoals.Af8irmativeactionconsiderationsshallbeacomponentofthese decisions. Each Department P&T Committeewill determine criteria forpromotion and tenure consistent with the discipline(s) represented in theDepartment and with the general university criteria specified in the FacultyHandbook,andthosecriteriawillbetransmittedwitheachcandidate’sdossiertotheDean,accordingtotheguidelinesdistributedbytheProvost(seeSection4.5.1).TheDepartmentP&TCommitteemustmaintainadequatewrittenrecordsof its deliberations. In view of the sensitive nature of the proceedingsof theDepartment P&T Committee, con8identiality shall be maintained by themembers of the committee. All communications shall be made through theDepartment P&T Committee Chairperson. During the period of committeedeliberations,it isdeemedinappropriateforcandidatestodiscusstheirstatusexceptwiththeDepartmentP&TCommitteeChairpersonorthefullcommittee.

4.5.2.3.2VotingProcedureAllmembersofaDepartmentP&TCommitteeshallbeeligibletodeliberateandvoteon allmattersunder considerationby the committee,with the followingexceptions: (1) Tenured Associate Professors serving as DepartmentChairpersons are subject to the restriction in Section 4.5.2.1.2.2; (2) TenuredAssociateProfessorsshallnotparticipateindeliberationsandvotingonannualreviewoftenuredAssociateProfessorsandoncasesinvolvingpromotionabovetheir rank. After discussions of the quali8ications of all candidates forpromotion,tenure,reappointmentandtermination,thecommitteewillvoteonthe candidates in accordance with the established criteria. Candidates forpromotion and tenure receiving a majority will be recommended, with thenumerical vote recorded. The vote of the Chairperson will be speci8ied andincludedinanyrecommendationsenttotheDean.TheindividualvotesofothermembersoftheDepartmentP&TCommitteewillnotbeidenti8ied.

4.5.2.3.3SubmissionofRecommendationsRecommendations for tenure and for promotion to the ranks of AssociateProfessor or Professor are submitted to the Dean. Before any reports aresubmittedtotheDean,theDepartmentP&TCommitteeChairpersonmustnotifyeach Faculty member being considered, in writing, of the Department P&TCommittee'sdecision,andeachFacultymembershallbegivenanopportunitytomeetwiththeDepartmentP&TCommitteetoreviewhisorhercase(seeSection4.5.2.3.5).

The Department P&T Committee Chairperson shall submit recommendationsand supportingmaterial to theDeanno later than the dates speci8ied for thevariouscategoriesbytheProvost(Section4.5.1).Anymaterialsubmittedbythecandidate to the Department P&T Committee Chairperson after the datesspeci8iedbytheProvostwillbeaccepted,butwithnoassurancethatitwillaffectthedeliberationsoftheUniversityPromotionandTenureCommittee.Aminorityreportsupportedbyat leastonethirdoftheDepartmentP&TCommitteemayaccompanyanyrecommendation.Allreports,bothmajorityandminority,willbeavailable to every member of the Department P&T Committee beforesubmissiontotheDean.

4.5.2.3.4ActionbytheDean

After receivingthe supportingmaterial from theDepartmentP&TCommittee,theDean renders a judgmenton the case (recommendedornot recommended),supportedbyawrittenevaluation,whichisaddedtoeachcandidate'sdossier.TheDean then submits the dossier to the University Committee onPromotion andTenureandsendsacopyofhis/herjudgmentandevaluationtotheChairpersonofthe candidate's Department P&T Committee, for distribution to the entirecommittee.

4.5.2.3.5ReconsiderationofaNegativeRecommendationA member of the Faculty who has held the rank of Assistant Professor orAssociate Professor for at least 8ive years and who has been eligible forconsiderationforpromotionforatleasttwoyears,orwhoisinhis/herlastyearof eligibility for consideration for tenure but has failed to receive a majorityrecommendation from his/herDepartmentP&T Committee,may request andmustbegrantedanopportunitytomeetwiththeDepartmentP&TCommitteepriortothesubmissionofitsrecommendationstotheDean.Atthismeeting,theFacultymembermay present, orally and in writing, the reasonswhy he/shebelievesarecommendationfortenure,and/orpromotioniswarranted.

4.5.2.3.6AppealingaNegativeRecommendationIf, after further deliberation, the Department P&T Committee upholds itsoriginaldecisionandif,uponnoti8ication(whichshallbewithinoneweek),theaffectedFacultymemberdoesnotaccept thisdecision,he/shemaysubmitanappealinwriting,alongwithanypertinentmaterial,totheDean,whotransmitsit to the University Committee on Promotion and Tenurewith an evaluation.ThisshallbedonenosoonerthanoneweekandnolaterthaneightweeksafterthemeetingwiththeDepartmentP&TCommittee,whichmustbeadvisedoftheFacultymember'saction.TheDepartmentP&TCommitteemayforwardareportsupporting its decision to the Dean, who transmits it to the UniversityCommitteeonPromotionandTenurewithanevaluation.Aminorityreportofone or more members may also be submitted. For promotion, the Facultymembermayexercise theappealproceduredescribedaboveonceeverythreeyears;fortenure,onlyinthelastyearofeligibilityforconsiderationfortenure.

4.5.3TheUniversityCommitteeonPromotionandTenure4.5.3.1MembershipTheUniversityCommitteeonPromotionandTenureistobeconstitutedsoastohavethreemembersdirectly appointedby the Provost and fourmembers chosenby theProvost from a slate nominated by Faculty Senate. The Provost will strive for amaximumrangeofdisciplinesandDepartmentstoberepresentedonthisCommittee.AllmembersmusthavetenureattherankofProfessororhigher.ThreeruleswillbeappliedtodeterminethecompositionoftheUniversityCommitteeonPromotionandTenure:(1)thereshallbeatleastonerepresentativefromeachofthe8iveCollegesorSchools, (2) there shall be two representatives from each of the two Colleges orSchools with the largest numbers of tenured and tenure-track Faculty, and (3) norepresentative shall hold an administrative title at or above the level of AssociateDean.TheUniversityCommitteeonPromotionandTenurewillselectitsChairpersoneachyear.

Memberswillservethree-yeartermsandwillnotbeeligibletoservemorethanthreeyears in any consecutive six-year period. This shall not include time served as areplacementforamemberwhowasunabletocompletehisorherterm.InMarchofevery year, or whenevernecessary, each Departmentwill nominate a candidate for

eachFacultySenate-designatedCommitteevacancy.ThenameofthenomineeisthentobesubmittedtotheFacultySenate.ByMay1,theFacultySenatewillrecommendtothe Provost, fromamong the names submittedto it, two persons for each availableposition.TheProvostwillmakethe8inalchoice fromtheserecommendations.Intheevent that a committee member is unable to complete his or her term, the sameprocedurewillbeemployedtosecureareplacement,whowillserveonlytotheendoftheunexpiredterm.

Amemberof theUniversity Committee onPromotion andTenureshallnot sit onaDepartmentP&TCommitteewhileservingontheUniversityCommitteeonPromotionandTenure,excepttoparticipateindeliberationsnotrelatedtopromotionandtenure.HeorsheshallnotbeapartytoanydeliberationsbyaDepartmentP&TCommitteewhichmightinvolvediscussionsanddecisionsonmattersthathavetobereportedtotheUniversityCommitteeonPromotionandTenure.

4.5.3.2DutiesThe University Committee on Promotion and Tenure will receive and consider therecommendationsfromtheDepartmentP&TCommitteesandtheDeans’evaluationspertaining to promotion and tenure, and will pass along to the Provost anyDepartment P&T Committee recommendations in addition to its ownrecommendations.TheUniversityCommitteeonPromotionandTenuremayalsoserveas an advisory body to the President if requested. The University Committee onPromotionandTenuremustmaintainadequatewrittenrecordsofitsdeliberations.

4.5.3.3Procedures4.5.3.3.1Con8identialityMembersoftheUniversityCommitteeonPromotionandTenuremustmaintainstrict con8identiality. Any questions regarding committee business shall bedirectedtoitsChairpersonalone.

4.5.3.3.2VotingTheUniversityCommitteeonPromotionandTenurewilldiscussandvoteonallthe candidates recommended for promotion or tenure. Department P&TCommittee recommendations supported by a majority of the UniversityCommitteearesentdirectlytotheProvost.

4.5.3.3.3SubmissionofRecommendationsTheUniversityCommitteeonPromotionandTenureChairpersonisresponsibleforpassingontheCommittee'sdecisionstotheProvost,andtoeachcandidate’sDeanandDepartmentChairperson.Thelatter,inturn,willinformeachpersonrecommendedby the DepartmentP&T Committeeof the status of his or hercandidacy.

4.5.3.3.4AppealingaRecommendation4.5.3.3.4.1AppealsbytheDepartmentIn the event of a differenceof opinion between the two committees, theDepartmentP&TCommitteemay, if itwishes,submitadditionalmaterialsandwritten arguments supporting its position to theDean,who reviewsthese materials and arguments and submits them to the UniversityCommitteeonPromotionandTenurewithanevaluationoftheirmerit.If,after considerationof thisnew information,theUniversity Committee onPromotionandTenurevotestosustainitsoriginaldecision,theDepartmentP&T Committee's recommendation, the Dean’s evaluation, and theUniversityCommitteeonPromotionandTenure'sdecisionwillbesentto

the Provost. If the University Committee votes to reverse its decision, apositiverecommendationwillatthispointbesenttotheProvost.

4.5.3.3.4.2AppealsbyaCandidateThe University Committee will consider the merit of all appeals byindividual Faculty members (see Section 4.5.2.3.6) and will transmit its8indingstotheDean,whowillinturntransmitthemtotheDepartmentP&TCommittee Chairperson, who informs the individual Faculty memberconcerned.IfamajorityoftheUniversityCommittee8indsanappealtohavemerit,theDeanwillask theDepartmentP&TCommitteetoreconsideritsoriginaldecision.If theDepartmentP&TCommitteereversesitsdecision,thenameoftheaffectedFacultymemberwillbeaddedto,andrankedwith,anyothersrecommendedinthesamecategory.

If the Department P&T Committee reaf8irms its original decision, theUniversityCommitteeonPromotionandTenurewill evaluate theFacultymember'scredentials in the sameway itwould evaluate thoseof Facultymembersrecommendedintheordinarywayforpromotion,tenure,orboth.However,atleast8iveofthesevenmembersoftheUniversityCommitteeonPromotionandTenuremustsupportanyrecommendationbeforeitmaybeconstruedasapositiverecommendationtobesenttotheProvost.

4.5.4FinalRecommendationsbytheProvostandthePresidentUpon receiving the recommendations from the University Committee on Promotion andTenure and the appeals from Department P&T Committees (see Section 4.5.3.3.4.1), theProvost may confer with the University Committee on Promotion and Tenure forclari8ication, if necessary, and confers with the President. The President makes the 8inalrecommendationsforpromotionandtenuretotheBoardofTrusteesforapproval.

ADDENDUMTOPARTFOUR TENUREPOLICIESTHATAPPLYTOFACULTYHIREDAFTERSEPTEMBER1,2016

A4.1NumberofTimesaFacultyMemberMayBeConsideredforTenureAnAssistant Professormaybe considered for tenure by theUniversity Committee onPromotionand Tenure only once, normally in the sixth year in that rank at NJIT. An untenured AssociateProfessormaybeconsideredfortenurebytheUniversityCommitteeonPromotionandTenureonlyonce,normallyinthefourthyearinthatrankatNJIT.

A4.2EarlyandLateConsiderationforTenureAnAssistant Professormaybe considered for tenure by theUniversity Committee onPromotionandTenureasearlyasthefourthyear(orinexceptionalcircumstances,evenearlier),whileincasesofillness,familycare,andotherspeci8iedandapprovedreasonsforextendingtheperiodoftenure,consideration may occur as late as the seventh year (see Section 4.3.3.2). Untenured AssociateProfessors are also eligible for early or extended tenure consideration.BothAssistantProfessorswho assume their positions with previous experience and untenured Associate Professors maynegotiateaspeci8icyearoftenureconsiderationatthetimeofhire,asstatedintheircontracthiringletters fromtheProvost,providedit isno laterthanthesixthyearforAssistantProfessorsorthefourth year forAssociate Professors. In all cases, the terminal year for a Facultymemberwho isdeniedtenureoccursintheyearaftertenureisdenied.

5.1CourseSyllabiandInstructors’Of7iceHours5.1.1CourseSyllabiEveryNJITcourseshouldhaveacoursesyllabus,availabletothestudentselectronicallybythe 8irst day of class. Course syllabi should contain information on (1) the course (e.g.,number, title, prerequisites/co-requisites, description, meeting-by-meeting outline), (2)course outcomes (see Section 5.1.1.1 below), (3) the instructor (e.g., name, contactinformation,andof8icehours—seeSection5.1.2below),(4)requiredandoptionalmaterials(e.g., title, author, edition, publisher, and ISBN number of assigned texts), (5) tests andassignments,and(6)thecoursegradingpolicy.Syllabishouldalsocontainastatementonacademicintegrity(seeSection5.1.1.2below).

5.1.1.1CourseOutcomesCourseoutcomes refer tomeasurableknowledgeandskills that studentsacquire ineachcourse.Measuresof student learning (i.e.,homework,quizzes,exams,projects,papers)shouldbelinkedtocourseoutcomes.

5.1.1.2AcademicIntegrityNJITmaintainsarigorouspolicyonacademicintegrityinall itscoursesandstudentwork, embodied in the University Code on Academic Integrity. Faculty should alsoconsult the document titled Best Practices related to Academic Integrity, which ismaintainedontheProvost’swebsite.

5.1.2Instructors’Of\iceHoursFaculty and Instructional Staff should post their scheduled of8ice hours for each courseonlineandattheirof8ice,andtheyshouldbeavailabletostudentsduringthosehours.

5.2ExaminationsandAssessment5.2.1ImportanceofEarlyandPeriodicAssessmentTestsandotherassignmentsshouldbereturnedinatimelyfashionsothatstudentsknowtheir status in the class. All instructors should grade and return a signi8icant amount ofstudents’workpriortothedeadlineforwithdrawalfromclasses.

5.2.2FinalExaminationsIncourseswith8inalexaminations,the8inalexamtypicallyconstitutesapproximatelyone-thirdof thetotalcoursegradeandmustbegivenduringtheUniversity 8inalexamperiod.Modi8ications to the 8inal examschedulemustbe approved inwritingby theDepartmentChairperson,andmodi8iedexaminationtimesmustoccurwithintheUniversity 8inalexamperiod. Other regulations relating to 8inal and other major examinations, including the

policy for resolving 8inal exam con8licts, shall be approved by the Faculty Senate and theProvostandpostedontheProvost’swebsite.

5.2.3.ExaminationsinOnlineCoursesExaminations in online coursesmust be scheduled at times that aremost convenient forstudents in the class, recognizing that studentsmaybe living in different time zones andthatmoststudentshavefull-timejobsduringthedaytime.

5.3MentoringofFacultyandInstructionalStaffinregardtoTeachingEachDepartmentshalldeviseandimplementplansformentoringitsFacultyandInstructionalStaff inorder to improve their teaching and the delivery of the curriculum. Such plans should includeconstructivefeedbackonteachingperformanceandreviewofcourseevaluationsandcoursematerials,including the assessment of syllabi and assignments. Faculty and Instructional Staff shall have anopportunity to express their views on ways to improve administrative and technological support,classroommanagement,curriculumdevelopment,andotherrelevantcomponentsofteaching.

5.4CourseEvaluationsEverysemestertheUniversityshallconductstudentevaluationsofallcourses,usinganevaluationformandaprocedureapprovedbytheFacultySenateandtheProvost. TheseevaluationsareintendedtoimprovethequalityofinstructionandforuseinpromotionandtenureevaluationsofFacultyandreviews of Instructional Staff. Theymay also be used in the process of determiningmerit salaryincreases and for selectingFaculty and Instructional Staff for teaching awards.AnyotherusesofcourseevaluationsrequirethepermissionofindividualFacultyandInstructionalStaff.

5.5CourseSchedulingandClassMeetings5.4.1GeneralPrincipleofCourseSchedulingAcademicdepartmentsshouldassigncourseschedulestotheirFacultyincoordinationwiththeregistrar,inamannerthat—tothegreatestpossibleextent—reducesrandomnessintheprocess, increasesschedulingcontinuityandconvenience,andtakes intoaccountboththediverse needs and policies of different academic departments and the special needs ofstudentsandFacultyrelatingtoresearch,teaching,andpersonalcircumstances.

5.4.2 CoursePreferences Each semester, Faculty members should have an opportunity to indicate their teachingpreferences, and these should be considered by the Chairperson and the AssociateChairperson when teaching assignments are made. Faculty members should normallyreceive teaching assignments requiring nomore than two different preparations, and noFaculty member should receive an assignment requiring more than three differentpreparations.UniversityLecturersandSeniorUniversityLecturersshouldnormallyreceiveteachingassignmentsrequiringnomorethanthreedifferentpreparations.

5.4.3EveningClassesFacultyhiredafterFebruary1,1965,mayberequiredtoteachoneeveningperweekaspartof their regular teaching load. Faculty hired prior to February 1, 1965, may teach oneeveningperweekforextracompensation.

5.4.4ClassMeetingsandCancellationsAll classes shouldmeet at their scheduled time and locationunless special arrangementshave been made with the Registrar’s Of8ice with the approval of the DepartmentChairperson. Individual classes should not be cancelled without the consent of theDepartment Chairperson. No classes should be scheduled during the University commonhourswithouttheapprovaloftheProvost.

5.6TeachingLoads5.5.1TeachingAssignmentCriteria(TAC)Teaching loads for each semester shall be assigned by the Department Chairperson inaccordancewitheachDepartment’sTeachingAssignmentCriteria(TAC)andtheCollectiveAgreementbetweenNJIT and thePSA.EachDepartment shall formulate, andperiodicallyreview,itsownTAC,usingcontacthoursratherthancourses,andsubmitittotheDeanforapproval.EachDepartment’sTACshallgointoeffectwhenapprovedbytheDepartment,theDean, and theProvost.Modi8ications to theTAC require approval by theDepartment, theDean,andtheProvost.

5.5.2.TeachingLoadTransparencyTACand load justi8icationdocuments shall bemaintained inDepartments for three yearsandshallbemadeavailabletoanyNJITFacultymemberuponrequest.TheteachingloadsofindividualFacultymembersineachDepartmentshallbemadeavailabletotheFacultyoftheUniversityeverysemesterandshallbeforwardedtotheFacultySenate.

5.5.3ExternalTeachingAfull-timememberoftheFacultyorInstructionalStaffwhowishestoteachacourseduringthe academic year at another institution, in industry, or in the Division of ContinuingProfessional Education must submit a request to the Department Chairperson. If theChairpersondoesnotapprove,theChairpersonshall,inatimelyfashion,informtheFacultymember ormember of the Instructional Staff inwriting of his/her reasons. The Facultymember or member of Instructional Staff may appeal the Chairperson’s decision to theDean,whomakesthe8inaldecision.

5.7ClassAttendanceThe policy for class attendance by students shall be determined by the Faculty Senate and theProvost and posted on the Provost’s website. It is the responsibility of all instructors to keep arecordofattendance,asnecessary,inordertocomplywiththepolicy.

5.8AttendanceatCommencementExercisesMembers of the Faculty and Instructional Staff should make every effort to attend annualcommencement exercises. Every Department/Academic Unit should have substantialrepresentation at commencement, including suf8icient personnel to assistwith themarshaling ofstudentsandothernecessaryfunctions.

PARTSIXFACULTYDEVELOPMENT

Asaresearchuniversity,NJITexpectsitsFacultytoachieveahighlevelofperformanceinresearchandscholarship,and“tocontributethroughresearchandscholarlyactivitiestotheadvancementoftheir disciplines” and of economic development in the state of New Jersey and the nation (seeSection2.1.2).TheUniversityinturnprovidesvariousformsofsupportandencouragementforthispurpose.“Facultymembersshouldhaveaccesstoprivilegestraditionallyassociatedwithresearchuniversities.Suchprivilegesincludesabbaticalleavesandleavesofabsence,aswellassupportforgrant applications, grant administration, and travel related to conferences and researchactivities.”(seeSection2.1.3)

6.1AcademicfreedomFacultyshallbefreetopursuetheirresearchandpublishtheirresults.

6.2MaintenanceofResearchFacilitiesLaboratoriesandotherfacilitiesessentialtoFacultyresearchandteachingshallbemaintainedbythe University at a level suf8icient to foster research productivity and excellence in graduateeducation.

6.3ResearchSupportTo the greatest extent possible, the university shall provide support for ongoing research whenFacultymembersor their laboratories experiencegaps in external funding. Such supportmaybeused to maintain and improve the research environment (e.g., maintenance of equipment,purchasingofsupplies,studentsupport,andconferenceorresearchtravel).

6.4FacultyMentoringEachDepartmentshalldeviseandimplementplansformentoringitsuntenuredFacultytowardtheattainmentoftenureand,beyondthat,towardaproductiveandful8illingcareeratNJIT.Suchplansshould includemonitoringandencouraging theirprogressasresearchersandscholars,providingpersonal guidance and support from senior Faculty, improving their performance as instructors,andensuringthattheyhavethenecessarytimeandresourcestoaccomplishthesegoals.

6.5ParticipationinProfessionalandLearnedSocietiesandConferencesFacultyandInstructionalStaffareurgedtoattendmeetingsofprofessionalandlearnedsocietiesandotheracademicconferences. Universityfundspermitting,allorpartoftheexpensesforattendingthesemeetings, including travelandaccommodationcostsandregistration fees,shouldbepaidifFaculty members participate in a panels, present papers, are active as of8icers of the sponsoringsociety,orperformotherimportantduties.

6.6 PublicationAssistanceFundsmaybeavailablefromtheUniversityforcoveringthecostofmanuscriptsandsubventionsrelatedtothepublicationofscholarlyarticlesorbooks.

6.7SabbaticalLeaveNJIT’ssabbaticalleavepolicyexiststoenhancetheprofessionaldevelopmentandincreasetheresearchandscholarlyproductionofFacultybyrelievingthemoftheirteachingandserviceresponsibilitiesforasemesteroranacademicyear.

6.7.1EligibilityTobeeligibleforasabbaticalleave,aFacultymembermusthavetenureandmusthaveservedaminimumofsixcontinuousyearsontheNJITFaculty.NoFacultymembershallhavemorethanonesabbaticalleavewithinanyseven-yearperiod.

6.7.2 Terms6.7.2.1Duration,Salary,andBene&itsA sabbatical leave may be granted for an academic year at 80% of salary or for asemesterwithfullpay,withallrightsandbene8itsofregularemploymentcontinuingineitheroption.

6.7.2.2CommitmenttoReturnafteraSabbaticalLeaveTheacceptanceofasabbatical leaveobligatestherecipienttoserveasamemberoftheFacultyforatleastoneyearfollowingthecompletionofatwo-semestersabbaticalleave or for at least one semester following the completion of a one-semestersabbatical leave, or else to reimburse the University for all salary paid during thesabbaticalleave.ExceptionstothispolicysoughtbyFacultymembersrequireaformalwaivergrantedbythePresidentontherecommendationoftheProvost.

6.7.3TheApplicationProcess6.7.3.1Provost’sMemo,Timeline,andCriteriaIn a memo to the Faculty in early September, the Provost shall distribute therequirements for sabbatical leave applications and list thedeadlines for all steps intheprocess.Thismemoandotherinformationonthesabbaticalprocedure,includingrelevantdeadlines,consistentwiththepolicyarticulatedinthissectionoftheFacultyHandbook, shall alsobepostedon theProvost’swebsite.Thedocumentspostedonthe website shall include the criteria for granting sabbatical leaves, which can beamendedbytheFacultySenatewiththeapprovaloftheProvost.

6.7.3.2SubmissionofApplicationsbyFacultyMembersEligible Faculty members applying for a sabbatical leave shall submit to theirDepartment Chairpersons by the appointed deadline an electronic applicationconsisting of all the documents identi8ied in the Guidelines for Sabbatical LeaveApplicationsontheProvost’swebsite.ChangestotheGuidelinesforSabbaticalLeaveApplicationsmustbeapprovedbytheFacultySenateandtheProvost.

6.7.3.3ReviewandRecommendationbyDepartmentChairpersonsandDeansDepartment Chairpersons shall review the applications for sabbatical leave fromFacultyintheirDepartmentsandshalltransmitelectronicallytotheDeanthosethatthey approve by the appointed deadline, along with their recommendation letters(with copies to the appropriate applicants). Each recommendation letter shouldinclude a statement on the value of the applicant’s sabbatical leave plan for theapplicant’s career and the Department’s scholarly research pro8ile, as well as astatement on the impact of the recommended sabbatical leave on the normalfunctioning of the Department. By the appointed deadline, the Dean shall transmitelectronically all applications to the Chairperson of the University Committee onSabbaticals, along with the recommendations of the Department Chairpersons andthe Dean. The Dean shall send a copy of his/her recommendation letter to theDepartmentChairpersonandtheapplicant.

6.7.3.4OpportunityforFacultyMemberstoUpdateApplicationsBy the appointed deadline, applicants for a sabbatical leave may submit to theUniversity Committee on Sabbaticals (with copies to theirDepartment ChairpersonandDean)anadditionalstatementthatcontainsrelevantnewinformationsupportingtheapplication.

6.7.3.5ReviewandRecommendationbytheUniversityCommitteeonSabbaticalsThe University Committee on Sabbaticals consists of Faculty from a wide range ofDepartmentsandColleges/Schools,appointedbytheProvosttoservefor8ixedterms.After receiving and rigorously reviewing all sabbatical leave applications, and afterduly considering the recommendations from Department Chairpersons and Deans,thecommitteeshall,bytheappointeddeadline,(1)providetheProvostwithalistthatranksandcategorizesalltheapplicationsasHighlyRecommended,Recommended,orNotRecommended,and(2)provideeachapplicantwiththecommittee’sdecisiononhis/her application accompanied by a written explanation (with copies to theappropriateDepartmentChairpersonandDean).

6.7.3.6RightofAppealtotheUniversityCommitteeonSabbaticalsIn the event that an applicant is not recommended for a sabbatical leave by theUniversity Committee on Sabbaticals, the applicantmay, by the appointeddeadline,send an appeal to the Chairperson of the committee inwriting (with copies to theDepartment Chairperson and the Dean), responding to the committee’s writtenexplanation. The Department Chairperson and the Dean may also send the

Chairpersonof thecommittee letters insupportof theappealwithin thesametimeframe. The committee shall respond to each appeal in writing by the appointeddeadline(withcopiestotheDepartmentChairpersonandtheDean).

6.7.3.7RecommendationbytheProvostandApprovalbytheBoardofTrusteesAfter reviewing the applications and the recommendations of the UniversityCommitteeonSabbaticals,theProvostshallmakerecommendationstothePresidentoftheUniversity,whoshallpresenttherecommendationstotheBoardofTrusteesattheir Februarymeeting for 8inal approval. If any of the Provost’s recommendationsshoulddifferfromthoseoftheUniversityCommitteeonSabbaticals,theProvostshallprovidethecommitteewithawrittenexplanationofthegroundsforhis/heractionineachcase(withcopiestotheDean,theDepartmentChairperson,andtheapplicant).The Provost shall subsequently notify all applicants and their DepartmentChairpersonsofthe8inaldecisionoftheBoardofTrustees.

6.7.4Post-SabbaticalLeaveReports6.7.4.1SubmissionandReviewofPost-SabbaticalReportsNo later than theendof the 8irstsemester following theirreturnafter asabbaticalleave,allFacultymembersshallsubmittotheirDepartmentChairpersonsareportontheiractivitiesandaccomplishmentsduringtheirsabbaticalleaves.Afterreviewingeachpost-sabbaticalreport,theDepartmentChairpersonshallforwardittotheDean,whoshall then forward it to theChairpersonof the UniversityCommitteeon Sabbaticals(with a copy to the Provost). After the committee has reviewed the post-sabbaticalreportalongwithanycommentsmadebytheDepartmentChairpersonandtheDean,the Chairperson of the committee shall send a letter to the Facultymember (withcopies to the Provost, Dean, and Department Chairperson), indicating whether thecommitteeapprovestheFacultymember’spost-sabbaticalreport.

6.7.4.2UnsatisfactoryPost-SabbaticalReportsIn theevent that theUniversityCommitteeonSabbaticals 8indsaFacultymember’spost-sabbaticalreportunsatisfactory,thecommittee’slettershallcontainthereasonsfor thisdecision. Insuchcases, theFacultymembermayappealwithin tenworkingdaysofreceivingthecommittee’sletter.Suchanappealshouldaddresstheobjectionsraisedinthecommittee’sletterandmayincludearevisedpost-sabbaticalreport.Thecommitteewillthenrenderits8inaljudgmentinalettertotheFacultymember(withcopiestotheDepartmentChairperson,theDean,andtheProvost).Apost-sabbaticalreport that is consideredunsatisfactoryby theUniversityCommitteeonSabbaticalsmay have a prejudicial effect on any future applications for sabbatical leave by theFacultymember.

6.7.5PreservationofRecordsAll applications, recommendations, formal correspondence, and supporting materialsrelating to sabbatical leaves andpost-sabbatical leave reports shall be kept on 8ile by theProvost’sof8ice.

6.8CompetitiveFellowshipLeaveProgramIn order to encourage Faculty to apply for and obtain prestigious national and internationalfellowships, the University maintains a Competitive Fellowship Leave Program. Changes in theCompetitiveFellowshipLeaveProgramrequiretheapprovalofFacultySenateandtheProvost.

6.9UnpaidLeaveofAbsenceFull-timemembersoftheFacultyorInstructionalStaffmayattheirownrequestbegrantedaleave

6.10Active-ServiceModi8ied-DutiesPolicyNJIT is committed tohelping itsFacultymaximize theirproductivitybyobtaininganappropriatebalancebetweenacademicandfamilylife.TheActive-ServiceModi8ied-DutiesPolicyservesthisendby providing support to Faculty following the birth or adoption of a child. Details of the policy,containedintheCollectiveAgreementbetweenNJITandthePSA,arepostedhere.

7.1.3.1DiversityandAf&irmativeActionAll hiring must be in compliance with University goals. Equal employmentopportunity considerations shall be a componentof all administrative searchesandrecruitmentprocedures.

7.1.3.2TimingoftheSearchThesearchcommitteeshallnormallybeappointedpriortotheactualvacancy,anditshallnotbeappointedlaterthanthreemonthsafterformalnoti8icationorcreationofavacancy.

7.1.3.3.1SearchCommitteefortheProvostandSeniorExecutiveVicePresidentforAcademicAffairsThe Search Committee for the Provost and Senior Executive Vice President forAcademic Affairs shall be appointed by the President of the University inconsultationwiththeFacultySenate.ThePresidentshalldeterminethesizeandconstitution of the search committee, but it must include at least six votingmemberschosenby the President froma list of at least tenFacultymembersformulated by the Executive Committee of the Faculty Senate. The list ofnomineesmustbebroadlyrepresentativeof thediverseUniversitycommunityandmust include Faculty members from all ranks and from all Colleges andSchools.ThePresidentshallalso select threevotingcommitteemembers fromtheUniversitycommunity,includingatleastoneacademicDean.ThePresidentmayalsoappointadditionalnon-votingmembers.

7.1.3.3.2SearchCommitteesforDeansofDegree-GrantingCollegesandSchoolsDean search committees shall consist of nine voting members chosen asfollows:(1)FiveFacultymembersfromtheCollegeorSchoolshallbeselectedby the Provost from a list of at least eight nominations provided by theExecutive Committee of the Faculty Senate. The list should be broadlyrepresentative of the College or School, with nominees from all constituentunitsandallFacultyranks.(2)TwoFacultymembersfromoutsidetheCollegeorSchoolshallbeselectedbytheProvostfromalistofatleastfournomineesprovided by the Executive Committee of the Faculty Senate. (3) The Provostshall select two additional voting members from the University, including atleast one academic Dean. The Provost may appoint additional non-voting

7.1.3.4TheSearchProcedureThesearchcommitteeshallinviteatleastthreepromisingcandidatestothecampustomeet and discuss issues with members of the University community. At least onesession shall be devoted to meetingwith appropriate members of the Faculty andInstructional Staff,whose input shall be solicited and considered.When the searchcommittee has completed its work, it shall send an unranked list of acceptablecandidatestotheadministratortowhomitreports.

7.1.4SelectionofOtherUniversity-WideAdministratorsIn the selection of all other Vice Presidents and university-wide administrators, thePresidentandProvostshallseekinputandfeedbackfromtheFacultySenateandappropriateFacultymembers.7.1.5InterimandActingPositions

7.1.5.1InterimPositionsUntil a permanent replacement takes of8ice, a vacant administrativeposition listed inSection 7.1.1 shall be 8illed by an interim of8icer appointed by the administrator towhomthepositionreports.NominationsprovidedbytheExecutiveCommitteeoftheFacultySenateand/orbymembersoftheFacultyshallbeconsideredinthisprocess.Interimappointmentsshall notnormally bemade formore thanoneacademicyear.Whenaninterimadministratorisneededforalongerperiod,theExecutiveCommitteeoftheFacultySenateshallbeconsultedaboutthebestcourseofaction.

7.1.5.2ActingPositionsActingpositionsare short-termappointmentsmadewhen thepermanentappointeeexpects to return following a period of temporary absence due to an emergency,temporaryassignmenttoanotherposition,orsabbaticalorotherleave.AppointmentstoactingpositionslistedinSection7.1.1shallbemadebytheadministratortowhomthe position reports, in consultation with the Executive Committee of the FacultySenate.Actingappointeesnormallyshouldnotholdof8iceformorethanoneyear.Anacting appointment may be extended only once and only after the process forappointing a permanent or an interim administrator, as de8ined above, has beeninitiated.

7.1.6SelectionofthePresidentoftheUniversity7.1.6.1ConstitutionofthePresidentSearchCommitteeThePresidentSearchCommitteeshallbeappointedbytheBoardofTrusteesandshallincluderepresentativesfromFaculty,administration,alumni,students,andtheBoarditself.TheFacultymembersonthesearchcommitteeshallbeappointedfromalistofnomineessubmittedbytheFacultySenate.ThislistshouldbebroadlyrepresentativeandincludenomineesfromallCollegesandSchools.

7.1.6.2TheSearchProcedureThe search committee shall invite promising candidates to the campus tomeet anddiscuss issueswith the Board of Trustees andwith the University community as awhole.AtleastonesessionshallbedevotedtomeetingwiththeFaculty,whoseinputshallbesolicitedandconsidered.Whenthesearchcommitteehascompleteditswork,itshallsendanunrankedlistofacceptablecandidatestotheBoardofTrustees. 7.1.6.3AppointmentbytheBoardofTrustees

Beforemakingtheappointment,theBoardofTrusteesshallconsultwiththeProvost,the Dean, and the Department P&T Committee of the Department in which thenomineewill be appointed, to determine the Faculty rank and tenure status of theappointment. The appointment of the President must be made with tenure, at orabovetherankofProfessor. IfappointmentattherankofDistinguishedProfessorisunderconsideration,theapprovaloftheDistinguishedProfessorsCommitteemustbeobtained.

7.2EvaluationofProvost,VicePresidents,DeansandChairpersonsWith the knowledge and cooperation of the President, the Faculty Senate will conduct periodicevaluations (at least every threeyears)by the facultyof theProvost,VicePresidents,Deans, andDepartmentChairpersons.TheCouncil,afterconsultationwiththePresident,mayalsoevaluatetheperformanceofotheradministrativeof8icerswhoseworkimpactsacademicaffairs.ThePresidentoftheFacultySenateisresponsiblefortransmittingtheresultsoftheseevaluationstothePresidentinthecaseoftheProvost,andtotheProvostforallothersadministrativeevaluations.
