    We had sincerely hoped that we will be able to

    bring outthis issue, Vol. 21.5 (Sep-Oct 2020) in

    the usual print format.

    How overoptimistic we were! This issue too

    comes to you in an electronic form as the war on

    Corona Virus and COVID19 still continues. It

    must… Till we have conclusively won over this

    dreaded enemy who has changed the face of

    earth in every walk of life.

    Also, having come this far, we can’t now give up

    and lose the war. Not especially when the vaccine

    is around the corner. That’s why this month’s

    slogan….करोना से हरोना. We bring to you one more article on Income Tax

    return filing that discusses the various aspects of

    ITR utilities, viz. excel or Java utilities. Hope this is

    useful too.

    AERWA (MC )ELECTIONS: Members may remember that in the online MC

    meeting held on 19th June 2020, it was

    unanimously resolved that in view of the

    prevailing situation, existing committee should

    continue till the new MC is elected and take

    over the charge. In continuation to the above,

    AERWA Managing Committee, in its online

    meeting held on 7th

    August 2020 discussed

    about the pending election of the Managing

    Committee. After due deliberations, it was

    concluded by majority vote that under the

    present circumstances, conducting an election

    would be difficult and the present committee

    should continue (with change of

    responsibilities) for the next term, subjected to

    the approval of the AGM. The President Dr

    Manchanda expressed his desire to step down

    from the post of President, due to other

    commitments. Thereafter the names of the

    following office bearers were proposed and

    unanimously approved by the members

    spots in India. Jaisalmer is one such place in the

    famous Thar Desert in the state of Rajasthan.

    Known as “The Golden City of India”, the town is

    built in yellow sandstone which gives it a golden-

    yellow hue when the morning sun’s rays fall on

    it. The town has a rich historical background and

    is strategically important being nearest to the

    Pakistan border. We visited Jaisalmer in

    July2015.

    Jaisalmer is named after Rawal Jaisal, a Bhati

    ruler who founded the city in 1156 AD. Jaisalmer

    means the Hill Fort of Jaisal. Being in the desert

    area, the temperatures during summers can vary

    from highs of 49degrees C in the day to 25

    degrees C in the night. During winters, the

    maximum day temperature is around 23degrees

    C whereas the temperature during night can go

    to as low as 5 degrees C.

    The fort, Sonar Quila, is one of the prominent

    structures in this city of sand and sand rocks.

    It stands on Trikuta Hill and has three layers

    of walls. Solid stone blocks were used for the first

    lower layer; the middle wall runs around the fort

    entirely and served as the first defensive barrier

    and the third wall was the final barrier. Jaisalmer

    Fort has a total of 99 bastions (angular openings

    on the top walls to position canons for

    protections). Four massive gateways, through

    which visitors to the fort must pass, situated

    along with the main approach to the citadel. The

    Jaisalmer Fort is referred to as a “living Fort”. It

    has people living within the premises. Shops are

    set up for commercial purpose, selling locally

    made products like handicrafts.

    At dawn, the massive yellow sandstone walls

    look beautiful golden yellow as the sun rays fall

    on them. For this reason, it is also known as the

    Sonar Quila or Golden Fort. Main attraction

    inside the Fort is the Raj Mahal Palace, the 7 Jain

    temples, Laxmi Nath temple and Havelis. The

    Fort is visible from miles in the foot hill region of

    Trikoot Hill.

    The city has several old buildings known as

    Havelies (large houses often built by wealthy

    merchants), most popular being Patwon Ki

    Haveli. These are carved from yellow sandstone.

    Some of these have many floors and countless

    rooms, with decorated windows, archways,

    doors and balconies. ThePatwon Ki Haveli was

    constructed in the year 1805 by Guman Chand

    Patwa, a rich trader of jewelry and fine brocades.

    The Haveli is a cluster of 5 buildings; the first in

    the row, Kothari’s Patwa ki Haveli, is the biggest

    and most beautiful of the five. Patwa Ji Ki Haveli

    is renowned for its ornate wall paintings,

    intricate yellow sandstone-carved jharokhas

    (balconies), gateways and archways. The building

    itself is made from yellow sandstone.One cannot

    but appreciate the arrangement of various rooms

    for residence as well as for use as office space

    and there is such a nice ventilation system

    because of the positioning of rooms and the

    cross ventilation, that even during the harsh

    summer months, you feel cool inside. One can

    spend hours to see the Haveli in detail.

    Close to the city is the portion of the desert

    where you could see sand dunes, hillock like

    buildup of sand, where one could take camel

    rides and enjoy the sunset. At times when the

    wind is strong, the sand dunes shift their

    positions. Local tourist department organizes

    tours to these sand dunes followed by some

    cultural program, dinner etc.

    About 122 km form the city is located the Tanot

    Mata temple. This is close to the border with

    Pakistan, and is very close to the battle site of

    Longewala of the Pakistan War of 1971. This is

    the last point upto which the visitors can go. The

    temple is being maintained by Military and all

    military movements seek the blessings of Tanot

    Mata before further proceeding towards

    Pakistan border. We were told that during the

    1971 war, when enemy shells were falling all

    around the temple, not one fell on the inner

    perimeter.We could see one shell still lying in the

    precinct of the temple.

    Visit to Jaisalmer is not complete without

    visiting a small village known as Kuldhara. It is

    an abandoned village established around the

    13th century. Once a prosperous village

    inhabited by Paliwal Brahmins, it was

    abandoned in the early 19th century. The story

    goes that one of the ministers Salim Singh was

    attracted to a beautiful girl from the village.

    The village people were not in favour of giving

    their daughter to him and so asked the guards

    to return next morning. The entire village,

    along with 83 other nearby villages was

    abandoned overnight. The village has now

    become a tourist center.

    Jaisalmer is popular for buying water bags and

    stuffed toys made of camel hide. It is also

    popular for handicraft items like glass inlaid

    ladies clothing, wall hangings, etc.which can be

    bought from many shops in the local market.

    Language spoken by locals is Marwari (a dialect

    of Hindi). Men wear colored headgear (known

    as Safa or Pagri), Kurta and Dhoti with typical

    local Jutis (shoes without laces). Women wear

    coloured heavy long skirts (Ghagra or Lengha),

    with Odhani (typical saree covering their heads)

    and silver or glass beaded jewelry.

    Jaisalmer has a number of lakes and Jain

    temples. In addition, it has a number of

    museums which show case the local art and

    history of Rajasthan and Jaisalmer.

    Jaisalmer has been a popular location for

    Bollywood, and can be seen in many popular

    Bollywood movies like Airlift, Parmanu and

    Bajrangi Bhaijaan, just to name a few. Famous

    film maker Satyajit Ray made a film called Sonar

    Kella (Golden Fortress) in 1974 in Jaisalmer.

    Jaisalmer also serves as a popular backdrop in

    many Bollywood songs.

    Jaisalmer is an important trading city and is a

    major military post. It attracts large number of

    foreign visitors during the Desert Festival

    organized by the tourism department. Visitors

    enjoy the Camel rides, the Desert Safaris and the

    various cultural programmes showcasing the

    Rajasthani Folk songs and dances. Camel races

    are organized with decorated camels

    participating. The magnificent Jaisalmer Fort,

    with its blending of Muslim and Rajput

    architecture styles, the vastness of Thar Desert

    and the Havelis with all their grandeur leave one

    amazed at the advanced state of art, skill and

    taste of the people at that time.

    INCOMETAX RETURN:

    Filing an Income Tax return is an annual affair

    and this year it should be completed by

    November end. Therefore, you need to collect

    documents viz. Form 16, pension slips, interest

    certificates and Form 26AS, details of incomes (1)

    Pension (2) Income from other sources like

    interest, (3) Income from house (rent), (4) Capital

    Gains from shares (long and short term) and

    from property sale etc. These documents/data

    help you compute your gross taxable income and

    provide you with the details of tax deducted at

    source (TDS) from your income in FY 2019-20.

    Here is how to file Income Tax Returns for AY

    2020-21: The department has released the ITR

    utility (e-form) on its e-filing website available in

    Excel and Java formats. The user can file

    the Income Tax Return (ITR) in two ways:

    Offline mode (Preferable): To e-File

    the ITR using the upload XML method, the user

    must download either of the

    following ITR utility: Excel Utility/Java Utility.

    After you download the excel or the java

    version of the utility form, extract the

    downloaded utility ZIP file and open the utility

    from the extracted folder. Prefill.XML also can

    be downloaded from your

    incometaxindiaefiling PAN account for ITR1 or

    ITR2 depending on previous year’s return. This

    Prefill.XML file already contains most of your

    personal data and current 26AS data filled in

    ITR1/ITR2 in required format. This reduces the

    effort of filling ITR1/ITR2 to a great extent and

    with fewer typing errors. Please don’t use

    CTRL-C/CTR-V or other such control keys in

    filling the ITR form as it will lead to errors in

    XML file which will be difficult to locate.

    Using yourPrefill.XML, fill the applicable and

    mandatory fields of the ITR Form, validate all

    the tabs of the ITR form and calculate

    the Tax. Then, generate and upload the XML to

    e-Filing portal by entering user ID (PAN),

    Password. Click on the 'e-File' menu and click

    'Income Tax Return' link and Submit the ITR.

    From XML Schema you can download all the

    essential that you will need while filing ITR.

    Online Mode: Taxpayers who are eligible to file

    ITR-1 and ITR-4 also have the option to file it

    online without downloading any software utility

    by Logging in to your account. Go to the Income

    Tax e-Filing portal,

    www.incometaxindiaefiling.gov.in.

    Login to e-Filing portal by entering user ID (PAN),

    Password, Captcha code and click 'Login'. Once

    you logged in, click on the 'e-File' menu and click

    'Income Tax Return' link. Fill in the asked details

    and submit it.

    Although, as mentioned above, we can file return

    in Online Mode for ITR1/ITR4, it is advisable to fill

    ITR form in Offline mode in Laptop/Desktop

    computer by installing the ITR preparation

    software available on IncomeTax site. The

    advantage of Offline mode is that one can enter

    Personal data and various income and

    deductions data, verify and modify to remove

    errors, pay the required self assessment tax and

    then upload the filled ITR form after login to

    income tax site on a convenient date.

    The reader might be familiar with one or two

    page ITR-1(SAHAJ) form filled in excel format

    with white and green cells. However, ITR2 in

    excel format is a better option as it covers

    income from various sources and is not

    restrictive like ITR1. For more

    advance/experienced users, Java utility is

    superior to Excel utility and one should try to

    graduate to ITR2 with Java utility (Read Note at

    end).

    After the return is verified, either via e-

    verification or physically, the income tax

    department will start processing your tax return.

    Once it is processed, the tax department will

    inform you of the same via e-mail.

    Note on Java (Read How_to_use_ITR_Utilities_

    Other.pdf): ”ITR utilities are developed using

    JAVA technology and effort has been made to

    make it user friendly, simpler and faster

    preparation of tax returns. This utility can run on

    operating systems like Windows 7.0 or above,

    latest Linux and Mac OS 10.10(OS X Yosemite),

    Book Review: The Saga of Atomic Energy in

    This book has just been published in June 2020

    by Authors Press, New Delhi. The Author of the

    book, Dr Mahadeva R Iyer, is well known to DAE

    fraternity for his association with Health Safety

    and Environment activities in the Department.

    He has long experience as radiation protection

    professional of nearly four decades in DAE and

    later for six years at Department of Nuclear

    Safeguards at IAEA Vienna. Being part of the

    Health, Safety & Environment Group at BARC, he

    had the opportunity of in-depth involvement in

    every aspect of nuclear programme of the

    Department. There are two parts of the book.

    The first part has an excellent account of

    historical evolution of Indian nuclear power

    programme. This is presented in crisp 9

    subchapters starting from the birth of Atomic

    Energy Estt. Trombay (AEET), the era of India

    of new reactor concepts deals with AHWR, HTR

    for hydrogen production and PWR for strategic

    use. Why nuclear power is still subcritical has

    been analysed based on present status of

    country’s PHWR programme, imported PWRs,

    fast reactors and uranium availability. Author’s

    views on the way ahead has been also described

    and merits attention.

    Part II of the book has two sections. Section A

    contains author’s articles which he published

    during 2007 to 2020 in Industrial Economist.

    These cover wide ranging subjects on global

    development and india’s potential. There are

    few articles dealing with Kudankulam project

    with which author was associated as a member

    of Expert Group constituted by Govt. of India to

    allay fear of public on nuclear power.

    Section B describes author’s articles published in

    other media. These deal with public safety

    concerns on nuclear power, public awareness of

    radiation and improving public perception of

    nuclear power. Indo-US nuclear agreement,

    safeguards implications and its status post

    Well Done DAE: The third unit of the Kakrapar

    Atomic Power Project (KAPP-3) in Kakrapar,

    Gujarat achieved its ‘first criticality’ at 9.36 am

    on Wednesday, July 22.

    This is a landmark event in India’s domestic

    civilian nuclear programme because it is the

    biggest indigenously developed variant of the

    Pressurised Heavy Water Reactor (PHWR) that

    uses natural uranium as fuel and heavy water as

    moderator.

    Four units of the 700MWe reactor are currently

    being built at Kakrapar (KAPP-3 and 4) and

    Rawatbhata (RAPS-7 and 8).

    As India works to ramp up its existing nuclear

    power capacity of 6,780 MWe to 22,480 MWe by

    2031, the 700MWe capacity would constitute the

    biggest component of the expansion plan.

    Currently, nuclear power capacity constitutes

    less than 2% of the total. India plans to put 21

    new nuclear power reactors - including 10

    indigenously designed PHWRs - with a combined

    generating capacity of 15,700 MWe into

    operation by 2031, the Department of Atomic

    Energy announced in January 2019.

    Pension Rules 1972 in place of NPS. Employees

    whose selection for employment was finalized

    before 31.12.2003 but who joined Govt. service

    on or after 1.1.2004 shall be eligible for coverage

    under CCS (Pension) Rule 1972.

    2. DoPPW OM No 1/6/2020-P&PW (E) dt

    03/03/2020; Sub: Co-authorization of

    permanently disabled child/ children in PPO for

    family pension; It is clarified that pensioners

    need not be pursued to furnish information such

    as name of guardian, photo of guardian and their

    bank account detail. Only details of disabled child

    or sibling along with disability certificate will

    suffice for processing the case of such dependent

    for co-authorization in PPO for family pension.

    3. DoPPW OM F No. 38/37/2016-P&PW (A)

    dt18/06/2020; Sub: Concordance Table

    Corrigendum. There was some error in entries in

    7 CPC concordance Table 29 (Level 9) at index

    no 10 wherein revised pension should be now

    read as 28,150 instead of 29000 as printed in

    earlier Table.

    4. DoPPW OM No.38/37/16-P&PW

    dt22/02/2020; Sub: Regularization of pension

    and other retirement benefits of Govt. servant

    who went on EOL unauthorised absence,

    suspension as on1.1.2016 and retired without

    joining. In accordance with CCS( Pension) Rule

    1972, the basic pay which he drew immediately

    before proceeding on such leave shall be

    emolument for purpose of pension

    5. DoPPW OM No 12/12/2020-

    P&PW(C)/6536 dt 27 June 2020; Sub: Dispensing

    with the requirement of BSR code of bank from

    the pension claim form. While submitting

    pension claim form, a retiree or family member

    has to provide detail of his/her bank account,

    IFSC and BSR code of concerned bank branch. It

    has been decided to dispense with the

    requirement of BSR code for processing all types

    of pension cases with immediate effect.

    6. DAE OM No 4/4/2011-SCS/Vol VI/5157

    dt Aug 3, 2020. Sub: Discontinuation of the

    scheme of grant of two additional increments in

    its entirety: As per DAE OM No 4/4/2011-

    SCS/Vol.III/7809 dt 13.6.2017, two additional

    increments granted to Scientists/ Engineers in

    the grade D, E, F and G were treated as “Pay” for

    Dearness Allowance, House Rent Allowance and

    for pension and pensionary benefits with effect

    from 01.01.1996 to Pensioners and similarly

    placed Scientists/ Engineers. Ministry of Finance

    vide their advice note dt 19.5.2017 has asked

    the Department to discontinue this scheme and

    it has further reiterated its advice to discontinue

    with immediate effect the scheme of providing

    two additional increments in respect of all

    promotions to take place in future.

    It is now decided in the Department to withdraw

    the scheme of two additional increments granted

    to Scientists/Engineers in the grade of D, E, F and

    G in its entirety with effect from the date of

    issue of DAE OM No. 4/4/20111-SCS/Vol. III/7809

    dt 13.6.2017. Consequently, payment made to

    all eligible officers viz. Scientists/ Engineers in the

    grade of D, E, F, and G from 13.6.2017 onwards

    till the date of issue of this OM shall be

    recovered in convenient instalments.

    7. BARC/MD /CHSS/COVID-19/2020 dt

    15/07/2020; Sub: COVID-19. : Further to Circular

    No.MD/COVID-19/20 dt March 26, 2020, in view

    of present COVID-19 scenario it is proposed to

    extend the facility stated in the Circular dated

    26/03/2020 for a period up to 30/09/2020.

    Further, CHSS beneficiaries who have already

    procured medicines for chronic illness based on

    prescription from Dispensaries are requested to

    submit P&C claim form to their respective

    dispensaries within a period of three months

    from the issue of this circular. In case any CHSS

    beneficiary has availed Covid treatment in

    Emergency, LES claims may be submitted to the

    respective dispensaries with in a period of three

    months from the date of discharge from the

    hospital. The P&C and LES form can be

    downloaded from BARC Medical Division

    Website.

    CHSS beneficiaries seeking to avail consultation

    may do so either by attending their respective

    dispensaries personally or telephonically. The

    numbers and dispensary timings have already

    been published in an earlier issue of NL

    (Newsletter of AERWA Vol 21.3, May-June 2020).

    AERWA members have always come forward

    whenever there is a National calamity and

    wholeheartedly donated to the PMNRF or

    equivalent funds, as part of their efforts to

    provide relief to the affected citizens. This

    time, during the Global Pandemic, arising due

    to COVID-19 that affected India on a

    frighteningly massive scale, our members have

    Readers write: Dr. Ramani writes on the article

    by Shri Pankaj Sinha,

    “The article by Shri Pankaj Sinha, in News Letter

    of AERWA Vol 21.4 (Jul-Aug 2020), is only

    partially correct”.

    In the case of income from business or

    profession the return form ITR-4 has to be filed.

    At first one has to state one’s profession. One

    can claim under more than one profession also.

    But the profession has to be one listed under

    Section 44AA.

    Further the taxable income has to be 50% of the

    gross receipts or the income claimed whichever

    is higher. What is ‘income claimed’ has not been

    defined. It can lead to various interpretations.

    One interpretation could be gross receipt minus

    expenditure incurred to receive that income.

    What is the expenditure incurred to receive that

    income?

    There is no need to register as a professional. But

    when a professional practice is discontinued one

    has to inform the assessing officer within 15 days

    under Section 176. Otherwise there is a penalty

    of Rs.100/- per day of discontinuance. Suppose a

    person gets some income this year, say for

    delivering lectures. He claims 50% of the amount

    received as professional income this year. He

    waits till the end of the next year but receives no

    such income. What shall he do? Will he claim

    that he has discontinued the profession and if so,

    from which date? What if he again gets such

    income in the subsequent year? Will he say that

    he has again started the profession?

    Shri Pankaj Sinha replies,

    I am thankful to Dr. Ramani for his comments on

    my article on NL Vol 21- 4. Let me clarify the

    points raised in the comment.

    The fee received on attending technical

    seminars, workshop, delivering lectures etc. are

    very much covered under specified professional

    income that can be claimed under sec 44ADA,

    only condition is TDS, if applicable, should be u/s

    194J not in any other section. One can check this

    in his form 26AS before claiming rebate.

    Sec 44AA as referred in the comment is different

    section, applicable beyond the scope of sec

    44ADA. The term “income claimed” used in the

    comment is not understood.

    Section 44ADA can be used to claim rebate on

    consultancy bills payments received at any

    irregular intervals. There is no clause of regular

    income mandatory every year. But switching

    back to 44ADA is restricted, if sec 44AA is used

    once.

    Laughter: Still the best medicine

    Can you imagine how the news of criticality was

    interpreted by a local, Taluka level newspaper

    few years ago?

    I was in my hometown when NAPS-2 attained

    first criticality. The headline went as:

    “चोर� करने पर िजंदगी भर पछताना पड़ता है” प!त अपने प#नीसे कह रहा था| तुमने तो शाद� से पहले मेर� नींद चुराई थी, चैन चुराया था|” प#नीने कहा| “वह� तो कह रहा हँू| चोर� करने पर िजंदगी भर पछताना पड़ता है|” प!तने जबाब +दया|

    His mother in law was down with Covid19 and

    was on ventilator. When called the doctor, his

    face became longer and longer.

    The wife was quite tense and could not wait to

    be told the fate of her mother.

    Darling, your mother will be coming to live with

    us today. Let’s be ready for it. He said in a very

    somber tone.

    “But how is it possible? She is on ventilator,

    isn’t she?” she asked.

    “Well“, he said, “ The doctor said that we

    should be prepared for the worst today.”
