In the story, Kei Kei and Ling Ling realized that the national flag and the regional flag were lost in the school and helped the teachers to find them. In this unit, students will read the story “Mysterious Theft on Campus” and understand the part of the Basic Law about the national flag and the regional flag. In the story, Kei Kei and Ling Ling realized that the national flag and the regional flag were lost in the school and helped the teachers to find them. (1) IntroductionStudents share their experiences of joining and/or seeing the flag raising ceremony.

(2) Development➢ Teachers’ Questions:

1. What etiquettes should we follow at the flag raising ceremony? What do you think are the reasons behind these etiquettes? (e.g. for the ceremony to go smoothly, to show respect to our country.)

2. What do the flag raising team and flag raisers do? What do you think their duties represent? (e.g. The flag raising team carries and protects the national flag to show respect to the national flag; raising the national flag higher than the regional flag means that the national flag represents a nation and the regional flag represents a region.)

➢ Teachers’ Explanations:The Law on the National Flag has clear statements about the requirements and etiquettes of raising the flag. The national flag represents our country, so each country will handle its national flag carefully according to the relevant laws. In the ceremonies of international events (such as sports competitions or meetings), they will follow the international practices to raise and lower their national flags.

➢ Students play the detective game to understand more about the correct ways of handling the national flag:1. Watch the short animated video “Mysterious Theft on Campus (1)” (see

Appendix 1 for the contents).2. In groups of four, read the screenplay of “Who Stole the National Flag?”

(Appendix 2).3. Group leaders lead the members to discuss who is most suspicious

of stealing the national flag, and fill in the Detective’s Journal (Appendix 3).

4. All groups report back their results and explain their guesses of the suspects.

➢ Teachers point out that they will reveal the answers later, but students may find from the characters’ conversations in the story that there was something wrong with Patriot, Rashman and Destroyer in the ways they handled the national flag. Students will then discuss the correct ways and attitudes to handle the national flag.1. What was wrong with Patriot, Rashman and Destroyer in their attitudes

or when they handled the national flag?2. If you were Patriot and if you liked a commercial product a lot but

you could not buy it because there was the national flag printed on it without the Government’s permission. What would you do?

3. If you were Rashman and were in a hurry to a tutorial class while the other classmates had not come yet, but you could not put the national flag on the ground. What would you do?

4. If you were Destroyer and were very angry, but you could not destroy the national flag or make it dirty at that time. What would you do?

➢ Students watch a short video about the flag raising ceremony. Then, imitate the etiquettes and the right attitude when joining the flag raising ceremony at the Golden Bauhinia Square.

(3) Brief Summary➢ The Hong Kong Special Administrative Region (HKSAR) can hoist the

national flag and the national emblem of the People’s Republic of China to show that the HKSAR is part of the State.

➢ According to the Basic Law, the HKSAR may also use the regional flag and the regional emblem.

➢ Citizens should perform their duties and obey the Law on the National Flag and the National Emblem Ordinances, and the Regional Flag and Regional Emblem Ordinances, and display or use the national flag and the regional flag in accordance with the law.

Tips for Teachers:1. It is good for teachers to collect the names of the organizations that hoist the national flag. If

students cannot name the examples or name the wrong examples, teachers may give the answers immediately.

2. When dealing with students’ attitudes to the flag raising ceremony, teachers may share some real-life examples, such as the exciting moments when some award-winning athletes see the national flag being raised in international sports competitions. This shows that the athletes recognize their national identity.

3. If the school has this learning activity in the assembly, teachers may let students watch the short video “Who Stole the National Flag?” to replace the reading activity.

4. Teachers may read the relevant articles in the Law of the People’s Republic of China on the National Flag excerpted in References for Teachers, so as to give students the relevant information when leading the discussion.

5. It is good for teachers to note that the Law of the People’s Republic of China on the National Flag is a national law, and is included in Annex III of the Basic Law.

“Law of the People’s Republic of China on the National Flag” (excerpt)

Article 1This Law is enacted in accordance with the Constitution with a view to defending the dignity of the National Flag, enhancing citizens’ consciousness of the State and promoting the spirit of patriotism.

Article 3The National Flag of the People’s Republic of China is the symbol and hallmark of the People’s Republic of China. All citizens and organizations shall respect and care for the National Flag.

Article 8The National Flag may be displayed when important celebration and commemorative activities, large-scale cultural and sports activities and major exhibitions are held.

Article 12The National Flag, when displayed under Articles 5, 6 and 7 of this Law, shall be hoisted in the morning and lowered in the evening.

Where the National Flag shall be displayed under this Law, when the weather is inclement, it is permissible that the Flag not be displayed.

Article 13When the National Flag is displayed, a Flag-hoisting ceremony may be held.

When a Flag-hoisting ceremony is held, persons present shall face the Flag and stand at attention to salute the Flag, and the National Anthem may be played or sung while the National Flag is being hoisted.

A full-time middle school or primary school shall hold a Flag-hoisting ceremony once a week, except during vacations.

Article 16The National Flag, when hoisted or lowered from a vertical staff, shall be hoisted or lowered slowly. When hoisted, the National Flag must reach the peak of the staff; when lowered, it may not touch the ground.

The National Flag, when flown at half staff, shall be first hoisted to the peak of the staff and then lowered to a point where the distance between the top of the Flag and the peak of the staff is one third of the length of the staff; the Flag, when lowered, shall be again hoisted to the peak before it is lowered.

Article 17No damaged, defiled, faded or substandard National Flag shall be displayed.

Article 18The National Flag and the design thereof shall not be used as a trade mark or for advertising purposes, and shall not be used in private funeral activities.

Article 19Whoever desecrates the National Flag of the People’s Republic of China by publicly and wilfully burning, mutilating, scrawling on, defiling or trampling upon it shall be investigated for criminal responsibilities according to law; where the offence is relatively minor, he shall be detained for not more than 15 days by the public security organ in reference to the provisions of the Regulations on Administrative Penalties for Public Security.

In a brisk morning, it was very quiet in Kei Ling Primary School. Kei Kei and Ling Ling studied there. Janitor Chan also worked and lived there. When he went to clean the playground, he found fallen leaves all over the ground. So he bent down and mopped away the leaves. After a short while, he felt sore on his waist so he stood up straight and looked up. Alas! The national flag and the regional flag in the play-ground were lost! Janitor Chan was very anxious and ran to the Principal’s office.

Janitor Chan: Ms. Lee. Big trouble! The national flag and the regional flag in the playground were lost!

Principal: How was it possible? Who would take away the national flag and the regional flag? Why did he take away the national flag and the regional flag? … Janitor Chan, please ask Ms. Cheung and Chiu Sir to come here.

Janitor Chan: Ah!

Janitor Chan hurried to the staff room and told Ms. Cheung the Vice Principal and Chiu Sir what hap-pened. The three hurried to the Principal’s office.

Principal: Ms. Cheung, Chiu Sir, What do you think?

Vice Principal: We’ll have the prize-giving ceremony tomorrow to celebrate our school’s outstanding results in the inter-school sports day. We have already invited a lot of guests to come.

Chiu Sir: The flag raising ceremony is the first item of the prize-giving ceremony.

Vice Principal: So we must find the national flag and the regional flag today.

Principal: Of course I know that, but I doubt if we can find out who took away the national flag and the regional flag today.

Chiu Sir: I agree with Ms. Lee.

Vice Principal: Hm… it would be great if we can buy the new national flag and regional flag, but we may not be able to buy them now. Shall we ask our janitors to borrow the flags from the schools nearby?

Principal: This is the only possible way we have. I prefer not to do this unless it is absolutely necessary, as the national flag and the regional flag mean a lot to us. If they are lost, we have to take it seriously and investigate it.

Chiu Sir: Ms. Lee, let me check it as soon as possible. I hope we can find the national flag and the regional flag today. Then we do not need to borrow them from other schools.

Chiu Sir was the head of the Discipline and Guidance Team. After he left the Principal’s office, he gathered all the prefects and teachers to help and investigate the theft of the national flag and the regional flag. The prefects divided their works and went to each classroom to ask if students have found them. Chiu Sir interviewed all the teachers and janitors. After some effort, they found three suspects. In order to protect their privacies, they gave them the code names Patriot, Rashman, and Destroyer for the time being. Chiu Sir asked the head prefects to invite three of them to go to the group counselling room one after another and talked to them in detail and recorded their conversations. Did they take the national flag and the regional flag?

Patriot Yes! I love the motherland. I love to collect or buy things with the national flag on it.

Chui Sir Where do you collect or buy the things with the national flag?

Patriot It is hard to pinpoint. Sometimes when I was shopping or travelling overseas, if I saw something with the national flag, I would buy it.

Chui Sir Do the merchants have the legal permission to print the national flag on these things?

Patriot Well, I am not sure but I will not care too much. As far as I like it, I will buy them and collect them and have a look at them in spare time.

Patriot I do not have the real one but I have many plastic or paper copies of the national flag.

Rashman Yes. I am a scout. I was in charge of the flag raising ceremony at school with some other scouts. Yesterday, Mr. Cheung asked us to take down the national flag and clean the dirt off the flag and leave it until we use it again in the prize-giving ceremony tomorrow.

Chui Sir Who did you go with to take the national flag?

Rashman Lee Loi Chi was supposed to go to the playground with me. But Mr. Chow needed to see him. He said he would help me a bit later. So I took the national flag myself.

Chui Sir Did other schoolmates see you take the national flag?

Rashman At that time most schoolmates left school already. However, some schoolmates walked pass the playground. They should have seen me take the national flag.

Chui Sir Do you remember who they were?

Rashman I only focused on taking the national flag down the pole, I did not notice who they were.

Chui Sir Did you finally take away the national flag?

Rashman No!

Chui Sir Why not?

Rashman The rope fastened the national flag so tight on the pole that I spent a long time to loosen it. When I took it down slowly from the pole, it dropped on the ground by accident. I looked at the watch and it was already late. So I hurried to a tutorial class and did not pick up the national flag.

Chui Sir So you left the national flag on the ground just like that. You did not fear that it might be lost?

Rashman Lee Loi Chi said he would come and help. I found that I did not have time to clean the national flag so I put it next to the pole and left it for Lee Loi Chi to clean it.

Chui Sir When you left the playground, did you see other schoolmates?

Rashman I saw Destroyer.

Chui Sir Was he alone?

Rashman Yes.

Chui Sir What did he do in the playground?

Rashman I do not know. I only saw him walk out there angrily. He was very quiet. I called him but he did not answer me.

(1) Introduction➢ Teachers and students review the contents of the story “Mysterious Theft

on Campus (1)”.

(2) Development➢ Watching Short Video:

1. Students watch the short video “Mysterious Theft on Campus (2)” (See Appendix 1 for the contents).

2. Teachers point out the ending of the theft case: the thief of the national flag and the regional flag was actually a stray cat. Did it steal the real flags? Ask students to help Kei Kei and Ling Ling to tell the differences between the real and fake national flag and regional flag.

➢ Watching PowerPoint:Students watch the PowerPoint (see Appendix 2 for the contents), tell the differences between the real and fake national flag and regional flag and point out the characteristics of the two flags (including the patterns, positions, colours and sizes).

➢ Teachers show the regional emblem and ask students to compare the differences and similarities of the regional emblem and the regional flag. Then, teachers introduce the government buildings that hoist the regional emblem. Examples are Government Headquarters and the main entrance of the Court of Final Appeal.

➢ Teachers’ Questions:1. The stray cat in the story was the thief that had stolen the flags. What

rights did it mention? (Freedom of the person, private property and unbreakable residence.)

2. The stray cat thought that the Basic Law protected the freedom of the person of Hong Kong citizens, so they would not face wilful or unlawful arrest, custody and imprisonment. So it refused to follow Kei Kei and Ling Ling to go to school. Do you agree with what it did? Why?

Residents of the Hong Kong Special Administrative Region (“Hong Kong residents”) shall include permanent residents and non-permanent residents.

The permanent residents of the Hong Kong Special Administrative Region shall be:

( 1 ) Chinese citizens born in Hong Kong before or after the establishment of the Hong Kong Special Administrative Region;

( 2 ) Chinese citizens who have ordinarily resided in Hong Kong for a continuous period of not less than seven years before or after the establishment of the Hong Kong Special Administrative Region;

( 3 ) Persons of Chinese nationality born outside Hong Kong of those residents listed in categories (1) and (2);

( 4 ) Persons not of Chinese nationality who have entered Hong Kong with valid travel documents, have ordinarily resided in Hong Kong for a continuous period of not less than seven years and have taken Hong Kong as their place of permanent residence before or after the establishment of the Hong Kong Special Administrative Region;

( 5 ) Persons under 21 years of age born in Hong Kong of those residents listed in category (4) before or after the establishment of the Hong Kong Special Administrative Region; and

( 6 ) Persons other than those residents listed in categories (1) to (5), who, before the establishment of the Hong Kong Special Administrative Region, had the right of abode in Hong Kong only.

The above-mentioned residents shall have the right of abode in the Hong Kong Special Administrative Region and shall be qualified to obtain, in accordance with the laws of the Region, permanent identity cards which state their right of abode.

The non-permanent residents of the Hong Kong Special Administrative Region shall be persons who are qualified to obtain Hong Kong identity cards in accordance with the laws of the Region but have no right of abode.

• Article 25 All Hong Kong residents shall be equal before the law.

• Article 26Permanent residents of the Hong Kong Special Administrative Region shall have the right to vote and the right to stand for election in accordance with law.

• Article 28 The freedom of the person of Hong Kong residents shall be inviolable.

No Hong Kong resident shall be subjected to arbitrary or unlawful arrest, detention or imprisonment. Arbitrary or unlawful search of the body of any resident or deprivation or restriction of the freedom of the person shall be prohibited. Torture of any resident or arbitrary or unlawful deprivation of the life of any resident shall be prohibited.

• Article 29The homes and other premises of Hong Kong residents shall be inviolable. Arbitrary or unlawful search of, or intrusion into, a resident’s home or other premises shall be prohibited.

• Article 36 Hong Kong residents shall have the right to social welfare in accordance with law. The welfare benefits and retirement security of the labour force shall be protected by law.

After detailed investigation, Chiu Sir thought that Patriot, Rashman and Destroyer did not take away the national flag and the regional flag. While he was still puzzling about this, he saw that a few birds were looking for food in the playground. He suddenly got an idea and immediately asked the Basic Law Smartie Kids to come. They are Primary 4 students Kei Kei and Ling Ling. They are witty and smart. They can also read minds, not of people, but of animals. Kei Kei and Ling Ling ran to the playground and talked to the birds. They found that some stray cats often came around there lately.

Kei Kei and Ling Ling met three stray cats near the school and collected information from them immediately. They found that one of the cats went into the school and stole the national flag and the regional flag. So Chiu Sir, Kei Kei and Ling Ling followed one stray cat to its home and suspected that the stray cat that might have stolen the flags. The cat saw them and was very surprised. It screamed loudly and meowed for a few times. The Basic Law Smartie Kids used their mind-reading power again!

Ling Ling: You do not need to be afraid. We are not here to harm you.

Stray cat: Meow...You come to my residence unlawfully... Do you want to steal my things? I am a permanent Hong Kong resident. The law of Hong Kong protects me.

Kei Kei: You live under the bridge. This is a public area and not your private property. Also, you are not a permanent Hong Kong resident.

Stray cat: Meow! Why?! I was born in Hong Kong and I have lived in Hong Kong for seven years continuously.

Kei Kei: However... You were not born in Hong Kong and are not a Chinese citizen.

Article 24 of the Basic Law and Section 2, Schedule 1 of the Immigration Ordinance briefly list who may enjoy the status of Hong Kong permanent residents. The website of the Community Legal Information Centre provided in References for Teachers gives simple and clear explanation of the ordinances above.

Case 1: kwok-keung is a permanent resident of Hong Kong.Whether or not he was born in Hong Kong, as long as his parents are already permanent residents of Hong Kong when he was born, he is a permanent resident of Hong Kong and he does not have to live in Hong Kong for more than seven years to become one.

Case 2: SiuWah is a permanent resident of Hong Kong.No matter where his parents are from, as long as he has Chinese nationality and was born in Hong Kong, he can become a permanent Hong Kong resident. Case 3: Ah Ming is not a permanent resident of Hong Kong.Ah Ming does not have Chinese nationality. Unless his parents have the identity of Hong Kong permanent residents before he was born, or successfully applied to become Chinese citizens, he cannot become a permanent resident of Hong Kong even if he was born in Hong Kong.

Case 4: Ching Mei is a permanent resident of Hong Kong.Ching Mei’s father and mother are not Chinese citizens. Ching Mei still has Japanese nationality. However, as she was born in Hong Kong, and her father became permanent resident of Hong Kong before she was born, so she may have the identity of permanent resident. But this identity only lasts until she is 21 years old. However, according to the Basic Law, after she is 21 years old, she may still apply to the Immigration Department for the permanent residency.
