Will of Harman Miller Sr. of Halifax County, Virginia
In the name of God Amen I Harman Miller of the of Halifax weak in Body but of sound &
perfect memory thanks be to God for the same do make (?) & ordain this and no other to be my
last will & Testament manner & form following that is to say Item I give bequeath unto my
son Jacob Miller all that Tract I bought from John Sanders together will all tha? the tract
whereon I now dwell lying below his spring Branch as it meander to the river to him & his (?)
Item I lend unto my beloved wife Elizabeth this the plantation whereon I now dwell with all
the (?) lying above the aforesaid Spring Branch together with th following Slaves viz } Jack
Zacharias (?) Aaron Cillar & Pegg also all stocks of every kind. All my Household
Furniture & all necessaries whatsoever belong to the plantation whereon I now dwell during her
life or widowhood for her use and to bring up & educate my children Item at the Death

This is the Last Will and Testament Harman, brother of John Frederick Miller, who died about
1772. It has been abstracted from a photocopy of the original, which shows the document to be
very damaged, with several sections of it missing. Neverless, the partial remains still provide
some valuable information on the family.

This pay was for service in the Orange and/or Randolph County Regiment of the
Hillsborough Brigade. The Hillsborough Brigade was comprised of Regiments from
Caswell, Chatham, Granville, Orange, Randolph, and Wake Counties.

"A Petition of Harmon Miller was presented to the House, and read; setting forth, that a
Ferry from the Petitioner's Land, on the South Side of Dan River, to the Land of James Le
Grand, on the other Side, would br very convenient to Travellers and others; and
therefore praying that a Ferry may be established at that place.
Ordered, that the said petition be referred to the Committee of Propositions and Grievances;
and that they do examine the Matter thereof, and report the same, with their Opinion
thereupon, to the House."
10 Dec. 1769
"Resolved, That is the opinion of this Committee, that the petition of Harmon Miller,
Praying that a Ferry may be established from his land on the South Side of Dan River, in
Halifax County, across the said River, to the land of James Legrand, on the opposite Side,
is reasonable."

[This is "Miller's Ferry" as appears in Halifax County records, and was operated by
Harman, brother of John Frederick Miller. James LeGrand owned property along
Difficult Creek, and Dan River to the South. Little Toby Creek (not shown on this map) is
where John Frederick Miller was living (1757 and onward), and is located just to the west
of Birch Creek, both creeks flowing into Dan River. -- CM]
Map of 1751, showing the area where John Frederick Miller initially settled. His first
land entry (1748) was on the North Branch of Mayo River. In 1749, he also acquired lands
on Horsepasture Creek; and later on Stones Creek, a small tributary of Horsepasture Cr.,
shown on the map as just north of Wart Mountain. The Great Wagon Road, coming from
Pennsylvania, through the Shennandoah Valley came by, or through his lands in southern
Virginia, as shown above. The dotted line on the map represents the Virginia/North
Carolina border. Later on, John Frederick also acquired 400 acres of land on Spoon Creek,
a tributary of the South Fork of Mayo River where his brother-in-law, Haman Critz had
settled in 1748.

The first Herman Miller above, was actually Harman, son of John Frederick. For some
reason, JFM's eldest son, Haman, does not appear on this list. Jacob Miller, with slaves
Moroco and Sal, was the son of Herman (Harman), brother of John Frederick Miller.
This Harman was the one who operated the Ferry on Dan River.

new name is shown to pay his tax on the same day as Martin, though no tax seems to be due.
Though shown as an independent tithable, he may have been living in Martin Miller's
household. It's possible that Obediah may have been the middle name of Martin Miller Jr.
In 1800, Martin is shown with six horses. In 1801, he has five and Martin Jr. has one. In
this list Martin has four horses and Obediah has none. In 1803, Martin has six horses and
Obediah again has one.

I am seeking information on Daniel Bird Miller and his family which I have listed below.
Daniel was found in census there in 1833 and died in Campbell Township of Green County
in 1839. I have no other information on Daniel or his wife Elizabeth. Anything would be
very appreciated.
Daniel and Elizabeth had two children, see below. I believe that their daughter, Loanzia W.
Miller, was my great, great grandmother. She was the first wife of Frank or Francis A.
McClure of Dade County, MO. Together they had one child, Dialphia or Dialtha Elvira
McClure, who married William Marshall Young. Frank and Louanza's names appear in
the Dade County Deed Index, dated April 10, 1850, as selling their farm. Apparently soon
after they left in a wagon train to California. It seems that Louanza may have died and was
buried on the trail to California. Sometime in the next few years before 1860, after his
return from California, Frank married again to Harriet M. Taylor Wells, recent widow of
F. John Wells, of Dade County. More info is available on Harriet if needed.
As there is listed below information on Daniel and Elizabeth's son Eldridge Boyd Miller, I
am hoping that I may make contact with his descendants.
Eldridge was born in 1821 in Tennessee, however, I do not have a birth date or location for
his sister, Loanzia or my gggrandmother, Louanza.
Again, anything that you could share on Daniel Bird Miller, his ancestry, his family and
descendats would be very appreciated.

Don't know if this will be helpful, but my Miller family comes from Madison County and
Jefferson County Alabama and the name Eldridge is a very significant name in this line.
Don't know if you can connect to Alabama, but am willing to send you information if you

The above conveyance on Dutch Creek, was in Amherst County, Virginia at the time it was
executed. It is now in Nelson County, after the creation of that county in 1807. Located
several miles east of Lovingston, the county seat. At this time, it is not clear if the power of
attorney given to Joseph Lane of Amherst County, in Feb. 1793, is related to the sale of the
200 acres of land there by Martin Miller, in December of that year; or if Martin Miller
owned the property aside from his position of executor of his father's Will. This property,
prior to being in Amhrest County, was in Albemarle County, which in turn was created
from Goochland County. The latter county contained the property in 1739, at the time
John Frederick Miller arrived in America. No record has been found to date as to how and
when John Frederick, or Martin Miller acquired the 200 acres in Amherst County, which
Martin Miller, sold in 1793.

Mary Douglas Miller, daughter of Martin Miller of Halifax County Virginia, was married
to (?) Overstreet, per Martin Miller's Will (1814). Unconfirmed sourecs state that there
was a Thomas and Judith (Walker) Overstreet family living in Halifax County 1793-1808,
which had a son named Benjamin b. ca 1784, who married a Mary Miller, b. ca. 1795. This
family is found in the 1850 Marion County, Ky Census. They were the parents of a son,
also named Benjamin, who married Elizabeth (?). They in turn had a daughter, named,
Mary D. Overstreet; also a son Fredrick M. Overstreet (1860 Taylor County, Ky Census).
Mary (Miller) Overstreet died during the 1850's; not being in the Census with her husband
in the 1860 Taylor County, Ky. Census.

"In February, 1830, J. P. Campbell and his brother-in-law, Joseph Miller, fixed up with their
small families, and set out for Kickapoo prairie. Mr. C.'s family consisted of himself, wife and
one child, Tabitha, then not a year old, who was afterward the mother of Lula, wife of Frank
Sheppard. Mr. Miller's family consisted of himself and wife and two children. Rufus was one
year old, and John, who is now a citizen of Ritchey, was twelve. They also had Six darkies,
one five horse team and one Derbin wagon which was driven by John. (Madison C. did not move
until 1832)....
They journeyed via Nashville and Hopkinsville, crossing the Ohio at Golconda, thence over the
south end of Illinois to Green's old ferry on the Mississippi. It being in February, they
encountered great difficulties in crossing on the quantities of floating ice, but after making
several trips across the river in an old, rickety piece of a flat, the wind being high and cold, they
succeeded in landing safe on the Missouri side; thence they were obliged to almost cut their own
road, but onward they went toward the West, by old Jackson in Cape Girardeau county, stopping
one day to rest at old Col. Abram Byro's, five miles west of Jackson. Thence they proceeded on
to Farmington, in St. Francois county, and by Caledonia, in Washington county, which was the
last town, and it only contained one little store and two or three dozen inhabitants. Then on west,
with scarcely any road, to the present site of Steeleville, in Crawford County, and on twelve
miles further to Massey's iron works, which had not been in operation but a very short time, and
so on to where Rolla now stands. Twelve miles farther on, they came to old Jimmey Harrison's ,
at the mouth of Little Piney, on the Gasconade, about four hundred yards south of the present
Gasconade bridge. Mr. Harrison kept a little store for the accommodation of the few settlers up
and down the Piney and the Gasconade ; that was also the courthouse for the whole of Southwest
Missouri. and so it was the only post office until 1832. Thence west twenty miles brought them
across the Pig Piney on to Roubideaux, now Waynesville, in Pulaski County. Continuing their
journey, they went up the Gasconade river to the mouth of the Osage fork, where they found a
few white settlers --some of the Starks, Ballous, Tygarts, O'Neals, and one old `Jim Campbell,'
who was sheriff of all of Southwest Missouri. This was in the neighborhood of the present
Oldland Post office. From there they came on to Cave Spring, where they crossed the Osage fork,
leaving it at the old Barnett place, from which they came to Pleasant prairie, now Marshfield,
and striking James fork 20 miles east, thence down to Jerry Peirson's, where he had built a little
water mill at a spring just below the Danforth place ; then on west they struck the Kickapoo
prairie one mile east of the present Joe Merritt place ; thence five miles more brought them to the
natural well a short distance north of the present public square of Springfield. Here they
first camped on the night of the 4th of March, 1830....

In the meantime, Uncle Billy Fulbright had got about three weeks ahead of them, and stopped at
the Fulbright Spring. His brother, John Fulbright, had settled at the spring where Capt. Geo. M.
Jones now lives, and had a cabin up ;and his brother-in-law, A. J. Burnett, had succeeded in
putting up a small oak-pole cabin l2x15, just on the spot of the old `Squire Burden residence. a
little west of Mr. McElhany's. Mr. Campbell having had rather the oldest claim, by his name
being cut en an ash tree at the well, Mr. Burnett gave way and went and commenced an
improvement five miles east, at the Merritt place. Both Miller's and Campbell's families then
moved into the pole cabin, the negroes having a good cloth tent to live in. This cabin had a
splendid dirt floor....

Joseph Miller settled at the spring, a short distance southwest of the city, where Mr.
Beiderlinden has since lived, after which he sold out to Maj. Joseph Weaver, and removed to
Sac river, thirty miles northwest of this city. Mr. Weaver came in March, 1830, from Marshall
county, Tennessee, and first settled at the Delaware town, where he purchased and improved the
farm now known as the Porter place, upon which he lived until his removal to the above named
point. On this farm he remained three or four years before removing to the place known as the
Weaver grove, two-and-a half miles west of town. After one or two other removals, he died in
September, 1852, on the farm three miles northwest of the city....
Of his family of thirteen children, eleven were by his first wife, to whom he was married in
Georgia. His second wife, and the mother of his two younger daughters, was the widow of Dr.
Wm. Shackelford, who will hereafter be mentioned. Of the first family eight are still living, and
one of the second. Of these J. J, and E. L. Weaver, and the wives of J. L. Carson and J. M.
Griffith, all living in this city, are well and favorably known to most of our readers ; also another
son, Thomas J. Weaver, who lives at the Weaver Grove. One brother, R. B., and two sisters, are
living in Boone county, Arkansas, Mr. Weaver being at the present time the Representative of
that county in the State Legislature. Joseph J. Weaver has taken a prominent part in the affairs of
this city, having served two or three terms as Councilman from the Third Ward, and one year as
Mayor. ...

First Settlers
Major Joseph Weaver arrived in March, 1830, and bought out a settler near Delaware Town,
where he lived three or four years. He then came Springfield and purchased the farm of Joseph
Miller, the brother-in-law of J. P. Campbell, just southwest of the town. Mr. Miller had come in
with his brother-in-law some four years before selling to Weaver. Mr. Weaver lived on this place
some years, when he moved to a farm two and a half miles west where he died in 1852, His
numerous descendants have always held a prominent place in the history of both the city of
Springfield and of Greene county. [134]
In 1831 Daniel B. Miller, a brother of Joseph Miller, settled in the northwest part of what is
now Springfield, at a great spring, still called for him, "The Miller Spring." After serving as a
water supply for the first Springfield woolen mill, which enterprise, soon died and remained with
the brick building standing vacant for twenty years, this spring and a fine tract of land of twenty
acres is now being turned into a city park, with a beautiful lake of several acres. Mr. Daniel B.
Miller only survived some nine years, dying in 1839. Samuel Lasley came to Greene county
with Daniel B. Miller and settled on Little Sac at the crossing of the Bolivar road. Spencer
O'Neil, who had been one of the first men to take up claims in the Indian country, and had been
forced to move away with the others in 1822, now returned and settled in the southwestern part
of the county. Many of his descendants are citizens of Pond Creek, Republic and Brookline
townships to the present day.

Chapter 1
"Joseph Miller settled at the spring, a short distance southwest of the city, after which he sold
out to Maj. Joseph Weaver, and removed to Sac river, thirty miles northwest of the city...
In 1831, Daniel B. Miller, a brother of Joseph, settled at what is still known as the Miller
spring in the northwest part of the city, and which furnishes power in the form of steam for the
Springfield woolen mills. Here he made a field which was afterward used as the Federal burying
ground. Mr. Miller remained in Springfield until his death, which occurred in January,
1839....
At the Miller spring is a disappeared graveyard of six or seven persons of the Miller family.
It is some eighty or one hundred yards east of the spring, may be a little southeast, now covered
over with houses and fences. I am very sure they have never been taken up. The graves were near
the foot of a solitary large black oak tree that then stood there, which was surrounded by a thick
growth of young oak sapplings or bushes. They were buried there in 1831, '32, '33, '34, '35
and '36.
About the middle of February, 1830, Wm. Fulbright, John Fulbright, and A. J. Burnett, from
Tennessee, settled near the Fulbright spring, and put up some cabins, built of small oak poles.
Previousty in the fall of 1829, John P. Campbell and his brother, Madison, Tennesseans also, had
"claimed" the land occupied by the Fulbrights, by cutting their names on some trees in the
vicinity of the spring. Returning to Tennessee, J. P. Campbell and his brother-in-law, Joseph
Miller, set out for Missouri in the month of February following, and on the evening of March 4th,
encamped near the "natural well," a little north of the former residence of R. J. McElhany. Mr.
Burnett having completed a cabin on the same site, and Mr. Campbell claiming priority of
ownership, evidenced by his initials on an ash tree near the "well," Mr. Burnett was compelled to
remove and readily gave away and removed five miles to the eastward. Messrs. Campbell and
Miller with their families, in all seven persons, took possession of the vacated cabin, 12x15 feet
in size, while their slaves, six in number, dwelt for a time in a stout, comfortable tent, which had
been used for sleeping quarters en route from Tennessee....
Among those who settled on and adjoining the present site in 1830 were Thomas Finney, Samuel
Weaver, and Joseph Miller. In the next year came Daniel B. Miller, Joseph Rountree, Signey S.
Ingram, Samuel Painter, and Junius T. Campbell. The latter opened a little store near where the
public school building is now. His stock, a small and by no means a varied one, was hauled from
Boonville. Mr. Campbell had a partner, one James Feland, an old Santa Fe trader....
The first settlers on the town site of Springfield were Wm. Fulbright, John Fulbright, A. J.
Burnett, John P. Campbell and Joseph Miller, in February and March, 1830.
The first house was a little pole cabin, built by A. J. Burnett, in January or February, 1830. It
stood on the hill a little south of the old "natural well," and a little northwest of the present brick
public school building, on Jefferson street. In size this cabin was 12x15 feet...A little later in the
year 1831, Frank Miller, a son of Joseph Miller, was born in a house which also stood near the
old well. He is now residing at San Diego, California. It is claimed, for these children, that they
were the first whites born in Greene county. The first death was that of a child of Joseph Miller,
in 1831. The body was buried under a large oak tree, near the Miller spring....Junius Rountree
married Martha Miller, a daughter of Joseph Miller then living about one and a half miles
west of Springfield, August 7, 1831. Not long afterwards Junius T. Campbell married Mary
Blackwell, at a house a mile and a half southwest of Springfield. These are believed to have been
the first marriages within the present limits of Greene county....The first school house was built
in 1832. It was of small logs and stood where is now the old Christian church (used at present as
a private residence), on the north side of College street, a little west of Main, and near where Gen.
Lyon's general headquarters were, and where his dead body lay. But the first school house
attended by children who then lived on the present site was built in 1831, and was also of small
logs. Of this school house, John H. Miller says it stood a mile and a quarter west of town, and
the first teacher was old uncle Joe Rountree; the pupils were Henry Fulbright and some of his
younger brothers, the Rountree boys, John Miller, J. J. Weaver, and his two older sisters,
Louisiana, late wife of Col. C. A. Haden, and Jane, mother of Joe Farrier, and a few others....
Chapter 33
Campbell Township
The first marriage in Campbell township, is said to have been the first marriage of white persons
in Southwest Missouri. It was that of Junius M. Rountree and Martha J. Miller, and the
marriage occurred August 7, 1831, at the house of the bride's father, Joseph H. Miller, in section
22, township 29, range 22. The ceremony was performed by Rev. Richard Kizee, a Baptist
minister. The groom was a son of old Joseph Rountree, and the bride a daughter of old Joe
Miller. The parties had been acquainted in Tennessee, the Rountree and Miller families being
from the same neighborhood."

for the sum of two hundred fifty pounds land, 444 acres in county of Henry on both sides of the

by them to John Stone. Beginning at Hamon Crite's (Critz?) upper cross line . . . lower cross line
of land laid off by Randolph & Company to John Frederick Miller and now in possession of

Transcription This indenture made this twenty eight day of April one thousand seven hundred and eighty one
[28 April 1781] between Thomas Kendrick of the County of Halifax of the one part and John
Moore of the said county of the other part, witnesseth that the said Thomas Kendrick for and in
consideration of the sum of forty [40] pounds current and lawful money to him in hand paid the
receipt whereof the said Thomas Kendrick doth hereby acknowledge hath granted bargained and
sold unto the said John Moore his heirs and assigns all that tract or parcel of land situate lying
and being in the County of Halifax and containing one hundred and si
xty [160] acres by estimation and bounded as follows: Beginning at a corner pine on Richard

resurveyed by William W. Simpson, which by his survey contains 142½ acres. The land is

Haman Miller of Randolph County, North Carolina
"Hamon Miller, Sr. (1753 - 1814) was one of the two executors of Godfrey Ridge. Hamon, wife
Frances Roberts, and family also came from Halifax County, Virginia. He was one of the
wealthiest men in Randolph County and lived on lands adjoining Godfrey Ridge. A grandson of
Hamon, namely, Jesse H. Miller, married a granddaughter of Godfrey, Mary Ridge in 1831.
James Roberts, one of the witnesses to Godfrey's will, was the brother of Frances Roberts and
brother-in-law to Hamon Miller...."

ago he understood that Haman Miller had a Mortgage against William Roberts for a number of
Negroes & he heard Haman Miller tell s'd Roberts that he now had it in his power to Settle the
Matter on good Terms & that he had Better do it as he was getting old & perhaps said he some
time or other the Bond may Come & I shall have to Distress your Children this mortgage was
given by William Roberts Sen'r to Haman Miller & Sam'l Roberts for Standing Security for s'd
William Roberts for a Sum of money to a Scotch Merchant who then Lived in the State of
Virginia but his name he does not recollect & the s'd Miller told the s'd William Roberts If he
would give him two hundred pounds he would Clear him of the Scotch Merchant & he saw
William Roberts after agreeing to pay the two hundred pounds pay down part of the money about
fifty pounds & he saw money paid at other times in Consequence of s'd mortgage or Deed of
trust but how much he does not recollect but he heard Haman Miller say that he had received all
of the money & that he heard William Roberts ask him for a receipt in full of all Demands of
Every kind & that s'd Miller told s'd William Roberts to write a receipt & that he the s'd Miller
would Sign it & s'd Roberts wrote a receipt & that s'd Haman Miller signed s'd receipt & that he
this deponant was a witness to the same & then he heard Haman Miller some time after that
Direct William Roberts how to dispose of the negroes that he gave to Isham Fuller & wife & he
Done agreeable to his Directions in giving them away & further this Deponant says that he saw
Haman Miller Deliver to his Father William Roberts the above mentioned Mortgage & that he
heard Haman Miller Say that he was amply Satisfied for S'd Mortgage & further says that after
the death of William Roberts he saw the S'd mortgage in among his Fathers papers & also the
above mentioned Receipt & further this deponant Sayeth that he heard Sam'l Roberts tell
William Roberts that he was amply Satisfied respecting the mortgage above mentioned & this
Deponant says that he is neither gainer nor looser in the Event of the Sute wherein Haman Miller

By virtue of a Didamus to us directed by the honourable Court of Hillsborough District in North
Carolina we have cause to come before us, William Bailey, Esq'r after duly Sworn as the law
directs saith as follows, that some time in the year one thousand Seven hundred & eighty three or
four as well as he can recollect, he the S'd Bailey had an Execution against Peter Roberts, son of
William Roberts and he directed the officer to execute a negro Boy named Simon then in
possession of William Roberts his father, which the said Bailey thought to be the property of
Peter Roberts and the S'd Bailey Said that he went to the house of the S'd William Roberts and
the S'd William Roberts and Sarah his wife Said that the negro boy named Simon and several
other Negros then in their possession was Mortgaged to Hamon Miller for becoming security for
the Said William Roberts for a large sum of Money which Debt was then unpaid, and that he the
S'd Bailey could not execute and Sell any of the Said negros for they ware the property of
Hamon Miller, also Peter Roberts, son of William Roberts told Said Bailey that the above
mentioned negros was then the property of Hamon Miller till Said debt was paid and the said
Bailey further saith that about the same time or some time before the negro girl named Clo was
in the possession of William Roberts and also a negro woman named Jinny was said to be made
over by the Same Mortgage to the S'd Haman Miller and the S'd Bailey further saith that Since
that time he has seen the S'd negro named Clo in possession of James Daniels further the

The first court in the county was held in the. barn of Evan S. Polk, northwest of Huntsville about
one fourth of a mile.

The contractor was Evan S. Polk, who burned the brick on his farm adjoining the town. The cost
was about $4,000. This building was burned by northern vandals in 1863. The records were
taken to Springfield, Mo., and there lost or destroyed, in great part.
Early History.-The southern part of the town site was originally entered by George Sanders, by
whom the first house was built. The tract adjoining this on the north was entered by Evan S. Polk.
John Sanders, brother to George, seems to have been most actively interested in having the town
laid off. This was done in 1837 by Thomas McCuistion, county surveyor.
