At EES Showhire we are aware of the problems of putting on a show in venues that are

often less than ideal.

One phone call to us could help solve all those problems!

We supply, hire and instal l al l the leading makes of stage lighting and sound equipment

available in the UK.

All our equipment is maintained to the highest standards and can be hired on a daily or

weekly basis.(longer term hires can be arranged if required, please call for detai ls)

We have kept our prices as low as possible to enable you to hire al l the equipment you

need to make your production a technical success.

Please remember that our advice is free and we are happy to help.

I f an item you require is not on our hire l ist we may sti l l be able to help you, or suggest an

alternative item that wil l do the job just as well .

The fol lowing pages represent a wide selection of our hire items but new equipment is

being added all the time so please feel free to contact us if an item you require is not

l isted.

In addition to our hire stock we also sell a wide range of sound and lighting equipment and

also have consumable items such as gaffa tape, fuses and lamps.

I f you experience any problems with our equipment, or your own, our technical

department has a ful ly equipped workshop to service and repair most items. We also

provide a Portable Appliance Testing service.

Operators are warned that pyrotechnic devices can sometimes vary in their performance and no guarantee is given or implied by LeMaitre or its agents that every device wil l

perform in the same manner.

LeMaitre pyrotechnics must only be used in conjunction with LeMaitre firing systems or LeMaitre approved devices. Any such device wil l have written approval for its use

from LeMaitre.

No liabi l ity of any sort wil l be entertained by LeMaitre or EES Showhire where pyrotechnics are used with a non-approved firing system, or if injury has occurred to any

person due to the inappropriate use or misuse of the pyrotechnic system

GENERAL TERMS & CONDITIONS OF HIRE OR PURCHASE

1 DEFINITIONS

In this document the fol lowing words shall have the fol lowing meanings:

1 .1 “Agreement” means these terms and Conditions together with the terms of any applicable Service Specification;

1 .2 “Customer” means the organisation or person who purchases goods and /or services from the supplier;

1 .3 “Order specification” means a quotation or other similar document describing the goods to be provided by the Supplier;

1 .4 “Goods” means the articles to be supplied to the Customer by the Supplier;

1 .5 “List Price” means the l ist of prices of the Goods maintained by the Supplier as amended from time to time;

1 .6 “Supplier” means EES Showhire, The Old Workshops, 47 Chancery Lane, Retford, Nottinghamshire, DN22 6EU.

2 CHARGES

2.1 Hire charges commence from the date stated in the contract and are payable for the period of hire

2.2 Equipment must be returned by 1 2 noon on the date specified in the Contract in a clean and serviceable condition.

2.3 Additional charges accrue at the ful l dai ly hire rate together with consequential loss in the event of the breach of these conditions or the equipment not

being available for use by other customers

2.4 All cables must be returned coiled and taped as collected or a charge of £1 .00 per cable may be levied by EES Showhire.

2.5 EES Showhire provides spare lamps and fuses with Equipment where appropriate. These and any lamps and fuses they replace must be returned with

the Equipment in an unopened condition or their ful l replacement cost wil l be charged

2.6 All charges are payable on demand

2.7 We understand and wil l exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are

not paid according to the invoice terms.

3 PAYMENT TERMS

FEES AND PAYMENT

The fees for the sale and supply of goods and services are set out in the Order Specification and Suppliers Current Price List or such other price as the

parties may agree in writing. The Supplier shall invoice the customer at cash on collection unless otherwise agreed. The price is exclusive of VAT or any other

applicable costs. Carriage shall be paid for by the Customer.

Invoiced amounts shall be due and payable within the invoice terms. In the event that the Customer's procedures require that an invoice be submitted against

a purchase order to payment, the Customer shall be responsible for issuing such purchase order before the goods are provided.

I f payment of the price or any part thereof is not made by the due date, the Supplier shall be entitled to:

require payment in advance of delivery in relation to any Goods not previously delivered;

refuse to make delivery of any undelivered Goods whether ordered under the contract or not and without incurring any liabi l ity whatever to the Customer for

non-delivery or any delay in delivery;

Please note all accounts beyond our credit terms wil l be passed to our debt col lection agency. All accounts, without exception, wil l be subject to late payment

charges and interest in addition to a surcharge of 1 5% plus VAT to cover our costs in recovery. These accounts wil l also be subject to any legal costs incurred

in obtaining settlement.

RETENTION OF TITLE

Legal title of the work the subject of this contract shall not pass to the customer unti l the supplier receives payment in ful l of al l sums whether in respect of the

work or otherwise due owing or incurred including VAT. Unti l legal title passes the customer shall be the bailee of the goods for the supplier but the risk in the

goods shall be borne by the customer from the date of delivery. The customer shall ensure that he has appropriate insurance in this connection

4 HIRE PERIOD

The hiring period commences on collection on the date specified in the Contract and continues for the period specified in the Contract and terminates at 1 2

noon on the last day of the hiring period. A day hire is col lect after 1 2noon on specified day, and returned before 1 2noon on the fol lowing day, a week hire is

col lect after 1 2noon and return before 1 2 noon 7 days from the collection date. i .e. Saturday to Saturday, Monday to Monday. Saturday after 1 2noon to

Monday before 1 2noon wil l be classed as a day hire rate.

5 AUTHORITY TO ENTER THIS CONTRACT

The signatory to the contract warrants that they are duly authorised on the Customer’s behalf to enter into the contract and hereby personally indemnifies

EES Showhire against al l losses and costs that may be incurred by EES Showhire if this is not the case

6 CUSTOMER'S RESPONSIBILITIES

6.1 The Customer’s responsibi l ity for the Equipment commences on receipt of the Equipment by the Customer or his agent or on delivery and ends when the

Customer returns all equipment as specified to EES Showhire

6.2 The Customer shall not at any time sell dispose or otherwise part with control of the Equipment or attempt to do so

6.3 The Signatory to the Contract and the Customer jointly and several ly undertake with EES Showhire that everyone who uses the Equipment has been

properly instructed in its safe and proper operation and wil l ensure that every user is in possession of necessary instructional material and further wil l not al low

the Equipment to be misused

6.4 The Customer wil l at al l times ful ly indemnify EES Showhire against any expense liabi l ity financial loss claim or proceedings whatsoever in respect of any

personal injury or damage to or loss of any property arising out of or in connection with the delivery hire use non use repossession collection return or non

return of the Equipment

6.5 In the case of outdoor venues, the customer must provide a secure environment at al l times. I f the equipment is to be left outdoors overnight a security

guard must be provided at the customers expense. I f EES Showhire is to provide a guard the cost wil l be covered by the customer.

6.6 The Customer is responsible to check where applicable and obtain any licenses that may be required to operate equipment hired or loaned to them by

EES Showhire.

6.7 Nothing in this clause shall affect the statutory rights of the Customers or purport to exclude any liabi l ity which may not be excluded under the Unfair

Contract Terms Act 1 977.

7 ELECTRICAL EQUIPMENT

7.1 Any electrical Equipment should be used with plugs and/or sockets as fitted. I f other plugs or sockets are to be fitted by the Customer such work shall be

carried out by a competent person who shall also reinstate the same to the original condition prior to return.

7.2 The Customer shall be responsible at al l times to arrange a proper supply of electricity for use with the Equipment and ensure that the Equipment shall at

al l times be properly earthed

8 EQUIPMENT MAINTENANCE AND REPORTING

8.1 The Customer shall ensure that the Equipment remains serviceable and clean during the hire period.

8.2 Any breakdown or unsatisfactory working of Equipment shall be immediately notified to EES Showhire.

8.3 The Customer shall under no circumstances attempt to repair the Equipment without prior authorisation from EES Showhire.

8.4 Any damaged or unsatisfactory Equipment must be returned to EES Showhire’s premises for examination at the Customer’s cost.

8.5 If the Equipment is involved in any accident resulting in damage to either the Equipment or other property or injury to any person the Customer shall notify

EES Showhire immediately.

8.6 Equipment must not be removed from any site original ly specified by the Customer or from any subsequently authorised site without prior consent of EES

Showhire.

9 COMPATABILITY OF EQUIPMENT

9.1 The Customer shall ensure that the Equipment is compatible and may safely be used with any other Equipment being used by the Customer.

9.2 The Customer shall be responsible for ensuring that any equipment is suitable for their purposes.

1 0 INSURANCE

1 0.1 The Customer agrees to pay EES Showhire the ful l retai l cost of any Equipment lost stolen or damaged beyond economic repair (without deduction for

usage wear tear or age). Any damage, marks or breakages caused by the customer to the equipment must be reported to EES Showhire immediately and

agree to pay any costs of repair or replacement in ful l .

1 0.2 The Customer shall insure the goods against the above liabi l ity.

1 0.3 All monies received by the Customer from any insurance company or third party in settlement of any claim shall be held in trust by the Customer and

paid to EES Showhire on demand to the extent that any such payment is due under this clause.

1 0.4 The Customer shall not compromise or settle any claim without the express consent of EES Showhire.

1 0.5 In the case of Equipment which is lost stolen or damaged beyond economic repair the Customer shall pay a charge at the ful l dai ly rate together with

interest and consequential loss unti l the Equipment is replaced.

11 CONDITION OF RETURNED EQUIPMENT

11 .1 The Customer is ful ly responsible for care safe keeping and return in good order of the Equipment.

1 1 .2 The Customer wil l reimburse all costs incurred by EES Showhire in rectifying the condition of any Equipment returned damaged or unclean and shall in

addition pay a charge at the ful l dai ly hire rate together with interest and any consequential loss unti l rectification.

1 2 TERMINATION OF HIRE

EES Showhire shall be entitled to terminate the contract with immediate effect and to repossess the Equipment if at any time: -

The Customer is in breach of these terms;

The Customer shall take any steps or if any act or proceeding is commenced in which the Customer’s solvency is in the reasonable view of EES Showhire in

doubt. Such termination shall not affect the right of EES Showhire to recover from the Customer any monies due under this contract interest consequential

loss or damages for breach;

The Customer hereby authorises EES Showhire to enter upon any property upon which EES Showhire reasonably believe any Equipment to be and EES

Showhire in their absolute discretion may recover and remove the Equipment;

The Customer hereby authorises EES Showhire (notwithstanding any subsequent instruction to the contrary after the date of the commencement of the

Contract) to deduct any sums properly due to EES Showhire arising under a breach of these terms from any credit card debit card or charge account detai ls

of which are in the possession of EES Showhire
