LANGKAH PERSEDIAAN • Tahun 2011 dan awal tahun 2012 - Perbincangan dengan SIRIM bagi
memastikan standard-standard terkini untuk semua kelengkapan
• Julai 2012 - mesyuarat diadakan dengan Bahagian Perkhidmatan Teknik, Kastam Diraja Malaysia supaya kelengkapan disenaraikan di dalam Jadual Ke 4, Perintah Kastam (Larangan Mengenai Import) 2008.
• Pada 5 Jun 2012 lalu, taklimat mengenai draf senarai kelengkapan baru telah di adakan kepada Persatuan Pengedar Alat Elektrik Malaysia (MEADA), Persatuan Pengilang, Pembekal, Kontraktor, Industri Elektrikal, Elektronik, dan ICT Melayu dan Bumiputera (PERKEM), TEEAM dan beberapa pengimport lain telah diadakan. Tiada apa-apa bantahan dari taklimat tersebut.
• Lembaga Suruhanjaya Tenaga telah meluluskan penyenaraian semula kelengkapan ini pada 15 Jun 2012.
Responsibility of Manufacturers, Importers, Exhibitors, Sellers and Advertisers
• Manufacturers, importers, exhibitors, sellers and advertisers of any electrical equipment prescribed under sub regulation 97(1), of the Electricity Regulations 1994 must ensure that their obligations under the said Regulations are fulfilled.
• Offences and Penalty Regulation 122, Electricity Regulations 1994 Unless otherwise made an offence under the Act, a person who
contravenes or fails to comply with any of the provisions of these Regulations shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding RM5,000 or to imprisonment for a term not exceeding 1 year or to both.
APPLICATION FOR CERTIFICATE OF APPROVAL FOR ELECTRICAL EQUIPMENT
Application Procedure
• Effective 1st October 2010, all applications are done through the online via e-Permit system, operated by DagangNet Technologies Sdn. Bhd. (DagangNet).
• To import household electrical equipment, applicants or their local agents need to register with DagangNet. Once registered, applicants can proceed to apply electronically. ST will issue the Certificate of Approval (CoA) if applications are in order.

ELECTRICITY (AMENDMENT) REGULATIONS 2012
• The purpose amendment is to align with Asean Agreement with regards to EE sector;
1. ASEAN Sectoral Mutual Recognition Arrangement for electrical & Electronic Equipment (Asean EE MRA).

2. Agreement on the ASEAN Harmonized Electrical and Electronic Equipment (EEE) Regulatory Regime (AHEEERR)

• The element of amendments include;
• (1) To recognize a foreign CABs within Asean and Non-Asean.
• (2) To register a CABs within Malaysia for the purpose of certifying that any equipment under regulation 97.
• (3) Manufactures or imports of EEE shall, prior to the commencement of business apply to be registered with the Commission
• (4) Importer of equipment shall submit to the Commission: • • (a) a test report of the equipment conformity with standards recognized by
the Commission; or • (b) a Certificate of Conformity (CoC) issued by a CAB recognized by the
Commission. – the Commission may inspect, test or review any equipment, documentation,
test report and conformity assessment submitted to it.
ELECTRICITY (AMENDMENT) REGULATIONS 2012
• (5) Manufacturers and importers shall keep all technical files of the equipment issued with a test report / CoC for not less than ten years after the last equipment has left the production line.
• • (6) A testing laboratory in Malaysia accredited by the
accreditation authority shall keep all technical files of any equipment issued with a test report for not less than six years after the expiry of that test report.
• (7) The Commission may, from time to time, carry out market surveillance to determine if any equipment referred to in regulation 97 is safe and has the label as specified in these Regulations being affixed to it.
ELECTRICITY (AMENDMENT) REGULATIONS 2012
Issues
• Despite all measures taken to control the importation and manufacturing of EEE, there are still lots of sub-standard equipment in the market.
• Our meeting with Jab. Kastam recently reveals that out of thousand CoAs sent to Custom Dept, only 10-15% are being used to import EEE products.
Way Forward
• Market Surveillance is an ongoing activities by ST Enforcement department. Most hypermarket and retailers has been reminded not to accept electrical appliances without Sirim-ST label. Most of the directors has been warned.
• ST will work together with agencies and associations to ensure EEE products in the market are in accordance with all requirement and safe to be used.
• Towards paperless – no hardcopy of CoA is to be issued. Applicant may print CoA at their end.
• To enhance ePermit process, online payment for CoA application will soon be implemented.
• ST will issue a new edition of ‘Application for CoA Information Booklet 2012’

The Electrical & Electronics Sector is one of the 11 priority sectors identified for integration in ASEAN under the ASEAN Priority Integration Sector initiative. In 2009 electronics sector has a total trade value of $330 billion. Electronics machinery, equipment and parts, sound equipment and television equipment accounted for 21.5% of the region total trade. With 11.8 percent share of world production in 2008, ASEAN is the fifth largest producer of electronic equipment.

The ASEAN cooperation in standards and conformance currently encompasses activities for the removal of Technical Barriers to Trade (TBT) in ASEAN. The main approaches are as follows: Harmonisation of national standards with international standards (IEC); Harmonisation of mandatory technical requirements which include registration and pre-market approval requirements to ensure free movement of goods; and Harmonisation of conformity assessment procedures which include accreditation, certification, testing and inspection and mutual recognition of test reports and certification to save transaction time and to avoid high cost through multiple testing requirements.

• For effective functioning of the MRA, a Joint Sectoral Committee is established. (JSC EEE MRA ).

Participating countries
All 10 members of ASEAN countries have notified their level of participation. Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Singapore and Myanmar , Vietnam- participating at the acceptance of both test reports and/or certification level. Malaysia, Philippines and Thailand are participating at the acceptance of test reports level.
AHEEER – PARTICIPATION LEVEL OF MEMBER COUNTRIES
Various initiatives are being undertaken to ensure that the infrastructure as well as the technical requirements that will support the full implementation of the AHEEERR are in place. These include: 1. Ratification and transposition of the AHEEERR into national legislation of Member States. All Member States except Thailand have ratified the Agreement. 2. Transposition of the AHEEERR into national legislation - The proposed amendment of Electricity Regulations 1994 has been forwarded for Minister’s approval.

3. Listing of International Standards and Harmonised Regulatory Requirements . Common international standards harmonized in ASEAN are identified which will be used to demonstrate compliance to the essential requirements of safety, health and environment as stipulated in the Agreement. 4. Conformity Assessment Procedures based on Risk Assessment Efforts are being carried out to finalise the Risk Assessment Model which will be used to determine the conformity assessment procedure for the product following the risk level that the electrical and electronic equipment may pose to consumers.
