    The Farmton property is located within unincorporated Volusia County and Brevard County; however, this transmittal package only covers the approximately 47,000-acre portion that is located within Volusia County between Interstate 95 and the St. Johns River, contiguous to the City of Edgewater at the I-95/SR 442 interchange. As a condition of the Farmton Local Plan, which was adopted by Volusia County and made effective on March 29, 2012, the property must submit an Application for Master Development Approval (AMDA) within 5 years of the adoption of the Local Plan in accordance with Section 380.06(21)(b), Florida Statutes (F.S.). The AMDA will establish the development program for conceptual Sustainable Development Areas and identify existing conditions as the framework for subsequent Applications for Incremental Development Approval (AIDA) submittal requirements. According to Policy FG 8.3.a, a Master Transportation Planning Study needs to be performed as part of the Master DRI. This Master Transportation Planning Study must reflect a representative build-out development program for the Farmton Local Plan and must identify the required transportation corridors needed to serve the Farmton development. Therefore, one of the objectives of this AMDA is the identification of such corridors and at (approximately) what point in time such corridors will be needed.

    According to Table 21-2, the proposed I-95/Maytown Road interchange will not be constructed until the year 2060. One of the objectives of the AMDA is to identify required improvements and the timing of these improvements (time and Farmton DRI development quantities/percentage). However, there is no analysis regarding the timing of this interchange. Please provide an analysis clearly identifying at what point in time and at what Farmton development level the interchange will be required.

    With respect to Table 21-10, please clarify the source for the 2005 Model volumes. We have reviewed the 2005 CFRPM Validation Model Run provided with the model, but the 2005 volumes included could not be replicated. Please revise these volumes in the analysis as necessary.     6 21-24 Question 21.D – Table 21-10 – Growth Projection

    The Florida Department of Transportation (the Department) has reviewed the proposed growth projections and has the following comments:

    S.R. 442 from Williamson Boulevard Extension to I-95: “Model Volume” is the proposed method to forecast 2060 background volumes. However, 2060 background model volumes are lower than 2035 model volumes resulting in a negative 2035-2060 growth rate, which does not appear reasonable. This may be due to the additional project traffic occupying the roadway capacity and not leaving “room” for background traffic. To avoid this issue, please apply a 1.0 percent annual growth rate to 2035 background volumes to forecast 2060 background volumes.

    S.R. 415 from S.R. 46 to Acorn Lake Road: The use of a 2.0 percent annual growth rate is the proposed method to forecast 2035 background volumes. According to the Applicant’s consultant, the reason for this is that the model overstates growth in the area due to the presence of the Osteen Local Plan. It is necessary to note that the Osteen Local Plan was included as background to be able to estimate the impacts of all the developments in the area. Therefore, its inclusion in the roadway volume forecast is necessary. Please apply the following methodology to forecast future background volumes:

    o 2035: Model obtained growth rates (to reflect the first 50 percent of the Osteen Local Plan)

    o 2060: 2.0 percent annual growth rate applied to 2035 (to reflect the second 50 percent of the Osteen Local Plan)

    8 21-41 Question 21H The Department is extremely concern about the fact that the Williamson Boulevard Extension is projected to fail in 2035 and that most of the Spine Transportation Network is anticipated to fail in 2060, even after being widened to 6 lanes. This indicates that the Spine Transportation Network is not adequate to support the proposed development and that additional roads connecting the different SDA’s will be needed. The Department’s concern in consistent with guidance provided by the Institute of Transportation Engineers Recommended Practice “Planning Urban Roadway Systems” – specifically the objectives of:

    providing adequate capacity for expected travel demands, providing a network at a scale suitable for transit, pedestrian, and

    bicycle travel, providing for routing alternatives for normal daily traffic flow as well

    as incident management purposes, and developing networks with more frequently spaced roadways rather

    than relying on sparse networks of wide arterials. We strongly encourage the applicant to work with Volusia County on identifying additional corridors that can serve the project. The Department will be more than glad to provide support during this process.

    9 21-41 Question 21H As noted above, the Department is very concern about the inadequacy of the Spine Transportation Network to support the proposed development. The proposed mitigation for this condition appears to be the implementation of transit. The Department is very supportive of multimodal strategies that can help mitigate the impact of this development. As transit will be a fundamental component of the project’s overall mitigation strategy, the following aspects need to be defined and agreed to during this AMDA:

    The type of transit system will be evaluated during the AIDA analyses. An example transit system could be a fixed guideway system which would avoid transit vehicles being trapped in general use lanes if roads become oversaturated. Therefore, the AMDA needs to include provisions ensuring the availability of sufficient right-of-way to accommodate such a transit system.

    The transit system serving this development will need to provide a connection to the “external” transit system. In other words, it cannot be an isolated transit system circulating strictly within the development, rather, it must have connection to Votran.

    The transit system to serve the development will be provided at no cost to either the County or FDOT. The applicant will be responsible for funding the system (both capital and operating costs). To ensure the funding of the system, some kind of special assessment within the proposed development may need to be considered.

    The specific characteristics and implementation plan of the transit system shall be discussed and agreed to during the AIDA analyses.

    Mr. Milch: Our staff at Central District Florida Department of Environmental Protection (Department)has completed review of the Farmton Application for Master Development Approval (AMDA)as requested by the ECFRPC on November 18, 2013. Please note the following staffcomments:

    Stormwater: Under the current operating agreement between the Department andthe St. Johns River Water

    Management District (SJRWMD), this project would be reviewed by the SJRWMDunder rules 62-330, Florida Administrative Code (FAC), Applicant’s Handbook Volume1 and Applicant’s Handbook Volume 2. Some of the area is located within the UpperSt John’s River Special Basin as designated under 40C-41, FAC. Appropriatestormwater treatment and attenuation would be required and possibly compensatingstorage for impacts to the regulated floodplain, which is the 10-yr floodplain. Withinthe Upper St. Johns River Special Basin, diversion of fresh water to coastal receivingwaters should not be increased and appropriate compensation will be required forincreases that cannot be avoided.

    Wetlands: This proposed master plan of 4,692 single family units, retail stores,offices, hotel, industrial construction, schools and a hospital will require review bySJRWMD pursuant to the Operating Agreement between the Department andSJRWMD (https://www.flrules.org/gateway/ChapterHome.asp?Chapter=62-113).

    As outlined in the application, portions of the subject lands to be developed werepermitted for a mitigation bank in 2000 under a SJRWMD permit, No. 4-217-76185-1known as Farmton Mitigation Bank – N, W & S segments. Based on the SJRWMD e-permitting site, a permit modification was authorized in 2011 that eliminated 1,116acres from the north bank site. SJRWMD will verify all portions of the proposeddevelopment lie outside of the permitted bank and meet the conditions of thepermits.

    The activities require an Individual Permit or a Conceptual Permit pursuant to 373,F.S. and will also be reviewed under the Environmental Resource Permit Applicant’sHandbook I and II (http://www.sjrwmd.com/handbooks/erphandbook.html). Theapplicant must demonstrate elimination and reduction of wetland and surface water

  • impacts and any unavoidable impacts will require mitigation pursuant to 62-345,F.A.C.

    Industrial Waste Water: Since this is a master development plan, it does not havespecific information at this time to make any Industrial Waste Water (IWW) technicalor IWW rule related comments.

    Potable Water: From the documents provided pertaining to potable water, part ofthe project will be served by the City of Edgewater. Since the City does not currentlyhave the capacity nor infrastructure in place, it appears they will have to either createa new PWS or substantially expand their existing PWS. In any of these cases, permitsunder Chapter 62-555.520, FAC, will be required for the construction, expansion,and/or modification of a PWS.

    Since the Volusia County Health Department has been delegated authority from theDepartment to administer the Potable Water program in Volusia County, they wouldbe the permitting authority. The AMDA was made available to Mr. Ron Freeman atVolusia County Health Department for his review and comment.

    The remaining portion will be served by a “Farmton Water Resources LLC”. Thisappears to be a proposed entity which would build and operate a new PWS.

    The utilities would also have to contact the appropriate water management district(s)for Consumptive Use Permitting (CUP).

    Waste Cleanup: Based on review of known contaminated facilities there are twoidentified to the west of the Farmton proposed development area, one in Osteen andone in Deltona. The cleanup activities of the waste cleanup sites do not appear to be aconcern to the Farmton Development project according to the information gatheredfrom the state database.

    Florida has numerous abandoned cattle-dipping vats on lands historically used inagriculture. Some are known, others are not. Chapter 376, Florida Statutesspecifically excludes properties that are privately owned from requirements forassessment and cleanup of contamination associated with cattle-dipping vats. However, this exclusion does not apply to publicly owned lands. Should a propertywith contamination from a cattle-dipping vat be placed into public ownership, stateregulations for assessment and remediation, and associated costs for the cleanup ofthe contamination would then be applicable to that public entity. With over 75% ofthe 47,000 acres of land within the Farmton development being proposed forconservation, any public entity contemplating accepting title to the lands for

  • conservation should be fully aware of this possibility and conduct appropriate inquiryfor the possibility of this occurrence.

    Dear Mr. Milch:

    Florida Fish and Wildlife Conservation Commission (FWC) staff has reviewed the above-referenced Application for Master Development Approval (AMDA). We provide the following comments and recommendations for your consideration, in accordance with Chapter 379, Florida Statutes (F.S.), and Chapter 380.06, F.S., Developments of Regional Impact.

    The applicant, Miami Corporation, submitted an application to Volusia County for a large-scale comprehensive plan amendment known as the Farmton Local Plan (FLP) for approximately 4 7,000 acres of land. An amended FLP was approved with a final order issued by the Department of Economic Opportunity on March 29, 2012. It established two broad land-use categories for the project site: Sustainable Development Areas (SDA), 15,000 acres designated for future development- 1,570 acres of which are designated as mandatory Resource-Based Open Space- and GreenK.ey, approximately 32,000 acres designated as high quality environmental resources land in an Environmental Core Overlay. The FLP required the development of a conservation management plan for the GreenK.ey lands and the Resource-Based Open Space designated within the SDA. FWC staffwas part of the task force that developed the plan, which establishes conservation goals and objectives for the long-term maintenance of the diverse habitats within those portions of the FLP.

    The approved FLP adopted by Volusia County includes a policy, FG 8.1, requiring the landowner to apply for and receive a master development approval for the entire project site. Volusia County requires that the application for a Master Development of Regional Impact (DRI) be submitted within five years of the effective date of the amendment, which was March 29, 2012. A pre-application conference was held on May 31, 2013. The AMDA was submitted in November 2013.

    The application for a Master DRI (Question 12) provides descriptions of the habitats on the project site and identifies fish and wildlife species either known to occur or having the potential to occur within the SDAs. Question 12 also requires a discussion of methodologies used to determine presence of state- and federally listed species (12.B.), what impacts development may pose to the species (12.D.), and what measures would be taken to mitigate impacts (12 .E.). The applicant has proposed to defer responses to these questions until such time as specific site development locations and construction plans for the SDAs have been determined and applications for incremental development approval (AIDA) are submitted. The FWC agrees with this approach, as well as the evaluation and wildlife methodology discussed in Attachment 3 of the Farmton Master Framework for Future DRI Submittals: Pre-application Synopsis. In addition to the related requirements listed in Attachment 3, we recommend that the Master Development Order include the following condition:

    Applicants for AIDAs will consult with the Florida Fish and Wildlife Conservation Commission on methodologies for conducting surveys for fish and wildlife species,

    measures for avoiding impacts to fish and wildlife species and their habitats, and recommendations for minimizing and/or mitigating unavoidable impacts.
