Dear Members,
Welcome to the 2016-2017 programyear! I am pleased to be the SanDiego Chapter President once again.We have a newly elected Board ofDirectors with a good combination ofnew ideas and seasoned veterans. TheSan Diego Chapter has a newStrategic Plan with a new Mission andVision statement. Our Mission: “TheNCMA San Diego Chapter’s missionis to advance the contract management profession in San Diego County.The Chapter provides educational programs to its local members, andfosters their professional growth and development through Chapterleadership, certification training, and networking opportunities.” Inaddition, the new Board has been able to reduce the cost of theworkshops and seminars. See our website (www.ncmasd.org) for moreinformation on the Strategic Plan.
This fall we start our new program year with some exciting topics anddynamic speakers.
In September Roger Duke, Vice President of General Atomics spoke on“Minding the Gap” between the prime contract and subcontract. Gapsand overlaps in subcontracting can be very costly for any contractor.
In October, we have a joint meeting with the Association of GovernmentAccounts (AGA) to address the confusion surrounding the use ofConsultants vs. Employees vs. Subcontractors vs. Vendors. A panel ofsubject matter experts will provide guidance in making wise choices inthis area.
In November, William M. Pannier will speak on “Out of Scope Work”including Changes, REAs and Claims. He is a senior counsel in Holland& Knight's Los Angeles office. Mr. Pannier practices in the areas offederal, state and local government contracts.

(CART) meetings, held on the second Wednesday of each month. TheCART meetings provide an open forum for specific questions andanswers on contract management issues. We will have an Octoberfestsocial on October 5, and a holiday party planned for December 9, 2016.These are great networking events to get to know other contractingprofessionals in San Diego.

Featured Board of Director MemberMeet Kristy Schultz, NCMA Education Director
Kristy Schultz is the Assistant Contracts Manger atVector Planning & Services, Inc. (VPSI), a smallbusiness located in San Diego. VPSI’s core competenciesinclude IT, Cyber Security, and Systems Engineeringservices with extensive experience across the DoD andFederal agencies.
Kristy has eight years of experience in the field ofcontracts administration, subcontracts administration, andproposal / pricing support. She holds a BA in Finance anda MBA from San Diego State University (SDSU). Kristy
has her Contract Management certificate and Advanced Contract Management certificate from SDSUalso. She has been a member of NCMA for five years and is looking forward to the challenges thatcome with her new role within the San Diego chapter. She is currently pursuing a Certified ProfessionalContract Manager (CPCM) certificate through NCMA.
In her spare time Kristy enjoys playing slow pitch softball, traveling, and volunteering at OperationGreyhound (a non-profit organization that rescues racing greyhounds from dog tracks in Mexico).
NCMA Advancing Professionals Award RecipientAn Interview with Sarah Ahn by Theresa Robinson Harris
Sarah Ahn was recently named a recipient of the NCMA Advancing Professionals Award.This award was established in 2012 to provide peerrecognition to the rising stars and top performers in thecontract management profession under the age of40. These professionals, who are the future of contractmanagement, come from academia, government andindustry. The award will be presented at the GovernmentContract Management Symposium (GCMS) inWashington DC in December, 2016.
In light of her achievements, I sat down with Sarah to talkcontract management and discuss heraccomplishments:
Q: How did you get started in contract management?

A: As a recent graduate from the University of Virginia, I entered the Department of the Navy’s, NavalAcquisition Intern Program (NAIP) in the Contract Specialist series (1102) where as a civilian I wasassigned to the Contracts Directorate at the Naval Sea Systems Command (NAVSEA) in WashingtonD.C.
Q: Why contract management; could you see yourself working in another field and if so what fieldwould that be?
A: I sort of fell into contracts by accident. It’s definitely not something I would have gone to school for,it’s hard to even explain what it is! I see myself continuing to work in the field and potentially,sometime in the long term, teaching in contracts management.
Q: What do you like best about working in contract management?
A: I like that our function allows us to apply sound business judgement within the confines of structuredframework. I also enjoy working with different program/product teams through the contracting process.Working with diverse teams allows for the fostering of new ideas and innovation—which can ultimatelyinspire people to do great things.
Q: What and/or who would you say helped you along your journey into being recognized today as one ofNCMA’s top young professionals?
A: I have been blessed with having very great mentors during the last ten (10) years. I believe they havebeen instrumental in fostering my professional growth. Mentors have a way of seeing things that youmight not be able to see in yourself.
Q: What would you say to managers reading this interview as far as advising them on how to supportyoung professionals in advancing their careers?
A: I think one of the biggest challenge in our field right now is the demographic shift. I wouldrecommend to managers (and young professionals as well) to have an open mind about the differentexperiences and viewpoints we all bring to the table.
Q: Where do you see yourself in the next 5 to 10 years?
A: I see myself continuing to tackle contracts related challenges at my current position at ViaSat, therecertainly has very rarely been dull moments in the last three (3) years here. Perhaps finishing myadvanced degree part time.
Q: How can individuals in the profession motivate and inspire young professionals like yourself?
A: Lead by example, strive to be a contracts professional worth emulating. Be available for mentoring,or even just as a sounding board.
Q: What is your advice to young professionals entering the contract management field?

Minding the Gap WorkshopBy Victoria Marin
Our first workshop of theprogram year got off to a greatstart with our presenter, Roger D.Duke, Vice President of Contractsand Procurement at GeneralAtomics Aeronautical Systems,Inc. (GA ASI). Mr. Dukepresented us with the topic of“Minding the Gaps between thePrime Contract and Subcontract”.Mr. Duke’s vast experience of over 30 years working in Contracts,Procurement, and Subcontracts made him a perfect candidate to educate us onthe gaps between all the parties within our government contracts. Over the
years, Mr. Duke has had firsthand experience with these gaps as he has worked for both large and smallcompanies. He believes one of the greatest risks in executing government contracts is the failure toadequately manage subcontractors where there is no privity. For example, large companies need toremember that small companies do not have the experience, financials, or bandwidth to handle all thegovernment terms and conditions flowed down to them from either the government or prime contractor.Nor do they have the privity with the government. A common gap seen in the industry is ‘CustomerRequirements vs. Business System Regulatory’. The customer and DCMA have different objectives.So how can a company of any size work to meet the guidelines of both and still successfully win andmanage a contract? Business Systems Requirements slow programs and procurements down. Not tomention compliance is expensive especially for a small business. Business Objectives Often in Conflictwith Regulatory Timeliness, as we see frequently during the proposal process; Average subcontractorproposal timeline for FAR Part 15 is 45 days minimum to be compliant and few subcontractors even getthis amount of time after the Prime Contractor reviews the RFP nor do they have the expertise andsystems to be in full compliance of FAR Part 15 Checklist.
There is even more of a gap when dealing with the Government Acquisitions, commercial FAR Part 12,as they neither favor nor support UCC Contracting. With all the heavy burdens of the Ts & Cs, thegovernment does not seem to encourage government contractors to do commercial work. Far Part 12 isa huge hurdle for many commercial companies and involves much subjectively. These commercialcompanies are being forced into Far Part 15 due to technicalities and large company Primes forcing flowdowns to small business seem unfair and add much risk to the company. For example, how would acommercial company meet government MIL standards in testing?
Being on the Prime and Subcontractor side of the contract, we have all found ourselves dealing with theheavy flow-down abuse seen from the Prime Contractor side. A Prime contractor cannot just flow every

single term and condition down to a subcontractor without a thorough review and especially if thatsubcontractor is a small business. This would be a huge risk and financial liability to a small business.However, both sides need to be aware of what terms they are passing down or receiving. Being asubcontractor does not mean you have to accept every clause flowed down. It is the responsibility of thesubcontracting company to determine what clauses are mandatory, necessary or risky and then tonegotiate these terms with their prime. This is a skillset that Mr. Duke has highly stressed for eachcompany to find and utilize in their workforce.
Mr. Duke emphasized that companies do need to comply and execute, do not take shortcuts, and it’s therole of the Gap Minder(s) to figure out which requirements are most necessary and critical to follow firstand have systems in place to handle these critical requirements so not to slow down your business. GapMinders need to be in place in every company. The most successful companies have created strategicsupplier management leaders to achieve business objective while meeting compliance requirements.Because if we are not minding the gap, we will fall short of our requirements, over spend, and/or losebusiness.

NCMA San Diego Oktoberfest Mixer andMembership Appreciation Event
We observed the start of a new program yearon October 5 at our Oktoberfest Mixer. We,again, took advantage of San Diego’s vibrantcraft brewing industry and visited IntergalacticBrewing and enjoyed some of their awardwinning brews.
The event was open to members and theirguests. The Chapter provided snacks and softdrinks. The brewery had a good selection ofbeer, including five German style selections inhonor of Oktoberfest.
Those who attended had the opportunity tomeet other members or possible prospectivemembers, to network, and to learn more aboutthe chapter, the new program year, and theprofession and/or just to socialize.
We hope you’ll join us for the next mixer,likely in May at another craft brewery.
