by!council!is!delegate,!and!such!motions!and!policies!are!implemented;!vi. To!monitor!council!member!absences!and!to!invite!motions!of!impeachment,!

vi. To!make,!or!cause!to!be!made,!purchase!of!supplies!for!Council,!making!every!effort!to!obtain!the!best!price,!value!and!terms!possible,!and!to!keep!an!inventory!of!these!supplies;!

vii. To!type!council@related!correspondence;!viii. To!notify!the!speaker!at!least!twenty@four!hours!in!advance,!if!possible,!of!an!

organization!associated!with!the!Orientation,!whether!by!telephone,!electronic!mail,!fax!or!other,!on!a!daily!basis!during!the!summer!session;!

iii. To!attend!all!activities!during!New!College’s!Orientation!Week;!iv. To!be!available!on!a!daily!basis!during!Orientation!Week!and!one!week!prior!

to!Orientation;!v. To!attend!all!meetings!of!Council!held!during!the!year,!and!present!a!report!at!

each!meeting!outlining!the!progress!of!planning!Orientation;!vi. To!work!closely,!on!a!weekly!basis!throughout!the!Winter!and!Summer!

2.2!Composition!and!Terms!of!Reference!for!Standing!Committees!!!

i. Violations!of!the!following!nature!will!result!in!an!automatic!disqualification!of!a!candidate:!!

a. Anyone!improperly!declared!an!eligible!candidate.!!b. Failure!to!attend!the!All@Candidates!meeting.!!c. Any!candidate!spending!over!the!maximum!spending!limit!as!set!by!the!Committee.!!

d. Intentional!misrepresentation!of!campaign!expenditures.!!e. A!candidate!accruing!greater!than!one@hundred!(100%)!per!cent!of!their!allowable!demerit!point!limit!of!10!demerit!points.!!!

f. Any!attempted!interference!in!the!Election!process!as!regulated!in!this!By@Law.!!

ii. Disqualification!of!Winning!Candidate!

In!the!event!a!winning!candidate!in!any!election!is!disqualified,!the!second!place!candidate!shall!take!the!place!of!the!disqualified!winner.!!

)BE!IT!ENACTED!as!a!by@law!of!New!College!Council,!as!follows:!

!7.1!The!New!College!Council!shall!be!empowered!to!hold!referendums.!!

!7.2!New!College!Council!shall!hold!a!referendum!on!a!motion!passed!by!two@thirds!of!the!members.!

!7.3!The!referendum!question!must!be!phrased!in!a!format!to!be!answered!by!a!vote!of!“Yes”!or!“No”.!It!must!be!a!neutral!question!without!bias!for!either!response.!!7.4!The!issue!to!be!questioned!in!a!referendum!must!fall!within!the!constitutional!mandate!of!the!New!College!Council!and!must!be!of!importance!to!the!constituents!of!New!College.!

!7.5!The!referendum!question!must!be!advertised!two!weeks!prior!to!voting.!

!!7.6!New!College!Council!shall!appoint!a!C.R.O.!to!monitor!the!referendum.!

!7.7!The!C.R.O.!shall!follow!the!basic!provisions!for!the!position!described!for!elections.!

!7.8!The!C.R.O.!must!make!the!result!of!the!referendum!public!within!24!hours!of!the!close!of!ballots!and!a!full!report!must!be!given!to!the!New!College!Council!the!following!week.!!7.9!The!C.R.O.!may!request!that!a!fellow!of!New!College!or!the!Master!of!New!College!to!act!as!arbiter!in!the!instance!that!any!infractions!or!other!problems!arise.!

!7.10!The!results!of!any!referendum!held!by!the!New!College!Council!must!be!made!public!and!provided!to!any!individual!who!requests!it.!

In!recognizing!the!need!for!a!consistent!source!of!media!in!the!New!College!Community,!New!College!Council!shall!commit!itself!to!maintaining!a!community!magazine!according!to!the!following!provisos.!!!

!PART!I!@!GENERAL!!1.1! The!name!of!the!magazine!shall!be!known!as!the!“New!Beat”!!!1.2! In!this!by@law:!

!i. “Committee”!refers!to!the!Publications!Committee!of!New!College.!!ii. “Editor(s)”!refers!to!the!Editor(s)@in@Chief!of!New!College.!!

!1.3! New!Beat!shall!be!published!twice!during!the!academic!year,!once!each!term.!Issues!published!immediately!prior!to!the!end!of!a!term!shall!be!available!not!less!than!one!week!prior!to!the!end!of!classes.!If!an!issue!is!either!significantly!late!or!cancelled,!the!Editor!shall!inform!the!Committee!as!to!the!reason(s)!for!the!delay!or!cancellation.!!1.4! It!is!the!responsibility!of!New!Beat!Publication!Committee!to!keep!the!New!College!community!informed!as!to!the!activities!of!New!College.!!Where!possible,!a!reporter!shall!be!present!at!Council!meetings.!!Except!where!Council!is!meeting!in!camera,!New!Beat!is!entitled!to!report!and!carefully!interpret!Council!proceedings.!!1.5! New!Beat!Publication!Committee!shall!keep!an!up@to@date!file!of!mail,!submissions,!and!any!other!material!that!New!Beat!Publication!Committee!receives.!A!minimum!of!5!copies!per!issue!of!the!New!Beat!should!be!filed.!Two!copies!of!each!issue!must!be!sent!to!the!York!University!Archives.!!1.6! The!Editor(s)!shall!receive!a!per!issue!stipend!(C.L.A.Y!student)!for!their!services,!the!amount!shall!be!determined!before!applications!are!distributed.!!1.7! It!is!the!responsibility!of!the!outgoing!Editor(s)!to!train!the!incoming!Editor(s).!!A!transitional!period!shall!be!established!at!the!discretion!of!the!Committee.!!1.8!! The!members!of!the!committee!of!New!Beat!will!consist!of!the!Vice!President!Academics,!Master’s!Office,!Editor!in!Chief,!and!Media!Assistant.!!!PART!II!@!POLICY!!2.1! The!following!is!standard!newspaper!policy!for!Comments!and!Letters!to!the!Editor,!and!shall!be!followed!and!applied!by!New!Beat!Publication!Committee:!!

i. All!letters!must!be!signed!by!the!author,!and!shall!include!an!address!or!telephone!number!at!which!the!author!can!be!reached;!!

ii. Anonymous!letters!shall!not!be!printed,!but!names!may!be!withheld!by!request;!

iii. New!Beat!Publication!Committee!reserves!the!right!to!edit!any!letter!for!length;!however,!each!issue!should!include!a!printed!disclaimer!that!such!editing!occurs;!

iv. New!Beat!Publication!Committee!shall!withhold!all!correspondence!that!is!of!a!libelous!nature.!

v. The!Editor(s)!shall!provide!written!reasons!to!any!person!whose!submission!is!refused,!upon!such!request!being!made!by!that!person.!!

!2.2! The!Editor(s)!have!the!right!to!refuse!submissions.!If!it!is!decided!that!a!submission,!in!order!to!be!printed,!must!be!significantly!edited,!the!Editor(s)!must!advise!the!contributor!before!publication.!If!a!workable!solution!(in!keeping!with!these!guidelines)!cannot!be!reached,!the!Editor(s)!should!refuse!to!print!the!work.!!2.3! The!Editor(s)!are!responsible!for!formulating,!with!the!guidance!of!the!Executive!Committee!and!the!Master’s!Office,!an!issue@!by@issue!budget.!The!Editor(s)!should!become!familiar!with!the!method!by!which!bills,!advances!and,!reimbursements!are!processed.!The!Editor(s)!must!submit!an!up@to@date!financial!statement!to!the!Executive!Committee!and!the!Master’s!Office!following!the!publication!of!each!issue.!!2.4! New!Beat!Publication!Committee!shall!print!advertising!in!accordance!with!the!advertising!policy!determined!by!the!Publications!Committee.!!2.5! New!Beat!Publication!Committee!should!strive!for!a!circulation!of!150!hits!per!issue;!they!shall!use!social!media!to!promote!an!increase!in!readers.!!2.6! The!Editor(s)!should!attempt!to!publish!New!Beat!with!at!least!twenty@eight!(28)!pages!of!content!material!in!each!issue.!!2.7! New!Beat!Publication!Committee!shall!refrain!from!continually!promoting!any!one!specific!political!or!ideological!point!of!view.!!During!elections!at!York!University,!New!Beat!Publication!Committee!shall!be!free!to!endorse!any!candidate.!!New!Beat!Publication!Committee!shall!not!make!any!endorsement!of!candidates!in!the!New!College!Council!elections.!All!candidates!being!considered!for!endorsement!shall!be!given!equal!opportunity!and!space!in!New!Beat,!if!requested,!with!the!exception!of!the!editorial!space.!!PART!III!@!TITLE!!3.1! The!Editor(s)!reserve!the!right!to!amend!the!title!of!New!Beat,!pending!approval!of!the!Committee.!!

i. The!Editor(s)!must!submit!a!proposal!to!the!Publications!Committee,!in!writing,!explaining!the!rationale!for!such!an!amendment.!

ii. Any!proposal!to!amend!the!name!of!New!Beat!must!be!presented!to!the!Publications!Committee!before!the!publication!of!its!premier!issue!in!any!given!academic!year.!

iii. If!the!Committee!approves!an!amendment!to!the!name,!it!is!the!responsibility!of!the!Committee!to!ensure!the!Editor(s)!prominently!display!the!phrase!"New!College!Community!Publication"!on!the!cover!of!each!issue!of!the!amended!publication.!

iv. Upon!approval!of!an!amendment!by!the!Committee,!the!Editor(s)!can’t!present!another!amendment!to!the!name!of!New!Beat!until!the!end!of!the!term!of!their!term!of!office.!
