1. Status. This directive supersedes the SHAPE Directive (SO) 100-001 dated 21 June 2010 (Reference A).

2. Purpose. The purpose of this directive is to outline the policies, responsibilities, and procedures governing the control, movement, and parking of vehicles on the SHAPE Installation. This directive is in compliance with and is based upon the Belgium Highway Code. This directive contains provisions to control vehicle operation, parking on the installation and suspension or revocation of driving privileges, vehicle immobilisation devices and vehicle impoundment. .

CHAPTER 1 – INTRODUCTION

1-1. Purpose

a. The SHAPE Traffic and Parking Regulation is designed to ensure the safety of personnel, security of the installation, and orderly circulation of traffic flow.

b. This policy sets forth the rules of the road for the operation of NATO, national, and privately owned vehicles operated on the SHAPE installation.

1-2. Responsibilities

a. Base Support Group Commander

(1) Responsible for the implementation of the provision in this directive.

(2) The appellate authority for suspension of driving privileges on SHAPE (Appendix 2 to Annex A).

b. Security and Emergency Services Branch Head

(1) Responsible for the supervision and provisions in this directive.

(2) Responsible for coordinating police, security, and emergency assets in support of enforcing this directive.

c. Infrastructure, Storage and Supply Branch Head

(1) Responsible for producing or procuring the appropriate road signs, pavement markings, and other traffic control devices as required by the Provost Marshal responsible for coordinating police, security, and emergency assets in support of enforcing this directive.

(2) Responsible for the maintenance of road signs, pavement markings, and other traffic control devices as required by the Provost Marshal.

d. SHAPE Provost Marshal

(1) Responsible for the detection, prevention and investigation of offenses that occur on SHAPE. The SHAPE Provost Marshal Office (PMO) and International Military Police (IMP), with support from the SHAPE Federal Police (SFP), shall carry out all necessary investigations into offenses and in the collection and production of evidence.

(2) The approval authority for the suspension of Installation Driving Privileges.

(3) The appellate authority for all contested Report of Incident/Traffic violations

(4) The approval authority for emplacement of all traffic and parking signs.

(5) Responsible for ensuring the SHAPE Installation is adequately equipped with the appropriate signs, pavement markings, or other traffic control devices and

those items are maintained in conjunction with the Base Support Group (BSG) Infrastructure, Storage, and Supply (ISS) Branch.

e. International Military Police Company Sergeant Major

(1) Approval authority for suspension of Instillation Driving Privileges up to 14 days.

(2) Responsible for informing the SHAPE Community of SHAPE Traffic and Parking Regulation.

(3) Responsible for the production of all necessary forms, notices, and relevant paperwork in support of this directive

(4) Responsible for the transmittal of all appeal results to the respective National Military Representative (NMR) or appropriate supervisor

f. SHAPE Federal Police

(1) Responsible for the enforcement of Belgian traffic law on the installation.

(2) Responsible for investigations of the violations pertaining to Belgian law.

g. IMP Traffic Non-Commissioned Officer in Charge

(1) Responsible for the tracking of points and suspensions for the administrative points system.

(2) Responsible for transmittal of traffic violations and suspension letter to the respective NMR or the appropriate supervisor of the violator.

h. SHAPE Members

(1) Responsible to ensure they, their dependents, and all sponsored visitors are informed of the Belgian Highway Code and SHAPE Traffic and Parking Regulations

(2) Liable for their, their dependents, and all sponsored visitors conduct while on SHAPE and will be subject to administrative actions under this regulation for that conduct.

CHAPTER 2 – DRIVING PRIVLIGES

1-1. Authority and requirements - Authority to operate a vehicle - The authority to operate a vehicle on SHAPE is a privilege granted by the BSG Commander. This privilege is contingent on the operator obeying all Belgian laws and SHAPE policies regarding vehicle registration and operation. The Installation Provost Marshal has the authority to suspend installation driving privileges to ensure the safety of the community and to prevent persons from committing further crimes.

1-2. Implied Consent to Search - Operators of vehicles on SHAPE have been deemed to give implied consent of their vehicle by operating on the installation. Vehicles are subject to search at all entry control points upon entry or exit of the installation. Vehicles are also subject to search at the request of an IMP or SFP officer in the performance of their duties.

1-3. Suspension of Driving Privileges

a. The suspension of driving privileges is authorised under the following circumstances.

(1) Accumulation of 12 points within a 12 month period.

(2) For any violation incurring and automatic suspension.

(3) At the discretion of the Provost Marshal to ensure safety.

b. The suspension of driving privileges is a progressive system with the intent to discourage future illegal activity. Suspension of privileges will be proportional to the individuals driving record for a specified time period.

(1) First accumulation of 12 points – 14 Day Suspension.

(2) Second accumulation of 12 points – 30 Day Suspension.

(3) Third accumulation of 12 points – 60 Day Suspension.

(4) Fourth accumulation of 12 points – 180 Day Suspension.

c. Any infraction incurring an automatic suspension will result in a 14 day suspension and accumulation of 6 points. In the event the driver has had a previous suspension the appropriate duration will be assessed as listed above and 6 points assessed on their SHAPE driving record.

1-4. Appeals Process

a. Offenses resulting in a suspension of installation driving privileges will result in the issuance of a Forfeiture of Privilege Memorandum transmitted from the Provost Marshal’s Office to the appropriate NMR or supervisor. The offender has 7 days from notification to appeal the suspension or ask for compassionate consideration, in writing, to the appropriate appellate authority.

(1) Appellate authorities for suspension memorandum area as follows:

(a) 14 day suspension or less – Provost Marshal.

(b) 15 days or more – BSG Commander.

b. The appellate authority will respond within 24 hours of receiving the notice of appeal and will render their decision to uphold the suspension, modify the suspension, or vacate the suspension. All correspondence will be transmitted to the driver’s NMR or designated supervisor as appropriate.

CHAPTER 3 – VEHICLE REGISTRATION

1-1. Registration Policy

a. All vehicles will be registered in accordance with Belgian Law and SHAPE Directive (SD) 100-002 (Reference B). Vehicle operators will have the following documents in their possession at all time while operating a vehicle on SHAPE.

(1) Proof of Registration, SHAPE Registration or National Equivalent.

(2) Proof of financial liability, Insurance documents.

(3) Controle Technique. (4) Operator’s license.

b. Failure to comply with the provisions of SD 100-002 or this directive, may result in the suspension of driving privileges and/or the report of violations to the SFP for civil penalties in association with the applicable Belgian laws.

CHAPTER 4 – GENERAL POLICIES

1-1. Applicability and Reporting Requirements

a. This policy and the driving privileges and points system outlined within is applicable to all SHAPE members, their dependants, guests, all civilian employees, and any person who operates a vehicle on the SHAPE installation

b. This directive does not apply to SFP, IMP, Law Enforcement personnel, Personal Security Agents, Fire Department personnel or Emergency Medical personnel in the performance of their official duties.

c. All violations of the Belgian Law or SHAPE Traffic and Parking Regulation will be recorded on a SHAPE Form 351, Notification of Traffic Violation (See Annex A).

d. Violation notices will be processed based on the offender’s status:

(1) SHAPE Members (Military and their Dependents)

(a) A report will be generated by the IMP Traffic Non-Commissioned Officer In Charge (NCOIC) and transmitted through the appropriate NMR (See Annex B).

(b) If applicable a notification of driving privileges suspension will be included to the appropriate NMR (See Annex C).

(c) Military personal will accumulate points on their SHAPE Driver’s record based upon actions of their dependants.

(d) Sponsors may submit in writing, to the Provost Marshal, 12a request to have point accruing from their dependants driving habits transferred to their dependant’s license.

(2) NATO International Civilians, and Local Workers (non-military employees including contractors)

(a) A report will be generated by the IMP Traffic NCOIC and transmitted to the appropriate supervisor.

(b) Disciplinary action may be taken by the Civilian Personnel Office, Manpower and Personnel office, or Human Resources Directorate, depending on the authority over the driver.

(c) Civilian personnel subject to Part I, Chapter XVIII, Articles 59 and 60 of the NATO Civilian Personnel Regulation may have action taken against them for violations of Belgian Law and/or the SHAPE Traffic and Parking Regulation.

(3) Visitors

(a) Visitors who violate Belgian Law and/or the SHAPE Traffic and Parking Regulation may have their visitor privileges suspended or revoked.

(b) SHAPE members who sponsor a visitor that violates this directive will be responsible for their actions. Points may be added to their SHAPE driving record based on offenses committed by their visitor.

1-2. Authority Granted

a. In accordance with the Memorandum of Understanding (MOU) of 1972 the SHAPE Provost Marshal is responsible for the enforcement of traffic laws, rules, and regulations on SHAPE. The IMP Company is responsible for carrying out those tasks on a daily basis.

b. Violations of the Belgian Traffic Law not covered by this directive will be assimilated under the provisions of safety, good order and discipline. Points will be assessed based upon the Traffic Points System in Annex A of this directive.

c. On scene instructions by an IMP Officer, Security Guard or SFP Officer will always have priority over road signals, posted signs, or pavement markings. Failure to obey the direction of a law enforcement officer is a serious offense and points will be assessed based upon the Traffic Points System in Annex A of this directive.

CHAPTER 5 – PARKING REGULATIONS

1-1. Disabled Parking

a. SHAPE is equipped with multiple parking spaces that are identified for use by disabled individuals. The spaces are marked by blue lines, parking signs, or by pavement markings. All versions of markings will be enforced. Parking in these designated spots is only authorised if the vehicle has a disability placard displayed.

b. Disability placards are to be displayed at all times while the vehicle is occupying a disabled parking space. The placard must be displayed in a manner where it can be clearly seen and is easily identifiable.

c. Disability placards are issued by the IMP Traffic NCOIC. Requests for a disability placard must be validated by a doctor’s letter or national disability permit.

d. Temporary disability placards may be issued. Individuals will request a temporary disability placard to the PMO with supporting documentation. A temporary placard, if approved, will be issued by the IMP Traffic NCOIC.

1-2. Reserved Parking

a. SHAPE is equipped with multiple reserved parking areas that are approved but not limited to operational needs, security necessities, and customs and courtesies extended to senior officials. Reserved parking areas include the following and have the following restrictions

(1) SHAPE Headquarters (100 Area)

(a) A5/OF-5 Parking. Parking by Permit Only.

(b) BSG Emergency Vehicles. Emergency Vehicle Parking Only.

(c) ISS Vehicle Parking. Service Vehicle Parking Only.

(d) NMR Parking. Parking by Permit Only.

(e) Motorcycle Parking. Reserved for motorcycles and scooters.

(2) SHAPE Housing Areas (600, 700, and 800 Areas) - Parking is reserved for residents. Designated areas will be issued parking placards to establish resident’s vehicles. Resident vehicles will have primary parking privileges in their housing areas. Parking on roadway is permitted at the discretion of residents as long as it does not impede the flow of traffic or case and unnecessary risk.

(3) All other areas. Signs that have been posted by ISS with the approval of the Provost Marshal will be enforced and citations will be issued based upon this directive.

1-3. Prohibited Parking

a. The following actions are prohibited in all areas of SHAPE:

(1) Parking on any grassy area with the exception of housing areas or during special events as authorised by the SHAPE Provost Marshal.

(2) On roads without designated parking locations unless directed to do so by an IMP or SFP officer.

(3) Parking within 5 meters of a junction.

(4) Parking within 5 meters of a pedestrian crossing.

(5) Parking within 5 meters of a curve.

(6) Parking on a sidewalk or footpath.

(7) Parking in any manner that causes and obstruction to traffic flow.

(8) Parking on or outside of designated parking lines.

(9) Parking, Standing, or Stopping other than active loading or unloading in a School Drop Zone, Bus Stop or Bus Lane.

(10) Overnight parking in the 100 area without written approval from the Provost Marshal (See Annex D).

1-4. Stopping, Standing or Idling Vehicles

a. In addition to the above parking directives stopping, standing, or idling in a vehicle in a school drop off zone, loading zone, or any other area other than a designated parking spot is prohibited.

b. Vehicles are not to be left unattended while idling.

1-5. Caravan, Trailer, and Motor Home Parking

a. Authority to tow or park a privately owned caravan, trailer, or motor home on the SHAPE installation is a privilege and is contingent upon proper observation of both traffic and parking regulations.

b. The only authorised caravan, trailer or motor home parking area for those personnel living on the SHAPE domain or visitors is an area within the International Motor Pool. These slots will be allocated on a first come, first served basis. Exception could be made upon request via e-mail or in person to the Provost Marshal for loading and unloading or exceptional circumstances.

c. Applications for a caravan, trailer or motor home space at the International Motor Pool is to be made through their dispatch office. The application office will be OPEN from Monday - Thursday, 0800 – 0930/1530 - 1700 and Friday 0800 – 0930/1330 - 1500. NCN: 254-4736 or Civilian (0)6544 4736. This office will be CLOSED at weekends and during Belgium/SHAPE holiday periods.

d. The dispatch office, will process all applications on a first come, first served basis as well as maintain a waiting list if necessary. When the Caravan Park is full, SHAPE members are to make their own provisions off base.

e. At the time of application, all caravan owners will be required to sign a liability waiver. (See Annex E)

f. Owners who park their caravan, trailer, or motor home at International Motor Pool are personally responsible for the cleanliness and appearance of the area directly under and for one meter around their caravan, trailer or motor home and are to prevent the buildup of rubbish or excessive growth of grass. Failure to comply will result in revocation of parking permit.

g. Caravans, trailers or motor homes are to display the issued permit inside their windscreens at all times.

h. Owners of caravans, trailers, or mobile homes are not allowed to occupy or have others occupy for the purpose of sleeping or living while parked on SHAPE.

i. The caravan parking area will be clearly marked with a thick yellow line painted around the caravan parking area perimeters. Under no circumstances are caravans, trailers or motor homes to be parked outside this area unless approved by the Provost Marshal.

j. All caravans, trailers or motor homes parked at the International Motor Pool are parked at the owner’s risk. Under no circumstances will SHAPE be financially responsible or liable for any damage caused to privately owned caravans, trailers or motor home, except under the conditions stated in Article VIII of the Status of Forces Agreement.

k. Any vehicle or trailer that is no longer operational (for any reason) is not authorised to be parked on the SHAPE Installation without the written authorisation of the Provost Marshal.

1-6. Vehicle Re-Sale Lot

a. The SHAPE vehicle re-sale lot is located in the 500 area. Vehicles are authorised to park in the assigned, numbered parking spaces provided.

b. Parking permits for the vehicle re-sale lot are available at the IMP Information Desk located in Building 102.

c. At the time of application, all caravan owners will be required to sign a liability waiver (See Annex F).

d. Parking permits will be issued for a maximum of 60 days.

e. Vehicles parked on the resale lot must be registered, insured and have a valid Control Technic if required to be in accordance with the Belgium Highway Code.

f. All vehicles parked on the SHAPE re-sale lot are parked at the owner’s risk. Under no circumstances will SHAPE be financially responsible or liable for any damage caused to privately owned vehicles, except under the conditions stated in Article VIII of the Status of Forces Agreement.

CHAPTER 6 – DRIVING REGULATIONS

1-1. Driver to Exercise Due Care

a. All drivers are responsible for actions resulting from the operation of a motor vehicle under their control. Drivers must exercise due care to avoid collisions, property damage and from creating unnecessary hazards to themselves and other persons.

b. Drivers are responsible to exercise due care when reversing in a vehicle. Drivers must exercise due care to avoid collisions, property damage and from creating unnecessary hazards to themselves and other persons.

1-2. Speeding

a. Except where otherwise indicated by signs the maximum speed limit on SHAPE in 50 KPH

b. In all parking areas the maximum speed limit on SHAPE is 15 KPH

c. Drivers are required to adjust their speed when weather or road conditions do not permit safe motor vehicle travel at the posted speed limit. Drivers must exercise due care to avoid collisions, property damage, and from creating unnecessary hazards to themselves and other persons.

1-3. Distracted Driving

a. The use of handheld electronic devices including, but not limited to, cellular phones, Global Positioning Systems(GPS), Citizen Band (CB) Radios, or portable music players is prohibited while operating a vehicle to include bicycles.

b. The use of in-ear, over the ear, or Bluetooth headphones while operating a vehicle is prohibited to include bicycles.

c. Texting while driving is prohibited.

d. Occupants of a vehicle are to cause no distractions for a driver while operating a motor vehicle.

e. Cellular phones are authorised for use as long as they are used in a hands-free mode. The use of speaker phone functions while driving is prohibited.

1-4. Failure to Stop, Yield, or Give Right of Way

a. Priority traffic is has the right of way at all intersections.

b. In traffic circles vehicles entering the traffic circle are to yield the right of way to vehicles already in the traffic circle.

c. Motor vehicles are required to give priority to all pedestrians in cross-walks and at school crossings.

1-5. Driving While Impaired

a. Driving while impaired by alcohol, drugs, or medication is a violation of the SHAPE Traffic and Parking Regulation as well as Belgian Law.

b. Violators will be subject to administrative actions under this directive as well as administrative and legal actions brought forth by the Belgian authorities and/or any applicable national laws from their sending nation.

c. All driving while impaired incidents will be referred to the SFP for criminal prosecution. IMPs will take temporary custody of the driver and vehicle until SFP can respond to the scene. IMP Duty Officer has the authority to release drivers after determining the driver no longer poses a threat to the SHAPE community.

1-6. Motorcycles, Scooters, Electric Driven Bicycles

a. Drivers of motorcycles, scooters, and electric driven vehicle are required to obtain an operator’s license in accordance with Belgian Law.

b. Motorcyclists and scooter riders are required to wear an approved helmet, glove, long sleeves, and over the ankle shoes while operating the vehicle on SHAPE.

c. Electric driven vehicles to include mopeds, stand-up scooters, and electric driven bicycles are required to follow the same rules as a motor vehicle. Operators must be 16 years old and possess a valid driver’s license. These vehicles are not authorised to exceed 25 KPH on SHAPE. Drivers under the age of 16 are prohibited from operating electric driven vehicles and vehicles under 50cc on SHAPE.

d. This section does not apply to hover-boards which are specifically addressed in paragraph 1-7 of this directive.

1-7. Non-Motor Driven Vehicles

a. Non-motor driven vehicles includes all vehicles propelled by pedal, manual power, pulled, or pushed. This includes bicycles, tricycles, hover-boards, manual powered scooters, skateboards, and rollerblades regardless of the number of wheels or configuration.

b. All cyclists must adhere to the same traffic laws as motor driven vehicles with the exception of children under the age of 10 years old when operating on sidewalks. Children on bicycles will be treated as pedestrians.

c. All bicycles will be equipped in accordance with the Belgian Highway Code.

d. All personnel should wear helmet, highly visible garments and protective equipment while operating non-motor driven vehicles.

e. Hover-boards are prohibited from operation on roadways. Hover-boards are authorised on sidewalks and in parking lots.
