Notice Inviting Tender - Comprehensive Annual Maintenance Contract for maintenance works for a period 01/05/2017 to 31/03/2020 NABARD, Himachal Pradesh Regional Office, Shimla intends to award the Comprehensive Annual Maintenance Contract for the period 01/05/2017 to 31/03/2020 and work related there with:

(i) Civil Works- Civil & Plumbing, Carpentry, Open Space Cleaning &

Gardening,

(ii) Electrical Works - Electrical Maintenance

(iii) Specialised Works- Water tank cleaning and Pest Control Works

at the following 6 locations:

For the purpose, a two stage bidding process i.e. Pre-qualification with respect to Techno- Commercial aspects and Competitive Rates is being followed. Tender documents can be obtained from the office of the Chief General Manager, National Bank for Agriculture and Rural Development (NABARD), Block No 32, SDA Complex, Kasumpti, Shimla-171009, on any working day (Monday to Friday) from 03/04/2017 to 12/04/2017(1200 Hrs) on payment of non-refundable amount of ` 500/-(Rupees Five Hundred only) or can be downloaded from website www.nabard.org/tenders. The firms downloading the application form and other documents related to the work from the website will have to pay non-refundable charges of ` 500/- (Rupees Five Hundred only) by directly crediting into our account as indicated in Clause (10). Contractors having experience in undertaking similar nature of work in Himachal Pradesh at similar organisations only need tender for the work.

1) National Bank for Agriculture and Rural Development (NABARD) has its Himachal Pradesh Regional Office at NABARD, Block No 32, SDA Complex, Kasumpti, Shimla-171009. The building consists of 4 Floors + Ground Floor with a total built up area of 1429.87 sq.m (approx). The building has 1 Officer's lounge, 1 Staff Canteen, Kitchen, sports rooms, Gymnasium, open areas etc., in addition to the cabins and workstations of the officers and staff. Besides, NABARD has officers/ staff quarters at various locations as indicated above. The tenderers are advised to visit the site, conduct survey of the existing conditions so as to familiarise and satisfy themselves with the nature of works to be carried out and get all clarifications as necessary from NABARD before quoting their rates.

Late tenders shall not be accepted. 3) The PART-I (PRE-QUALIFICATION BID) of the tender shall contain Pre-Qualification bid (as per Section I, II, III, IV & V) along with proof of having submitted EMD and tender fee and terms & conditions in prescribed tender document. The PART-II (FINANCIAL BID) of the tender shall contain only the financial bid in the prescribed format. Late tenders shall not be accepted. 4) Tenders submitted in a single envelope shall not be accepted and shall be returned unopened to the respective tenderers. 5) The PART-I (PRE-QUALIFICATION BID) of the tender shall be opened first on 17/04/2017 at 1100 hours in the presence of the tenderers or their authorised representatives who choose to be present. Based on the Pre-Qualification bid / tender, the eligible tenderers will be empanelled and the financial bids for competitive rates submitted by such of the empanelled tenderers only will be opened/ considered. 6) NABARD reserves the right to accept or reject any tender, either in whole or in part and it is not binding on the part of the NABARD to accept the lowest or any other tender. 7) Tenders which do not fulfil all or any of NABARD's conditions or are incomplete in any respect and tenders with the tenderer's own conditions other than those specified by NABARD are liable to be rejected. 8) Any discrepancies, omissions, ambiguities in the Tender Documents, if any, or any doubt as to their meaning should be reported in writing to the The Chief General Manager, National Bank for Agriculture and Rural Development, Block No 32, SDA Complex, Kasumpti, Shimla-171009 who will review the same and if it is felt that the information sought is not clearly indicated or specified, NABARD will issue clarifications to all the tenderers which will become part of the Tender Document. the amount in NABARD Current Account as per the details given below, failing which, the Tender shall not be considered. No interest shall be paid on the EMD deposited by the tenderers. EMD of unsuccessful tenderers would be refunded within a reasonable period of time. INSTRUCTIONS TO THE TENDERERS FOR FURNISHING INFORMATION AS PART OF PRE-TENDER QUALIFICATIONS

1. The work involved is upkeep/ general maintenance of the Office Premises, Staff/ Officers’ Quarters, Visiting Officers’/Executives’ Flats, housekeeping and horticulture services at different locations in Shimla. The office building located at Block No. 32, SDA Complex, Kasumpti Shimla-171009 consists of 4 Floors + Ground Floor. The building has one Officers’ lounge, one Staff Canteen, Kitchen, Sports Rooms, Gymnasium, open areas etc., in addition to the cabins and workstations of the officers and staff. The tenderers are advised to visit the site, conduct survey of the existing conditions so as to familiarise & satisfy themselves with the nature of works to be carried out and get all clarifications as necessary from NABARD before quoting their rates. The Tenderer should have experience of working with nature of works as briefly mentioned below:

A. Civil Works : (1) Civil repair, maintenance works related to minor water proofing works in buildings (2) Supplying and/or fixing of different types of building materials viz. cement, sand, reinforcement, all types of granites, tiles, marbles, kota stone, cuddapa, marble mosaic tiles, all types of precast paver blocks, bricks, centering & shuttering materials, manhole / gully trap chamber cover (3) Repair, maintenance and construction of all types of underground sewer lines (4) Internal painting / polishing of building and its parts (5) Structural repair works in buildings, etc. (6) Repair, maintenance and fabrication of all types of M.S. Grill and sheet works.

B. Plumbing and Sanitary works : (1) All types of plumbing, sanitary works in the residential /

office complex including supply of plumbing and sanitary materials as per the requirement (2) Repair, maintenance of rain water pipes, Sewerage / stack lines in the duct / other area of the buildings (3) Maintenance of water supply line to meter chambers, water meters, foot valves, sewerage system for buildings & other ancillary structures (4) Cleaning of water tanks and disinfecting with chlorine based approved chemicals etc. (5) Removing the deposits from the septic tanks, soak pits and cleaning the sewage lines etc.

C. Carpentry & Interior decoration: (1) Repair, painting, maintenance and construction of all types of wooden works including the fittings and fixtures attached to wooden works (2) Ancillary civil related works in connection with wooden, aluminium or steel works (3) Fixing of all types of glass in doors, wooden or steel windows (4) Writing inventory no. and name plates (5) All types of wooden works related to interior decoration. (6) Aluminium door and window work, venetian blinds etc.(7) Door closer, louver window work, floor spring etc.

D. Horticulture (1) Maintenance of existing flowers/ plants (2) Supplying of good earth, manure etc. (3) Supplying and maintenance of plants etc. (4) Pruning of plants /branches (5) Removal of all gardening related debris, dry leaves etc.

E. Internal & External Electrical works: (1) Repair & Maintenance of all electrical low tension (LT) installation (2) Maintenance and repair of lights, flood lights and other indoor / outdoor luminaires etc. (4) Cleaning of switchyards, meter panels and LT panels (5) replacement of old defective materials / equipment those are beyond economic repair with new ones (6) Maintenance and repair of earthing system and lightning arrestors.

F. House Keeping / Sweeping & Cleaning: (1) Sweeping & cleaning of open space & common areas in the residential Colony / Office. (2) Collection and removing the household waste every day. (3) Removing all the debris such as broken stone pieces / aggregates, earth deposits, plastic / polythene bags, broken glass pieces etc.

G. Pest, Rodent & Termite Control works : (1) All types of pest & rodent control works H. Mechanical cleaning & disinfection of underground and overhead water ranks in the office

building & staff quarters (to be carried out twice in a year)

2. The contractors who have minimum 5 years of experience (ending 31.03.2016) in undertaking similar works and who fulfil the following criteria are eligible to tender:

. i. The tenderers should have average Annual Turn Over of ` 4.50 lakh during the last three

years ending 31 March 2016 duly supported with audited balance sheets or certified statements of accounts from a registered Chartered Accountant.

ii. The tenderers should have applicable Tax registrations (PAN, TIN, TAN, VAT, CST, Service Tax Number, etc.) duly supported with documentary evidence and licenses, permissions, approvals issued by Labour enforcement and other statutory authorities, wherever applicable and furnish copies of the same along with the tender.

iii. Should have their own office within the city limits of of Shimla

3. Tenderers are requested to enclose the following documents in Envelope containing PART -I (Prequalification bid) for examining their qualification/ suitability. Opening of Part -II (Financial Bid) will be subject to the tenderers satisfying the prescribed eligibility criteria:

i. Copies of Work Orders and Completion Certificates from clients for executing similar works for Central/State Government offices/Public Sector Undertakings/Public Sector Banks/Autonomous Bodies/Private Sector/ Housing Societies etc. “Similar Works” means experience in executing Maintenance Contracts in similar Government/PSU/PSBs Public Sector Banks/Autonomous Bodies/Private Sector/Housing Societies etc. having offices & guestrooms or such similar set-up.

ii. Income Tax returns for the last three consecutive years. iii. References of clients/particulars of bankers, specifying their names and contact

numbers (landline and mobile) and names of the contact executives/ officials. iv. Information in Sections -I, II, III, IV & V as per enclosed proforma.

4. Intending tenderers are required to submit their full bio-data giving details about their

organisation, experience, personnel in their organisation, spare capacity, competence and adequate evidence of their financial standing, etc. in the enclosed statement which will be kept confidential.

5. While deciding upon the selection of contractors, emphasis will be laid on the ability and competence of tenderers to undertake quality works within the specified time schedule and in close co-ordination with other agencies, besides the rate structure of the items.

6. If required, NABARD will obtain reports on past performance of the tenderer from his clients

and bankers and evaluate the said reports before opening of the PART–II (Financial Bid) of the tenders and also visit the office & site / sites where they are carrying out / carried out similar works. If any tenderer is not found to possess the required eligibility for participating in the tendering process at any point of time and/or his performance reports received from his clients and/or his bankers are found not satisfactory, NABARD reserves the right to reject his offer even after opening of PART-I (Pre-Qualification Bid) of the tender and his sealed cover containing PART-II of the tender will be returned to him. NABARD is not bound to assign any reason for rejecting the tender.

7. After scrutiny of PART-I (Pre-Qualification Bid), if any of the tenderer is found not to be satisfying the required eligibility criteria, the tender submitted by him will not be processed further and returned to the tenderer.

8. Each page of the tender shall be signed. The tender shall be signed by person/persons on behalf of the organisation having necessary authorisation/ Power of Attorney to do so.

9. If the space in the proforma (Section -I, II, III, IV & V) is not sufficient for furnishing full

details, the information shall be supplemented on separate sheets of paper stating therein the part of the statement and serial number. Separate sheets shall be used for each part which shall also be signed by all the Authorised signatories.

INSTRUCTIONS TO THE TENDERER 1. All the pages of the Tender Document shall be signed by the Tenderer. 2. NABARD takes no responsibility for delay / loss in post or non-receipt of tender Documents. 3. The envelope containing Tender / Quotation should be properly sealed, addressed, duly superscribed as PART-I (Pre-Qualification Bid) and PART-II (Financial Bid) as the case may be, with name of work and due date of opening and should be dropped inside the prescribed Tender Box in the Office of the Chief General Manager, National Bank for Agriculture and Rural Development, Himachal Pradesh Regional Office, NABARD Block No 32, SDA Complex, Kasumpti, Shimla-171009. The last date of receipt of Tender is 12/04/2017 (1500 Hrs). PART-I (Pre-Qualification Bid) of Tender will be opened on 13/04/2017 at 1500 hours or at a later date convenient to NABARD. 4. Tenders submitted by unauthorised agents or FAX / Telex / Telegrams/ e-mails shall not be entertained. 5. Tenderers are advised to visit the site at their cost, conduct survey of existing conditions so as to familiarize themselves with the site conditions, nature of works etc. and get all clarifications as necessary from NABARD to their utmost satisfaction before quoting the rates. 6. If last date of receipt of Tender and opening date happens to be a holiday, the submission and opening of Tenders / Quotations shall be shifted to next working day without any change of time and venue. 7. The Tenderers should quote their rates strictly adhering to Terms and Conditions stipulated in the Tender Document. Unsolicited correspondence after opening of the Tender shall not be entertained. Conditional / Deviational Tenders may be rejected without making any reference to the Tenderers. 8. The Tenders will be opened in the presence of such Tenderers or their authorised representatives who choose to be present. 9. No Tenderer will be allowed to withdraw his Tender during the validity period. Subletting of the Contract is not permitted. In case any tenderer withdraws his/her tender during the validity period, the EMD amount received from such tenderers shall be forfeited. 10. Rates should be filled in the Tender neatly and as far as possible, no correction shall be made. The rates quoted should be written legibly in words and figures. If on checking, differences are observed between the rates given by the Contractor in words and figures or in the amount worked out by him, scrutiny of the tender shall be done as per NABARD's guidelines. 11. Notwithstanding anything stated above, NABARD reserves the right to assess the tenderers capability and capacity to perform the contract, should the circumstances warrant such assessment in the overall interest of NABARD.

Complex, Kasumpti, Shimla GENERAL INSTRUCTIONS TO THE TENDERERS AND GENERAL CONDITIONS OF CONTRACT 1. Tenderers are advised to visit the site and thoroughly understand the nature and scope of the works and be familiar with the site conditions to their utmost satisfaction before quoting. 2. Quoted rates should be workable and reasonable and should include incidental and all overheads and profits. The contractor would be required to furnish Rate Analysis for scrutiny of the rates, as and when called for by NABARD. 3. Rates should include all Taxes ( VAT, IT, WCT, etc.), Duties, Octroi, Levies, Wages as per relevant Act etc. as applicable and should be firm for the entire Contract period. Under any circumstances, no price escalation, whatsoever, shall be entertained/permitted/allowed during the contract period. 4. Monthly payment will be made based on bill submitted by the contractor and certified by the concerned Assistant Caretaker (ACT)/Caretaker (CT)/Site Supervisor or any other person authorised by NABARD to the effect that the complaints recorded in the Registers are attended to and as per the scope of the work. The Contractor has to get the Signature of the Assistant Caretaker (ACT)/Caretaker (CT)/Site Supervisor or any other person authorised by NABARD after completion of the respective work on the prescribed formats /given for respective work and should submit all these with the bill. Bills for Maintenance of Office Premises, Visiting Officers/Executives Flats, Staff quarters, Housekeeping and Horticulture Services should be raised separately. 5. Separate work orders will be issued by NABARD in respect of additional works which are not covered under the comprehensive monthly charges. The bills for the same are to be submitted within a period of one month after completion of the work. NABARD may reject any claim made after the stipulated period. The bills for the works carried out without proper work slips/ work order will be rejected and no further representation will be entertained. 6. Income Tax, Works Contract Tax and other taxes as applicable, will be deducted at Source from total payments due to the Contractors. 7. NABARD will not be under any liability whatsoever, to pay any compensation to the persons deployed by the contractor if they sustain any injury etc., while discharging the duties in the said premises. The contractor shall get them insured against any liability under the Employee Compensation Act or any accident at his (contractor’s) own cost. The Contractor should arrange to obtain necessary insurance cover (Workmen Compensation policy and Contractors All Risk Policy) for his employees at his cost and should be responsible for the safety of persons employed by him. The Contractor shall be fully responsible and shall compensate NABARD with suitable Insurance cover in the event of any damage to persons or material, injury /damage or death as the case may be, caused directly or indirectly due to the negligence of the Contractor or his agents and / or his employees or workforce. The insurance policy may be obtained in the joint names of NABARD (to appear first) and the contractor’s respectively for the insured amount to the amount of at least 1.25 times of the tender amount and the original Insurance policy may be deposited in NABARD. In case, no insurance policy is furnished before commencement of the work, NABARD will take the policy on behalf of the contractor and recover the amount of premium, interest on premium etc. from the contractor. The

decision of NABARD in this regard shall be final and binding on the contractor. The insurance policy shall be work and site specific. 8. Any damages caused to the building / premises during the execution of the work shall be made good by the Contractor and if necessary, through suitable Insurance cover at his cost. 9. The contractor shall deploy such minimum number of qualified and experienced staff as indicated in Section -IV by the contractor to ensure that the work is attended to in time as per the scope of work of the tender, to the satisfaction of NABARD. 10. All the Standard Conditions of the Contract shall be binding on the parties as per Indian Contract Act and prevailing Rules the contractor shall pay the personnel deployed in NABARD, their wages in accordance with the minimum Wages Act, 1948 on a monthly basis. The contractor shall also make PF contribution, ESI contribution and or any other statutory contribution in respect of the personnel deployed in NABARD. Tenders/bids not complying with the minimum wages payment are liable to be rejected which will be ascertained on the basis of Section -IV submitted by the contractor. The contractor shall, for all intents and purposes, be the “Employer” within the meaning of different Labour Legislations in respect of skilled and unskilled personnel so employed and deployed in NABARD and the manpower so employed and deployed in NABARD shall remain under the overall control and supervision of the contractor. The persons deployed by the contractor in NABARD shall not have claims of Master and Servant relationship (implicitly or explicitly) between him/her/them and NABARD, nor have any principal and agent relationship with or against the NABARD. The contractor's personnel shall not claim any benefit/ compensation /absorption /regularization of services under the provisions of the Industrial Disputes Act, 1947 or Contract Labour (Regulation & Abolition) Act, 1970. 11. The Contractor shall comply with the provisions of Contract Labour (Regulation & Abolition) Act, 1970, Minimum Wages Act, 1948 and all other Labour Laws and other Statutory Regulations (both Central and State) that may be enforced from time to time by the appropriate authorities. NABARD shall not be responsible in any manner in the event of non-compliance with various labour laws in force by the contractor and the onus of compliance lies solely with the contractor. The contractor is advised to maintain attendance register of his staff employed/deployed at various sites and wage register for payment (at least minimum wages as per Central or State Govt., whichever is higher, shall be paid) with all records up to date as per the labour regulations. The contractor may be asked to submit to NABARD the monthly payment records to the staff employed by him. The contractor is advised to ensure that the payment is regularly credited to the bank account of the individual staff employed and payslips for respective payments are duly issued regularly. NABARD may ask for past payslips and payment records to be submitted along with the monthly bill. In case wages are required to be disbursed in cash, the same may be done in the presence of authorized representative of NABARD as required as under relevant law. 12. Contractor shall pay the ESI & EPF contributions of all employees as per the prevailing Employees Insurance and Employees Provident Funds Acts under the contract, if ESI & EPF Act is applicable to the contractor as per law. The rates quoted by the contractor should be inclusive of employer's share of ESI & EPF contributions for this contract. The contractor should submit proof of payment (counterfoils), as and when called for by NABARD, towards ESI & PF with monthly bill & other documents such as registration number, photo card etc. 13. The Contractor should be responsible to fulfil all the obligations in connection with the workers employed by the Contractor for the purpose of the Contract and all the Statutory and other liabilities, if any, including minimum wages, leave salary, uniform, ex-gratia, gratuity, ESI, Provident Fund,

Workman Compensation, if any, etc. in connection therewith shall be on the Contractor's account and payable by the Contractor. 14. The contractor shall ensure regular payment to his staff posted for the captioned work and the payment made to his staff should not be less than the minimum wages notified by the Central Govt. from time to time and make available for inspection of the Bank the relevant records. However, rate quoted by the Contractor shall be firm and remain valid till the expiry of the contract period. The contractor should quote the rates accordingly so that the revision of wages during the currency of the contract can be done. 15. The manpower deployed by the contractor should be polite, cordial, positive and efficient, while handling the assigned work so that their actions promote goodwill and enhance the image of NABARD. Necessary grooming should be done by the contractor before posting the staff at site. The Contractor shall also comply with the provisions of all labour legislations. Receipt of any complaint in this regard shall be viewed seriously. No additional payment shall be made if contractor keep more staff at site for completing the pending work or if the minimum staff strength deployed is not able to perform satisfactorily as per the contract provision. The Contractor’s workmen should report to ACT/ Site supervisor as per timings mentioned in the Price bid/ Bill of Quantities. A register will be kept at site on all the locations showing attendance on day to day basis and which will be countersigned by the

security guard on duty the time when contractor’s worker arrives & signs at site. The same shall also be signed by ACT & the same or copy shall be presented along with the Contractor’s monthly bill. 16. The Contractor shall abide by the requirements of Security from time to time and shall strictly follow the obligations required by NABARD. 17. The Contractor should obtain necessary permission that may be required for the purpose of this Contract from such authorities as may be prescribed by Law from time to time. 18. The Contractor or his authorised representative should visit the site frequently as required by NABARD and meet Officials for any clarifications and to receive instructions. 19. The Contractor shall have whole/ sole responsibility for any damage / loss of life and property of NABARD. In the event of any damage / loss of life and property of NABARD, the contractor shall fully compensate NABARD for such damage/loss. The decision of NABARD in this regard shall be final and binding on the contractor. 20. Any act of indiscipline / misconduct / theft / pilferage on the part of any employee engaged by the Contractor resulting in any loss to NABARD or any of its clients in kind or cash will be viewed seriously and NABARD will have the right to claim damages or levy fine and/ or terminate the Contract forthwith, if necessary without any notice. 21. In case of any default or failure on Contractor's part to comply with anyone / all of the Terms/ Conditions, NABARD reserves to itself the right to take necessary steps to remedy the situation including, inter-alia, the deduction of appropriate amount/s from dues otherwise payable to Contractor and / or by taking recourse to appropriate recovery proceedings. 22. If any dispute arises on any matter concerning this Contract, the decision of NABARD shall be final and binding.

23. The Contractor should not at any time do, cause or permit any nuisance on the site / do anything which shall cause unnecessary disturbances or inconvenience to the occupants / visitors at site or near the site of work. 24. The work should be carried out with least inconvenience to the occupants of Visiting Officers/Executives Flats & Officers/Staff members of NABARD. The workmen employed by the Contractor should abide by the Rules and Regulations prescribed by NABARD in the premises, especially in respect of working hours, entry of the workers to the premises, wearing of uniforms, interpersonal relation with the occupants of Visiting Officers/Executives Flats. The contractor shall provide photo identity card to its workers including the leave reserves. Any workman not maintaining discipline / decorum inside the premises shall be immediately removed from site. 25. The Contractor should obtain approvals, if any, necessary for the work from the statutory bodies. The Contractor shall assist NABARD fully in respect of any liaison with the Municipal or any other authority for necessary approval / permission with regard to the maintenance works. The fees and other statutory charges, if any, will be reimbursed to the Contractor based on the original receipts produced to NABARD. 26. EXIT: i. First three months on a trial basis. If the services of the contractor are not found to be satisfactory, the contractor will be given a notice, with a notice period of 30 days, to improve his services. If the contractor fails to improve his services within the Notice period, NABARD shall have the discretion to terminate the contract either in part or in whole, any day after the expiry of the said notice period. ii. The contract is liable for termination by giving one month’s notice by either of the parties ie., NABARD or the contractor. 27. The contractor shall provide mobile phone to the supervisor and number to be communicated to NABARD. 28. The Contractor should provide 2 sets of uniforms and one set of shoes of approved colour every year to the employees deployed in NABARD at his own cost. 29. The contractor shall ensure to provide an alternate qualified manpower or replace with a standby in case any of the regular staff deployed is absent or is on leave. 30. On-site storage space will be provided to the Contractor. NABARD will not be responsible for contractor’s materials. The contractor may be required to vacate the storage space as per exigency without any extra cost to NABARD. 31. The contractor shall provide everything necessary for the proper execution of the works. 32. The Contractor shall not directly or indirectly transfer, assign or sublet the Contract or any part thereof, without written permission of NABARD. While submitting the monthly bill for comprehensive maintenance bill, the contractors have to submit detailed information on the complaints received, pending and the reasons there for and likely date of attending the same. Bill will be considered for payment after receiving the statements. Contractor will not link payments to his labourers with the settlement of bills by NABARD. 33. VALIDITY OF TENDER: Not less than 90 Days from the date of opening of the Financial Bid.

34. If in the opinion of NABARD the work done by the contractor is not satisfactory, NABARD may decide, depending upon the merit of the work, to deduct such amount from the monthly bill amount, as it may deem fit. 35. The contractor shall use necessary safety equipment and maintain all safety measures during the execution of works and ensure compliance of Safety Code as per rules and Regulations in force. 36. The Contractor shall extend necessary help to other Contractors engaged by NABARD under rate contract for their respective work. 37. The Contractor shall be required to furnish NABARD, as and when required, the following: i. The Power of Attorney, name and signature of his authorized representative, who will be in-charge of execution of this contract. ii. Wage Book, Muster Book pertaining to labourers engaged under this contract. iii. Validity of Insurance Policies, Labour Contract License relating to staff engaged at NABARD site. The Contractor shall take all precautions necessary and shall be responsible for safety of work and risk involved in works carried out by their personnel. iv. The Contractor shall vouchsafe bonafides, conduct and fidelity of the staff employed by him. Any damage caused wilfully or in negligence to the works executed, shall be borne by him. 38. The contractor shall remove from work any worker who is found to be failing in his duties or whose presence in premises is otherwise objectionable in the opinion of NABARD. 39. The manpower deployed by the contractor for discharging the contractual obligations under the contract shall be the employees of the contractor. NABARD shall in no way be connected with such manpower and they shall have no claim whatever against NABARD. 40. The Contractor shall at his own cost and expenses provide all the materials, labour, supervision tools, plant apparatus, ladders, trolleys, conveyance, uniforms etc. required for execution of the work covered by this contract to the entire satisfaction of NABARD. 41. Notwithstanding anything contained therein, the labourers, workmen, supervisors and other employed persons by the Contractor for the purpose of the works shall for all purposes be regarded as the Contractor's employees. Therefore, neither the contractor nor any of such employees shall have any right to complain or claim against NABARD. NABARD also shall have no concern with them and shall not be liable to make any payment to or any contribution on account of them. Contractor shall maintain a proper Record /Register indicating reasons for not attending to any particular complaint

within time schedule, failing which penalty as per Bank’s decision shall be levied. The expected period of completion of the various items and the amount of deduction beyond that period for pending complaints will be as follows:

In case of delay in attending the work in time, NABARD will be at liberty to get the work done through any other agency and the cost therefor shall be recovered from the Contractor at the discretion of NABARD.

42. In case of any stoppage of work resorted to by the employees of the Contractors, NABARD reserves the right to employ workers from other sources, without any notice, for carrying out the maintenance work. In such cases, either the actual cost of such labourers on whole day basis shall be deducted from the existing Contractor's bills or recovery will be made on the basis of actual amount paid to the other contractor plus the service charges of 2% and any other tax, as applicable. i. The contract shall be valid up to 31/03/2020. The bank also reserves the right/option to extend the validity of this contract for a further period not exceeding one (01) year at the same rates and on the same terms and conditions. ii. Forfeiture clause: In case of negligence/dereliction of duty by contractor's staff, the contract shall be terminated without giving any notice and the security deposit shall be forfeited. iii. Recovery of income tax, education cess, work contract tax and any other tax, as applicable & in force shall be deducted from the bills during the currency of the contract. 43. Note: The property shall be handed over to the contractor for maintenance on as-is-where-is basis and the contractor shall be required to complete the pending work (if any), without any extra cost. National Bank for Agriculture and Rural Development, Shimla Maintenance Contract for General Maintenance of Office Premises, Visiting Officers/ Executives Flats, Officers’/ Staff quarters, Housekeeping and Horticulture Services at NABARD, Block No 32, SDA Complex, Kasumpti, Shimla SAFETY CONDITIONS OF THE CONTRACT As part of the contract, the contractor must satisfy the under-mentioned safety requirements and must ensure at all time that these are followed without any deviation. A. General 1. Smoking and chewing pan/tobacco/ gutkha/ any other drugs etc. are strictly prohibited in the building. 2. For any job involving welding, soldering, lighting of flames, use of heat source or temporary electrical connection, prior permission of NABARD's engineer or any person authorised by NABARD shall be taken before execution of the same. No jobs involving heat sources are permitted to be carried out after office hours, or on holidays and Sundays without prior permission of NABARD. 3. It is entirely the responsibility of the contractor to ensure that safety appliances such as safety belts, life lines, helmets, rubber gloves of appropriate voltage (1100V) rating etc., depending on the job demand, are made available to his staff at contractor's cost. If the contractor needs any suggestion on the matter, he may approach NABARD's engineer for the same. Any lapse on safety will be viewed seriously. 4. The contractor shall ensure that the persons deployed for the work are well conversant with the operation of fire extinguishers. 5. The contractor shall take all precautions to avoid accidents and causes of accidents. He must be careful regarding safety during working of his staff in the premises. B. Safety precautions of portable electrical appliances Precautions in handling portable electrical appliances are more significant under monsoon conditions. Some likely situations are highlighted here for attention and action to ensure that conditions and methods of usage conform to the safety of personnel and property. 1. Broken sockets / pin plug / loose connections: These conditions cause sparks which lead to fault conditions or electrical shock situations. Wires shall not be directly inserted into the sockets as the earth lead of the equipment inserted into the phase socket may give shock to the operator. 2. Polarity of phase / neutral and earth: Certain appliances like Poroscope may give violent electrical shock during work if polarity conditions are not satisfied. 3. Joints in flexible cables: Usage of portable appliance is such that electrical and physical integrity of joint may be suddenly affected, leading to severe sparking and fire if combustible / inflammable materials are present near the joint. Perhaps this may not be noticed by the operator at all.

4. Appliance body grounding and system grounding: In the absence of or ineffective appliance body grounding, operator may receive severe shock in case of phase to earth fault during usage. All earth pins in sockets must have low impedance and mechanically firm earthling according to Indian Electricity Rules/BIS 3043 so that safety is assured to operators even under fault conditions. 5. Water leakage: Water reduces efficiency of insulation depending upon exposure. Presence of moisture on ordinary switches may give a shock during operation, switches in chronic leakage areas should preferably be de-energised until the rectification is done and contractor take clearance from NABARD’s engineer on the issue. 6. Excavation / Addition / Alteration of the Building: During excavations, alterations of the building etc. every care shall be taken that electric shock or damages to cables are avoided. De- energisation of circuits must be considered whenever required. We/I agree to the safety conditions and to ensure compliance with the same fully. National Bank for Agriculture and Rural Development, Shimla Maintenance Contract for General Maintenance of Office Premises, Officers’/ Staff Quarters, Visiting Officers/Executives Flats, Housekeeping and Horticulture Services at NABARD, Block No 32, SDA Complex, Kasumpti, Shimla SCOPE OF WORK FOR MAINTENANCE WORK OF OFFICE PREMISES & STAFF QUARTERS 1. NABARD is desirous of having a maintenance contractor responsible for maintenance & upkeep of its Office Premises (hereinafter referred to as the said premises), Visiting Officers/Executives Flats & Officers’/Staff Quarters. The details of such services to be provided by the contractor are enclosed. 2. The Office Premises include the FOUR Floors plus Ground Floor of the building with staircases. The said premises also include the open area all around the building as well as the areas in front of the entrances of the building and the parking lots. 3. The maintenance contractor shall keep, at conspicuous and specified places complaint book/books in which complaints and suggestions, if any, may be recorded and the complaint book/books shall be open to inspection by the officers of NABARD. 4. The maintenance contractor shall maintain and update any or all registers/documents relating to maintenance work, as asked to do from time to time by NABARD, for attending complaints and upkeep of the said premises etc. 5. Adequate number of experienced staff including one female staff for cleaning & general maintenance of the office building under the supervision of a suitably experienced supervisor (minimum one supervisor) shall be deployed by the contractor on-site. 6. Contractor will maintain records of day-to-day remedial work and materials required/used for the same. 7. The terms and conditions regarding fixtures, fittings and all other items present within the said premises shall be as follows: (i) The maintenance contractor shall ensure the safety of the furniture, fittings, stores and all other electrical, electronic and office equipment present within the said premises that the maintenance contractor will not be responsible for any thefts, pilferages, breakages committed by the persons not engaged by him or for reasons beyond his control. (ii) As security for due performance of his obligations hereunder, the maintenance contractor shall deposit with and keep deposited with Bank a sum @ 2% of the quoted amount (total annual value of the contract), as initial security deposit within 7 days of award of work. No interest will accrue on the said deposit. Such deposit would be refunded to the maintenance contractor after the maintenance contractor has settled all his liabilities, if any, towards NABARD at the time of termination of this agreement. The security deposit is liable to be forfeited by NABARD if the maintenance contractor commits breach of any or all of the terms and conditions contained herein. The amount of liability to be recovered for breakages, of articles referred above shall be arrived at on the basis of the prevailing market prices of such articles/items or the prices paid by NABARD at the time of purchasing them, whichever is higher.

(iii) The officer/s of NABARD may at any time inspect the maintenance work/job and all items/articles handed over by NABARD to the maintenance contractor and deemed to be in possession of the maintenance contractor and the maintenance contractor shall give all assistance for this purpose to officers deputed in this behalf. PART A List of Items of work to be attended to in respect of Maintenance Work (As per day-to-day schedule indicated in Annexure-I) A. OFFICE BUILDING (INCLUDING CABINS, CONFERENCE ROOM, LOUNGE/ CANTEEN, SPORTS ROOMS, GYMNASIUM & OTHER ROOMS/AREAS IN OFFICE BUILDING ETC.)

i. Cleaning, Sweeping and Washing of floors, bathrooms, toilets and wash basins of the office premises as per enclosed ANNEXURE -I.

ii. Dusting of furniture & fixture provided in the office building. iii. Supplying the drinking water in the cabins of the Senior Officers/ Guests and at Officers’

Desks. iv. Cleaning of Cabins, Conference Room, Lounge, Gymnasium, Dispensary, Association rooms

and other areas/rooms in office premises. v. Removal of cobwebs from the staircases, passages, etc. vi. Change of curtains in the Cabins, Conference Room, Executive Lounge, Board Room,

Gymnasium and other areas/rooms in office building. vii. Attending to minor plumbing and electrical works 03 half-days a week and also in case of

urgency. viii. Removal of waste papers etc. from all the rooms of the office building. ix. Supply of drinking water at executive meetings/conferences. x. Switching on / off the lights, heaters and other electrical appliances in the building as per

requirement. xi. Cleaning of window panes, doors etc. in the office building. Cleaning of the surrounding

area of the office building. Surrounding area here is specified as the vacant area, parking lot, driveway etc.

xii. General Cleaning of Office Building, Pathways, Drains, Sewer Lines and Manholes, Shafts, Common areas in the building, staircases, catch basins, all sewer lines and manholes, gully traps, sluice valve and wheel valve chambers etc., to keep them in proper hygienic conditions.

xiii. Collection of all garbage from the office building, dining hall & kitchen, road, drains and sewer lines etc. and disposal of all rubbish/waste material at a distant place away from the premises in the approved municipal dump.

B. STAFF QUARTERS

i. Cleaning of bathrooms, toilets and wash basins of individual Staff Quarters once in a week. ii. Cleaning of fans, cobwebs, inaccessible spots and Netlon mesh once in three months. iii. Cleaning of other rooms once in a year. iv. General Cleaning of the Buildings, Pathways, Drains, Sewer Lines and Manholes, Shafts,

Common areas in the building, staircases, terrace, outer stone paving, road side and other drains, catch basins, all sewer lines and manholes, gully traps, sluice valve and wheel valve chambers etc., to keep them in proper hygienic conditions.

v. Attending to minor plumbing and electrical works 03 half-days a week and also in case of urgency.

vi. Collection of garbage and disposal of all rubbish/waste material at a distant place away from the premises in the approved municipal dump.

Specialised works

(1) Mechanical cleaning and Disinfection of overhead water tanks. (To be done through specialised agency)

SPECIAL CONDITION: The work shall be carried out through a firm which is related to this work and the workmen employed by the Contractor should also have experience in their trade.

1. Method of Cleaning:

a. The tank shall be emptied manually or by pumping.

b. The inside surfaces of the tank shall be thoroughly scrubbed with brush and using

Rotary jet application and the scraped dirt/ dust/ debris/ scales/ encrustations be

removed from the tank by means of Slurry Vacuum pump.

c. Anti -Bacterial agents should be sprayed on the walls.

d. Disinfection to be done by UV Radiation.

e. After drying up the tank shall be ready to use.

Note:

a. Successful tenderer should submit the detailed procedure of treatment and get it approved.

b. Cleaning will be done half-yearly preferably in April and October.

c. Cleaning of one tank shall be done on a single day.

d. The Contractor has to give the proposed dates of Cleaning of Tanks (In consultation with the

ACT/CT) at least one week in advance before the starting of each Quarter.

e. The contractor shall put notice at building where cleaning work would be done.

f. The Contractor has to get the Signature of the ACT/ CT after the completion of the Cleaning of

the Tanks as per the format enclosed and should submit with the bill along with the

declaration given in the format.

Details and location of Water Tanks:

PVC Tanks at various Location of following sizes:

1. 2 Nos. x 4000 ltrs

2. 6 Nos. x 2000 ltrs.

3. 2 Nos. x 1000 ltrs.

4. 42 Nos. x 500 ltrs

(2) Pest Control Services (To be done through specialised agency)

1. The Contractor has to engage trained operatives for Pest Control Services. The necessary

supervision, safety, tools and other arrangements shall be made by the contractor during

execution of work.

2. The Pest Control work involves arrest/ control of pests like cockroaches, silver fish, rodents and

lizards etc. and shall be carried out at intervals as below:

a. Office Premises- Monthly as well as check-up service whenever found necessary.

b. Officers’/ Staff Quarters & VOF/VEF- Common Areas- Quarterly & in between two

successive treatments also, if found necessary.

c. Officers’/ Staff Quarters & VOF/VEF- inside the flats- Quarterly

d. Bank’s Property- External drainage/ sewerage system- Quarterly

Note: Treatment against termites shall be carried out if needed

(3) Horticulture Work Providing the services of well experienced gardener with necessary tools for maintenance of all potted

plants and flowers within and around the building. The horticulture work includes the followings:

1. The contractor will supply the plants.

2. The contractor will submit a list of plants which he intends to supply.

3. NABARD will have right to choose the plants from the list given by contractor.

4. The contractor will quickly replace the poor quality plants on call.

5. Regular maintenance of plants in the flower pots including daily watering, manuring, adding

extra earth etc. all complete for healthy growth of plants in the pots.

6. Painting of the flower pots as and when necessary with white lime or brick red colour as

directed.

7. The cost of transportation and keeping the plants at various floors shall be borne by the

contractor.

8. The contractor shall provide all the tools, tackles, such as knives, scissors, water jugs for

sprinkling water on plants and all other relevant accessories generally required for the jobs.

9. All the rubbish, debris, unusable materials, plants etc. removed from the premises should be

disposed off in the municipal dumping yard or any other suitable place not objectionable to

municipal or any other statutory authority

10. The plants / shrubs already planted to be properly trimmed and maintained.

11. Periodical replacement of old potted plants with fresh new plants in office and cabins along

with arrangement of flowers in the cabins every day.

12. Cleaning & polishing of flower pots/ containers.
