So, after 18 months of discussions, heated debates and con-troversy we finally have an agreement with the lightest oftouches, a sign that diplomacy ultimately prevailed to pro-duce a compromise acceptable to all parties.

This, in a nutshell, sums up the deal signed in Francebetween the music and broadcast industries that estab-lishes a new "code of practice" (see front page story).

France being France, and having invented the conceptof "cultural exception" and established airplay quotas, oneshould not be surprised to see that the country felt it nec-essary to establish such a code. Of course, radio groupswere not asking for it. But the music industry was. Andwith music a "cultural industry", the government had totake notice and to act.

The agreement outlines some main principles andavoids some specific issues, such as setting a fixed limit onpower rotations. Its main positive point-and a real stepforward-is that both parties will meet every six months to

monitor the situation, and will have access to a wide rangeof tools from airplay monitored data to figures outliningthe level of investment in A&R and the marketing of music.

There are two scenarios for the future: either this agree-ment is taken seriously by both parties, especially the radioside, and there is a real improvement in the situation, withmore diversity and a better working relationship; or radiostations, pressed by other concerns, such as ratings andfinancial results, simply sit on it and the value of the agree-ment is not even worth the paper is is written on.

If scenario two prevails-and some in the music indus-try in France fear this will be the case-then a situationsimilar to a decade ago when quotas were first mutedmight resurface, resulting in the gov-ernment legislating in order to limitcertain programming practices suchas power rotations.

The fact that this agreement need-ed to be drafted is incongruousenough, but if on top of this there wereto be additional legislation affectingprogramming, it would only act to castFrance's "cultural exception" in arather poor light.

Eurocast looks for a French windowby Lisa Pasold

PARIS - Paris dance station VoltageFM is being eyed up by German com-

The Berlin -based group has placed afirm offer for the station with currentowners with Lagardere Active, which isobliged to sell Voltage following itstake-over of the LV&Co radio group.The undisclosed offer is rumoured to bebetween 10 and 12 million euros.

Eurocast is a grouping of five radiostation operators in Germany, includ-ing R.S.2/Berlin and Hit Radio FFH inHesse. The group is not currently pre-sent in France, but it does have foreigninvestments in the Czech Republic,Poland and the UK. Until recently itwas also present in Austria, though lastmonth the company sold its shares inNRJ Vienna. That sale is being seen asa way of financing the group's moveinto the French market.

Currently waiting for a hearingwith French broadcasting regulatorthe CSA in order to present its case forbeing able to own Voltage, EurocastCEO and founder Rainer Poelmann isoptimistic about the deal. Poelmann

emphasises his group's Europeanmind -set and expertise, which he feelswill bring fresh ideas to French radio."The French market is extremelyattractive for radio," says Poelmann."There are much higher market shares[here] than in Germany."

Poelmann is vague at this stageabout the group's plans for Voltage,other than bringing in a more devel-oped version of its current dance for-mat. A major programming shiftappears unlikely, as Poelmann hasstated that the station appears rela-tively well -positioned in the market. Atthe moment, Voltage is Eurocast's onlyFrench bid, with no other French sta-tions currently in the group's sights.

TV sell-off to spread Chrysalis' radio wings?by Jon Heasman

LONDON - The Chrysalis Group hasadmitted that it is selling its TV pro-duction company with a view to mak-ing more radio acquisitions in theUK's post -Communications Bill mediaenvironment.

The publicly -quoted media group,which has interests in music and bookpublishing as well as broadcasting, iscurrently in negotiations to sellChrysalis TV to a consortium led by atrio of executives who formerly workedfor UK commercial TV network ITV.

Unveiling the company's best -everinterim results at a press conferenceon May 6, chief executive RichardHuntingford (pictured) said that itmade sense for Chrysalis to put morefocus on areas such as radio, where itis outperforming the average industrygrowth, and that the sale of ChrysalisTV without new acquisitions wouldleave the company's balance sheet"ungeared".

However, he emphasised that theUK's other big radio groups, which areoperating mainly heritage stations,needed the benefits of consolidationmore than Chrysalis Radio. "Our port-

folio of stations is still relatively imma-ture in terms of reaching full advertis-ing and audience potential," he said. "Alot of our competitors need acquisitionto drive the next level of earningsgrowth."

Chrysalis Group's pre-tax profits forthe half -year ending February 28 wereup to £9.03million (euros 12.85m), upfrom £650,000 last year. Turnover forthe period increased by 10.3% to£125.5m.

Chrysalis Radio's operating profitsincreased from £3.3m in 2002 to£3.9m in 2003, with like -for -like radiorevenues up by 17.5%. Chrysalis pur-chased London news/talk broadcasterLBC for £23.5m in September 2002,and Chrysalis Radio chief executive

Phil Riley doesn't expect that opera-tion to be profitable for three years.

Operating profits at the company'smusic division-comprising Chrysalis'publishing business and record labelEcho-were also up, from £1.4m inthe equivalent period last year to£1.7m. Turnover for music jumped15.6% to £40m. Echo made £200,000in pre-tax operating profits, comparedwith a loss last year, according to fi-nance director Nigel Butterfield.

Chrysalis Group chairman ChrisWright claimed that it is Echo's inde-pendence that has enabled it to makeprofit at a time when the majors arelosing money. "I have predicted thisfor some time; the majors' chickensare coming home to roost," he said."We know [free] downloading of musicis a problem, but people are still buy-ing music. Yet the majors are all indisarray."

The one blackspot for Chrysalis wasthe performance of its books division,which has moved into the red to thetune of £500,000, and is currentlyundergoing a major structural review.Huntingford denied that once this iscomplete the company would be active-ly looking to sell the division.

VMM launches anti -piracy drivelby Marc Maes

BRUSSELS - Radio stationsand TV operations owned byVlaamse Media Maatschap-pij (VMM) have launched acampaign to persuade musicconsumers to stop down-loading music illegally.

Details of the campaignwere announced on May 2by VMM under the banner"Just because you can, does-n't mean you should". It isbeing backed by the BelgianIFPI office, local collectionsociety SABAM, and BERA,the Belgian retail associa-tion. The announcementwas made in tandem withnews that Belgium's recordsales figures for last yearfell 7.8% in value and an8.0% fall in unit sales com-pared with 2001.

"The idea came [to us]some time ago," says JoNachtergaele, MD of VMM-owned JIM -TV, "mainlybecause we felt the existingcampaign, with its 'Don'tCopy Music' logo, was point-ing the finger too much at

our audience."After meetings with

record companies and retail-ers, VMM decided to provideairtime for the campaign onVMM's Q -Music and TopRa-dio and TV. The proposalincludes a video produced bythe Belgian IFPI and featur-

ing BMG Ariola BelgiumMD Bart Brusseleers. Thecampaign is costing aroundeuros 125,000 to air.

VMM's radio stations canplay an important part inthe fight against Internetpiracy, believes VMM Radiodirector Bert Geenen (pic-tured). "I'm convinced thatalthough we [aim at] the 18 -

to -44 -year -old audience, Q' Music can do its bit to per-suade people not to copymusic. Downloading isn'tthe preserve of 13 -year -olds." Geenen adds that the32 -station TOP Radio net-work will also carry thecampaign until May 31, thedate its network agreementwith VMM terminates.

IFPI Belgium directorMarcel Hymens says he is"delighted" with the cam-paign as it combines retailand media, adding that hegreatly appreciates the freemedia budget. Negotiationswere being held to persuadethe Flemish public broad-caster VRT and Belgium'sFrench -language radio andTV stations to join the cam-paign, he said.

Meanwhile, also on May2, the Belgian governmentannounced it was imposinga levy of 12 cents on everyblank CD disc sold. While hesaid it was merely a "drop inthe ocean", the IFPI'sHymens said the move wasa step in the right direction.

RDP staff fear public radio 'purge'by Chris Graeme

LISBON - Staff at Portu-gal's public radio broadcast-er RDP claim they are liv-ing in an atmosphere of"fear, insecurity and uncer-tainty" as the governmentprepares to axe a further100 jobs.

Since last spring onethird of RDP's workforce-representing 210 people-has been shown the door aspart of the government'splan to merge the corpora-

tion with public TV broad-caster RTP.

"What we are effectivelyseeing is a purge of radioprofessionals with years ofexperience in the business,while others come in fromoutside with little or noexperience in the industry,"says Maria Clara of broad-casting trade union CT.

"At the moment 210 peo-ple have left which we'rehappy with, but the idealwould be around 300 stafffrom a total of 750," says

RDP administrator LuisMarques.

The CT is also complain-ing that radio is being sub-ordinated to television, withTV journalists able to makeradio programmes, but notthe other way round.

Meanwhile, RDPaccountants reported onMay 5 that the cost of ter-minating its staff contractsand providing early retire-ment packages has sentRDP euros 18 million intothe red.

MP3.com Europe in rebranding moveby Juliana Koranteng

LONDON - MP3.com Europe,the London -based pan-Euro-pean online music service, isto be relaunched in order togive it a global brand imagein line with its US sister com-pany MP3.com.

A subsidiary of VivendiUniversal's VU Net division,based in Paris, MP3.comEurope's revamp is the mostradical since its launch inNovember 2001.

"By having the same logo,colours and look as its UScounterpart, MP3.comEurope will be able toimprove its service for spon-sorship partners, which todate have been mostly globalbrands such as Sony MusicEntertainment, Columbia

TriStar, Pioneer and Motoro-la, more effectively," saysLeanne Sharman, VP salesand marketing, London.

But she adds the content

of the Web portal's six nation-al -language editions (for theUK, the Netherlands, Ger-many, France, Italy andSpain) won't change. Shar-man says the move to stream-line the US and Europeansites comes at a time whenMP3.com Europe has seenthe number of registeredusers jump to 8 million inMay.

Moreover, to improve the

targeted reach among theregistered users accessing the1.7 million tracks availablefor listening on MP3.comEurope, the company haslinked up with Scottishsearch -engine outfit Amber -green, which has been briefedto ensure that whenever con-sumers look for a Europeanmusic site on the Internet,MP3.com Europe is high inthe listings.

The news comes shortlyafter the recent departure ofCEO Chris Montgomery, whosays he is now "evaluating[his] next career move".

Asked whether Mont-gomery's departure led to thechanges, Sharman insiststhat they were part of hisvision and that it was busi-ness as usual.

ON THE BEATMUSIC STORE FAILS TO BLOCK BMG/FRS PROMOTIONHILVERSUM - Dutch music retailer Music Store haslost a summary court proceeding to block BMGNetherlands from releasing Idols finalist Jim's firstsingle exclusively to competing chain Free RecordShop (FRS). For three euros and two Mars chocolatewrapper barcodes, the single, Tell Her, will be avail-able in FRS shops exclusively for one week. After thatperiod BMG will also supply other retailers. MusicStore director Rick Guurink claims this will harm theimage of his stores, but according to BMG MD RobSchouw the market situation leaves him no otheroption than to go for such specific cross promotions.The track features in a new Mars bar TV promotioncampaign.

BERLIN, BRANDENBURG PUBLIC BROADCASTERS MERGE

BERLIN - Germany's public broadcasters for Berlin(SFB) and Brandenburg (ORB) have merged to createa new public broadcaster, RBB (Rundfunk BerlinBrandenburg). SFB (Sender Freies Berlin, or "RadioFree Berlin") was originally set up in 1953 during the

Cold War. The two small, financiallychallenged broadcasters ran eightradio stations-three of them joint-ly-and two TV stations. The newauthority, under Germany's firstfemale director-general, DagmarReim (pictured), will combine ORBand SFB's cultural stations, but sta-tions such as Fritz and Radio EMswill remain unchanged.

Bullet-proofing at breakfastRadio consultant Phil Dowse, who is now working inEurope after a successful career in Australia,explains why-more than ever-great breakfastshows are important to "bullet proof" music radiostations in the ratings, and outlines how "thinking pri-mal" can help radio's approach to mornings.

n these competitive times forradio, an increasing number ofstation managers and program-mers talk to me about designinga strategy that will "bullet-

proof" their radio stations.They are all rightly concerned

about uncertain futures with newlicences, consolidation, the poach-ing of talent and a blurring ofmusical points of difference due toincreased competition. If you are amarket leader how do you staythere and maintain the higherground? If you're not, is theresomething that can be done to tipyour station to success?

Is music the answer? Well yes,and no. Of course music is impor-tant, but even stations with bigmusical heritage, points of differ-ence and great execution are notbullet-proof. If music alone is yourbiggest asset or your one and onlyreally positive brand attribute, youare vulnerable. You are not bullet-proof because a new competitprcould open up in your market andclone your music or in some way,"out -music" you. If they achievedthis and if they also possessed onemore "stand out" attribute theycould, very conceivably, beat you.

With format finders, perceptualstudies, auditorium tests, call outand other great musical tools, ourprogrammers and music direc-tors/managers have an exception-ally strong arsenal at their dispos-al. The only problem is that so doesthe other guy.

Sure, some stations gain advan-tages thanks to a larger budget orthrough the quality of their people,whether it be their ability to readand action the research or simplyin the way they craft their particu-lar radio stations. Again the ques-tion must be asked, is this really anongoing competitive advantage ornot?

What is bullet-proofing?It is the simple art of giving your cur-rent and potential new listeners someoutstanding "essential" that theyreally desire, or that you think theywill desire, that your opposition willhave difficulty in duplicating.

Start by looking at the "4 M's": Playing the best music for yourtarget Designing a strategic market-ing plan and highly -flexible tacticsthat drive the strategy. Making sure that you and yourproduct is memorable. After all,you do need to get the credit for all

your hard work. The fourth "M"is for morning, ormorning radio.

A winning breakfast show is ahighly desirable commodity. It isthe engine room of the radio sta-tion that drives cume/listeners intothe station, can impact hugely onyour workday results and can seri-ously grow your brand.

This is because great breakfastshows can deliver a broader agedemographic to your station thanyour music position would indicateis possible. For instance, a stationtargeting 25-34 females can notonly dominate that demo, it canalso win 35-44 females, have solidmale scores, and also drive the allimportant "Listened Yesterday"scores, all due to the impact of the

So, how do you build that sta-tion armour that will bullet-proofyou against attack? After workingwith breakfast shows for around20 years you do notice a patterndeveloping, and a number of criti-cal rules that need to be embraced:

Bullet-proof breakfasts Before you do anything, monitorthe opposition. Find out what ismissing in the market. Are thereany obvious holes available that fitwith the predisposition of yourradio station? Recognise that any great break-fast show takes time to mature, somove decisively but with caution.Find your anchor or the centre-piece of your show first if youcan-then build the show aroundthat person. "Maximum music" breakfastshows don't win, nor do showswhose major point of difference isonly that they are local. Beinglocal and playing the right musicfor listeners is obviously impor-tant, but alone, they are notenough. Entertainment is the key ingre-dient, and even a show that is inits infancy can have seriously goodentertainment every 15 minutes. You must have good role defini-tion within your on air team. Ifthey don't know their roles or onair personas, the audience wontbuy in. A great breakfast show can andshould be multi -dimensional. Funand quotability are the numberone ingredients, but other emo-tions are also important. It really

breakfast show. Consider theseattributes that can serve to make abreakfast show "sticky": A special chemistry betweenteam members that evokes an emo-tional connection with the audi-ence. Being famous for one thing-orowning one word in the marketplace. Having one or more consistentdaily benchmarks that listenersflock to. Performing one great quotablestunt or event every month or so. Taking the approach that eachshow, like a TV serial, has a senseof continuity. Like our favouritesoap opera, we can't miss anepisode.

is the "make them laugh, makethem cry" approach. Use all the resources available toyou. Record off the TV and edit forbreakfast, listen and swipe ideas offthe Internet-many great stationsstream. Use your greatest andcheapest source of entertainment-your listeners. Make them starsand build lists of talented listeners,and use them over and over again. Find a producer or someone whocan answer the phones at break-fast to prep your callers. Embracethe idea of having "insurance"callers-the killer calls that areguaranteed to hit the spot. Recordthese the previous day, just in caseyou don't get a lot of calls on themorning.

Include a benchmark (regularfeature) every half-hour between07.00 and 09.00. And once you set-tle on benchmarks, keep them andbecome famous for them. Listen to your breakfast showand offer good, consistent feed-back. Focus on one issue peraircheck meeting. Preparation is everything forbreakfast radio. Encourage yourteam to have a post -show meetingevery day to prepare for the follow-ing day, and once a week, a medi-um -term planning session is alsoinvaluable.

Making great breakfast radiodoes bullet-proof your station, andhaving the great on -air product isthe major challenge. There is onefinal hurdle to negotiate, however,in order to attain breakfast radioimmortality, and that is to distin-guish between thinking local ortopical and thinking "primal".

Thinking primalIn 2003, your breakfast showneeds to stand out and be talkedabout. Being local and topicalwon't do it but if you weave "pri-mal themes" through each showand occasionally "spike" the showwith a major "primal stunt", youwon't believe how quickly new lis-teners will converge on your sta-tion.

Here are some primal themesfor you, and frankly these are theonly broad themes that listenerscare about. Sex Greed Gossip Waist line (for females) Sport (for males).

It is this kind of thinking thatled to incredibly successful "pri-mal" radio campaigns such as TheFugitive, Two Strangers and aWedding and The Lie Detector. How does your station score onthe Primal Scale? What did your breakfast showdo today that is being quoted inthe workplaces in your market?

The Rasmus come alive with Dead Lettersby Jonathan Mander

It appears a small matter of changing record labelshas done wonders for Finnish rock act TheRasmus, both reigniting their popularity at homeand launching their international career.

Since swapping Warner Music Finland forSweden's Playground Music, 2001's Into and thelatest album Dead Letters-released in Finland onFebruary 28-both hit number one in the Finnishalbum charts. And the lead-off singles for bothalbums, F -F -F -Falling and In The Shadows respec-tively, have reached number one in the singlescharts.

The local picture may be a sign of things tocome, as Playground Music has just signed alicensing deal for The Rasmus with UniversalMusic Germany's Motor/Urban/DefJam group forthe world outside of Scandinavia, Iceland, theBaltic States, Italy and Russia.

"This is a huge step for The Rasmus," says LarsTengroth, A&R manager at Playground Music. "It'sa great chance to reach a big international audi-ence and give them a well deserved breakthroughin Europe, starting in Germany."

At the same time the act has been taken on forthe GSA territories by the Marek LieberbergKonzertagentur booking agency, who have alreadyarranged for them to play the two premier Germansummer festivals, Rock Im Park and Rock Am Ring.

"When we signed the band it was clearly time tofind audiences outside Finland," says Tengroth."The band took it as a big challenge, and it hasmade them better."

In fact, live shows play a large role in of the act'spopularity. Recent heavy touring and promotion inthe rest of Scandinavia pre -dated In The Shadowspeaking in the Swedish singles charts at numberfour, while Dead Letters-released in Sweden onMarch 25-reached number six in the Swedish

album charts."Playing live is one of the band's main strengths,

and one of the reasons I signed them," saysTengroth. "Gigs are the best way to break them."

Despite the band members being only 23-24years old, they are already old hands, havingembarked on their recording careers at the ages ofaround 15. "They're very experienced," notesTengroth. "They've worked with two record compa-nies, played hundreds of gigs and they know thebusiness. They'll be able to handle success when it

comes."Dead Letters, like Into, is produced by Swedes

Micke Anderson and Martin Hansen and continuesthe move away from the jolly, nervous funk of earli-er works towards a more mature sound. The strongmelodies are still there, but they are emphasised bythe big -sounding, Bon Jovi-style rock. The newalbum also reveals a darker edge to the act.

Explains lead singer Lauri Yliinen: "We've spenta lot of time away on tour over the years and rela-tionships easily suffer during that time. Those feel-ings are reflected in the lyrics, which are like per-sonal letters to friends."

Compared to the brighter, poppier Into, Yilinenbelieves the new album represents the band's bestsides better. "The differences between our liveshows and our recordings are now fewer," he says.

Radio hasn't been put off by the darker tones.Both In The Shadows and the second single In MyLife-released April 25 in Finland-made it ontothe A -list of public broadcater YLE's national CHRstation YLEX.

"Even though Dead Letters rocks more than pre-vious material, these songs continue the develop-ment from Liquid [the previous single withWarner], and really highlight the group's excep-tional songwriting talent," says YLEX's head ofmusic Heikki Hilamaa.

After Scandinavia, the album will be released inRussia and Italy, with Germany to follow later inthe summer. Thanks to earlier tours and showcas-es, The Rasmus already have a following inGermany and intend to play there more beforeDead Letters is released.

Yltinen makes it clear that The Rasmus prefer tointroduce themselves in new territories in person.

"We want to take it slowly, one region at a time,since we prefer doing promo in person, and show-ing people our strongest side, which is playinglive," he says.

Zucchero gets religion in Manars love revolutionby Mark Worden

Warner Music Mexico's Grammy -winning act Minahave enjoyed plenty of international success sincetheir 1987 recording debut, but non -SpanishEurope is proving to be a stimulating challenge.

The raunchy, romantic rock quartet's latestalbum, Revolucion De Amor, was given a simulta-neous release in Latin America and Spain inOctober, and has already been issued in Germany,while a special version has been prepared for theItalian market, where it comes out on May 16.

This contains an additional track and single,Eres Mi Religion (trans. You Are My Religion), apowerful ballad featuring a duet with Zucchero. Inexchange for his services, the Universal Music Italyblues'n'soul man got Mand to duet on the Spanishversion of his 2001 hit single Baila, which wasincluded in last month's special Latin American re-packaging of the album from which it came, Shake.The Eres Mi Religion experiment has been suchthat Warner are also considering releasing this ver-sion of Revolucion De Amor in France andScandinavia.

Jon Uren, Warner Music Europe's senior directorof marketing, says that the album's Spanish andGerman release has already produced combinedEuropean sales of 250,000 copies, but is confidentthat "it will also chart in Italy and that it can beworked in at least a dozen European territories."The band's introductory compilation, Grandes,made the Italian top 20 following its late 2001release.

Says Warner Music Italy president MassimoGiuliano: "This produced sales of 70,000, thanks to

appearances on Italian TV and at last summer'sHeinekin Jammin' Festival. When Revolucion DeAmor was released in October we decided to waituntil January, as we felt there was still somemileage in Grandes. Then the Zucchero duet ideacame up and so we delayed until May. We're cur-rently hoping that the band will be able to duetwith Zucchero at the Pavarotti And Friends charityconcert in Modena on May 27, in addition to touringin autumn." The aim in Italy is to go platinum withthe album, he says.

Executives over at Universal Music Italy appearto be delighted with the swap scheme. Says A&Rdirector, Stefano Zappaterra: "Both tracks wererecorded in Milan in February and it was just a fab-ulous experience, with a fabulous outcome. They're

great guys and great musicians, and they really hitit off with Zucchero. I mean I've worked with himfor years, but the chemistry in the studio was fan-tastic."

The Italian airdate for Eres Mi Religion wasApril 18, with a commercial release date of May 2.Two national networks in particular have beenaffording the track high rotation, namely RadioDimensione Suono in Rome and RTL 102.5 HitRadio in Milan. RTL's programme director LucaViscardi is also a fan of the reciprocal deal: "It'sclearly of mutual benefit. Maria are essentially arock outfit, but they are sufficiently melodic toappeal to Italian audiences and I'm sure Zuccherois likewise the right mix for South America.Musically, Italy and Latin America have a naturalrelationship."

The massive South American sales for LauraPausini and Eros Ramazzotti would confirm this.As for bringing Latin American artists to Europe,Warner's Massimo Giuliano is convinced that themarket is still there.

"Previously you would see more dance -orientedacts like Ricky Martin, Paola Rubio and EnriqueIglesias," he says. "Maria are clearly different and Ithink that this type of Latin music has a future inEurope." He also thinks that the duet concept hasgreat potential as a promotional tool: "We've beendoing of lot of this of late. In the last year we've hadAnggun guest on Piero Pehi's hit single, L'AmoreImrnaginato, while Nek has recorded with DanteThomas. Well-chosen duets can provide prestige toboth acts in the respective territories. And now thatwe live and work in a united Europe, I find thatartists are more willing to give it a shot."

tortured vocals over strings and acousticguitar, with lyrics like "When I look at what mylife has been coming to/I'm all about lovingyou". UK rock station Virgin Radio is one ofthose playing the track. "It's a classic Bon Joviballad, along the lines of Always and This Ain'tA Love Song-with maybe a hint of The Eaglesabout it," says head of music James Curran. "Ithink the album's under -achieved a bit, so thiscould kick-start it." The new single is the thirdcut to be taken from Bounce. "Whether theyshould go for four singles I'm not sure," saysCurran. "But if they do, then the title trackBounce is a nice, upbeat track and should bethe one." All About Lovin' You is on lowrotation at Virgin at the moment, at six orseven plays a week, but it "could move up-we'll keep an eye on it," Curran says.

DJ Sammyand the female singer on the track, Dutchartist Do, apparently subsequently fell out,resulting in Do re-recording the ballad versionof Heaven for Dutch independent labelPatriott. Heaven (Unplugged) was released inHolland in December last year and has sincespent over 12 weeks in the top 10 of thesingles chart there. "She's got a great voiceand she's got great potential," says Frans vanDun, programme controller of national ACstation Sky Radio, which has been playing thetrack for 20 weeks. "The original by BryanAdams was never a hit in Holland, whichhelped," he adds. Patriott is currently lookingfor licensing partners to release the trackelsewhere in Europe, and is in the process ofrecording a more mainstream album with thesinger, who was previously known for herdance work.

Traxx chart, this latest leap is based on positiveupwards motion on most European dance charts,with a debut in Poland this week.

Also entering the top 10 for the first time thisweek is Dannii Minogue with I Begin To Wonder(London). The tune is a new version of J.C.A.'s IBegin To Wonder (Club Culture), which peaked atnumber 21 on the European Dance Traxx chart inJune 2002. Minogue's track has already surpassedJ.C.A.'s achievement, rocketing up from number 22to number 10 this week.

Further down the top 40, Plummet's Damaged(Serious) jumps up from number 46 .to 23 aftergoing straight in at number one on the UK's official12 -inch singles chart. The track also registers thebiggest sales increase of the week at Europe's spe-cialist dance stores. Meanwhile, Italian act PlanetFunk move up from 27 to 12 with Who Said (StuckIn The UK) on Virgin.

The highest of 15 new entries to the top 100, atnumber 24, is Paul van Dyk's Nothing But You(Vandit). It is currently charting in Germany,Holland, Belgium, Poland and Hungary. Second -highest entry of the week is Madonna's AmericanLife (Maverick), at number 30.

There are also three re-entries this week, ofwhich Voodoo & Serrano's Overload (Urban) is thehighest at number 58.

The jostling for position at the top of theEuropean Radio Top 50 chart continues withRobbie Williams' Come Undone (Chrysalis)reclaiming the top spot from Avril Lavigne's I'mWith You (Arista), which spent only one weekthere.

Italian national hot AC radio station RTL102.5 is playing both tracks. "Come Undone is alovely track," says head of music Paolo Ravasi."And, while Avril Lavigne's previous single Sk8erBoi was a bit rocky, she has succeeded in reposi-tioning herself with this track."

The rest of the top ten remains the same aslast week, apart from number 10 itself, whichsees Craig David featuring Sting move up oneplace with Rise & Fall on UK label Wildstar. "Wewere expecting bigger things for this track, but it

didn't strike a chord with ourlisteners," says Ravasi.

Indeed, the top twentytracks remain pretty stable thisweek, the exception being USrapper 50 Cent (pictured) whomoves up five places to number19 with In Da Club off his high -selling debut album Get RichOr Die Tryin' (Interscope).Capitalising on his almost

instant success 50 Cent is already at radio withthe second cut off that album, 21 Questions.

Further down the list we find fellow US rap-per Busta Rhymes featuring Mariah Carey withI Know What You Want (J Records).

Ravasi says that, while Italian radio has tra-ditionally shied away from rap, things havechanged recently. "We play rap in the afternoonsand evenings-Ja Rule, 50 Cent, Nas and obvi-ously Eminem," he says. "Rap now has a follow-ing here." Ravasi particularly likes the newBusta Rhymes track, which moves from number50 to number 26 this week. "It's going down verywell here-Mariah Carey has been re-evaluated!"

This week's highest new entryis Fighter (RCA), the new singleby Christina Aguilera (pictured).It comes straight into the chartat number 37.

RTL 102.5 plays around 45%of homegrown acts, includingEros Ramazzotti, whose Un'Emozione Per Sempre is current-

ly the most -played track on Italian radio and isalso proving to be big further afield. It comes intothe top 50 this week at number 44.

"We've been playing that track a lot-it's onaround five spins a day," says Ravasi, who addsthat Ramazzotti-along with the likes of ClaudioBaglioni, Irene Grandi and Adriano Celentano-is one of the station's priority Italian artists.

Reviewed two weeks ago in Airbourne is TheWreckoning (Dreamworks) by US brother -sisteract Boomkat, which is another new entry thisweek at number 48.

One track which is going down a storm atradio in Italy is Will Young's version of TheDoors, classic Light My Fire on BMG. "I think it'sdown to the fact that it's such a well-knownrecord and that it's been redone in a very listen -able way," says Ravasi. "He hasn't ruined theoriginal."

Knocking at the door of the Top 50 are BonJovi with All About Lovin You (Universal),Tomcraft with Loneliness (Kosmo) and GoodCharlotte's catchy Boys And Boys (Epic).

French radio/label codebanishes certain practices such as"pay for play", but overall, stationshave managed to escape overtly strictguidelines, especially on the questionof rotations.

The deal reaffirms the importanceof broadcasting authority, the CSA, asa catalyst for the relationship betweenrecord companies and radio stations,and the role of the ministry of cultureand communication as an umbrella forthe discussion between the two par-ties, and as the guardian of the princi-ples established by the agreement.

Christophe Sabot, MD of LagardereActive's networks Europe 2 (CHR) andRFM (AC), says: "This is an agreementthat suits us and is satisfying for bothparties. I think we have tried to find agood balance between what the indiesand the majors wanted."

However, Herve Rony, director-gen-eral of labels' body SNEP, sees thingsdifferently. "This is obviously not thedeal we expected. We are now going tosee how the deal is implemented. Onegood thing is that it puts radio stationsunder much more scrutiny. Radio sta-tions admit [in the agreement] thatthe principle of musical diversity doesexist and that this principle can betwisted. In short, it is the recognitionthat [French language] radio quotasare not the only way of ensuring musi-cal diversity."

Radio groups who have signed theagreement include all the nationalmusic networks with the exception ofUrban network Skyrock, public broad-caster Radio France and non-commer-cial groups such as Ferarock or CNRA.Music representatives from the labels(SNEP and UPFI), music publishers(CSDEM), as well as the CSA have allsigned. Missing are authors rightssociety SACEM and artists' body Ada-mi, as well as local and regional radiorepresentative group, SIRTI.

Both parties have agreed to meettwice a year to review the situation.

The agreement in briefMusical diversity: Labels undertake to continue investingin the development and promotion ofartists, especially local repertoire, andwill make public -on a regular basis -statistics regarding their efforts. Theywill also facilitate the access of newreleases to radio stations, especially non-commercial local stations. Radio stations undertake to do "theirbest efforts" to "preserve and encourage"the diversity of repertoire they broadcastand to guarantee the broadcast of tracksfrom a variety of labels (majors andindies) in an "objective, transparent, fairand non discriminatory manner" Stations undertake not to unduly pushtracks that might be produced, co -pro-duced or co -published by themselves orone of their affiliates. Both parties will be monitor the evolu-tion of playlists, especially the share of themost -played tracks, the average weeklyrotation of titles, the number of differenttitles played, the new tracks added by each

station, the variety of musical genres, andthe origins of the titles, among other things.A yearly report containing this data will besubmitted to the ministry of culture.

Radio/labels relationships: The operational divide between the func-tion of music production and publishing onone side and broadcasting on the other is afundamental factor in establishing musicaldiversity. Commercial deals between broadcastersand labels should be guided by the notion offair access and transparency. The practiceof giving broadcasters a cut of royalties fora limited period of time in exchange foradvertising airtime is considered "accept-able and useful" by both parties, especiallyif applied to new talent. However, the practice of "pay for play"[written in English in the agreement] is"prohibited". The practice is described asthe act of making a deal between a broad-caster and a label that will link broadcast-ing of musical works to payments.

Digital age finally dawns for UK radiobuild-up and early stages of the war inIraq drawing listeners tothe BBC's two nationalspeech stations, Radio 4and 5 Live, and to the pub-lic broadcaster's speech -heavy local and regionalservices.

Radio 1 is down from an8.4% share to 7.9% quarter -on -quar-ter, while in London Capital FM fellfrom 8.8% to 8.1%, despite the high -profile launch in January of arevamped Chris Tarrant breakfastshow, which attracted 100,000 addi-tional listeners at breakfast. CapitalFM's group programme director KeithPringle says that most of Capital'saudience loss was among those agedover 45, and the figures are "a reflec-tion [of the fact that] that heritage sta-tions will now concentrate on theircore demographics."

The Finnish five -piece used theterm "love metal" in the beginning oftheir career to give people an ideawhat their music was like. "It wasjust a joke," says HIM's singer andsongwriter Ville Valo. "But we'vebeen asked 'What's love metal?' eversince. Now when someone asks that,we can give them Love Metal -thealbum."

The band's melodic rock soundhas won them fans in their home-land and in Germany, where HIMexploded in 1999 with both the radiosmash Join Me In Death and theiralbum Razorblade Romance, whichsold more than half a million unitsthere.

BMG has decided on The Funeralof Hearts as the lead-off single forthe act's traditionally strong mar-kets, including GSA. Meanwhile theUK is going with Buried Alive ByLove, which was released on May 5.

"HIM have always been a radioact in Germany and Finland,"explains BMG Finland MD NikoNordstrom. "So it was natural to gowith a more traditional single inthose regions. But we didn't have toforce the same strategy elsewhere."

Despite its harsh guitars, TheFuneral Of Hearts is a pop song withd catchy chorus. It went straight inat number one on the Finnish singlescharts and number three in Ger-many, and is HIM's biggest hit theresince Join Me In Death.

Finnish public CHR station YLEXhas warmed to the single, which hasbeen on the station's A -list for 12weeks. "The song easily endures a lotof play," says YLEX's head of musicHeikki Hilamaa. "It's probably themelodic hook of the chorus, whichsounds good even after you've heardit for the third time that day."

The video to Buried Alive By Lovewas directed by Barn Margera, amember of MTV's "Jackass" teamwho is a both a big fan and a goodfriend of the band. Shot in Los Ange-les, where the band was mixing thealbum with Tim Palmer, the videostars actress Juliette Lewis.

Featuring the band's trademarkepic, sweeping goth-style rock, one ofHIM's intentions on Love Metal wasto pay tribute to all the artists whohave inspired them over the years.

Buried Alive By Love is the open-ing track of the album and featuresraw guitar riffs, which Valo says area tribute to Search And Destroy bythe fashionable -again Iggy Pop andThe Stooges.

The band's influences are certain-ly diverse. "Basically the idea was torip off as many idols as we could -such as Led Zeppelin, Black Sab-bath, Iggy Pop, Cat Stevens, NeilYoung -and not hide our influ-ences," Valo states candidly.

The act played a sold -out gig atLondon's Astoria May 3, and HIMwill now be focusing on a series ofpromotional dates, acoustic sets andsoon -to -be -confirmed summer festi-vals across Europe.

BMG is set to announce a global distribution dealwith one of Europe's largest independent labels.The major will be delighted at the latter's wide-ranging catalogue, while the UK -based indie,which must remain nameless for the time being,will doubtless be pleased to have found a "safehaven" for its worldwide distributed product...Meanwhile, BMG's owner, Bertelsmann, hasposted a euros 399 million Q1 2003 loss. The costof integrating and restructuring Zomba (euros60m) into the company didn't help matters,apparently, nor did the weakness of the USdollar.

The board of Sveriges Radio decided lastweek to award JoachimBerner (pictured) up to Skr3.2 million (euros 350,000) ascompensation for his abortedrecruitment as SR's new MD.After an eight hour boardmeeting, five board members

resigned after claims emerged that SR chairmanMarika Ehrenkrona had approved thecompensation with Berner a month ago withoutinforming the board, suggesting that herpublicly -quoted misgivings about the deal weremisleading. SR's owners were due to have anemergency meeting on May 9 to find a way out ofthe mess...

Not the most positive of messages fromEurope's capitals on VAT on recorded music. Theissue was to have been discussed by financeministers in June, but Hotline hears this is nowunlikely. Discussions at ministerial level are nowanticipated for September or October at theearliest.

Following the accord between French labelsand radio stations (see story, front page) Hotlinehears that culture minister Jean -JacquesAillagon has been lending a sympathetic ear toindie labels' claims that TV channels distortcompetition rules when acting as bothbroadcaster and record label. Last year, France'ssecond best-selling single originated from TVchannel M6...still in France, Hotline understandsthat French label's body SNEP will put theofficial sales charts tender up for grabs at the endof 2004, when the existing contract with currentcompilers IFOP-Tite Live expires. Expected tobid for the contract are IFOP-Tite Live and Gfk,which already compiles its own sales charts inFrance.

Don't expect the UK's Chrysalis Radio toextend into speech radio beyond its recent LBCpurchase come the UK's Communications Bill.Referring to Kelvin McKenzie's Talk SportChrysalis chairman Chris Wright said: "I don'tthink it would be top of our shopping list."
